The Common Provisions Regulation (CPR) Article 114 (8) Functions of the managing
authority
This document is provisional, without prejudice to the on-going negotiations in the Trilogues
between the European Parliament and the Council (in line with the principle that "nothing is
agreed until everything is agreed"). This document is a draft that shall be adjusted following
the expert meeting.
It does not prejudge the final nature of the basic act, nor the content of any delegated or
implementing act that may be prepared by the Commission.

1. EMPOWERMENT
Article 114 (8) of the CPR sets out that:
“The Commission shall be empowered to adopt delegated acts, in accordance with
Article 142 laying down rules specifying the information in relation to the data to be
recorded and stored in computerised form within monitoring system established under
point (d) of paragraph 2.”
Point (d) of paragraph 2 of this Article states that the managing authority shall:
“(d) establish a system to record and store in computerised form data on each
operation necessary for monitoring, evaluation, financial management, verification and
audit, including data on individual participants in operations, where applicable”.
This empowerment for a delegated act is complemented by a parallel empowerment to adopt
an implementing act to lay down the technical specifications of the system referred to above.
2. MAIN OBJECTIVES AND SCOPE
The main objective of the act is to set out minimum data necessary to be maintained in a
computerised form for the purposes of monitoring, evaluation, financial management,
verification and audit including reporting to the Commission.
In the definition of these data requirements an alignment has been sought with reporting
requirements (including the draft reporting models for annual implementation reports,
payment applications and accounts already discussed in the expert group) in order to ensure
that Member States maintain, in a computerised form, data on operations including data on
individual participants that in aggregated form is used for the purposes of reporting to the
Commision.
Some of data is necessary in computerised form also to fulfil other functions of the managing
authority and the certifying authority (e.g. ensuring compliance with ceilings established at
EU level).
The data requirements set out in in the delegated acts will constitute minimum requirements
established at EU level. The managing authority or the Member State may record and store
additional data in their monitoring systems in particular to facilitate the electronic data
exchange with beneficiaries as set out in Article 112 (3) of the CPR1. In addition, the
remaining information necessary to fulfil the responsibilities of the managing authority,
certifying authority and audit authority may also be kept in an electronic unstructured format
or paper format.
The delegated act will set out a list of data to be recorded and stored and accompanying legal
provisions. This list does not prejudge the technical characteristics or the structure of the
computerised systems established by managing authorities. Without prejudice to the
requirements set out in Article 114(2)(d) CPR it does not pre-determine the format of the data

recorded and stored, unless specifically indicated (e.g. it will be indicated if amounts will be
needed in EUR or that the format/measurement unit will need to be standard within the
system to allow for aggregation). In some cases the data may require the entry of multiple
values for a single operation.
The delegated act also does not prejudge the means by which data is entered or generated
within the system. The data can therefore be entered manually, by way of electronic
information exchange with beneficiaries (e-cohesion), other information systems etc.
It should be possible to record this data, where it is appropriate, at the latest before
submission of the first payment application to the Commission.

4. CONTENT
(1) A definition of data to be recorded and stored in computerised form
The data requirements proposed are threefold:
The list of data set out in Annex 1. Some of this data is relevant only for particular
types of operations, or individual Funds (and will not be required for all operations or
Funds). Therefore Annex 1 specifies the applicability of data requirements.
[In order to ensure the recording and storage of information necessary for reporting on
financial instruments in accordance with Article 40 of the CPR, additional data
requirements are necessary for operations implemented through financial instruments.
Therefore, the computerised system should also include the data listed under Article
40 of the CPR, which is set out in more detail in the model for the reporting of
financial instruments (Fiche 4b, already presented to the expert group).]
Specific requirements for the recording and storage of data on individual participants
as set out in article 114(2)(d) and Annex XX CPR (3)(A)(iv)
The rules set out in the CPR and Fund-specific regulations, as well as in other delegated
and implementing acts, particularly those pertaining to reporting need to be taken into
account.
Therefore, where an operation is supported from more than one operational programme,
priority, Fund or under more than one category of regions, the information referred to in
fields 46-139 of Annex 1 should be broken down by operational programme, priority,

