PREFACE:
ThepurposeofthisManualistosetforthgeneralguidelinestobefollowedintheday-to-dayoperationoftheCompany.Itcanneverbesocompleteastocovereveryincident,norcanitanswereveryquestion.Inanymatternotcoveredbythis Manual, Management will decide and be guided is such decisions byexperience,theREALTORSCodeofEthics,theMultipleListingAssociationRulesand the Laws andRegulations of theReal Estate Commission, all ofwhich areincorporatedhereinby reference. Managementwill, from time to time,makeadditions and revisions, which will be announced and published to becomeeffectivewith reasonablenotice. Acopyof thisManual isalwaysavailable forreference.RealEstateofFlorida isherein referred toasCompany,Broker,Office,FirmorManagement.SalespeopleshallbereferredtoasAssociates.Therelationshipofthe Company to its Associates is that of Independent Contractor and noEmployer/Employeerelationshipexistsoristobeimpliedfromanytitle,provisionorlanguageusedinthisManual.
FAIRHOUSING: SALESPERSONhasbeenadvisedthatfailuretocomplywithFairHousing principlesshallresultin,appropriatedisciplinaryaction,andpossible terminationofthisAgreement.SALESPERSONwarrantsandrepresents thatitisSALESPERSON'SintenttoattendFairHousinginstructional programsandkeepcurrentondevelopmentsinFairHousingasitaffects realestatemarketingandsales.SALEPERSONunderstandsthis acknowledgement,warrantyandrepresentationandagreestoit voluntarily.ESCROWFUNDS:
RealEstateofFloridadoesnothaveaninhouseescrowaccount.Earnestmoney,lease deposits and other money; Purchase and Sale (EarnestMoney) shall beimmediatelydeliveredtoaproperescrowagentinaccordancewiththeStateLaw.Rule61J2-14.008:OftheFloridaAdministrativeCodenowrequireslicensees,whoprepareorpresentanoffer,toindicatethename,addressandtelephonenumberoftheattorneyorTitleCompanythatwillserveasescrowagent.

Within ten (10)businessdays aftermaking the request forwritten verificationfromtheescrowagentthatthedeposithasbeenmade,thelicensee’sbrokermustprovidetheseller’sbroker,orthesellerdirectlyifthesellerhasnobroker,withacopyofthewrittenverificationprovidedbytheescrowagentorwrittennoticethatlicensee’sbrokerdidnotreceiveverificationfromtheescrowagent.Pleasenotethatallcommunicationmustbeinwriting.

SELLERSREALPROPERTYDISCLOSURE: Thisformismandatoryforeveryresidentialrealestatesale.Youmust provideadisclosuretotheotheragent,eventhoughyoumightnot representthebuyer.Ifonepartyisnotwillingtosign,justwritethaton thereandhaveyourclientsignthedisclosure.Thisdocumentisrequired ineveryfilebyourE&OInsuranceandafileisNOTCOMPLETEwithout thisdisclosure.
DISCLOSUREINFORMATIONANDAGREEMENTFORM:Allsalesofrealpropertyrequiretheuseofthisdisclosure.Thisdisclosureoutlinesimportantinformationrelativetothepurchaseofrealestatethatallbuyersshouldbeawareof. BROKER/ASSOCIATERELATIONSHIP:
TheopportunityistakenheretoremindeachAssociatetoread,andfromtimetotime,re-readtheFloridaStateRealEstateLicenseLaw.Associates are reminded, particularly, that the Broker is responsible for theiractions.ItisourbeliefthatifAssociatesadheretotheforthcomingguidelines,theBrokerwillneverhaveoccasiontoappearbeforetheRealEstateCommissionorappearbeforeaCourtofLawontheirbehalf.Associates are reminded, again, that they are Independent Contractors. TheCompany shall have no obligation to withhold taxes or Social Security frombrokerage fees. To the benefit of both the Associate and the Company, anIndependentContractorAgreementshallbesignedbybothparties,datedandonecopyshallberetainedbytheAssociateforhisorherownuse.ChangesoftheIndependentContractorAgreementshallbeinwriting,signedanddatedbytheCompanyandtheAssociate.TheIndependentContractorAgreement
willalwaystakeprecedenceofthisProceduresManualandwillserveasabindingcontractbetweentheCompanyandtheAssociate.
