As we get closer to the transmittal deadline at the state legislature, when all the bills that originated in the House pass over to the Senate and vice verse, we are hearing and voting on more and more bills each day in committees and on the House floor.

Here’s just a quick update of a few interesting bills that we’ve considered lately.

Ban on human reproductive cloning (HB 288). We passed it in Judiciary Committee, and then it passed on the House floor 93/7.

Revise Post Adoptive Services Law (HB 367) passed the House 96/4. If enacted, this law will allow private adoption agencies to also provide post-adoptive counseling and support to birth mothers who have relinquished their children for adoption (no cost to the state).

Montana Firearms Freedom Act – Exempt Montana Made Firearms and Ammunition from Commerce Clause (HB 246). This states that a personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in Montana and that remains within the borders of Montana is not subject to federal law or federal regulation, including registration, under the authority of Congress to regulate interstate commerce. Passed second reading on the House floor 64/36 and is awaiting third reading before moving on to the

Senate – hopefully!

Authorize Archery Season for Mountain Lion, Bear, and Wolf (HB 74) passed unanimously. This act would grant the Fish, Wildlife & Parks Commission the discretion to set up areas and seasons for archery hunting mountain lion, bear, and wolf in archery hunting seasons. Passed the House unanimously.

Authorize Reciprocal Fishing with Adjoining States on Contiguous Rivers & Streams (HB 366). If this bill becomes law, any person who is properly licensed to fish in a state that borders Montana may fish in any part of a

lake, reservoir, pond, river, stream, or body of water in Montana within 10 miles of the border, if the bordering state grants the same or similar privileges to holders of valid Montana fishing licenses and enters into a reciprocal agreement with Montana. Passed 92/7.

Authorize investor owned livestock slaughter and processing plants (HB 418). This bill will pave the way for a horse processing plant to open in Montana – contributing to the economy and improving the horse market while also providing a humane place for people to take old, injured, or dangerous horses. I am a co-sponsor. The hearing for this bill brought the most people I have yet seen come to Helena to testify. Dozens of proponents came from all over the state to support this bill, with only a handful opposing it. I will let you know if it makes it out of the Agriculture Committee.

I’m pleased to report that my House Joint Resolution 14, supporting the Interior Department in their recent decision to match gun regulations in national parks with the gun laws of the state they are in, passed out of the Judiciary Committee and will soon be heard on the House floor.

Often, the life of an entrepreneur follows a winding path full of unexpected twists and turns. This can be said for the owners of North Star Dodge in Havre. Jim and Ila Reighard purchased the dealership in 1989 after its previous owner was killed in an automobile accident. Their entrepreneurship story truly began over 30 years before, however. Having owned several business ventures prior to this, including an oil drilling company for fifteen years, a pizza house and bar for eight years in Billings, a dude ranch at Utica and one at Hobson, customer service and the business world were familiar territory for the couple. North Star Dodge inevitably grew by leaps and bounds under their skilled leadership and wisdom. As any smart business owner must do, the Reighards planned for longevity by empowering individuals within the company with responsibility and ownership. A young, hardworking, key employee there since 1990, Rocky Preeshl soon moved up the ranks from detailer to technician to parts manager to parts and service director. Today, Preeshl is the General Sales Manager and co-owner of North Star Dodge. He is a vital element in keeping the company on track and growing. Later, son Gary and his wife Jennifer joined North Star Dodge in 1995, both leaving previous positions with The Boeing Company to come “home” to Montana. Each of them took positions working for Gary’s father: Gary started as the parts manager, and Jennifer went to work as the bookkeeper. When Jim and Ila semi-retired in 2000, Gary moved up to become General Manager and dealer principle; Jennifer advanced to Office Manager and accountant. It was after this that North Star Dodge-Chrysler-Jeep entered the motor-sports arena with the purchase of a Yamaha dealership. Then, in 2008, Chrysler selected North Star Dodge as one of only three dealers in Montana to bring on BusinessLink, which is an innovative program featuring a line-up of Heavy Duty 4500 and 5500 commercial trucks. As the company inches toward the 25 year mark in business, Gary, Jennifer and Rocky adhere to the philosophy that made their company successful from the start—“Treat ‘em right, every time, all the time.” With a full staff of over 20 hard-working people dedicated to treating customers right, North Star Dodge draws repeat business from as far away as Billings. Yet, they remember that their local community is the key to their success. “We continually strive for the opportunity to sell and serve within the community,” Gary says. “We appreciate the person who gives us the chance and we work hard to give them the best deal possible. We appreciate customer loyalty and we pledge our loyalty to them in return.” He adds, “One thing I firmly believe is when you spend your paycheck out of town that money does not come back to your community. Every chance I get I buy here. Sometimes it costs me a little more, but that money supports Havre and eventually supports my business, as well as others.” Besides being strong supporters of motor-cross and hill-climbs throughout the state, North Star Dodge makes a concerted effort to support the youth in their community. They donate to 4-H, Boys and Girls Club, Youth Hockey, Lions Swim Team, High School Athletics, MSU-Northern Athletics. In addition, the company donates a vehicle for MSU-Northern coaches to use when they go on athletic scouting trips. As the saying goes, “Think globally, act locally.” North Star Dodge-Chrysler-Jeep-Yamaha takes care of who and what is around them. And they believe that will have a big payoff at the end of the day.

