The seminar assists lawyers representing employees and employers in relation to the key practical aspects of these injunction applications as well as providing tips in relation to the litigation process. It will also consider the topic in relation to retirement or discipline of partners/members of LLPs. The seminar will consider injunctive action brought to stop suspensions and disciplinary action, to overturn dismissals and to extend the life of the employment contract. An important theme of the seminar is the extent to which the case law can be used in private employment – the speakers believe that injunctions can readily be used outside of public employment. As well as focussing on injunctions that prevent disciplinary action or order employers to comply with aspects of the contractual disciplinary process, the seminar considers the possibility of using injunctions where the employer is said to have an ulterior or unlawful purpose behind the action. The seminar will also focus on employee benefits where those benefits become non-payable once the employee’s employment has been terminated or notice of termination has been given. This is particularly relevant in the context of bonuses. The seminar will consider the relevant law (e.g. Reda v Flag and Jenvey v ABC) in relation to terms that can be implied in to contracts of employment regarding the employer’s actions/motives in deciding to terminate employment and whether injunctions could be used to ensure that the employment continues until the key bonus payment date.