ETHICS:
Definedsimply,theword“ethics”meansmoralprinciplesandqualityofpractice.IntheRealEstatebusiness,ethicsgovernourprofessionalrelationshipwithourprospective buyers and sellers and with our fellow REALTORS. Our ethicsrepresentourhonesty,integrityandspiritforproperconduct.TheCompany isamemberof theNationalAssociationofREALTOS, theFloridaAssociationofREALTORSandtheLocalBoardofREALTORS.EachAssociate,afterassociation with the Company, shall make application for membership in theAssociationofREALTORSandbecomeamemberoftheLocalBoardorREALTORS,theFloridaAssociationofREALTORSandtheNationalAssociationorREALTORS.EachAssociateinthisCompanyisrequiredtoreadtheCodeofEthicsassetforthbytheNationalAssociationofREALTORSandthecodesadoptedbyourlocalboardandMultipleListingAssociation. It isfundamentaltosaythattobesuccessful,onemustbeethical.
CONDUCT:
DRESSCODE:IthasalwaysbeenthepolicyofRealEstateofFloridatoencouragetheir salespeople todress inabusiness-like fashion. Everyoneshouldkeep inmindthatweoftenhavejustoneopportunitytocreateagoodinitialimpressionWhatever the style or color, it goeswithout saying that the clothes should becoordinatedandpressedwithshoesshined,allofwhichgivetheappearanceofasuccessfulbusinessperson.
CAREOFCARS:Sinceanagent’s car is the“office”most seenandusedby theclientsandcustomers,itisexpectedthatitwillbekeptcleanandfreeofcluttertomake a good impression. It is also in the agent’s best interest to keep thefollowingitemsstoredneatlyinthetruck:purchaseandsaleagreements,listingagreements,hammer,screwdriver,stapler,flashlightandanysuchmaterialsthatmightbenecessary in theday todaymanagementof the realestatebusiness.Eachagentmustfurnishhis/herownautomobile,registeredintheStateofFloridaandpayallitsexpenses.Theagentshallprovideevidenceofinsurancecoveragewithlimitsofbodilyinjury,propertydamageliability$300,000ofcombinedsinglelimitcoverageormore,medicalpaymentsof$100,000toeachperson.
OFFICEAPPEARANCE:Alldesksareasshouldbeclearedwhenleavingfortheday.Inaddition,allAssociatesshare in theresponsibilityofmaintainingneatness in
other parts of the office i.e., work, conference, training and kitchen areas.Rememberjustcleanupafteryourself.Theorderlinessoftheofficeshouldalwaysreflectabusinesslikeatmosphere.DRINKING:Alcohol isprohibitedonCompanypremises. It is furthersuggestedthatsalespeopledonotdrinkduringworkhours. It isunwisetoappearattheofficeormakebusinesscallswithalcoholonyourbreath.Suchactiononlydefeatsyourefforts,encouragesdisrespectandincursillwillofclientsandassociates.SMOKING:ThereisNOsmokinginanyareaintheofficeoradjacenttothebuildingorparkinglotarea.Agentswillnotsmokeinfrontofthebuildingatanytime.
OFFICECOMMUNICATIONS:
Ifyou’retakingadayofforanextendedvacation,itisexpectedthatyouletthereceptionistknowwhowillbetakingcareofyourbusinessinyourabsenceorhowyouplanonaccommodatingyourclients. Failure tomakethesearrangementsmay result in assigning another Associate to complete work and commissionadjustment.MESSAGES: All agents are required to have voicemail (i.e; cell phone, withvoicemail, home phones with answering machine or voicemail, pager withvoicemail).Associatesshouldalsohaveane-mailaddress.In special circumstances, the office may take written messages. Wheneverpossible,theofficewillattempttonotifyAssociateofimportantphonemessagesandincomingfaxes.
ADVERTISING:
PHILOSOPHY:TheCompanyisworkingtowardabalancedadvertisingprogram.For this to be accomplished, the Companymust not be bound by sellerswhoexpect,ordemand,specialadvertisingontheirindividualproperties.Itisthoughtinmindthatweshoulddefineourgeneralpolicy.TheCompanyreservestherighttoselectanduseadvertisements,whichwillfitintoawell-balancedprogramandsecure thegreatestnumberofprospects forseller’sproperties.ItisapolicyoftheCompanytoadvertiseonlythosepropertiesonwhichtheCompanyhasanExclusiveRighttoSellAgreement.
