Legal Definitions of Public Domain-US
Date Range Copyright status
Pre-1923 Expired copyright; can be determined by pub loc and fixed field date in most cases
1923-1963 Copyright status depends on existence of renewal and copyright formalities in work. Can be complicated by inclusion of previously published content within other works, by earlier foreign editions and by the nationality or work location of the author
1963- Protected by copyright with minor exceptions
Why Nationality Matters
A foreign author writing in the US retains his European rights
A foreign writer often has an earlier foreign edition of his work
published prior to the US edition

Pre-1873 Rights assumed to have expired
Less than 140 years ago (currently, published in 1873 or after)
Copyright status determined by:
• Author’s death dates (expires death + 70 yrs (UK) + 50 yrs (Canada))
