At the outset I wish to advise that RWAs if f o r m e d a f t e r t h e commencement of U.P. Apartment Act 2010 with the nomenclature. “ R e s i d e n t We l f a r e Associations” will be d e e m e d t o b e Apar tmen t Owners Association (AOAs) M. M. MathurUnder the Act and the Model Bye laws framed there. RWAs/AOAs are well advised to ensure c o m p l i a n c e o f t h e fo l l ow ing s ta tu to ry provisions under the Model Bye-laws (Which all RWAs/AOAs are expected to adopt in TOTO)(a)All persons who have purchased apartments in a Housing Society and executed a deed of a p a r t m e n t s h a l l automatically for the M e m b e r s o f t h e Association and will pay rupees an entrance fee o f o n e t h o u s a n d ( C l a u s e 4 ) . A Membership certificate also needs to be issued to all the Members.(b)Every apartment owner must hold at least o n e s h a r e o f t h e Association (Clause 5) The face value of a share however has not been mentioned in the Bye-Laws Generally the face value of a share is either RS 10 or Rs 100. A f t e r a l l o t m e n t o f shares share certificate need to be issued to all the shareholders.( c ) T h e B o a r d o f M a n a g e m e n t s h a l l among other duties ensure that Cash Book is written up promptly and is signed daily by one of the Members of the Board (Clause 25 (F))( d )The Boa rd may require that all officers and employees of the Association handling or r e s p o n s i b l e f o r Association funds shall
furnish adequate fidelity bonds. The premium on such bonds shall be paid by the Associations (Clause 34)(e)The Secretary may retain in his personal custody an amount not exceeding Rs 20,000 for petty expenses. This works out to be around Rs 18 per flat pe r mon th f o r t he society which is nothing if we compare this to the electronic composing machines which cost anywhere between 2-15 lacs with a very high o p e r a t i n g c o s t o f around Rs 120 per flat p e r m o n t h . T h e residents of the society also wholeheartedly supported this initiative a n d 1 0 0 % w a s t e segregation started to happen only within 3-4 days of operation. This s o c i e t y g e n e r a t e s about 60KG of kitchen
waste every day which is getting converted into manure.

What cons�tutes covered areas must be defined. Who has verified and cer�fied the super area declared by Builder, of the flats, for purpose of calcula�on of Stamp Duty. It should be cer�fied by Noida Authority with submi�on of comple�on drawings. It cannot be different for builder, for purpose of sale, who wants more money for less areas and different for Stamps department of District Magistrate who want to stamp duty on actual covered areas declared by builder and approved by Noida Authority.Covered Area has to be the FAR unit area as declared in the final comple�on drawings, or plinth area (an area within four walls of the flat) i.e. the carpet area plus the external walls, as declared in the fi n a l c o m p l e � o n d r a w i n g s submi�ed by the builder and has calculated the built-up permissible FAR areas.Thus as per the above men�oned circular under reference, point no. 3, on page 67, only 15% have to be added for all the five services(fire b a c k- u p , co m m u n i t yc e nt re , swimming pool, Gym, Li�) over the FAR unit area of 99.33 ( being the actual FAR covered area built).Thus
the chargeable super area for propose of stamp duty shall be 99 .33+15%=114.23 and not 144.92Circle rate is 40000 less 2%

Stamp duty will be on each of the above d i ff e r e n t v a l u a � o n w i l l b e Rs.2,14,752 instead of Rs.3,13,352 and thus a difference of stamp duty of Rs.98574 excess is forcibly charged from such flat owners.Hence we request that (1) only authority cer�fied FAR flat Unit Covered Areas as declared in fi n a l C o m p l e � o n D r a w i n g s submi�ed to Noida Authority be considered as the legal authen�c Covered Area for purpose of valua�ons of a Flat and (2) Addi�onal common services @2% each should NOT be added only again to SUPER AREA when it is already included. PLEASE DO NOT ADD covered areas twice again onto super areas.

The 5 towers of Mahagun Maestro is
located in sector 50, Noida, is an
apartment complex that houses
about 188 plus families. Mahagun
maestro was built by Mahagun Realtors
Pvt Ltd 10 years before and currently
occupancy is 99%. In 2009 when we took
the handover from the builders we faced
major challenges like builder did not
transferred sinking fund to RWA, he
refunded back to apartment owners.
AOA had to collect the fund again.
Generator capacity was much less
than sold, had to follow up with
builder to increase it. Seepages in
swimming pool and suspension joints. AOA h a d
to chase builder a lot. The maintenance agency w a s
affiliated to builder hence, AOA had to find a new maintenance agency. To
make our society clean and hygiene, Ini�ally we worked with NGO, was
collec�ng the waste and recycle it. Currently in discussion with many garbage
segrega�on agencies who have facility to decompose bio degradable waste.
AOA and individual residents ac�vely complained Noida Authority to stop
garbage dump in open area in front of society. Mahugun Maestro has

maintenance. We are very concern about the security, Society has guards for
each tower and main gate. Also have gunman during night. There is intercom
facility and no one is allowed entry before permission from the resident. More
than 20 CCTV cameras at key places. To prevent the fire we have fire pipe line
around the society and each floor in society. Sprinklers in the basement.
Adequate amount of fire ex�nguishers. Residents in Mahagun Maestro
celebrate all na�onal and cultural fes�vi�es with enthusiasm. We have annual
Diwali mela with many residents put up games, food and other stalls. Holi
dahan and milan with DJ and rain dance and lunch post holi. Aug 15 and Jan 26
flag hos�ng and sports events. Events during other major fes�vals. Other sports
events like Swimming compe��on and badminton compe��on. So many
achievements we got a�er take handover from the builder, able to maintain
society using less money. Also builder was charging much more on account of
the electricity (Had sold more amount of KVA to residents however taken much
less load from the electricity board) Apart from that he collected Rs. 550/- per
flat for common area electricity. We have been able to reduce the common area
electricity charge to only Rs 150/- also we are able to maintain (AMC and other
material cost) of generator and panels without any extra contribu�on from the
residents. Completed building paint, covered lobby area with glass, ARD in li�s
is under process. To make society eco friendly we are Changing all the bulbs to
LED gradually.Also planning to deploy garbage segrega�on. The goal for 2019 is
adding more CCTV coverage, deploy garbage segrega�on.