RELOCATION:
A 30% referral fee shall be charged on all Company generated referral as accepted andassignedbyManagement. These referralsmaybe fromany thirdparty, Program, ‘Third-Party”companies,AffinityGroups,etc. Incomingreferrals,withtheexceptionofpersonalcontacts,arethepropertyoftheCompanyandshallbehandledinthebestinterestoftheCompany. Outgoing referrals will be disbursed at Associate’s current commission split.Incomingreferralswillbedisbursedat70/30regardlessofagent’ssplit.Referralsgeneratedby theCompanywherebyagentassignedsaidreferral, leavescompanyandaffiliateswithanotherrealestatecompany,saidreferralshallberetainedbyBroker.Inanyevent,areferralfeewillbepaidtoreferringcompany.Intheeventanagenthadgivenareferralandisunabletoadequatelycontinuewithit,itmustbereturnedtomanagement.Undernocircumstancesshallanagentbeallowedtopassthereferralontoanotheragentonhisorherownwithoutmanagementapproval.

INDEPENDENTCONTRACTORAGREEMENT
It isagreedbyREALESTATEOFFLORIDAJENSENBEACH,INC.dbaREALESTATEOFFLORIDA,Hereinafter referred to as "BROKER", and FREDERICK H. KRAUS/REAL ESTATE OF FLORIDA,Hereinafter referred to as "ASSOCIATE",_______________________________________________________________asfollows:1. LICENSES:EachofthepartiesholdsappropriaterealestatelicensesissuedbytheStateOfFlorida.2. OFFICE ASSOCIATION: Associate agrees to exert his/her best efforts to promote theBroker's,theoffice'sandtheAssociate'sreputationandbusiness.3. INDEPENDENTCONTRACTORSTATUS:ThepartiesagreethatAssociateisanindependentcontractor for payment of all federal and state taxes and all other purposes, and is not anemployerof,orpartnerwiththeBroker.4. BROKERTOPROVIDEOFFICEANDOFFICEPROCEDURES:Brokershall,incommonwithother Associates of the office, make available office equipment, local telephone service,membershipinlocalBoardandMLS.ToallowAssociateanequalopportunityinthematterofcustomersalesandlistings,andtopromotetheimageofthepartiesandtheoffice.Brokeragreestomaintainrulesandregardinguseoftheoffice,daysitwillbeopen,officeprocedures,leadsandothersalesopportunities.AgenthasreceivedandreadtheProcedureManual.5. ASSOCIATERESPONSIBILITY-BUSINESSEXPENSES:Associateshallberesponsibletopayforhis/herownlicenseandbusinessfess,automobileandothertransportation, longdistancephonecharges,entertainment,duesinprofessionalandotherorganizations,chargesformultiplelistingsbooksandotherservices,includingmultiplelisting,mapsandothersalestools,businesscards,postage,longdistancephonebills,insuranceandotherbusinessexpenses.6. ASSOCIATE'SADVERTISING:Associateisresponsibletopayforhis/herownadvertising.Notwithstandingthis,itisunderstoodthattheStateRealEstateCodeimposescertainrestrictionsonadvertisingandsigns.Associate isnot toutilizeanyadvertising, signs,brochures,orothersolicitationmaterialswithoutBroker'sadvanceapprovalthereof.7. VEHICLESANDINSURNCE:Associateshallprovidehis/herownmotorvehicle(s)andpayall expenses thereof and carry insurance coverage with the following minimum limits and
liabilities:a)Bodilyinjury,propertydamageliability$100,000ofcombinedsinglelimitcoverageormore.b)Medicalpaymentof$10,000toeachperson.c)Uninsuredmotoristsof$100,000toeachperson.Associatewilladvisehis/herinsurancecarrierofthetypeofworktheyareengagedin. Associate will name REAL ESTATE OF FLORIDA JENSEN BEACH, INC., on their insurance policy.AssociateswillatalltimesmaintainaValidStateofFloridadriver'slicense,andshouldthelicense,andshould the license become invalid for any reason, Associatewill immediately cease operation of anyvehicle in connectionwith theAgreement.Vehiclesoperated regardingAgreementwill