The meeting consisted of one public hearing. The meeting was convened at 22329 170th Street, Redwood Falls. The following Board of Adjustment members were present: John Rohlik, Dan Tauer, and John Schueller. The following individuals were also present: Tom Jenniges and Land Use & Zoning Supervisor Nick Brozek. At 8: 35 a. m., the meeting was called to order by Chair John Schueller. Chair Schueller opened a public hearing on an Application for Variance, Permit Application No. 1- 19v, submitted by Tom Jenniges. Prior to the Board of Adjustment meeting, the Board of Adjustment members were provided an informational packet which included the following information regarding the Application for Variance: 1. A public hearing will be held on May 28th, 2019, at 8: 30 a. m. regarding an Application for Variance filed by Tom Jenniges, pursuant to Redwood County Code of Ordinances, Title XV, Section 153. 026, requesting a variance from the required '/ 4 mile setback from a neighboring dwelling and the 300 foot setback from a public drainage ditch set forth at Redwood County Code of Ordinances, Title XV, Section 153. 290( H). 2. Tom Jenniges has raised cattle on his farm site located at 22329 170t" Street since prior to the feedlot ordinance going into effect in 1996. Consequently, he continues to operate a 225 animal unit cattle feedlot on his property without ever having obtained a conditional use permit. Additionally, the existing feedlot does not meet the 1/ 4 mile setback from a neighboring dwelling currently unoccupied). The feedlot is about 1, 100 feet from the neighboring dwelling. Mr. Jenniges now proposes to increase the animal units on the site to 499, and construct a new mono- slope barn, in addition to the existing barn and open lot feedlot structures. 3. The proposed new barn will be located about 920 feet away from the neighboring dwelling. Furthermore, it will be located about 200 feet from the bank of Judicial Ditch 36, Lat lA, Lat U. The required setback from the ditch is 300 feet. 4. The ground between the existing feedlot and the ditch is currently tilled farmland. It contains private drain tile, but no county tile. Some of the private tile will need to be re- routed in order to build the proposed barn. The land slopes gently from north to south, toward the ditch, with about 4 feet of fall over a distance of 350 feet from the feedlot to the ditch bank. Ditch Inspector Brent Lang has expressed that he has no concerns about the project affecting the ditch.

MINUTES

Meeting Date: May 28, 2019

A meeting of the Redwood County Board of Adjustment convened on Tuesday, the 28`" day of May,2019. The meeting consisted of one public hearing. The meeting was convened at 22329 170th Street,Redwood Falls. The following Board of Adjustment members were present: John Rohlik, Dan Tauer, andJohn Schueller. The following individuals were also present: Tom Jenniges and Land Use & ZoningSupervisor Nick Brozek.

At 8: 35 a.m., the meeting was called to order by Chair John Schueller.

5. The neighboring dwelling lying within the '/ 4 mile setback is part of an old farm building siteowned by Verna Timm. The dwelling has been unoccupied for 2 or more years, according to theapplicant.

6. Pursuant to Redwood County Ordinance, written notice shall be provided to all property owners ofrecord within five hundred (500) feet of the affected property via U.S. Mail as to the time andplace of the public hearing. Further, written notice shall also be provided to the affected board oftownship supervisors and the municipal council of any municipality within two (2) miles of theaffected property.

The following information was presented to and considered by the Redwood County Board of Adjustmentat the public hearing:

Tom Jenniges was present to explain the project. He made the following statements about the application:Tom is working with the Equip program to get grant money to build a 440 foot by 60 footmonoslope barn to house 499 head of beef cattle.

The barn will have indoor manure storage.

The barn will be about 230 feet from the public drainage ditch on the property.The barn will need to be about 50 feet from the gates of the current feedlot site for access purposes

and moving snow in winter.The cattle will be kept inside the barn, under a roof, at all times except when they are beingworked.

In winter a snowbank forms on the west edge of the grove, so Tom needs to leave a gap betweenthe new barn and the existing structures.The neighboring house owned by Verna Timm is unoccupied.The site of the barn will be built up 3 feet above the existing grade.The existing partial confinement feedlot will no longer be used to house livestock. Instead, the oldbarn and lot will be used for feed storage and bale storage.

The Board of Adjustment members had the following questions and comments:What will happen to the storm water runoff from the roof of the new barn?

Which way will the monoslope roof slope down to?Where will the barn be accessed from?

Will the new barn interfere with the existing power lines??

Jenniges responded as follows to the Board members questions:

Nick Rowe, an engineer, and the NRCS will design a drain tile system to handle all the water

runoff—this is required by the Equip program.The monoslope roof will slope to the north, away from the ditch.The barn will be accessed from the east end.

The power lines ( to Jenniges' property) will probably be buried.Some private tile intakes will need to be moved and some additional intakes will be installed as

part of the new drainage plan.

No members of the public appeared in support of or in opposition to the variance.

On a motion by Tauer, seconded by Rohlik, the variance was approved by unanimous vote.

Discussion was held regarding the Minutes of the Board of Adjustment meeting held on the 28h

day ofNovember, 2018. On a motion made by Tauer and seconded by Rohlik, it was moved and passedunanimously that said minutes be approved as presented.
