The Minutes of the 215th Meeting of the NRC held from May, 20th to 22nd, 2013

The 215th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from May, 20th to 22nd, 2013 at NRC, NCTE, Jaipur.

The following were present:-

The Regional Director, NRC apprised the members of Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

AGENDA ITEM NO.- 215.1 CONFIRMATION OF MINUTES OF 214th

MEETINGNRC confirmed the minutes of 214th Meeting with the following modifications:-

Letter under clasue 7 (9) of NCTE, Regulations, issued to Central University of Tibetan Studies, Plot Number- SA 15/135F, Town/City- Varanasi, District- Varanasi, Pin Code- 221007, State- Uttar Pradesh be withdrawn and the decision mentioned against agenda item No. 214.23.16 (S. No.164) be read as Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the following points and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice.

I. The total area of land earmarked for B.A.B.Ed./B.Sc. B.Ed. (Innovative) is only 1500 Sq.Mts. The total built-up area is only 1117 Sq. Meter. Thus, the measurements of total land area and built-up Area are less than required for proposed Course as per the NCTE Regulations, 2009.

II. The size of the multipurpose hall is only 1049 Sq. Ft. which is less than that 2000 Sq. Ft. (required as per the provision of the NCTE Regulations, 2009.)

III. Total number of books in library is 1773 only. This is less than required as per the provision of NCTE Regulations, 2009.

IV. Only 03 educational journals and 03 educational periodicals are being subscribed.

V. The total seating capacity in the library is only 20 which is not as per the NCTE Regulation, 2009.

The decision taken by NRC against Aganda Item No. 214.36.19 (S.No.234) be read as “ the request of the institution for withdrawl application is accepted” in place of “The institution vide letter dated 28/3/2013 has requested to return the Proposal. (Page165-168). The institution applied for B.Ed course for the session 2013-14. The application was processed and letter of deficiency to the institution and letter to the State Govt. for recommendation were sent on 18/3/2013. In view of the request of the institution to return the proposal, matter is placed before Committee for its consideration and decision.In view of the above position, NRC decided that a Show Cause Notice be issued to the Institution before summarily rejection on the above grounds.”In the decision against agenda item no.:-214.36.8 (S.No. 223) the deficiency observed by the NRC may be read as “As per the land documents submitted by the instiution, the land is in the name of Colonel P.G. College of Education, Chural Kalan, Tehsil-Lehra which is not in the name of the either institution or Trust/Society. Therefore, a copy of the registered land documents issued by the competent authority indicating that the society/institution applying for the course, possessed land

on the date of application is not dispatched within 7 days of the submission of the online application as per clause 7 (1-A) (i) of the NCTE Regulations, 2009.In the decision against Agenda Item No.-214.22.1 (S. No.-145) the decision may be read as “NRC decided to issue formal recognition order under section 7 (11) of the NCTE Regulations, 2009 for 100 seats in B.Ed. course from the academic session 2014-2015 in the light of NCTE Hq. letter dated 31.8.2010 and in compliance of the orders of Hon’ble High court.

The Hon’ble High Court of Punjab & Haryana at Chandigarh while disposing of the writ petition in the light of the directions of the Hon’ble Supreme Court of India in the Civil Appeal No. 3505/2012 arising out of SLP (C) No. 233/2011 vide order dated 12.4.2012 directed the NCTE to continue with its exercise regarding verification of infrastructure available with the colleges as has been mentioned in affidavit placed on record and also directed to take action against the colleges violating the norms laid down by it after proper verification as per the provisions of the NCTE ACT, Rules and Regulations.

The Northern Regional Committee considered

This contradiction needs an explanation from the applicant Institution.

The Institution has issued the following from cheques in four consecutive four months.

Course is earmarked on ground and First Floor, Block C as common space for both the course i.e., multipurpose hall, canteen, Gurad Room etc. The Three Blocks are close to each other and are in the campus.” (the Khasra Number not mentioned)

The affidavit prepared on 29th November, 2012 states that:

1) Sewa Devi SD Degree College building is located on Khasra No. 399, 400.

2) Sewa Devi S.D. College of Education building is located on Khasra No. 394, 395.

The institution has confirmed that the Executive Office, Municipal Council, Tara Taran issued building construction certificate of B.Ed. College on Khasra No. 48/259, 72/330, 10 No. 394/5 Kanal and 395/3 Kanal 15 marta and 396/015 on 17th February, 2012.

Another affidavit submitted on 19th April, 2013 contradicts the above stated letter dated 2.04.2013 and affidavit (29.11.2012) and certificate of Executive Officer of Municipal Council “proposed D.El.Ed. in a separate building in the Khasra No. 398, 399 and 400 at first, Second Floor and multipurpose hall at third floor (1737.37 Sq. Meter) Area.

The affidavit No. 3 views that by mistake the institution “submitted approved B.Ed. Course which is in a separate building and on a different khasra number.”