onlybe thoseproperlyregisteredintheStateofFlorida.8. ASSOCIATE'STAXES:Associateshallberesponsibletofileandpayquarterlyestimate,andannual,federalincometaxreturns,andanyothertaxesrequiredonanindependentcontractor.Brokerwillfileanyrequirednoticesorreturns(suchasIRSform1099)onallmoniesreceivedbyAssociatethroughBroker.9. COMPLIANCEWITHASSOCIATIONBYLAWSANDRULES:BoththeBrokerandAssociateagree to comply with all rules and regulations of anyMultiple Listing and Service, Board ofREALTORS,orotherrealestateassociationstowhicheitherorbothpartiesbelong.Eachpartyherebyagreestosavetheotherharmlessfromviolationofanysuchrulesorregulations.10. BOARDOFREALTORS:IfBroker(noworinthefuture)belongstoanyBoardofRealtorswhichrequiresthat(asaconditionofBroker'smembership)allofthoseassociatedwithBrokermustbelong,thenAssociateagreestoimmediatelyapplyforandmaintainmembershipandpay(whendue)allduesorotherchargesleviedbysuchBoard.IntheeventofAssociate'sfailuretodoso,BrokermayterminatethisAgreementand/ordeductrequiredduesorchargesfromthenextcommissionorothermoniesdueAssociate.11. PROPERTY INVESTMENT:Associatemayacquire forpersonal investmentorresidence,propertylistedwithBroker'sofficeorthroughmultiplelistingservice,providedthattheBrokerandanyotherAssociate'sportionof thecommissionprovided in the listing ispaidatclosing.Broker or other Associate(s)may likewise acquire property listed by Associate, provided theAssociate'sportionofthecommissionprovidedinthelistingispaidatclosing.AnypersonalrealestateinvestmentsinvolvingAssociate,whetherlistedornotshallbereportedtoBrokertogetherwithdocumentationofsame.12. ESCROW FUNDS: Real Estate of Florida does not have an in house escrow account.Earnestmoney, leasedepositsandothermoney;PurchaseandSale (EarnestMoney)shallbeimmediatelydeliveredtoaproperescrowagentinaccordancewiththeStateLaw.RULE61J2-14.008:OftheFloridaAdministrativeCodenowrequireslicensees,whoprepareorpresentanoffer,to indicatethename,addressandtelephonenumberoftheAttorneyorTitleCompanythatwillserveasescrowagent.ThemostrecentversionsoftheFARANDFAR/BARcontractformsprovidethespaceneededtowritenecessaryinformation.Withinthree(3)businessdaysafter
initial and subsequentdeposits aredueunder the contract, the licensee'sbrokermustmakewrittenrequesttotheescrowforwrittenverificationthatthedeposithasbeenmade.Withinten(10)businessdaysaftermakingtherequestforwrittenverificationfromtheescrowagentthatthedeposithasbeenmade,thelicensee'sbrokermustprovidetheseller'sbroker,orthesellerdirectlyifthesellerhasnobroker,withacopyofthewrittenverificationprovidedbytheescrowagentorwrittennoticethatlicensee'sbrokerdidnotreceiveverificationfromtheescrowagent.Pleasenotethatallcommunicationmustbeinwriting.13. OWNERSHIP-LISTINGS: It is understood that all listings, sales and other agreementsobtainedornegotiatedbyAssociateshall,inaccordancewithStateLaw,beinthenameofandbe the property of the Broker, subject to the Associate's share of any commission. ListingAgreements;leases,andanyotherwhollyorpartiallyexecutedinstrumentsordocumentsshallbeimmediatelydeliveredtotheBroker.Associateshallbeentitledtocopiesthereofofhis/herown records. Associate has no authority, expressed or implied, to represent anything to apurchaser,selleroranyoneelse,unlessitiscontainedinthelistingagreement,andthenthereare reasonable grounds for Associate to suspect that it is otherwise, or unless Associate isspecificallyauthorizedbytheBroker,intheinstancetomaketherepresentation.Anylistingnotunder contract at that time of the termination of this agreement, are the property of