Huey Newton, Minister of Defense of the Black PantherParty for Self Defense, lies in the hospital at San QuentinState Prison, with a gunshot wound in his stomach, inflictedby an Oakland cop . An Oakland cop is dead and buried and asecond cop lies somewhere in some hospital with three bulletwounds in his body . Huey has been charged with the murder ofthe first cop and the shooting of the second .
The shooting occured in the heart of Oakland's blackghetto . Huey is a black man, a resident of Oakland's blackghetto, and_the two cops were white and lived in the whitesuburbs . On the night that the shooting occurred, there were400 years of oppression of black people by white people focusedand manifested in the incident . We are at that crossroads in -
history where black people are determined to bring down thefinal curtain on the drama of their struggle to free themselvesfrom the boot of the white man that is on their collectiveneck . Huey Newton knew that the chief instrument of oppressionof black people in America is the police departments of thecities . Through murder, brutality, and the terror of theirimage, the police of America have kept black people intimidated,locked in a mortal fear, and paralyzed in their bid for freedom .He knew that the power of the police over black people has tobe broken if we are to be liberated from our bondage . Thesegestapo dogs are not holy, they are not angels, and there is nomore mystery surrounding them . They are brutal beasts who havebeen gunning down black people and getting away with it . Theycall this "justifiable homicide" carried out by an officer ofthe`'law iit-,~,~e line of duty . Black people understand that thisis very true'°"- but not in the way that the lying mass mediawould have people believe .
The "duty"_that these wretched jackels are carrying outis to keep the niggers in .check ; the peacethat they arecharged with keeping is the peace of the power structure, thepeace of the Bank of America and General Motors . To performtheir duty, they must necessari ly disturb the peace of blackpeople . In fact, black people have had no peace since the firstday they sat foot on this bloody Babylonian soil called Ameri-ca . Peace is what black people seek, what they are determinedto have . Peace is what is being witheld from black people .

Newton heard Malcolm's voice and understood his message . 20,000,000 black people heard Malcolm's message and that same 20,
000,000 feel exactly the same way about it as Huey Newton feels .
20,000,000 black people say that the cops ark down wrong
from the get-go and that'Huey Newton is right . 20,000,040 black
people say that Huey is not guilty of any crime, that he is now
being held as a political prisoner, and they want him set free .
We know thatswhite people, the majority of them, neither under-
stana this npr do they believe that black people really meanthis . Some white people understand this, know it to be trueand just, and they back black people up in their just demandsfor liberation and an end to the terror .
Huey Newton's case is the showdown case . It marks theend of history . We cannot go a step beyond this point . Herewe must draw the line . We say that we have had enough ofblack men and women being shot down like dogs in the street .We say that we have had enough of cops being set free with averdict of justifiable homicide . We say that black people inAmerica have the right to self defense . Huey Newton has laidhis life on the line so that 20,000,000 black people can findout just where they are at and so that we can find out justwhere white America is at .
We have reached the point in history where we must claimthat a black man, confronted by a bloodthirsty cop who is outto take his life out of hatred for the black race, has a rightto defend himself -- even if this means picking up a gun andblowing that cop away . Make no mistake about it : that is wherewe are at today . A cop is nothing but a man in a uniform .Through their propaganda and brainwashing of the people theyhave us believing that there is something supernatural orspecial about a cop . A cop is a human being just like anybodyelse, he came into the world just like anybody else, and hecan leave this world just like anybody else .

Huey Must Be Set Free!guns and one for black men with guns . Either human life issacred or it is not . If human life is sacred then we mustdemand that black life also be considered sacred .
On the very same day that the shooting incident invol-ving Huey occurred, a 70 year old black man in Palo Alto had-his head blown off by a cop, from behind, and he was unarmed .Yet there has been no outcry about that . There has har3lybeen a peep about it . Was this 70 year old black man's lifesacred?
The racist dog Oakland cops say that this dead cop isthe first one who has been killed "in the line of duty" intwenty years . Yet that same Oakland police force has shotand killed scores of black men and women in that same period .What about them? Don't trey count? Who is keeping the sta-tistics about them?
And what are we supposed to do aboutthat? Are we supposed to just sit back calmly and add anotherdigit to the statistics everytime another black person iskilled by an Oakland cop? We know-that that_is what theywant us to do -- but we are here to say that those days aregone : Does everybody understand that? THOSE DAY ARE GONE :THE DAY WHEN A COP CAN SHOOT A BLACK MAN, WOMAN, OR CHILDDOWN IN COLD BLOOD AND HAVE IT RULED JUSTIFIABLE HOMICIDE ISGONE FOREVER .

