The Lostwithiel Neighbourhood Development Plan (NDP) is a planning policy document prepared by the community. Lostwithiel Town Council is the Qualifying Body for the submission of a neighbourhood plan: the plan is prepared by the community and endorsed and submitted to Cornwall Council by Lostwithiel Town Council, under the powers granted by the Localism Act 2011. If successful at Examination and Referendum, it will be ‘made’ by Cornwall Council and used in conjunction with the strategic policies of the Cornwall Local Plan as part of the policy framework for determining planning applications in the neighbourhood plan area, which is the parish of Lostwithiel.

The Neighbourhood Planning (General) Regulations 2012 (as amended) require Lostwithiel Town Council as the qualifying body to submit a request to designate their Plan area (known as the Neighbourhood area) to Cornwall Council. The Lostwithiel Parish boundary was designated as their Neighbourhood area. Lostwithiel Town Council is required to consult the Community throughout the development of the Plan and carry out a 6 week pre-submission consultation. The draft Plan is required to be screened for Strategic Environmental Assessment (SEA) and Habitat Regulations Assessment (HRA) under the European Directive. Once the NDP is submitted Cornwall Council carries out a legal compliance check (the current stage) and then publishes the plan for a statutory 6 week consultation period. The NDP is then subject to independent Examination by an approved Examiner, and a Referendum must be held within the neighbourhood plan area, before the NDP is

made and the policies can come into force.

2. What are the aims, objectives, outcomes, purpose of the policy, service change, function that you are assessing?

The plan contains policies for land use development within the neighbourhood development area, Lostwithiel parish. The Neighbourhood plan objectives and policies identified are:

1. Housing - To meet projected housing needs resulting from population growth. To promote sustainable housing development that maintains a sense of community

and local identity. To meet the need for affordable and supported housing in integrated communities. To preserve and enhance the heritage townscape through the sensitive design and

layout of housing developments. To support development that is sensitive to the natural environment and recognises

the consequences of climate change.

2. Employment and the Local Economy – To encourage a growth in local employment so as to create a resilient and expanding

economy while ensuring that the character of the town is retained. To revitalise the retail and commercial activities of the town centre so as to enhance

the experience of local residents and attract visitors.

3. Transport and Travel – To ensure better conditions on major trunk roads. To provide the conditions for additional parking space. To increase connectivity within the county through regular bus and rail services. To improve Lostwithiel railway station facilities. To facilitate more active and sustainable modes of travel. To enhance street and pavement facilities.

4. Community Wellbeing and Recreation – To strengthen the community through a wide range of cultural activities.

To strengthen services supporting community health, wellbeing, and education. To ensure adequate physical recreational opportunities for all. To build and maintain community spirit in all respects.

The policies are designed to add local detail to the strategic policies of the Cornwall local plan and will operate from 2018 – 2030.

The Lostwithiel Neighbourhood Plan Steering Group developed the Plan on behalf of the Lostwithiel Town Council. During development of the Plan, the steering group undertook the following consultation to assist them in evidencing and developing the planning policies in the plan:

1. The consultation processIn 2014, the Town Council published the results of a questionnaire and in 2015 worked with Cornwall Council to conduct out a Housing Survey the latter publicised by a letter sent to all households and Newsletter 2 and by an article written by the Mayor in the Community Newsletter. A set of draft housing policies was put out to consultation in Newsletter 2 and displayed at three public exhibitions, in December 2015. The exhibitions were attended by members of the Steering Group who engaged with attendees.

The responses to the above were used to produce a Housing Report in January 2017. This report comprised a comprehensive analysis of the housing needs for the Civil Parish and set out a revised version of the 10 draft housing policies updated as a result of the responses received.

In April 2016 Newsletter 3 which included a questionnaire seeking views on transport was inserted into the Lostwithiel Community Newsletter. The responses were analysed and a Transport Report published in May 2016. Informed by the responses to this questionnaire The Steering Group formulated five potential Policy Areas and asked, in Newsletter 4 published in the September 2016 which of these Policy areas was supported. Responses to this Newsletter and a further exhibition on June 11th (see below) informed the Neighbourhood Plan's policies on transport.

