Understanding Maryland's Need for Improved Electricity Infrastructure

Population Growth

Maryland’s population was 4,216,933 in 1980. Electricity consumption in the state that year was 17,788 million kilowatts.1 Since then, the state’spopulation has increased by nearly 1,680,000, or approximately 40 percent. Electricity consumption is estimated for 2008 at 70,213 million kilowatts, anearly 300 percent increase over 1980.2

Increased Consumption

Maryland’s relatively strong economy has fueled its construction industry, especially residential construction. House size and energy consumptionwithin those new homes has increased. Though statistics on what products account for electricity consumption are not available for specific states,some national and regional facts are compelling. The average American household uses at least 21 percent more electricity now than it did 30 yearsago. Consumption is expected to rise by 11 percent in the next 20 years.3 Computer servers and related equipment now account for more electricityconsumption than color televisions. The use of electricity by servers grew from 2000 to 2005 at a rate of 14 percent per year, more than doubling infive years. By 2010, this use is expected to reach 40 percent growth.4

At 31 percent of the total, the largest use of household electricity is for HVAC systems, air conditioning accounting for the greatest portion. In 1984,12 percent of American households had two refrigerators. In 2001, 17 percent had two. Color televisions are the largest single home electronics user ofelectricity.5


Among the products cited whose use has grown are computers and charging devices for everything from flash lights to electric cars, including cellularand portable phones. Other growing uses include outdoor and indoor lighting, swimming pool filtration and heating systems, and security systems.

Lagging Generation

In the past 30 years, only three new electricity generation plants have been built in Maryland. Planned additional generation is only expected to add831 megawatts. As a result of the lack of new in-state generation and increased population and electricity use, Maryland is now estimated to beimporting approximately 32 percent of its electricity from out-of-state suppliers. This imported electricity comes from out-of-state suppliers which arepart of PJM Interconnection, the 13-state regional grid to which Maryland’s power companies belong. So much imported electricity accounts forMarylanders paying the highest marginal prices of electricity users supplied by this grid, calculated by the U.S. Department of Energy at $500 millionannually in higher electricity costs. 6

Congested Supply Grid

The regional supply system (grid) has a capacity of 163,000 megawatts. Peak electricity usage in 2006 required 144,644 megawatts, or 89 percent oftotal capacity. This summer’s highest demand is expected to be 137,950 megawatts.7 With increased future demand, Maryland’s reliance on powerimported through the heavily congested grid puts the state in jeopardy for power interruptions or worse.

Impact of Inaction

What would a blackout of the magnitude of one that affected 50 million people mean to Maryland? Fortunately, those served through PJMInterconnection were little affected by that multi-day blackout across the northern United States on August 14, 2003. However, with Maryland’s supplygrid approaching capacity, the possibility of such an occurrence cannot be dismissed. The potential loss of productivity over several days and the threatto public safety and public health are monumental. Equally alarming is the likely impact to the state’s fiscal condition with the loss of revenuesresulting from such a power failure.

The respective allocations were updated annually to include these components. All allocations including transition services were denoted by "_T." With the conclusion of transition services, the respective allocations were discontinued in 2010.

With facilities going into service for certain TrAIL projects, the Transmission Load (TRANS_LOAD) allocation factor became obsolete. Therefore, TRANS_LOAD was discontinued in 2010. This allocation was based on the highest peaking month in the 12-month period applicable to the calculation. Since TrAIL does not produce peaks, it could not be factored into the allocation. All cost objects using TRANS_ LOAD were replaced withAP 4CO.

On February 11, 2010, Allegheny Energy announced its intent to merge with FirstEnergy. To accommodate for merger activity, three new allocation factors were created. Two allocations (CORPGOV2 and AP _ 6C02) were put into place that exclude charging PATH-WV. The third allocation (MWCOAL) was put into place to include only coal stations.

Two additional allocation factors were added during 2010. Allocation OPCORT was added to allocate costs related to Rate Department activities and NO_ WIRELESS was added to allocate wireless communication charges.

On June 1, 2010, Allegheny Power sold its' Virginia Distribution Assets to two electric cooperatives. With the sale of the Virginia assets, all affected allocations were recalculated to remove the associated Virginia pieces.

During 2010, PATH -AYE was segregated into new companies by state jurisdiction. PATH-VA was added in January 2010 and PATH-MD was added in August 2010. All affected allocations were updated to allocate to these two new companies, with PATHAYE consolidated total not changing.

Allocation Factors

ALLCO -All System Companies Allocation Factor

• Used for allocating primarily corporate services performed for the benefit of all Allegheny Energy system companies.

