In the case of state of Rajasthan. Appealant V Smt. Kalbi and others, respondents the High Court declined to rely on the witness because she “ is the wife of the deceased,” and therefore , she was a “highly interested” witness and moreover, there was discrapencics in the evidence.

But the Supereme Court observed with resp. that in their opinion the grounds “are invailid.” For, in the aicumotar of the case, she is the only and most natural witness. She was only person present in the hut with the deceased at the time of occurance and the only person who saw the occurance.Truly she is the wife of the deceased, but she can not be called an “interested’ witness. She is related to the deceased. “Related” is not equivalent to “Interested.”A witness may be called “interested” only when he or she derives benefit from the result of the litigaton in the decre in a civil case, or in seeing an accused person punished. A witness who is a natural one and is the only possible witness in the circumstances of the case can not be said to be “interested”. In the instant case this witness had no interest in protecting the culprit and falsely implicating the respondents.

For the discrepencies the Supereme Court observed that these are , minor ,insignificant and natural. In the deposition at witness these are always discrepencies however honest and truthful thay

may be the discrepencies are due to named errors of observation, Loss of memory due to lapse of time, mental disposition such as shock and horror at the time of occurance.

It is true that in an appeal under Article 136 of constitution the court normally does not interfare with findings of facts arrived at by High Court. But when it appears that findings of facts arrived at are bordering on perversity and are in mis carriage of Justice, this court will not decline to qua such finding to prevent the miscarriage of Justice.
