Chilean Needlegrass (E315-004-003-01) The Chilean Needlegrass Community-led Action Group is having monthly meetings developing their strategy and work plans for the short and long term future. Council has funded a facilitator from NZ Landcare Trust to support the group initially through the first year of development to ensure a sustainable and solid group for the long term and to aid them in applying for funding.

Wallaby Incursion (E315-012-008) Recently there was a sighting of a Wallaby in Grovetown area. Biosecurity staff have been working with Animal Control and have identified the owners and are now working with them to move the animal to a legally permitted owner outside of the region. An article was written in the newspaper educating people on the impact Wallabies can have on the environment, and their status as an unwanted organism under the Biosecurity Act 1993, and an animal we do not want established in Marlborough.

Department of Conservation Operational Plans and Collaborative Consultation (E315-005-005-01) The Biosecurity Team had a meeting with Department of Conservation (DOC) on both 24 June and 26 June 2014 with the Picton and Renwick staff respectively to discuss last season’s activities and the 2014/2015 operational initiatives. DOC were also given an overview of the Regional Pest Management Strategy (RPMS) review progress to date and the potential impact and elements of further collaboration between DOC and Council were discussed. Overall DOC were quite comfortable with where the RPMS review is heading.

Regional Pest Management Strategy Review Update (E315-002-005-01) Council staff are continuing work toward a goal to have potential policy options out for early discussion before the end of the year. Many of the existing pest programmes have been reviewed, with option(s) under the new legislation developed. Some of the more complex programmes (e.g. Chilean Needlegrass and Wilding Conifers) are proving more time consuming to develop options. The National Policy Direction, which all councils are waiting on to be able to formally release a Proposal, has still not be ratified with indications looking like early 2015. This is now some 2.5 years since the Biosecurity Act 1993 was amended.

Environmental Science National Environmental Monitoring and Reporting (EMaR) (E360-003-005) (Report prepared by Alan Johnson)

The regional sector (regional councils) is working with the Ministry for the Environment in partnership to develop and implement a regional and national based environmental data collection network that is intended to be delivered widely on an accessible national data and reporting platform. The project aligns to Central Government’s legislative mandate in respect of the National Environmental Reporting framework.

The chart below provides an overview of the data reporting platform that is envisaged to be developed collectively. In essence, Council’s existing regional data sets are expected to be collected for each of the environmental domains (e.g. water, coastal). The collection and specificity of data over time is expected to be jointly developed and the collection of data standardised and agreed through the development of National Environmental Monitoring Standards (NEMS).

The data is envisaged as being openly accessible, and produced into information for the public, and integrated through a federated data management system. The data is then intended to be available to the public through a national reporting digital platform known as Land and Water Aotearoa (LAWA) and other media.

The intention of the partnership is to realise our shared objectives and maximise efficiencies in the collection and reporting of environmental data. The environmental monitoring and reporting domains will be centred around the regions’ main functions relating to natural resources; fresh water, coastal, land, air and biodiversity.

An agreed set of operating and guiding principles with this process are:

a) There will be a high level of national standardisation of monitoring protocols and methods for data collection, and a robust quality assurance process.

b) In acknowledgement of public funding of our services, there will be open access to the national (public facing) information delivery platform. Principles around third party access to and use of data will be developed and agreed with partners.

c) The use of existing investment (in staff, technology and infrastructure) will be optimised and sector costs contained to current scale, plus any additional costs for the sector in meeting national policies and standards.

Project teams have been formalised with lead councils supported by internal networks and the Ministry for the Environment (MfE). The project teams are expected to undertake a range of scoping reports to design and develop a national data collection network. The focus will be on accommodating existing data sets,

identifying gaps and recommending targets and timeframes for possible domain inclusion in reporting on the LAWA platform. The following table provides a summary of the domains and project teams:

Wairau River-Wairau Aquifer Interaction Project (E345-007-001) (Report prepared by Peter Davidson)

The results from the February 2014 radon gas survey have been analysed by the Institute of Environmental Science and Research and the report will be formally presented to the Environment Committee at its September 2014 meeting.