DEAR DAVE, I’m divorced and have a teenager who will be driving soon. What would be the best way to set up insurance for the child? ~Mike

Dear Mike, I suppose a break-up does change the dynamic somewhat, but with my kids I simply left the car in my name and paid the extra insurance cost for a little while. For me, still being in control of the car as a dad outweighed the additional money I was paying in premiums. Having a minor child running around in the world with his or her name on a car title is not a good plan.Then, when they turned 18, I put each of their cars into their names. This, of course, was dependent on them behaving and acting responsibly. They were legally liable at that age too. I’m sure the insurance costs went up, but at that point the financial risk and liability factors were on them, not me. In this kind of situation, especially because there’s more of a potential for disagreements, I think I’d do it that way. Just put it in your name for now, especially if you’re putting money toward the purchase of a vehicle. ~Dave

DEAR DAVE, My employer recently stopped matching my 401(k) contributions. Together, my husband and I make about $100,000 a year. Should I continue to invest in this option, or should I put money into an IRA? ~Linda

Dear Linda, If possible, I would put 100 percent of my retirement savings into a Roth IRA with good, growth stock mutual funds before messing with a non-matching 401(k). But remember, my goal if you follow the Baby Steps is to be debt-free except for your home, and have an emergency fund of three to six months of expenses, before you begin setting aside for retirement. These are the steps that allow you to be prepared for emergencies and free up your largest wealth-building tool, which is your income. With your income, both you and your husband could open Roth IRAs and contribute $5,500 each in 2013. That’s a total of $11,000 toward retirement next year, and it’s only 11 percent of your income. With this in mind, I’d advise going ahead with your 401(k)s after your Roth IRAs are in place. That would flesh out the remaining four percent and give you guys 15 percent of your income going toward retirement! ~Dave

Tuesday morning around 5:30, I was finishing my daily seven mile run before grabbing breakfast and heading to the capitol. It was dark and I was running north on Helena’s Montana Avenue about a half mile from my temporary home. For safety sake, I wear a florescent yellow jersey, a highly reflective body harness, headlamp, and red strobe light. On roads lacking a sidewalk, I run on the shoulder facing traffic should a probable collision require my leap into the barrow pit. This four lane street is mostly deserted at this early hour, and this morning, with no other cars in sight, a sedan zipped past me holding firm in the outside lane; their passenger side mirror missing my right elbow by a mere couple feet. Had the motorist drifted to the left lane we would have passed each other at a safer distance of eight to ten feet. Oh well; he made his point and I kept running. Fifteen seconds later, another set of headlights approached and at a distance of 200 yards, they shifted to the left lane, before safely passing and drifting back to the outside lane. In the darkness, I smiled, mouthed “thank you” and nodded my head in gratitude; a gesture the minivan driver would never see. In my last quarter mile, a third vehicle approached; again in the out-side lane. This driver held his pickup firmly in his lane and I considered tak-ing an evasive leap over the snow bank piled along the road’s shoulder. Just like with the sedan driver, I could have reached out and slapped the pickup’s rearview mirror as it zoomed past, dislocating my shoulder thereby proving I am stupid; a trait I prefer kept a secret. Now, let me jump to another subject. I will get back to the sedan and pickup drivers when I make my point at the end of this column. Montana’s code book grows every session. Beginning with our one page compact to join the union in 1889, our Treasure State book of laws has ballooned past 16,000 pages, stands 16 inches tall, weighs over 50 pounds and

citizens are expected to know and obey every single regulation. Ignorance of the law is not a defense in court; it’s a dang good excuse and I use it frequent-ly, but it is not a defense. Answer me this: Would you buy a new blender if it came with a 16,000 page operator’s manual and you were expected to commit every page to memory before blending your first margarita? Prob-ably not, which is why people lick the salt, slam down the shot of tequila and suck on the lime rather than buy a new blender. Progressives assume citizens will obey every law and this is the special logic behind solutions like gun-free zones. To the left, utopia is but one regulation away and once the magical combination of laws is enacted America will achieve nirvana. Liberals are delusional. Last week in the House Transportation Committee, we heard HB257 an “act revising laws pertaining to bicycles.” In addition to further defin-ing bicycles and regulating lights and brakes, HB 257 requires motorists to maintain five feet of clearance when passing bicycles. Even though driver’s manuals have required this five foot clearance for six years, and it is common sense, it was never part of Montana Code. We heard emotional testimony from bicyclists who have been critically injured being rear-ended by autos and I empathize with their pain and suffering, but I voted “No” and here is why. Yielding a five foot safe zone to walkers, runners, or bikers is a simple courtesy, but if you were preparing to zoom past a bicycle at highway speeds separated by only inches, I doubt the presence or absence of a law will change your behavior. To close the loop and prove my point, both the sedan and the pickup who zipped past me in the darkness on Montana Avenue were Lewis and Clark County Sheriff vehicles operated by citizens educated in the rules of the road and sworn to public safety. HB257 slipped out of committee 8-3, but logic prevailed on the House floor where we defeated it on a vote of 43-57. Just like knapweed, it will grow back.