theAssociate,withpropertyownerswrittenconsent.14. TERMINATION:Thisagreementmaybeterminated,atanytime,withoutcause,byeitherparty giving notice to the other. If Associate contemplates termination of this Agreement,AssociatewillmakeeveryefforttocloseanypendingsalesinwhichAssociateisinterested.IntheeventthatanysuchsaledoesnotclosepriortotheterminationofthisAgreement,anditisnecessaryorappropriatefortheBrokerorothersintheofficetoattendmattersconcerningthesale ( including changes in financing, securing of occupancy agreements, removal ofcontingencies,andanyotherusualorunusualmattersrequiredtoclosethesale), theBrokershallbeauthorizedtodeductupto50%oftheAssociate'sshareofthecommissionandtopaythesametohimself/herself,ortootherassociatesaccordingtotheirparticipationonmattersnecessarytoclosesale.TheAssociatemaytransferallactivelistingstotheirnewofficewiththepropertyowner'sapprovalorleavethelistingsandreceiveareferralfee.15. ARBITRATION: AssociatewithBroker'sofficeshallmakeeveryattempttosettledisputesdirectly,or,ifnecessary,withBroker'sassistancepriortoresolvebyformalarbitration.AnyandalldisputesbetweenAssociateandBroker,orbetweenAssociateandotherAssociatesinBroker'soffice, frommatters occurring all or in part, prior to terminationof thisAgreement, shall beresolvedbyarbitrationratherthansuit.Eachofthepartiesshall,within(5)daysofbeingrequeststodosobytheother,nameonearbitrator.Thetwoarbitratorssoappointedshall,within(5)daysof their appointment, appoint a third arbitrator. The dispute shall be heardwithin (30) daysthereafter,inaccordancewiththestatestatutesgoverningarbitration,andthedecisionofthearbitrators shallbe finalandbindingupon theparties subjectonly tostatutory reviewof theSuperiorCourt.Alternatively,thepartiesmayagreetosubmitthedisputetoaBoardofRealtorsormultiplelisting,whichofferssucharbitrationservices.IfAssociateviolatesanyoftherulesand
regulations or codes of ethics applicable to the real estate business and an arbitration bymembersofthemultipleorotherprofessionalresults,anyresultinglossesandcostsofdefenseshall be sharedbyBroker andAssociate in the sameproportion that any commissionon thetransactionwasshared.16.ERRORSANDOMISSIONINSURANCE:BrokermaintainsErrorsandOmissionsInsuranceforprofessionalliabilities.IfInsurancecarriedbyBrokercontainsaprovisiondeductingafixedsumfromtheamountofsettlementtobepaidbythecarrier,thanthecostofthedeductionshallbesharedbytheBrokerandAssociateinthesameportionthatanycommissiononthattransactionwassharedorwouldhavebeensharedifthetransactionhadclosedasscheduled.Associatemayberequiredtopurchaseandmaintain,atAssociate'sexpense,anindividualErrorsandOmissionspolicysupplementaltothatcarriedbyBroker.17. INDEMINIFICATION OF BROKER: In the event that charges or claims are made, orlitigation is initiatedagainstBroker,arising fromactionsofAssociate, in transaction involvingAssociate's misconduct, intentional malfeasance, or gross negligence, Associate agrees toreimburse,indemnify,andholdBrokerharmlessfromanyandalllossarisingtherefore,includingthecostsandlegalexpensesofdefendingorsettlinganysuchclaimsorlitigation,andtopayanyjudgmentsenteredagainstBrokerinconnectionwithsuchclaimsorlitigation.18. SUITS: If Associate and Broker agree to initiate legal action to enforce payment ofcommissionor to recoverdamages, thecosts shallbe sharedbetweenBrokerandAssociate.AssociatesandBroker'sshareandoffundsrecoveredshallbeagreeduponinwritingbyAssociateandBrokerpriortotheinitiationofanyfinaldetermination.IntheeventlegalactionisinitiatedagainsttheBrokerwithoutnecessityofactivatingErrorsandOmissionsInsurance,saidcostoflegalfeesshallbesharedequallybetweenBrokerandAssociate.19. COMMISSION: