ESS transition from ESS AB to an ERIC

• ESS member countries will submit application this summer to establish a European Research Infrastructure Consortium (ERIC) for ESS. ERIC will be in place in early 2015.

Review Charge (1st Annual Review Nov 2013)

A Performance Measurement Baseline (PMB) is an integrated work plan made up of a sequence of activities which cover the complete scope, cost and schedule of a project. Once the PMB established and approved, the PMB can be used to evaluate actual cost and schedule performance to determine whether the project is meeting its planned scope, cost and schedule objectives.

Review Charge

7. Are the plans for host laboratory support functions (HR, IT, Legal, Finance, etc.)adequate to support the construction project?

No, the new ERIC framework might solve some of the problems. HR contracts for visitors and in-kind personnel need particular attention.

Procurement office and procurement procedures might require more attention. Already in 2014 ~160M will be going to procurement. An internal audit organization is necessary

Evaluate the ESS response to the recommendations from the 1st Annual Project Review held in November 2013

Purchasing rules & transition to ERIC The ERIC will have new purchasing rules, and the StC has

set up a committee to address this Very good progress However, a committee from the StC needs to inform

itself to build an understanding of what is needed to maximally facilitate procurement through ESS for laboratories providing deliverables

The ERIC may be an opportunity wrt labour law issues, by establishing staff regulations. This may be easier to negotiate with unions for an ERIC than as exceptions for an AB

In general for the ERIC transition ESS may need an elaborate process for the transition

including an advisory body as a sounding board for the management in this process

Meeting goals

• Support ESS objectives to pursue the highest quality research at the lowest possible cost, providing maximum benefits to ESS member states:- Engage the best people through direct hires, segundments to Lund, or

engagement on member in-kind contributions- Realize low cost for FTE’s, hardware, services, and energy- Enable free flow of ideas and intellectual property

• Ensure that the ERIC formed for the European Spallation Source meets the objectives of the organization

• Evaluate the legal framework and the organization’s implementation plans and provide advice and recommendations

General organizational goals

• Organization is open to all ESS members including non-EU members, e.g., possibility to easily employ staff from all countries in the world

• Equal conditions (pension, tax, social security, etc.) for staff employed in Lund (SE) and data and software center in Copenhagen (DK), including flexibility to work in both places

• Staff and procurement rules benefit all member countries

• ERIC legal framework provides long-term stability and achieves many benefits of an international treaty organization

• VAT exoneration, exempt from duties, excise taxes, income tax for foreign employees, energy taxes (Swedish bid offer)