An exhibition and consultation event was held on June 11th 2016 which further consulted on the draft housing and transport policies. A member of the Steering Group discussed with attendees in a

series of workshops, what they saw as the most important features of Lostwithiel. These discussions were used to produce the 'Word Cloud' on page 9 of the Neighbourhood Plan and the 'Vision for Lostwithiel' on page 10.

Newsletter 4 advertised the forthcoming Employment and Business Survey. This survey, which was carried out in conjunction with the Lostwithiel Business Group, was sent with a covering letter to all businesses in the town. The responses were analysed and used to formulate the Neighbourhood Plan's Draft policies on business and the economy.

A set of questionnaires was published in September 2016 asking for views on Heritage, the Environment and Community and Recreation These formed part of the exhibition and consultation event on September 24th 2016. The questionnaires were also on the Neighbourhood Plan Website. The responses to these questionnaires were analysed and used to formulate a set of draft policies which were published as a second set of questionnaires in December 2016. Each was accompanied by an informative 'Narrative'. The questionnaires and narratives were presented as part of a series of public exhibition events on December 14th, December 15th 2016, January 9th and January 30th 2017. The responses were analysed and used to formulate the Neighbourhood Plan policies on Heritage and the Environment and Community, Wellbeing and Recreation.

Newsletter 5 was published in January and delivered by a team of volunteers to all properties in the Civil Parish. It invited members of the public to make comments, suggest new ideas or put forward additional other policies.

2. Early Draft Plan publishedThe Steering Group decided to publish an Early Draft of the Neighbourhood Plan in May 2017 in order to elicit the views of the people of Lostwithiel before producing the further Draft. This was advertised both in Newsletter 6 delivered to all properties in the Civil Parish and in the Community Newsletter. The Early Draft and a Summary formed part of a public exhibition and consultation events held on July 16th and August 5th. Both the Early Draft and the Summary were placed in the Library, Community Centre and Town Library as well as being on the website. The results were analysed and used to inform the writing of the further Draft.

3. Engagement with the younger generationAs part of the Steering Group's aspiration to engage with the younger generation of Lostwithiel, two workshops were held at Lostwithiel Primary School and one at St Winnow Primary School. Pupils were encouraged to talk to their family and friends about the Neighbourhood Plan.

At Lostwithiel Primary School Fair on December 15th 2016 the Neighbourhood Plan exhibit was set up explaining all sections of the Developing NP. Questionnaires on Environment, Heritage, Community & Recreation were available for attendees to either complete at the fair or to take home to complete.

In February 2017 a letter was sent to parents of pupils at Lostwithiel Primary School Inviting parents to read and comment on the Neighbourhood Plan. This was an strategy to involve a section of the community that had not attended consultation events.

4. Meeting with estate agents.On October 17th 2017 the Chairman of the Steering Group met with the two Lostwithiel estate agents to discuss the demand for housing in the town and to what extent this demand is able to be met.

5. Consultation on a further draft of the Neighbourhood PlanThe further Draft Plan was published in December 2017 together with a Summary. Newsletter 7 was published in January 2018. It comprised a series of questions to ascertain the level of public support for the position of the Development boundary and the criteria used in order to establish its position and for a number of policies in the December Draft. It included an invitation to submit pieces of land to be considered for inclusion within the Development Boundary. The responses were analysed.

6. Consultation on the draft Development BoundaryThere was a public exhibition and consultation event held at the Community Centre on January 13th 2018. The exhibition showed the rationale for the drawing of the Draft Development Boundary. Attendees were encouraged to ask questions about the updated policies and to take away a copy of the Draft Plan and/or its Summary and to comment on it.

7. Statutory 6-week consultationNewsletter 8 was delivered to all households in the Civil Parish in the week leading up to the public exhibition and consultation event in the Community Centre on March 24th. As for the earlier events, members of the Steering Group were on hand to answer questions and discuss issues. This marked the start of the statutory 6-week consultation. The Pre-submission Draft Neighbourhood Plan and its Summary were available to take away and comment on. Further copies of this draft were placed in the Community Centre reception area, the Church and the Town Library.

In response to requests from Lostwithiel residents, an extraordinary meeting of the Steering Group was held on April 10th 2018 to hear comments on aspects of the Pre-Submission Draft.

There was a public exhibition and consultation event held at the Community Centre on April 28th. Steering Group members were in attendance to engage with attendees and to encourage them to submit responses to the Pre-Submission Draft before the closing date of May 6th.