The parties shall share commission in accordance with Addendumattachedhereto. Under federal law,remunerationpaidAssociatemustbedirectlyrelatedtosalesorotheroutputratherthantothenumberofhoursworked,ortheindependentcontractorstatuswillbelostforfederalincometaxpurposes.20. FLORIDASTATELICENSELAW:FloridaStateLicenseLawrequiretheBrokertosuperviseAssociate's real estate activities. Associate agrees to comply with Broker's directions andproceduresinthisregard.21. PROCEDURESMANUAL:Brokermayprovideanoperationsmanualandamendmentsandadditionsthereto,whichwillincludeadministrativemattersandrecommendedprocedures.ThecontentofsaidmanualareandwillremainadvisoryonlyanditsexistenceanduseisnottobeconstruedtorequiredefinitiveproceduresoftheAssociate.22. LENGTHOF CONTRACT: This contract and the commission and expense addendumshereto, shall be in force for a period of one year from the date of the execution of these

ItisagreedbetweenREALESTATEOFFLORIDAJENSENBEACH,INC.dbaREALESTATEOFFLORIDA,hereinafterreferredtoasBroker,FREDERICKH.KRAUSAND_______________________________________hereinafterreferredtoasASSOCIATE.1. LISTINGFEESANDCOMMISSIONS:Associateshallnotbeentitledtoasalary,drawsorcompensation of any nature other than the listing fees and commission share as set forthhereinafter.SUBJECTTOtheforegoingandtheBROKER/ASSOCIATEAGREEMENTtowhichthisisattached,theCompanyoffersthefollowingcommissionprograms:EXHIBIT"A"AddendumtotheAgreement.2. BROKER PAYS COMMISSIONS AND FEES: Associate shall no claim to a listing fee orcommissionexceptfrommoneyactuallyreceivedbyBroker.Anybonusreceivedforcompletingasale,whichis inadditiontocommissionpaid,shallbetreatedasacommissionandshallbedividedbetweenBrokerandAssociateinthesamemannerasthecommission.3. COMMISSIONPAIDTOBROKERALONE:Allcommissionsandothermoniesmustbepaidto Broker alone. State law prohibits Associate from receiving commissions other than fromBroker holding his/her license. The Associate also recognizes that it is unlawful to share acommissionwith,orpayafeeto,apersonnotholdingarealestatelicenseandherebyagreesnottodoso.4. COMPANYGENERATEDREFERRALS: Aminimum30% referral fee shall be chargedoncompanygeneratedreferralsasacceptedandassignedbymanagement.Thesereferralsmaybefromany"Third-Party"personorcompany.5. DISCLOSUREINFORMATIONANDAGREEMENTFORMInformationRelativetothePurchaseofRealEstate
RealEstateofFloridaherebyprovidesthisstatementtoaffordyou,asaconsumer,someinformationwithwhichtomakeaninformeddecisiononthepurchaseorrentalofrealpropertyinFlorida.Youshouldcarefullyreadallagreementstoensurethattheyadequatelyexpressyourunderstandingofthetransaction.Thisformisprovidedforyourinformation.Iflegal,taxorotheradviceisdesired,consultacompetentprofessionalinthatfield.1. CLOSINGCOSTSANDBROKERONLYCOMMISSONFEE.Upontheclosingofthesaleoftherealproperty,theBuyermayberequiredtopayadditionalcostsintheformofclosingcostsunderthetermsofthepurchaseandsalecontractandtheBuyer’smortgageloancommitment,ifany.Alistofsomeoftheknownmajorcostitemsisasfollows:appraisalfee,application,survey,inspections (termite, roof, toxic or hazardous substances), credit report, title insurance, closing charges, title examination,mortgagetransferorservicefee,recordingofdeed,recordingfeeonmortgage,assumptionfeeonexistingmortgage,servicefee(ororiginationfee)onanynewmortgage,intangibletaxonnewmortgagesorassumedmortgages,documentarystampsonnewnotes,set-upofescrowaccounts(taxesandinsurance),insurancepolicy,mortgagelender’sattorney’sfees,andbroker’sBrokerOnlyCommissionFee.I/Weunderstandandagreethatatclosing,additionalsumswillberequiredfromtheBuyer/Tenantintheformofclosingcosts.Themortgagelenderorclosingagentwillprovideanestimateofthesecosts.TheseclosingcostswillincludeRealEstateofFloridaBrokerOnlyCommissionFeeof$295.00. 