The findings were not as definitive as was hoped in terms of identifying the principal recharge reaches where the Wairau Aquifer receives recharge from Wairau River channel losses. This partly reflects the small number of wells available to sample and their distribution relative to the Wairau River channel.

Groundwater flow rates were higher in the aquifer gravels upstream of the State Highway 6 bridge, with a calculated velocity of 94 metres/day compared to 25 metres/day downstream of the bridge.

Higher groundwater flow rates mean the gravels are more permeable. This means that the average travel time for Wairau River water leaving the channel in the Giffords Road area to reach the middle reaches of Spring Creek is about six months.

This transit time, in conjunction with the rate of aquifer throughflow, is being used to calculate the volume of groundwater naturally stored in the Wairau Aquifer.

It was tentatively inferred that more Wairau River recharge losses to the Wairau Aquifer occur in the upstream reach, but historical flow gauging surveys show that channel losses vary in time and space.

At the time of the field work, Wairau River water temperature was at its peak and considerably warmer than groundwater. This natural temperature contrast provides a tracer to identify recharge with warm anomalies indicating more river influence in that particular area.

Council will install temperature loggers in wells close to the Wairau River channel in July for six months to measure the mean temperature. Wells with the highest temperature range are located in more transmissive gravels with higher rates of Wairau River recharge.

Work is progressing slowly but steadily on the hydraulic model of the Wairau River-Wairau Aquifer that is being carried out at the University of Tubingen in Germany and at Lincoln Agritech. The work is underpinned by real time measurements of flow at four places in the recharge reach between the Waihopai River and Tuamarina where channel losses represent gains to the Wairau Aquifer.

Cross sections of the Wairau River floodway, in conjunction with flow and aquifer levels, are being used to build a computer model of the recharge mechanism. It is hoped that the model will identify the factors that most sensitively control Wairau Aquifer recharge.

This hydrological research is a collaborative effort between Council staff and experts that is in part being done gratis. Its application will assist with maintaining rates of aquifer recharge and the setting of practical allocation limits, which in turn will provide certainty for water users in the future, including Council municipal supplies.

Groundwater Quality 2014 Annual State of the Environment Report (E345-007-001) (Report prepared by Peter Davidson)

The annual state of the environment report for groundwater resources is currently being prepared, but its release will be delayed until the September 2014 Environment Committee meeting.

Its release has been delayed to:

• Allow more in-depth analysis and comparison with the chemistry of spring or river water within the same catchment, and to explain links with land based sources of contamination.

• How these values relate to limits in the recently released National Policy Statement for Freshwater Management 2014.

This year’s report focuses on nutrient levels in Marlborough’s groundwater resources and, in particular nitrate-nitrogen, which is the most common form of nitrogen in local aquifers.

Nutrients are overwhelmingly generated by human activities and are useful for identifying the hydrology of a catchment or aquifer, and its vulnerability to land based activities.

Groundwater Monitoring Network Modifications (E345-007-001) (Report prepared by Peter Davidson)

Work is progressing well on the alternative access route to the Council Wairau Bar monitoring well that is needed because of sea storm surges covering the track in sand and logs. An agreement has been signed with the leaseholder and landowner. The next step is to install a gate to allow access to the reserve and bypass the road block.

The replacement Lagoon monitoring well has been drilled and the accessway and work platform are being constructed. There will be a period of overlap when instruments record the electrical conductivity and elevation of groundwater simultaneously at both wells, to see if they represent the same water body.

The Lagoon well is an important Council permanent monitoring well. Its primary aim is to provide advanced warning of an inland move of the seawater interface along the coastal sector of the Riverlands Aquifer. Many water permits have conditions tied to certain level or electrical conductivity thresholds.

Autumn/Winter Aquifer Status (E345-007-001) (Report prepared by Peter Davidson)

The levels of monitoring wells across all of Marlborough aquifers are presently at normal to high status for this time of year compared to the long-term historical record.

Because demand is low at this time of year, there are no problems with supply and it follows that groundwater fed spring flows are also in a healthy state.