8. Pre-submission consultation (Regulation 14) Formal Consultee engagementIn April 2018 consultation letters were sent out under The Neighbourhood Planning (General) Regulations 2012; Regulation 14 (b) to all the bodies listed by Cornwall Council and a number of local organisations.

9. Pre-Submission consultation - Community engagement resultsThe responses to the consultation on the Pre-submission draft were analysed. A meeting of the Steering Group was held on May 22nd 2018 to consider what changes should be made to the Pre-submission draft in the light of the consultation responses received. Members of the public who attended were asked for their views on each of the decisions before they were voted on.

10. Landowner engagementOn October 5th 2017, members of the Steering Group met on-site, at the request of the landowner, to consider whether cells 2 and 4 should be included within the Development Boundary.

inclusion within the Development Boundary. December 2017 Neighbourhood Plan Newsletter 7 Delivered to all properties in Lostwithiel Civil Parish included a 'Call for sites' which invited land to be considered for inclusion within the Development Boundary.

End of November 2017 to January 31st 2018 Town Council public notice board and the Neighbourhood Plan Website. Public notice advertising the Neighbourhood Plan 'Call for Sites' which invited land to be considered for inclusion within the Development Boundary.

On May 10th 2018, members of the Steering Group met on-site, at the request of the landowner, to consider whether his land, which is part of Cell 29, should be included within the Development Boundary.

The landowner of cells 2 and 4 attended the Steering Group meetings of 28th November 2017 and 27th February 2018.

Landowners were given the opportunity to make personal representation at a meeting of the Steering Group of January 23rd 2018.

The Neighbourhood Plan is tested against what is known as the Basic Conditions which are set down in legislation (Neighbourhood Planning Regulations 2012 “as amended”). It is against the criteria that the examination must focus:

Has had regard to the national policies and advice contained in the guidance issued by the Secretary of State?

Will contribute to the achievement of sustainable development? Will be in general conformity with the strategic policies set out in the Development Plan for

the area? Does not breach or is otherwise incompatible with EU obligations or human rights legislation? Whether prescribed conditions are met and prescribed matters have been complied with? Whether the making of the Plan will have a significant effect upon a European Sites or a

European offshore marine site, either alone or in combination with other plans and projects?

4. Equality and Diversity - Who will be affected by this proposal? Is the proposal likely to result in positive or negative impacts/risks? If so what are they? What plans do you have in place, or are developing, that will mitigate the likely identified negative impacts/risks? This section should include reference to the 9 protected characteristics as referenced in the Equality Act 2010.Consideration should also be given to the Cornish status different employee groups such as part-time, on-call or ‘hard to reach’ employees – see CIA

Who will be affected by this proposal? (Include consideration of the protected characteristics: age, disability, gender reassignment, marriage & civil partnership, pregnancy & maternity, race (incl. Cornish Minority), religion & belief, sex and sexual orientation; also different employee groups such as part-time, on-call or ‘hard to reach’ employees)

Existing and prospective residents of Lostwithiel will be affected by the policies as well as landowners, businesses and developers who have an interest in the area. The policies will apply equally to all those making a planning application and are applied in the public interest.

The plan aims to deliver sustainable development and to provide for the needs of the local community as a whole. The whole community is able to be involved in the preparation of the NDP and influence its vision and objectives. The Neighbourhood Planning Regulations 2012 (as amended) require the consultation of specific groups including statutory bodies, stakeholders and community groups , some of whom represent the interests of people from the 9 protected characteristics, for example:

bodies which represent the interests of different racial, ethnic or national groups in the neighbourhood area;

bodies which represent the interests of different religious groups in the neighbourhood area; bodies which represent the interests of disabled persons in the neighbourhood area

The NDP group is required to consult widely and to demonstrate how they have involved different sectors of the community in plan preparation. The aim of this involvement is to ensure that people

guidance for further information.

with different needs are able to express their views and have their issues considered.

Age:There is no evidence that the Neighbourhood Plan discriminates on the basis of age. Information available to the Council does not suggest that there will be a specific group in terms of age that would be disadvantaged. Consultation events were varied and included social media campaigns, school visits, attendance at local events, contacting local groups and local services such as libraries. This extensive consultation has minimised the risk of excluding any age ranges within the community. Supported housing is promoted within the plan.

