1. On the authority of Railway Board's letters under reference, this railway has executed LWISagreement No FM/LWIS/UTKAUBTCS/2011/1 wi.thMIs Utkal Alumina International Limitedon 27.11.2012 for movement of Caustic Soda Lye in 62 BTCS wagons (01 rake including4°!o spares) and 2 BlVans. Out of which the investor has inducted 62 BTCS 'wagons andone brake van, details of which are furnished at Anexure-1.

2. If MIs Utkal Alumina International Ltd does not place any indents, these wagons will remainidle in their premises. If E.Co.Railwayllndian Railways has to stable these rakes in railwaysowned yards at the request of MIs Utkal Alumina International ltd or otherwise, stablingcharges will be payable to Railway as per the rates fixed by Railway Board from time totime. Normally, no demurrage charge will be levied when the detention to the wagons'takesplace in the Investor's own premises. If the wagons are stabled in the Railway's premiseson account of default attributable to the Investor, stabling charges as prescribed by theRailways from time to time shall be paid by the Investor to the Railways.

3. 15% (fifteen percentage) freight concession will be granted for a period of 20(twenty) yearsfor each loading of the subject rakes of SPW procured under LWIS operating betweenexisting or new private terminal capable of handling the traffic in such Special PurposeWagons in an approved closed circuits. The concession will be given in the RR itself. Theabove mentioned freight concession will be granted in each case on the Base Freight rateprevailing at the time of issue of this commercial notification for the said wagonsie, dt.06.02.2014, which is Rs.365.80 Per ton Ex PGFV to MUAT or Base freight rate

..applicable at the time of booking, during the currency of the concession period of 20years, whichever is lower.

4. The freight concession will be granted only on the wagons specified at Annexure-I..The date of commencement of the concession will be from the date of this notificationLe.06.02.2014 and the period of concession shall remain valid for 20 years i.e. upto 05.02.2034.

P/025. No freight will be charged for movement of empty rake to the next destination

provided the distance traveled by empty rake is less or equal to the distance traveledby the train before unloading. However, if the distance traveled by empty rake is morethan the loaded distance then for additional distance traveled by empty·rake over andabove the loaded distance, empty freight rate shall be charged at 50% of loadedfreight of public tariff on carrying capacity of the wagons. Whenever empty haulage isrequired for maintenance/POH or for any other reasons, empty haulage charges willbe payable by the Investor at the prescribed tariff rates.

6. Maintenance of wagons will be undertaken by Indian Railway on payment as perAnnexure-I of the agreement. The cost of maintenance of these wagons will be borneby the customer till the period of rebate in freight is given i.e, for 20 years from thedate of commencement of service.

7. Various details of this traffic like number of trips, total freight, rebate etc. should bemaintained at the respective loading and unloading points and furnished to divisionalhead quarters duly signed by CGS or SM of the respective stations. The said monthlystatement should be furnished by Sr.DCM of respective divisions to CCM/ECoR/BBSfor appraisal.

8. This notification is valid for only One rake comprising any of the 62 BTCS wagons and01 brake van mentioned at Annexure-I.

9. Sr.DCMIWAT is advised to ensure the availability of the copy of the agreement andthis circular at loading/unloading points. The sectional CMI may guide supervisors /staff concerned at the loading/unloading points regarding correct charging of the saidBTCS rake as per the provision of this circular and LWIS agreement.

10. CGS /In-charge of VPT & MUAT are advised to ensure correct charging as per theprovision of this circular and LWIS Agreement No FM/LWIS/UTKAUBTCS/2011/1dtd.27.11.2012 signed between East Coast Railway & Mis Utkal Alumina InternationalLtd.

Ref: Rates Circular NO.20 of 2012 {CCM/ECoR's Commercial Circular No.75(G)/2012dated 03.08.2012}.

A clarification was sought regarding fixation of Siding Charge in case of goods shed laidat a distance from the main station Le. outside the station limits.

•In terms of Para (b) of Rates Circular No.20 of 2012 {CCM/ECoR's Commercial Circular

No.75(G)/2012 dated 03.08.2012} where a goods shed is laid at a distance from the main stationLe. outside the station limits, such goods sheds should be notified by Zonal Railways as PublicSidings and in such cases, Siding Charge will accrue and get accounted for in accordance withinstructions contained in Para 2523 of fRCM Vof.ll.

Regarding fixation of Siding Charge, instructions already exist vide Board's letterNo.2007fTC-I/302/1Pt.E dated 23.06.2010 {CCM/ECoR's Commercial Circular No.103(G)/2010dated 07.07.2010} regarding system of charging of freight with respect to the traffic pertaining to asiding and the same may be followed.

2. If Mis Utkal Alumina International Ud does not place any indents, these wagons will remainidle in their premises. If E.Co.Railwayllndian Railways has to stable these rakes in railwaysowned yards at the request of Mis Utkal Alumina International Ltd or otherwise, stablingcharges will be payable to Railway' as per the rates fixed by Railway Board from time totime. Normally, no demurrage charge will be levied when the detention to the wagons takesplace in the Investor's own premises. If the wagons are ~tabled in the Railway's premiseson account of default attributable to the Investor, stabling charges as prescribed by theRailways from time to time shall be paid by the Investor to the Railways.

3. 15% (fifteen percentage) freight CQncessionwill be granted for a period of 20(twentv) yearsfor each loading of the subject rake,Sof SPW procured under LWIS operating betweenexisting or new private terminal capable of handling the. traffic in such Special PurposeWagons in an approved closedtircuits. ,The concession will be given in the RR itself. Theabove mentioned freight concession will be .granted in each case on the Base Freight rateprevailing at the time of issue of this commercial notification for the said wagons •i.e, dt.13.02.2014, which is Rs.676.,OOPer ton Ex MUATto MAAL or Base freight rateapplicable at the dme of booking, during ,the currency of the concession period of 20years, whiche~er is lower.

4. The freight concession will be granted only on the wagons specified at Annexure-I.the date of commencement of the concession will be from the date of this notificaiotnI.e.13.02.2014 and the period of cone.,.lon shall remain valid for 20 yea!,! i.e. upto 12.02.2034.

5. No freight will be charged for movement <6f.emptyrilke to the next destinationprovided the distance traveled by empty rake is les$ or equal to the distance traveledby the tril1n before unloading. However. if the distance traveled by empty rake is morethan the loadeq distance then for additional distance trav.l8ctby jm~rake over andabove the loaded distance, empty freight rate shall be charged, at ~% of loadedfreight of pU~lic tariff on' cafl)'ing capacity of the wagons. 6. Maintenance of wagons will be undertaken by Indian Railway on payment 8$, per theAnnexure-1 of agreement. The cost of maintenance of these wagons Will be borne bythe customer till the period of rebate in freight is given i.e, for 20 yea •.• from the dateof commencement of service.

The sectionaleMI may guide supervisors / staff concemed at the loading/unloading points regardingcorrect charging of the said BTAPrake as per the provision of this circular and LWISagreement. 2. Para 2(d) of aforesaid circular may henceforth be read as under:

"In case the investor wants to shift to a new loading station not fallingin th& category as in para ( c ) above, they may be permitted to shift,provided they are willing to forego priority supply in terms of assuredsupply and bonus rakes clauses."