Undoubtedly, the Oakland cops would be tickled pink ifinstead of having a dead cop and a live Huey on their hands,they had a dead Huey and a live cop . But we go further and say that we want Hueyto stay alive -- we go even further and say that we want Hueyset free .

The brutal savagery of the Oakland police during thedemonstrations at the Oakland Induction Center and thevicious attack upon Huey P . Newton, Minister of Defenseof the Black Panther Party for Self Defense, make itcrystal clear that Oakland cops constitute a politicalforce with purposes and tactics similar to those of theGerman gestapo . The widespread and unprovoked clubbingand gassing of women, children, and other citizens --most notably on October 17th, leave little doubt that theOakland police are not the servants and protectors of thepeople, but their bitter oppressors . These acts -- whichwere well-documented by many members of the press whowere not only witnesses but often innocent victims aswell -- are consistent with the common police practicesof harassing, brutalizing and terrorizing black people inthe ghettoes of Oakland . ~In fact, the Oakland police re-present nothing more than an army of occupation in theblack communities .
In cases where participants in the demonstration ag-ainst the Induction Center were arrested by Oakland policeand charged with assaulting "peace"officers, an examination of the facts reveals that it was in fact the Oaklandpolice aho, without provocation, attacked the demonstra-tors and viciously beat them . Then, after the victimsof these police attacks attempted to defend themselves,they were charged with assaulting policemen : This isalso totally consistent with the Oakland police practiceof attacking black people, without provocation, in theirhomes, on the streets, and in police stations . Here ag-ain, when the victims of these attacks attempt to defendthemselves, they are charged with assaulting police of-ficers .
For this reason, we fully support Huey P . Newton,Minister of Defense of the Black Panther Party for SelfDefense, in his leadership of the resistance againstthese brutally oppressive tactics . We know Huey P. Newtonto be a courageous leader in the struggle against oppres-sion and we further know that, despite the long-standingand undeniable grievances that all black people haveagainst occupying forces like the Oakland police, FIueyP . Newton would not have confronted cops in the mannerdescribed by the Oakland police . Our own experienceswith the same Oakland police strengthens our convictionthat Huey P . Newton is a victim of police assault and isnow being held as a political prisoner . We thereforepledge our continuing support for him in his struggleagainst the oppressive and discriminatory "legal" system,of which the police and the courts are both parts .
In light of the above incontrovertible facts con-cerning the conduct of the Oakland police and the con-sequences resulting from it, we demand that the followingsteps bP taken immediately :
1) Chief Gain must publically confess that his police-men provoked and assaulted Huey P . Newton and leaders ofStop the Draft Week ; and he must insist that all chargesagainst them be dropped and charges initiated insteadagainst the policemen involved and those who were respon-sible for issuing their orders, including Chief Gain him-self .
2) If Chief Gain is unwilling to perform his duty tothe people in this manner, he is clearly not qualifiedto hold his position and should resign .
3) We remind the Oakland police that they are paid bythe

eo le .Instead they have allowed themselves to become mercenariesof the Power Structure, to be used as an occupying armyin the black communities and as storm troopers in societyat large . Oakland police must rebel against their supe-rior officers and all others who order them to commitcrimes against the people ; otherwise, they will-face thesame fate as the German soldiers and secret policemen whowere judged guilty of war crimes, despite their pleasthat they were only obeying orders .
If these demands are not met, the future can onlyhold further confrontation, further bloodshed, and thecontin;ring state of war between the people and the police .