Disability:There is no evidence that the proposals and its Policies would discriminate on the basis of disability. Supported housing is promoted within the plan.

Gender reassignment:There is no evidence that the proposals and Policies of the Neighbourhood Plan would discriminate on the basis of gender.

Pregnancy and maternity:There is no evidence that the proposals and Policies of the Neighbourhood Plan would discriminate on the basis of Pregnancy and maternity.

Race:By promoting housing to meet local needs, the Neighbourhood Plan is seeking to ensure more housing occupied by local residents. In general local residents are seen as more likely to fall within the status of ‘Cornish’. The Cornish are protected as a national minority under the Council of Europe’s Framework Convention for the Protection of National Minorities which was ratified by the Government in 1998.

Religion or belief:There is no evidence that the proposals and Policies of the Neighbourhood Plan would discriminate

on the basis of Religion or belief.

Sex:There is no evidence that the proposals and Policies of the Neighbourhood Plan discriminate on the basis of sex. The steering group and consultation responses had a large response rate irrespective of sex.

Sexual orientation:There is no evidence that the proposals and Policies of the Neighbourhood Plan discriminate on the basis of sexual orientation. This was not information that was collected and therefore there was no opportunity to discriminate against sexual orientation.

Formal meetings and events were held as well as drop in sessions, this flexibility has allowed for all members of the community to participate in the consultation, regardless of their availability.

What are the positive impacts/risks – if any?The inclusion of supported housing; the enhancement to local facilities; the inclusion to provide adequate physical recreational opportunities for all; and to enhance street and pavement facilities.

The NDP is subject to independent Examination and the Examiner is required to assess whether the NDP meets basic conditions set out in the legislation, one of which is whether the NDP is compatible with European Union law and human rights obligations.

What are the positive impacts/risks – if any?The plan ensures that the widest range of community members were consulted upon to reflect community wishes.

What are the negative impacts/risks – if any?Some members of the community may not be in favour of the Neighbourhood Plan, but, if it is made by Cornwall Council, the standard Development Management process of determining applications will apply and this mitigates any risk of community members being at risk of negative impacts as a result of the proposed plan.

The NDP aims to provide housing to meet local need, supporting local services, business, education and infrastructure, which will have a positive impact on the rural area.

What are the positive impacts – if any?Positive impacts of this plan include the delivery of infrastructure and community service improvements as a result of forthcoming development. For example, Policy HH3 encourages the re-use of redundant buildings for residential use. This will have a positive effect on the rurality of the area, potentially providing housing. Policy BE2, CR3 and CR4 seeks to provide additional protection against the further loss of services and facilities within the Parish. This will sustain the sense of community and local amenities, which, if lost would have a negative effect on the local area. Policy TT1 seeks to provide additional parking spaces. The plan aims to increase connectivity within the County through regular bus and rail services, which also benefits the surrounding rural areas.

Homes required will need to demonstrate how they meet local needs, which may include supported housing. The plan also seeks to strengthen services supporting the community health, wellbeing, and education.

What type of information will be required to deliver this proposal?Planning applications will be made and dealt with in the usual way. Systems are already set up to make NDPs available to planning officers and the public during the statutory stages of the Neighbourhood Development Plan process as set out in the Neighbourhood Planning Regulations 2012 (as amended). Information is available on the Neighbourhood Planning Toolkit webpages on the Council’s website and on the Mapping system webpages.

Is the proposal likely to result in increased risks to the information, if so what are they?The GDPR regulations could have an effect on the personal information such as names which were submitted with consultation comments. However, the intention and use of the comments was well established and consultations were carried out prior to the GDPR Regulations coming in to effect. All contact details provided that were additional to the statutory consultees were available in the public

The Neighbourhood Planning (General) Regulations 2012 (as amended) set out the required consultation procedures and the consultation bodies. A consultation statement is submitted at Examination and assessed to ensure that the correct procedures have been carried out by the steering group prior to submission. Cornwall Council also has a duty to publicise the plan after submission (Regulation 16 publication) and this procedure has also been followed.

There is no direct effect on staff; development management officers will use the neighbourhood plan policies, if it is made, to deal with planning applications in the area. They are consulted on the plan and notified if it is made.