Notwithstanding this, the Benmorven Aquifer is still recovering at a sluggish rate and levels in the relatively extensive Wairau Aquifer will fall to low if rates of recharge from the Wairau River are below average for two successive months.

Unusually, over the past 12 month period, no restrictions were applied in the Needles Creek gravels because of the higher than average river and subsurface flows in the shallow riparian gravel aquifer typical of the Ward area. It demonstrates how saturated the catchment has been recently.

Water Resource Update and Summary - June 2014 (E320-001-001) (Report prepared by Val Wadsworth)

This report is prepared using data from Council’s environmental monitoring network, as well as additional sites operated by NIWA and the NZ Fire Service.

Rainfall Rainfall throughout the district was above average in June. Central and Southern Marlborough received a significant rainfall event on 10 June, whereas Northern Marlborough had four moderate sized events, each roughly a week apart. The highest total was at Tunakino where 430mm was recorded for the month, nearly double the normal June rainfall, but this is a high rainfall area where falls of 400-500mm per month are not uncommon. At the Blenheim site, monthly rainfall exceeded evapotranspiration for only the second time this year, which will be good for soil moisture levels.

The following graphs show the monthly rainfall totals for 2014 at four representative sites, compared to the long term monthly averages for those sites. The Blenheim graph also shows the actual monthly evapotranspiration (ET). The difference between monthly rain and ET indicates the likely soil moisture gain or loss.

NIWA Seasonal Outlook for Marlborough, Nelson and Buller Outlook for July to September 2014 Temperatures are likely to be about or slightly above average. Seasonal rainfall totals, soil moisture levels and river flows are all forecast to be near normal or slightly below normal.

Marlborough Environment Awards 2014/15 (E340-008-004-05) (Report prepared by Nicky Eade)

The Marlborough Environment Awards were established in Marlborough in 1997 and have been run biennially since that time. Council plays a key role in running and funding the Awards, along with other trustee organisations. The next Awards (the tenth) are just getting underway.

The Cawthron Institute has been secured as a new major sponsor this time around. A small gathering to mark this new partnership was held at Council on 23 June 2014. Cawthron have secured naming rights so the Awards will now be the “Cawthron Marlborough Environment Awards”. Speakers included Awards Trustee David Dillon, Mayor Sowman, Bob Dickenson representing Cawthron, Simon Heath from Mistletoe Trust and Awards co-ordinator Bev Doole, who provided a brief presentation.

Other sponsorship is in the process of being secured. The 2014/15 Awards will be officially launched at an event at Wither Hills Winery on 12 September 2014. At that point entrants for the six categories will be actively sought. The categories are:

• Farming;

• Forestry;

• Viticulture/Horticulture;

• Landscape and Habitat Enhancement;

• Business Innovation; and

• Community Innovation.

Judging will take place once entries close in November. The Awards presentation dinner is to be held on Friday, 20 March 2015 at the Convention Centre. Field days showcasing the winners will be held in April and May 2015 following the dinner.

Council’s involvement in the Awards is recognised in the objectives and policies of the Wairau/Awatere Resource Management Plan as a method to help achieve sustainable management. It has proved to be a successful investment of time and effort over the years, involving the Council in close collaboration with the other trustee organisations and highlighting a wide range of positive business enterprises in the Marlborough region.

We look forward to another successful Awards round over the next year.

Marlborough Landscape Group (C230-001-M05) (Report prepared by Nicky Eade)

The Marlborough Landscape Group was established in 2002 in response to widespread community concerns about rapid land use change in Marlborough. Landscape management is set out as an important matter within the Resource Management Act 1991 and the Landscape Group currently has a role as a focus group in relation to the current policy reviews being undertaken by the Council. Members of the group represent private, industry and agency interests. Meetings are held on a two monthly basis under the current chairperson, Councillor Peter Jerram.

The most recent meeting was held on 6 June 2014 and the minutes are attached.

Matters arising from previous meeting

• Grove Road plantings: Marlborough Roads continue their interest and support to work with private land owners to establish plantings. Clr Arbuckle confirmed with CEO Andrew Besley that as part of Annual Plan budget discussions, $20,000 from Reserves has been tagged for Grove Road.

