In Islamic Furisprudence KIstiFrar is an agreement wherea buyer purchases something under a single agreement in different instalments.Eowever+ no offer and acceptance or bargain is re!uired each time. )he deal will beconsidered as a single agreement where all terms and conditions are finalied.

`Bai<IstiFrar` is called such a buying and selling where a person keeps on takingdelivery of re!uired commodities part by part from time to time from a supplier andno offerIFaab7 C acceptance obul7 and bargaining between them is taken placeeach time of making and taking delivery.

Features

In the case where the seller discloses the price of goods at the time of eachdeal?transaction the sale becomes valid only when the buyer takes possessionof the goods. )he amount is paid after all transactions have been completed.

If the seller does not disclose each and every time to the buyer the price of the subFect matter+ but the parties concerned know that it is being sold onmarket value and the market value is specified and determined in such amanner that it does not vary and it does not lead to differences of the parties.

If at the time of taking possession+ the price of the subFect matter is unknownor the parties agree that whatever the price shall be+ the sale will be e3ecuted.Eowever+ if there is any difference with the market price+ the sale will not be

valid until settlement of the payment is made. #fter the payment of price the buyers usage of the subFect matter will be valid from the time of taking the possession.

)he Bank enters into agreement separately with the suppliers and the clientsto purchase and sell the goods?commodities at predetermined?agreed price onthe basis of IstiFrar.

)he supply and delivery will be made in phases with in the specified time period.

investment under IstiFrar. #vailability of the goods as per specification of the client is a basic condition

goods to the &lient within the stipulated period and at a specified place as per &ontract.

and divided over the period of hire contract per unit of time7 so that the Eirer inaddition to the payment of fi3ed rent ? rentals may pay gradually the proportionateconsideration of the total price of the hired property or asset to ac!uire proportionateownership of the same part by part and become full owner of the hired asset at theend of the hire period.

It should be noted that there should be a separate sale contract for payment ?ac!uisition of each share per unit of time as per hire deal7 ? part of asset sold to theEirer and the amount of rent should be decreased proportionately with decrease of Eires ownership and increase of Eirers ownership on the property?asset.

If+ for any reason+ the hire contract is revoked prior to the payment ? transfer of fulltitle to the Eirer+ the Eirer will share that part of the title to the hired property whichhas been transferred to him against payment made by him and the remaining partwill be shared by the Eire Bank. If any loss arises to the Bank after the sale of Banks share to the property ? asset that shall be recouped from the &lient ? &lientssecurity.

#s soon as any part of Eires Banks7 ownership of the asset is transferred to theEirer &lient7 that becomes the property of the Eirer and hire contract for that share ? part and entitlement for rent thereof lapses.

In Eire ;urchase under *hirkatul 4elk #greement+ the *hirkatul 4elk contract iseffected from the day the e!uity of both parties deposited and the asset is purchasedand continues upto the day on which the full title of Eire Bank7 is transferred to theEirer &lient7.

 

)he hire contract becomes effective from the day on which the Eire transfers the possession of the hired asset in good order and usable condition to the Eirer+ so thatthe Eirer may make use of the same as per provisions of the agreement.

Affectiveness of the sale contract depends on the actual sale and transfer of ownership of the asset by the Eire to the Eirer. It is sold and transferred part by part+it will become effective part by part and with the sale and transfer of ownership of every share ? part. )he hire contract for that share ? part will lapse and the rent will

 be reduced proportionately. #t the end of the hire period when the full title of theasset will be sold out and transferred to the Eirer &lient7+ the Eirer will become theowner of both the benefit and the asset conse!uently the hire contract will fully end.

 Eire ;urchase under *hirkatul 4elk is a binding contract for the parties to it < theBank and the &lient who are committed to fulfill ? meet their undertakings ?obligations in accordance with the relevant agreement.

nder this agreement the Bank acts as a partner+ as a Eire and at last as a seller Donthe other hand the &lient acts as a partner+ as a Eirer and lastly as a purchaser.

 Ownership risk is borne by both the Eire and Eirer in proportion to their retainedownership ? e!uity.

 nder this agreement the role of Eirer is one that of a trustee+ the hired asset being atrust property in his handsD he will manage+ maintain the asset in favour of theinterest of the Eire at his own cost as the e3act subFect of hirer e3cept in cases of anyaccident due to any event entirely beyond control of the hirer and natural

calamity?disaster acts of #llah7 to be determined by the Bank after proper investigation within the knowledge of the hirer.

 )he Eirer is responsible for keeping the hired assets7 in good condition throughout

the whole period of hire and if the asset is damaged or destroyed due tomismanagement+ corruption+ negligence+ transgressions+ default+ etc. of the Eirer+ heshall be responsible to compensate the Eire Bank7 for that. Of course+ suchmismanagement+ corruption+ negligence+ transgressions+ default+ etc. of the hirer shall be determined by the Eire Bank7 after proper investigation within theknowledge of the hirer.

 )he Eirer cannot+ without obtaining prior written permission of the Eire Bank7make any changes in the e3act item of the hire+ and ? or remove it from its place of installation and transfer it to another location.

 In a Eire ;urchase under *hirkatul 4elk agreement any stipulation may be made+ provided it is not against the nature and re!uirements of the contract itself+ nor doesit violate the ?this may be the last one devine laws of Islam and is also acceptable to both the parties.

Eire ;urchase under *hirkatul 4elk facilities may be for medium<term or long<term period hich may be utilised for the e3pansion of production and services+ as well ashousing activities. )he duration of Eire ;urchase under *hirkatul 4elk contract shallnot e3ceed the useful life of the subFect ? asset of the transaction. )he Bank shouldnot normally enter a Eire ;urchase under *hirkatul 4elk transaction for items withuseful life of less than two years.

Eire ;urchase under *hirkatul 4elk transaction facilitates the &lient Eirer7 to get benefit from the hired asset in e3change of rental and also to become full owner of the asset by purchasing it part by part.

If+ for any reason+ the hire contract is revoked prior to the transfer of full title of theasset to the Eirer+ then the title of the asset will be shared by both Eire and Eirer  the Eirer will share that part of title which has been transferred to him against payment and the Eire will share the remaining part.

)he Eirer to secure the Bank the Eire7 will pledge ? hypothecate ? mortgage his portion ? part ? share in the asset ac!uired ? to be ac!uired7 and or any other asset ? property of his own ? third party guarantor to the Bank to fulfill his all liabilities ?commitments including the accrued rental+ if any.