The question of political prisoners has, from time .immemorial, been a dilemma in the field of legal juris-prudence . Socrates was a political prisoner ; so wereJesus, Galileo, Sir Thomas Moore, Sacco and Venzetti .Contemporary political prisoners include Mohandas Ghandi,Jawaharlal Nehru, Kwame Nkrumah, Sukarno, Fidel Castro,and Adam Clayton Powell . What is the common thread in-exorably binding these men together? It is the fact thattheir imprisonment stemmed not from acts committed thatare universally held to be outside the pale o~f acceptedhuman behavior such as murder, arson, theft, or mayhem .It is rather that their acts were deemed criminal in thecontext of the political experience of the day .
The Black Man in America ~.s, too, a political priso-ner . He too has committed an act deemed criminal in lightof current political expediency . His act? His birth :It has been the political expedient for 400 years to cas-tigate, emasculate, and finally to eliminate the BlackMan from American society .
The late and sainted E1 Hadji Malik El Shabazz alsoknown as Brother Malcolm clearly saw this fact and toldhis Black Bretheren that America to them is just anotherprison ; that the only difference between themselves andtheir brothers in penal institutions is the fact thatthe imprisonment of the latter is to a degree more confi-ning .
If this historical context is not fully understood,the plight of Dred Scott, the Scottsboro boys, the Har-lem Six, LeRoi Jones, Barry Wynn, and Charles McCrae, HueyNewton, and Asante Kimani has no significance .
In light of the foregoing, Floyd B. McKissick, Na-tional Director of the Congress of Racial Equality (CORE),today announced that CORE has honored the request ofLeRoi Jones and his co-defendants, Barry Wynn and CtrarlesMcCrae,their counsel and families, to assist in theirdefense . The three defendants were convicted of the il-legal possession of firearms on Noygt~~g~ ~,
ThC dgf¬R=dants pleaded not guilty and were convicted of the charge .The case is now on appeal . The defendants are presentlyrepresented by Irving Booker, Esq . Sentence is to bepassed on the 28th day of November at the Morris CountyCourthouse, Morris County, New Jersey .
CORE maintains that the case of LeRoi Jones, thenoted Black Playright, and his two co-defendants, raiseserious constitutional questions .
1 . Whether Black People have the right to own andpossess firearms .
2 . Whether,in light of the ancient right of a trialof a jury of one's peers, twelve white men canbe peers of three Black Men.
3 . Whether constitutional rights were denied byillegal search and seizure .
4 . Whether at the time the trial was conducted, inlight of the national feeling, the feeling ofthe .local community and statements wade by theGovernor of the state as well as the Mayor ofthe city in which the incident took place, do notin themselves, amount to a judgment prior totrial .
These serious questions are germaine to the Bill ofRights of the Constitution of the United States, underthe Fourth Amendment (The Right to Bear Arms) and underthree sections of the Fourtheenth Amendment :
a . Due Process of the Lawb . The Privileges and Immunities clause ; and,c . Equal Protection under the Law .

Right here in the Bay Area, HueyNewton, Minister of Defense of the Black Panther Party forSelf Defense, has been charged with murder and assaultwith intent to commit murder, as a result of an afllegedgun battle betcaeen Newton and tcao Oakland cops, in whichNewton was slightly injured, one policeman seriouslywounded, . and the ether policeman kill -~ . The traitor of other racesis generally confined to themediocre or irresponsible in-dividuals, but, unfortunately,the traitors among the Negrorace are generally to be foundamong the men highest placedin education and society, thefellows who call themselvesleaders .
For us to examine ourselvesthoroughly as a people we willfind that we have more traitorsthan leaders, because nearlyeveryone who essays to lead therace at this time does so byfirst establishing himself asthe pet of some philanthropistof another race, to whom hewill go and debase his race inthe worst form, humiliate hisown manhood, and thereby winthe sympathy of the "greatbenefactor", who will dictateto him what he should do in theleadership of the Negro race .It is generally, "You must goout and teach your people tobe meek and humble ; tell themto be good servants, loyal andobedient to their masters . Ifyou will teach them such a doc-trine you can always depend onme to give you $1,000 a yearor $5,000 a year for the sup-port of yourself, the newspaperor institution you represent .I will always recommend you tomy friends as a good fellowwho is all right ." With thisadvice and prospect of patro-nage the average Negro leadergoes out to lead the unfortu-nate mass . These leaders tellus how good Mr . So and So is,how many good friends we havein the opposite race, and thatif we leave everything to themall will work out well .
This is the kind of leader-ship we have been having forthe last fifty years . It isnothing else but treachery andtreason of the worst kind . Theman who will compromise theattitude of his country is atraitor, and even so the manwho will compromise the rightsof his race can be classifiedin no other way than a traitoralso .
Not until we settle down asfour hundred million people andlet the men who have placedthemselves in the lead of usrealize that we are disgustedand dissatisfied, and that weshall have a leadership of ourown and stick by it when we getit, we will be able to lift our-selves from this mire of degre-dation to the heights of pro-perity, human liberty, and hu-man appreciation .