• Lombardy poplars, Omaka Riverbed: All trees will be removed, in stages, and new trees will need to be fenced from stock and planted further away from the stopbank. Seeking advice from MLG on replacement species – suggestions for autumn colour include upright oak (quercus fastigiata) or rust-resistant Lombardy poplars.

• Arboretum launch: Was held on May 10 with good-sized cherry trees planted near the High Street bridge. Robin Dunn presented the meeting with 11 key objectives for the arboretum project. These will be discussed along with a landscape plan at the August MLG meeting.

• Forestry industry representative: Kyle Heagney (Merryl Ring) or Aaron Robinson were suggested as possible replacements for Michael Cambridge.

• Leeds Quay pocket park: Council staff have nearly finished access steps from the Marlborough Lines pocket park to Riverside. A letter of appreciation will be sent to Marlborough Lines to coincide with the opening.

• Sounds forestry Plan Review: Pere Hawes explained there are regulatory tools available to provide incentives for forest owners not to replant harvested areas in the Sounds. For example, an Oyster Bay forest owner was permitted to subdivide forestry land into 30ha blocks using old skid sites as building platforms. The owner was required to control wilding pines in return. This sort of approach is not suitable to all areas and needs to be applied on a site-by-site basis. Paul Williams commented that 30ha site is too big for bach owners. There is sufficient flexibility in the landscape chapter of the Plan Review for decision makers to contemplate a trade-off to create a subdivision in return for controlling wilding pines. Members commented that this is a message to get out to forestry owners, many of whom are reluctant to replant in the Sounds because it is uneconomic yet if they walk away there will be ongoing wilding pine issues.

Correspondence

• Eucalyptus trees: Marlborough Lines has written to Council CEO Andrew Besley for agreement to remove two eucalyptus trees near power lines at Grassmere. This request was forwarded on to the Landscape Group for comment. This issue was raised last year after severe storms in the area and the company regards it as a safety issue. The Landscape Group seeks more information about the condition of each tree and what specific risk they might pose. Trees are not dangerous just because they are standing. These eucalypts have been there a long time and are significant features on an otherwise stark landscape. Clr Jerram noted that neither of the prevailing winds (nor’wester and southerly) would put the trees on to the lines. Frank Porter said Marlborough Roads understands the potential hazard but is not proposing any action at this stage. Motion: The Marlborough Landscape Group has noted Marlborough Lines’ position and at this stage is not prepared to recommend the trees be removed. The Group advises Council that there needs to be an independent arborist report on these trees, funded by Marlborough Lines. Ian Mitchell / David Dillon. Carried

• MLG Planting maintenance: Email from Mark Wheeler clarifying funding of maintenance for MLG planting projects. First three years for establishment and maintenance is from MLG budget. Then ongoing maintenance is the responsibility of the relevant Council section, on the understanding that that section has approved the project before it started. Rivers and Reserves representatives on the MLG have signalled the need for more maintenance budget and Clr Jerram suggests an item to the Assets and Services Committee in a few months time explaining this.

• Beacon Road purchase: Email from Geoff Dick that Settlement and Titles have been completed for Beacon Road land purchase. Hawthorn control is planned over winter, followed by stopbank repairs. Robin Cox suggests a management plan before planting begins.

Brad Cadwallader, database manager for the NZ Tree Register

The NZ Tree Register is an internet database for information on significant or unusual trees. It is not restricted to protected trees, and anyone can register a tree based on the protocol on the website. New Zealand has some fantastic indigenous and exotic trees that attract people from around the world for their growth and size. This register gathers and holds the information for people to easily find and share.

The register started as Notable Tree Scheme 1978 to identify notable trees and then ask councils to list them on their District Plans. In 2008 it was relaunched online as the NZ Tree Register. MDC has been a solid supporter, providing funding and seed collection services.

Objectives of the NZ Tree Register:

• Centralise the tree records

• Be freely available

• Appeal to general public while being scientifically robust

• Foster greater understanding of cultural, aesthetic, historic, conservation and scientific values of New Zealand’s most significant trees.