Fund or category of region. The indicator data referred to in fields 46 -55 of Annex 1
shall in addition be broken down by investment priority and by gender, where applicable.
(1) The nature of data recoded and stored
The nature and the format of the data recorded and stored for each operation (including where
appropriate, data on individual participants) shall allow for its aggregation where this is
necessary for the purposes of the financial data referred to in Article 102 of the CPR,
payment applications referred to in Article 121 of the CPR, accounts referred to in Article
128 of the CPR, the annual implementation and final reports referred to in Article 44, Article
101 of the CPR and Article 15(iv)(3) and (4) ESF Regulation. It shall also allow the
aggregation of such data cumulatively for the entire programming period. For the ESF, the
data shall be recorded and stored in a way that permits the managing authorities to perform
the tasks related to monitoring and evaluation in conformity with the requirements set out in
Art. 49 CPR and Articles 5 and 15(iv)(4) and (6) and Annex 1 and 2 of the ESF Regulation.
Respective provisions will be included in the delegated act.
(2) The protection of individuals with regard to the processing of personal data linked
to individual participants
Managing authorities will be deemed as data controllers and therefore should ensure adequate
safeguards for the protection of individuals with regard to the personal data recorded and
stored. Managing authorities should, in particular:
Ensure that national data protection laws regarding the processing of of special categories
of data considered sensitive data, as defined by Article 8 of Directive 95/46/EC and the
national legislation implementing it, are respected;
Ensure that data subjects’ rights are duly respected and in particular with reference to the
right to information referred to in Articles 10 and 11 of Directive 95/46/EC, the right to
access referred to in Article 12 of Directive 95/46/EC, the right to object referred to
Articles 14 and 15 of Directive 95/46/EC, and national legislation implementing these
provisions;
Ensure the respect of the principle of data quality, as required under Article 6 of Directive
94/35/EC and national legislation implementing it. In particular the managing authorities
should not process the data on individual participants for purposes other than complying
with the requirements set out in Article 114 (2)(d) of the Common Provisions Regulation.
Managing authorities shall take measures to ensure that the data are accurate and, where
relevant, kept up to date and that maximum periods for the retention of personal data are
set.
Notify the national supervisory authority of the processing of sensitive data as required in
Articles 18 and 19 of Directive 95/46/EC and national legislation implementing it.
Implement appropriate technical and organizational measures to ensure confidentiality
and protect personal data against accidental or unlawful destruction or accidental loss,

alteration, unauthorized disclosure or access, in particular where the processing involves
the transmission of data over a network, and against all other unlawful forms of
processing as required under the provisions of Articles 16 and 17 of Directive 95/46/EC
and national legislation implementing them.
Apply other measures where required in national data protection legislation, seeking,
where appropriate, advice from the national data protection authorities on how to ensure
adequate respect of national data protection legislation implementing Directive 95/46/EC
when processing personal data.
Respective requirements will be included in the delegated act.
5. MAIN CHANGES COMPARED TO THE PERIOD 2007-2013
There is no directly comparable secondary legislation in place for the period 2007-2013.
Annex III of Commission Regulation 1828/2006 sets out a list of information that Member
States must be ready to submit for all operations within 15 working days of the request of the
Commission. Many of the elements proposed for the delegated act in 2014-2020 are derived
from this list.
However, this list is primarily used for audit purposes and does not, for instance, include
elements necessary for monitoring and evaluation, which are required under the new
empowerment provided under Article 114 (8) of the CPR. Therefore, the elements pertaining
to elements categorisation and indicators have been added to the list.
In addition, the basic data on operations, as well data used for the purposes of control and
audit as well as financial management have been reviewed and revised, and adjusted to the
new legislative framework, and therefore new elements have been inserted in this type of
data.