2. DISCLOSURES. Throughout the transaction youmay receivemore than one disclosure form. You should read alldisclosureformscarefullywhenpresentedtoyou,takingintoconsiderationtherelationshipbetweenyouandtherealestatebrokerinyourspecifictransaction.RealEstateofFloridawillactastransactionalbroker.3. INSPECTIONS. AsaprospectiveBuyeryoushouldexerciseyourrighttoorderandarrangeforanyandallpropertyinspections,whichyoufeel,arenecessary.YouhavetherightasaBuyer/Tenanttoemploy,atyourexpense,alicensedengineer,homeinspectionspecialist,orotherexpertofyourchoicetoinspectthepropertyandprovidetoyouananalysisofthatpropertyasaconditionofapurchaseofferoflease.Itmaybeprudenttoobtain,asaminimum,roof,andtermiteinspection.Ifinterestedaskyouragentaboutahomewarranty.4. LEGALREQUIREMENTS. InFlorida,all contracts for realproperty,and leases forperiods inexcessofoneyear,arerequiredtobeinwritingtobeenforceableandtocomplywiththelaw.Youhavetherighttohavelegalcounselrepresentyouinanyrealestatetransaction.Asarealestatebroker,theBrokerisprohibitedfromgivingyoulegaladviceregardingyourrightsandobligationsinthisoranyothertransaction5. EQUALHOUSINGOPPORTUNITIES.ThebrokerisrequiredbylawandtheNationalAssociationofRealtors,CodeofEthicstotreatallpartiesinapropertytransactionfairlywithoutregardtorace,color,religion,nationalorigin,ancestry,sex,age,maritalstatus,presenceofchildrenorphysicalormentalhandicaps.Inaddition,inBrowardCountyyoumaynotdiscriminatewithregardstosexualorientationand/orfamilystatus.6. FINANCING.Mortgageratesandpointsvarywithfinancialinstitutionsandthemarketplace.TheBuyerhastherighttoselectthelender,therighttonegotiatethetermsoffinancingandothertermsandconditionsofloanarrangementswithintherequirementsofthesalescontract.TheBrokermayrecommendaspecificlender(s),butyoustillhavetherighttoselectanyotherlenderofyourchoice.7. HIDDEN/KNOWNDEFECTS.FloridalawrequirestheSellertodisclosetoanypotentialBuyeranyknowndefectswhichmaynotbereadilyvisible.TheBrokerhasnotconductedaphysicalinspectionofthepropertytodiscoverconcealeddefects,todeterminethepresenceofanyleadhazardoranyothertoxicsubstanceortodeterminetheaccuracyorcompletenessofthe
Owner’sdisclosuresoranymarketingbrochure,propertydescriptionorpropertyinformation.TheBrokerhasnotexaminedthepublicrecordstodeterminetheproperty’scompliancewithapplicablezoning,buildingcodesorotherapplicablelaw.8. THIRDPARTYVENDORS.Brokermayprovideyouwithnamesofserviceproviders(including,butnotlimitedto,homeinspectors,engineers,contractors,repairpersons,orattorneys)thatotherconsumershaveusedorofwhomweareaware.Ourdoingsoshallnotinanywaybeconstruedtoberecommendationorendorsementof,norisBrokerwarrantingtheworkofanysuchproviders.Thefinalchoiceofanyserviceproviderrestssolelywithyou.Youagreetorelease,holdharmlessandindemnifyBrokerfromallclaimsorlossesthatinanywayariseoutof,orrelateto,theselectionofuseofanysuchserviceprovider.9. PROPERTYTAXES.Youshouldnotrelyontheseller’scurrentpropertytaxesastheamountofpropertytaxesthatyouwillbeobligatedtopay.Achangeofownershiporproperty improvementstriggersreassessmentsofthepropertythatcouldresultinhigherpropertytaxes.IfyouarethecurrentownerofaFloridahomesteadedproperty,youmaybeabletotransferaportionoftheSaveOurHomesbenefittoanotherqualifyingFloridaproperty.Ifyouhaveanyquestionsconcerningvaluation,taxation,ortaxportability,contacttheCountyPropertyAppraiser’sOffice.