• Record significant trees, photos and the stories behind them.

• Encourage people to want to look after their tree heritage

The database is used by Government departments, local authorities, tourists, historians, Dept of Conservation, authors, arborists, tree interest groups and the general public and is a great tool for ranking and establishing the significance of trees nationwide. There is a high representation of exotic trees, with more indigenous listings needed, especially for tourist interest.

Brad emphasised that the register is purely a database and does not mean the trees are automatically protected (only local authorities can register and protect trees). All entries are validated by Brad before being added. Rob Dunn is working to put all of Marlborough’s protected trees that meet the criteria on to the database, giving location, health, height, girth and the story behind botanical and historical specimens. Specimens in Marlborough include the manna gum at Woodbourne, the largest in the world for that species, and the bunya bunya at Spring Creek, which had the largest girth in New Zealand until it died after the paddock was sprayed.

MLG members thanked and encouraged Brad to keep up the excellent work, and volunteered to help publicise the database. Suggestions include profiling a Marlborough tree from the database on the MDC Council page and website. Also approach the Saturday Express for a regular spot featuring a Landscape Group member with a significant tree.

General Business

1. Policy work on heritage trees in Marlborough

Rob Dunn has put together a draft paper on how Council could assist private landowners to look after protected trees on their property. At the moment the legal position is if a tree is on private land, the Council will not assist. There is no incentive or assistance to help the property owner look after the tree, such as arborist pruning, maintenance or resource consent. Rob is working with the legal and policy teams to improve this approach.

MLG has received $10,000 to provide plaques for trees and help council reserves staff and private property owners look after notable trees. Brad Cadwallader said the challenge is for Council is to offer assistance but not take responsibility or liability for trees. That responsibility remains with the owner and needs to be clear. The draft paper will be discussed at the August MLG meeting.

2. Landscape Group 2014-15 Budget

Draft budget for 2014-2015: Group 1: $36,000 Taylor River Project, riparian and arboretum plantings Group 2: $27,000 Grove Road enhancement Group 3: $27,000 Kahikatea Reserve $9000 (lease has expired so more land is available to plant), River Reserve maintenance $9000, Sheps Park $9000 Admin: $10,000 Council staff will determine opportunities for carry-forwards in the event of under-spending. The strategy is to focus on high visibility and publicly accessible sites for plantings. Other projects for consideration: Equestrian Park and Bothams Bend area plus across the channel where Fish and Game Lease has expired; Beacon Road Reserve.

3. Landscape plan for Equestrian Park

Members of the Landscape Group met the Equestrian Park Committee on May 7, 2014. (Meeting notes attached). They are seeking MLG support to help create a landscaping plan. Members were impressed with the potential of the site and the professionalism of the Equestrian Park Committee. The development of this site would attract events and bring more people to Marlborough and members were keen to assist in planning for this positive project. The Committee was also encouraged to call on the skills of MLG members Tim Newsham, David Dillon, Bill P and Jon Waddy. The Group also considered providing a concept plan for planting.

Harbour Functions

Derelict Vessel and Abandoned Vessels Harbours staff frequently deal with vessels that are either abandoned, derelict or illegally occupying moorings.

In recent months, Harbours has dealt with an unusually large number of derelict vessels. Two of these vessels have been advertised in local media in an attempt to locate the owners.

One of the derelict vessels sank on its mooring and the wreck was recovered at Harbours’ expense as the owner cannot be traced (as yet). The police are assisting in this matter.

A further derelict vessel was very recently recovered drifting in Waikawa Bay after breaking a mooring.

The recovery, storage and salvage of derelict vessels, and the time spent attempting to trace owners, comes at significant expense. Even when owners can be found they are often unable to pay costs. The vessels are all but worthless on the market.

The Harbour Master exercises powers under the Maritime Transport Act to secure a derelict vessel in a safe location or remove the vessel from the water.

Thereafter, the process involves making a reasonable effort to locate the owner. If an owner cannot be found the vessel is advertised in local newspapers and, after a specified time (30 days from second advertisement), the vessel is declared abandoned. Once officially abandoned the vessel is either sold or destroyed.