• Examples of these types of services are preparing the consolidated financial statements for Allegheny Energy, internal corporate communications expenses and training expenses related to accounting system.

• Values used for TrAIL and PATH were based on budgeted salaries & overheads.

AP 3CO, AP4CO TrAIL and AP 6CO- Delivery Allocation Factors - - -• Used to allocate services provided for the benefit of the Allegheny Energy delivery

regulated utilities.

• Examples of these types of services are establishing policies and standards.for use by all delivery regulated companies, operating and maintaining the customer billing

• Examples of these types of costs are insurance premium payments made for medical program covering Union #102 employees.

RESTORE

• Used to allocate expenses related to managing and mobilizing Restore Service events.

• Examples of these types of costs are internal labor, contract work, employee expenses, vehicle expenses, tools and materials.

AGGREGATE BANDWIDTH (AGBNWD) • Used to allocate charges for network circuits that allow data or voice to run over the

Allegheny network incurred for the benefit of all Allegheny system companies.

• Examples of these types of charges are network telecom charges from V erizon or AT&T.

MERGER ALLOCATORS (CORPGOV2, AP_6C02 and MWCOAL) • The merger allocators are variations of the original calculations excluding PATH

WV. These allocators are used for merger activity. • Examples of these types of costs are internal labor, employee expenses and outside

Referencing Newman2011-11.14, Attachment A: If the expense was related to relocation of employees to the new transmission headquarters in Fairmont: The building of the transmission headquarters was a stipulation of the TrAIL settlement with the WV-PSC. "d. In an effort to address the Staffs desire to enhance the economic impact of the West Virginia Segments of TrAIL to West Virginia, Mon Power, Potomac Edison, and TrAILCo agree that on or before April 21, 2008, they will see to the public announcement of their intention to locate 100 to 150 additional managerial, professional, technical, and administrative jobs in north-central West Virginia not later than the in-service date of the West. Virginia Segments of TrAIL, projected to be June 1, 2011. This commitment will involve the construction of a new, technologically advanced facility in north-central West Virginia with an estimated construction and installation cost of $50 million, and the annual payroll and benefits associated with the new jobs at this facility are currently estimated to be $12 million." And, TrAIL costs were not to be charged to Mon Power and Potomac Edison customers for a certain period of time as per the Stipulations, "a. Rate Mitigation. If the West Virginia Segments of TrAIL are certified by the Commission in accordance with the recommendations and agreements in this Joint Stipulation, then Mon Power and Potomac Edison agree: 1. Not to seek recovery in West Virginia of transmission charges billed by PJM to Mon Power and Potomac Edison for TrAIL (500 kV facilities and under 500 kV facilities, including the Prexy Facilities as defined in the Application) for the period beginning January 1, 2007 through the latest to occur of (i) December 31, 2013, (ii) the last day of the thirtieth month following the month during which the in-service date for the West Virginia Segments of TrAIL occurs, or (iii) the last day of the month during which the in-service date occurs of the facility in which the additional jobs described in subparagraph 6(d) are to be located."

The PATH Companies object to this request on the grounds that it is argumentative, assumes incorrect facts, unreasonable and overbroad, constitutes an undue annoyance, burden, harassment and oppression, seeks information that is beyond the scope of discovery and review set forth in the PATH Formula Rate Implementation Protocols, and is irrelevant and not reasonably calculated to lead to the discovery of relevant information. Without waiving such objection, the PATH Companies state that the settlement approved by the West Virginia Public Service Commission in Case No. 07-0508-E-CN does not prohibit Trans-Allegheny Interstate Line Company (TrAILCo) from recovering any costs from any load serving entity, including its affiliates, pursuant to the PJM Tariff nor does the settlement prohibit TrAILCo from allocating costs associated with the transmission headquarters building to its affiliates, such as Mon Power, Potomac Edison and the PATH Companies, through corporate allocations. The recovery of costs from an affiliate under the PJM Tariff and the intra-corporate allocation of costs to an affiliate are not the same transactions as recovery of costs from ratepayers.

2. Why are the costs of a concession rendered necessary as a condition for approval for the TrAIL project not considered an expense of the TrAIL project?

3. While the stipulation does not prohibit TrAILCo from recovering costs from any load serving entity, does it prohibit Potomac Edison and Mon Power from recovering TrAIL costs billed by PJM from their customers?

4. 1. § 385.410 (a)(2)(ii) applies only to discovery requests that request the production of documents. Newman2011-16.15 did not request the production of documents. Therefore, § 385.410 (a)(2)(ii) is not applicable.

2. The PATH Companies object to parts 2 and 3 of this request on the grounds that