The map of building plan (approved on 21.04.2011) enclosed alongwith the reply dated 2.04.2013 reads that the proposed building is located on Khasra No. 398/399/400.

The demarcated area for D.El.Ed. Course marked in green ink indicates Ground Floor of a building, First Floor of the same building and a portion of second Floor of the same building.

The second floor of the building earmarked for multipurpose hall (as covered by green ink) does not have a clear cut map for the hall, rather the areas have been earmarked for four rooms with common passage in the original map.

There is no mention of Block A, Block B and Block C in the map. It contradicts the statement “B.Ed. Course in Block-A, the proposed D.El.Ed. Course is earmarked on ground and first floor of block B and Block C as common space for the three Blocks are close to each other and are in the same campus. Can different floors of the same building as shown in the map be read as three blocks close to each other? In the affidavit, it is stated that B.Ed. College is located on a building on Khasra No. 394 and 395.

How can the B.Ed. programme building located

inKhasra No. 394/395 share common space on the building constructed on Khasra No. 398/399/400 with D.El.Ed. (with total area of 3009.20 Sq. Meter) programme in Block A, ground and first floor and Block C ? How can the affidavit mention that there will be a common space for multipurpose hall to be used by B.Ed. and D.El.Ed. in a building located 398/399/400.

The institution admits that by mistake the B.Ed. College map located in Khasra No. 394 and 395 was submitted for D.El.Ed. programme in the affidavit dated 19.04.2013. The B.Ed. College is located separately from the D.El.Ed building. At the same time, the institution claims that B.Ed. and D.El.Ed., share common space in a building’s ground floor and second floor located in khasra no. 398/399/400.

The above facts submitted by the institution are of contradictory nature. They mislead NRC, NCTE.

Hence, NRC decided that the application for the said course be rejected on the above point as per provisions of NCTE Regulations, 2009 of NCTE Act, 1993.

152. 215.33.1 Consideration of the recommendations of the State Govt. in respect of the State of the Haryana, regarding D.Ed. course

The NRC considered the letter No. 49-7/2012/NCTE/N&S dated 20.3.2013 containing instructions in respect of consideration/processing of applications for recognition of Teacher Education programmes viz a viz recommendations of the State Govt. of Haryana as well as the Demand and Supply study of Teachers conducted by the NCTE and also the following judgements of the Hon’ble Supreme Court:-

The Hon’ble Supreme Court vide its judgment dated 31.01.2011 in the SLP No. 17165-168/2009, has held that the provisions contained in Section 14 of the NCTE Act 1993 and the Regulations framed for grant of recognition including the requirement of recommendation of the State Government/Union Territory Administration are mandatory and an institution is not entitled to recognition unless it fulfils the conditions specified in various clauses of the Regulations.Further, the Hon’ble Supreme Court in its judgment dated 06.01.2012 in SLP (C) No. 14020/2009, has held that the State Government/UT Administration, to whom a copy of the application made by an institution for grant of recognition is sent in terms of Regulation 7(2) of the Regulations of the NCTE, is under an obligation to make its recommendation within the time specified in the Regulations 7(3) of the Regulations.

The NRC noted that the NCTE Committee vide letter dated 20.3.2013 made it is clear that the general recommendations of the State Government were applicable in each individual case, since in view of the Hon’ble Supreme Court’s orders, it is mandatory to obtain the recommendation of the State Government.

In view of the above judgement of the Hon’ble Supreme Court and the decision taken by the NCTE Committee, the NRC decided that the recommendations of the State Govt. of Haryana received vide letter dated 26.4.2013 i.e. not to allow setting up of new D.Ed. . institutions to add any capacity in the year 2013-14/2014-15 in the State be accepted and the applications so received be returned to the respective institutions. Also the application fees be refunded to the applicants.

“Regarding, Minority Institution, the State Government be asked to give specific recommendation for the Minority Institution. Keeping in view of the Public Notice issued by the NCTE mentioning that the restiriction will not appliy in case of Minority Educational institutions estasblisment under Artical 30 of the constitution.

Infrastructure Facility should be improved. The University has rated the college under C-Grade and has decided to take disciplinary action against the college. The size of the multipurpose hall is less than the required size of 2000 Sq.ft. as per NCTE norms.

The institution has stated in its letter dated 27.04.2013 that they “have selected the faculty ‘staff through properly constituted Committee on 25.02.2013.” However, the approval for appointment of the faculty has not been obtained from affiliating/examining body. In the absence of submission of approval letter why the application shall not be rejected. In the meanwhile, the Government of Haryana vide Memo No. 12/21-2013 C-III (3_ dated 9th May, 2013, has stated that any new B.Ed. College shall not be opened in the State of Haryana.

The original file of the Institution along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time were carefully considered by NRC in detail.

The NRC noted that the NRC received a complaint from Shri Jitender Singh S/o Shri Ratan Singh against the institution alongwith the report of SDM, Haridwar which has been forwarded to the Registrar, HNB Garwal University for necessary action. However the reply/action taken by the HNB Garwal University is still awaited.