Presently one vessel is being advertised but is as yet unclaimed. Another vessel has recently been advertised and the owner has surfaced. However, it is unclear as to whether the owner will be able to meet the necessary expenses to reclaim the vessel. A third vessel is currently in a secure location while the Harbours team searches for the owner.

Full and clear details of the process followed by the Harbour Master in regard to derelict vessels are contained within the Harbours Safety Management Plan.

Aids to Navigation AtoNs Update May 2014 - July 2015 The Council is responsible for the provision and servicing of 98 AtoN in the region, which include beacons, buoys, channel markers and leading lights. The collective replacement cost of these units is estimated at $1.2 million.

These AtoN are a critical component of the Harbour Safety Management System and their operation must comply with international standards as set by the International Lighthouse Authority (IALA). Requirements include minimum response times to rectify light failures, prescribed inspection routines and the establishment of an accurate performance data recording programme.

In late 2012 the organisation contracted to carry out the management of AtoN within the Marlborough region failed to renew terms and the contract was put to tender. No cost effective option was presented and the management of navigational aids was brought ‘in house’ to be carried out internally by the Harbours Department.

Following the decision to bring the AtoN contract ‘in house’ a 6.5 metre vessel ‘Astrolabe’ was purchased for the purpose of servicing AtoNs. This vessel was brought into service in November 2013.

The AtoN lights have performed well over winter. The only exception has been a failure of the Category 1 East Head sector light. This is a critical light for ships transiting outbound Tory Channel. The light was repaired within 10 hours of being reported.

Another round of six monthly navigation aid checks is about to commence in Pelorus Sound. This process gives us confidence that the lights are fully functional and allows us to identify any maintenance requirements.

Weather and contractor workload has prevented the Motuara North Cardinal from being installed. However we expect this to be completed very soon.

The Pickersgill Island West Cardinal Mark has been destroyed. This is an unlit beacon but an important navigational aid. It has been temporarily replaced by a red buoy. A suitable permanent replacement is to be sourced.

The blue light warning system to indicate ferries departing the berth continues to require troubleshooting. It is expected this will enter testing phase very soon.

The reliability of Marlborough AtoN and the failure response times achieved for the preceding six weeks have exceeded IALA standards.

Note: IALA specifies three categories for AtoN. ‘Category 1’ AtoN are defined as being ‘of primary navigational significance’ and have the highest availability requirement. Tory Channel leading lights are the only Category 1 AtoN under Council control.

Over 90% of AtoN under Council control are listed Category 2, being defined by IALA as ‘of navigational significance’.

IALA standards have been achieved for the past six weeks.

Diesel Spill - Picton Harbour - 6 July 2014 The Sealord fishing vessel, Otakou, is a regular caller at Picton Harbour, particularly during the hoki season, when multiple calls occur.

As with all vessels, it is not unusual to transfer fuel internally, either for stability/trimming purposes or to top up daily service tanks.

During Otakou’s call on 6 July, the engineer proceeded to transfer diesel fuel from one tank to another using a low-volume on-board pump. It was expected to take about 8 hours to fill the receiving tank. The engineer was sole charge in the engine room.

Breathers, or vent pies, from fuel tanks are located on deck to prevent tanks becoming over pressurised and have sealed save-alls fitted around them. Save-alls capture any ‘blow-back’ that may occur during a transfer process in order to prevent diesel from entering the environment. Save-alls are also fitted with valves to allow accumulated water to be drained off.

From interviews with on-board staff, it appears that the ongoing transfer operation, being particularly slow on account of the low volume pump, was simply forgotten about. Additionally, the save-all drain valve was left in the open position at the time of the transfer operation. As a consequence, when the receiving tank was full, the overflow escaped up the vent pipe and spilled into the save-all and onto the vessel’s deck and into Picton Harbour. The overflow was not noticed immediately but the alarm was eventually raised by crew. It is not known exactly how much diesel overflowed from the vent during this time, but ship’s estimates stand at 200 litres. Harbour Master Group staff and Port Marlborough staff attended the spill and provided absorbent pads and pillows to collect diesel spilled onto the vessel’s deck.