The NRC also noted that a PIL was also filed by Shri Biram Singh S/O Shri Balu Singh, Hardwar before the Hon’ble High Court of Utttrakhand at Nanital. The following have been alleged against the institution in the PIL:-

1. That since inception the institution are indulged in illegal activities and even the land granted to them through Patta is also under criminal investigation. The respondent no. 3 applied through one Om Praksh for attainment of the Patta of 50 Bighas of land in the year 2003 for the purpose of establishment of the institutions in question, and while applying for the Patta the said Om Prakesh was shown as Secretary of the Society but when the Patta was a allotted in the

year 2004, it was allotted in the name of the one Alok Kumar Sharma, who was not even the member of the said society. The institution has obtained a fabricated Patta in the name of Alok Kumar in the year 2010 and the same has forged the signature of District Magistrate and in this regard an F.I.R. has also been lodged against the institution.

2. That the institution had applied for affiliation from CBSE to respondent no. 7 institution in the name of one Meenaxi on 4.2.2008 whereas in her own letter to A.D.M. dated 20.09.2011 she has stated that Meenaxi has left the college on 31st September, 2007. Furthermore a bank account was opened at Syndicate Bank in year 2008 as A/c No. 8736220003322 in the name of Meenaxi. A letter was written to the NCTE in the year 2009 by the institution stating that Meenaxi is employed in her B.Ed. faculty and in her own letter to CBSE on 19.4.2012 she has stated that Meenaxi has left the college on 23rd September, 2006. These facts clearly establishes that while applying for affiliation from CBSE, the institution has misrepresented & misled the authority concerned and in a fake name of Meenaxi the said affiliation was applied in 2008 whereas a per the own admission said Meenaxi had left the college on 23.9.06.

3. That Ms. Meenaxi has wrote a letter to A.D.M., Haridwar categorically stating that she has left the college on 1.10.2007 and presently she is serving in Government Girls Higher Secondary School Thal Nadi Pauri. Also Ms. Meenaxi in her letter dated 20.9.2011 written to ADM Haridwar stated that Sri Purushottam due to long absent has been suspended from the college but in the affidavit given to NCTE on 19.6.09 the said Purushottam has been shown at serial no. 3. Mr. Purushottam has given statement before the ADM Haridwar stating that he has never gone to the college and has never drawn salary from said college and is serving as Teacher from 2007 in Government Higher Secondary School Khalsi Uttarkashi.

4. That similarly one Navraj Kumar mentioned at serial no. 4 in affidavit given to NCTE, given statement to ADM Haridwar wherein she has stated that she was teaching from 2007. Mr. Ajay Kumar as been show to be pursuing Ph.D. in the year 2010 and in present also he has been shown as a teacher in the institution. Dr. Ashok Kumar Sharma who has been shown as H.O.D. of the B.P.Ed. in the institution has given a letter that he has never been served in the college and is working at Ch. Devil Lal University Sirsa Haryana as Lecturer Physical Education since 22.8.07 and in this regard an inquiry was also conducted and report was submitted before District Social Welfare Officer Haridwar in which it is categorically mentioned that the said Dr. Ashok Kumar Sharma had never posted in the respondent no. 6 institution and his signatures were forged in the documents pertaining to scholarship. Also Ms. Neelam who has been shown in the list of teachers of institution, has given an affidavit on 6.10.12 in which she has stated that she has never been worked in the college in fact she has only participated in the selection process but was not selected.

5. That it is stated that as per the letters of HNB Garhwal University, for the Session 2010-11, 2011-12, 2012-13 no recognition has been given the respondent institution by the HNB Garhwal University for B.Ed. and B.P.Ed. but still the respondent institution has issued advertisement for admission in B.Ed. and B.P.Ed. courses.

6. That previously in the year 2008 also the affiliation of the college was cancelled due to the illegal admission given by the respondent college. In this regard the Vice Chancellor HNB Garhwal University wrote letter to the NCTE on 31.1.09. Also in the year 2010 the respondent college has also manipulated the number of students, in this regard information was obtained by the petitioner from the department.

The NRC noted that the Punjab University Chandigarh vide letter dated 28.1.2013 has sought clarification with regard to the order of the NRC dated 28.1.2013 withdrawing the recognition of the institution. The NRC noted the following:

The Section 17 (3) of the NCTE Act, 1993 provides that:-

“(3) Once the recognition of a recognised institution is withdrawn under sub-section (1), such institution shall discontinue the course or training in teacher education, and the concerned University or the examining body shall cancel affiliation of the institution in accordance with the order passed under sub-section (1), with effect from the end of the academic session next following the date of communication of the said order.

It is hereby clarified that as per the above provisions, the institution shall not be allowed to take fresh admission for the ensuing academic session and the candicates/students alrady admitted shall be allowed to continue till the end of the current academic session.

In view of the above the Committee decides that the concerned affiliating Unviersity be informed accoridngly.