It would seem that there were no procedures exercised to mitigate risk when transferring fuel between tanks. In addition, it is reported that the tank high-level alarm was not working.

It is considered that adherence to some fairly standard procedures would have prevented the spill from occurring. For example, a system to remind the engineer of the fuel transfer should have been in place as well as a system of monitoring the filling rate/progress of the tank. A system to ensure save-all valves were closed during the transfer should also have been in place.

On the positive side, once the spill was noted, the vessel’s crew were quick in ensuring that as much of the spilt product was retained on board the vessel and that this was dealt with effectively. Additionally, the engineer immediately dropped the level within the tank to prevent further spillage. Efforts by both Harbour

Master Group staff, Port Marlborough and ship-board personnel resulted in an efficient and effective clean-up response.

Diesel that escaped overboard was allowed to disperse naturally. Inspection of the area the morning following the spill did not find any further visible traces of the spill.

A search of the incident database indicates that this is not the first spill the vessel has had in Picton Harbour. A previous spill occurred on 15 June 2010 as a result of an unintended discharge of the vessels bilges alongside Waitohi Wharf. No further action, other than a warning, was taken following this spill.

The matter has been referred to the Prosecution Sub-Committee for consideration of further action.

Monthly Harbours Incident Summary (H100-004-001-14) (Report prepared by the Harbour Master)

The Committee will be aware that staff deal with a variety of incidents that occur within the Sounds on a regular basis. Some of the incidents are reported in the media due to their nature, but the majority are reports received by the Harbour Master’s office.

With the introduction of the Port and Harbour Safety Code and the requirement to undertake a risk assessment, staff have reviewed the Harbours Incident database and revised it to the extent that retrieval and manipulation of statistical information is simplified and that standard reporting on a month-by-month basis is made easier. Current cumulative incident totals are as from the start of the current calendar year.

Attached to this item is the summary of the incident reports that have occurred since the Committee’s last regular meeting. It should be noted that incidents are generally up to the day prior to the Agenda closure. Staff will be on hand to outline and explain the data, however, information as it is set out will generally form the basis of the report.

A variety of incidents occur and these are recorded with a view to keeping the Committee informed, identifying potential trends as well as using the data to plan educational initiatives.

The Harbour Master will review/investigate all navigational incidents reported. As incidents occur, they will be listed on this document. Each incident remains ‘live’ until such time as the investigation/review is complete and the file on that particular incident is closed. Some incidents will be investigated/reviewed by the Harbours staff, some jointly with Maritime New Zealand whilst others will be dealt with by the Authority alone.

Consents Section

Resource Consents Group Update (R450-004-12) (Report prepared by Anna Eatherley)

Applications for resource consent up until the end of June 2014 are still being received and issued at an increased level over the same period last year. There is a 19% increase in applications received since 1 January and a 10% increase in applications issued.

The increase in applications is partially due to the large number of coastal permits coming up for expiry. However, there is also a number of short and longer term water permits coming up for renewal.

The Land Use/Subdivision team is one down with the departure of Daniel Shao back to Auckland. The number of land use applications received has been recently inflated by a number of frost fan and other applications associated with new vineyards in the Wairau Valley.

Only two hearings are scheduled for July. The first is a mooring in Ngakuta Bay and the other is a reconvened hearing for a water permit for Marlborough District Council in Riverlands. Both hearings will be heard by independent commissioners.

Council also recently received the decision for the KPF Investments Limited and Pelorus Wildlife Sanctuaries and Others v MDC appeal. The appeal of Pelorus Wildlife Sanctuaries and others was allowed and the appeal by KPF Investments Limited was dismissed and therefore the grant of consent by Council was cancelled. Judge Jackson and Commissioners Prime and Buchanan found that the proposal would have adverse effects on the Area of Outstanding Landscape Value in which the site sits and also that the proposal failed to recognise the traditional and continuing relationship tangata whenua have with the site and its environment. This relationship has been already weakened by the four existing salmon farms in the area and therefore the cumulative effects of this proposal weighed heavily against granting the consent.
