Dear FREEDOM OF INFORMATION REQUEST: NOTICE OF DECISION I refer to your application made under section 30 of the Freedom of Information Act 2016 (the Act), received by Major Projects Canberra (MPC) on 8 October 2019, in which you sought access to:
• “All the inspection reports on all utility services handed over to the Government for the Light Rail Stage 1 project, from the beginning of construction to date. Additionally, any correspondence between the inspectors and TCCS, including any minutes of meetings or documents regarding these inspection reports.”
On 21 October 2019 you refined the scope to: • “All certification of Light Rail Stage 1 undertaken by the ACT Utilities Regulator.”
On 4 November 2019, the MPC FOI team wrote to inform you of the need for third party consultation. In accordance with section 38(5)(b) of the Act, the due date was extended by 15 working days to allow the relevant third parties to provide their views on disclosure of the documents. On 21 November 2019, the MPC FOI team wrote to you seeking an extension of the access date to 3 December 2019. The extension was granted by your office on 22 November 2019. Timeframes In accordance with sections 40 and 41 of the Act, MPC was required to provide a decision on your access application by 3 December 2019. On 3 December 2019, you received a Notice of Decision letter informing you that I had decided to defer access to all identified documents as an affected third party, Canberra Metro Pty Ltd, had objected to disclosure. The third party had 20 working days to apply to the ACT Ombudsman for a review of my decision. On 8 January 2020, Canberra Metro Pty Ltd sought Ombudsman review of my decision under section 73 of the Act. On 7 May 2020, the ACT Ombudsman informed the MPC FOI team that the delegate has confirmed my decision under section 82(2)(a) of the Act. Authority I am an Information Officer appointed by the Chief Projects Officer under section 18 of the Act to deal with access applications made under Part 5 of the Act.

Third Party Consultation In making this decision, I completed consultation in accordance with section 38 of the Act. The views of Canberra Metro Pty Ltd, SEEG Holdings Pty Ltd, APP Corporation Pty Ltd and ACT Earthing Pty Ltd were considered when making this decision. Decision on access Searches were completed for relevant documents and 500 documents were identified that fall within the scope of your revised request. For clarity of scheduling, the identified documents were scheduled together in 23 parts. I have decided to grant partial access to 18 documents and withhold from release five (5) documents. The information that has been withheld from release or redacted in the documents I consider to be information that is contrary to the public interest in accordance with section 16 of the Act, or would, on balance, be contrary to the public interest to disclose under the test set out in section 17 of the Act. I have included at Attachment A to this decision the schedule of relevant documents. This provides a description of each scheduled part that falls within the scope of your request and the access decision for each of those parts. Materials considered In reaching my access decision, I have taken the following into account:
• The Act; • The content of the documents that fall within the scope of your request; • Contentions made by Canberra Metro Pty Ltd; and • The Human Rights Act 2004.
Third Party Contentions As noted above, pursuant to section 38 of the Act, third party consultation was undertaken with Canberra Metro Pty Ltd, SEEG Holdings Pty Ltd, APP Corporation Pty Ltd and ACT Earthing Pty Ltd. MPC considered the release of information may reasonably be expected to be of concern to these organisations. Canberra Metro Pty Ltd raised several objections to the release of this information under Schedule 2 of the Act. I consider the objections raised by Canberra Metro Pty Ltd are ‘relevant considerations’ for the purpose of this decision. Factors favouring nondisclosure under Schedule 2 s2.2
As required in the public interest test set out in section 17 of the Act, I have identified the following public interest factors in favour of non-disclosure that I believe are relevant to determine if release of the information contained within these documents is within the 'public interest':
• Information disclosure could be reasonably expected to prejudice the flow of information to a regulatory agency.
• Information disclosure could be reasonably expected to prejudice trade secrets, business affairs or research of Canberra Metro Pty Ltd.
• Information disclosure could reasonably be expected to prejudice security, law enforcement or public safety.
• Information disclosure could be reasonably expected to prejudice the protection

of an individual's right to privacy or any other right under the Human Rights Act 2004.
Flow of Information to a Regulator The flow of information to the regulatory agency and the agency’s ability to obtain confidential information are essential for the operation of government. I am cognisant that release of information under the Act may impact the future flow of information as individuals may be concerned that information they provide will be released more widely than they had initially intended it to be. I am not satisfied release of information contained in these documents could be reasonably expected to prejudice the flow of information to the police or other law enforcement or regulatory agency, or the agency’s ability to obtain confidential information. Prejudice to Trade Secrets, Business Affairs or Research In the case of Re Magnan and The Treasury [2005] AATA 898 the term ‘business affairs’ was interpreted as meaning the totality of the money-making affairs of an organisation or undertaking as distinct from its private or internal affairs’. Schedule 2, section 2.2 allows for government information to be withheld from release if the disclosure of the information could be reasonably expected to prejudice the trade secrets, business affairs or research of an agency or person. Having reviewed the documents, I am satisfied that some of the methods, approaches and calculations contained within Electrical Inspection Reports are sensitive business information. This information was compiled as part of Canberra Metro’s design and commissioning of the light rail system. Accordingly, I consider release of the information would prejudice the business affairs of Canberra Metro. Prejudice to Security, Law Enforcement or Public Safety I note that schedule 2.2, section 2.2(a)(iii) should be considered as part of the public interest test under section 17 of the Act. In considering this factor, I note my reasoning for not accepting release of these documents would impact the security, or public safety of the Canberra Light system under schedule 2. Accordingly, I consider this factor carries, no weight in determining the public interest, as I am not satisfied that release of the information contained in the documents, could reasonably be expected to prejudice the security, or public safety of the project. Right to Personal Privacy Finally, I consider that the protection of an individual's right to privacy, especially in the course of dealings with the ACT Government is a significant factor as the parties involved have provided their personal information for the purposes of working with the ACT Government, in my opinion, outweighs the benefit which may be derived from releasing the personal information of the individual's involved in this matter.
These individuals are entitled to expect the personal information they have supplied as part of this process will be dealt with in a manner that protects their privacy. Considering the type of information to be withheld from release, I am satisfied that the factors in favour of release can still be met while protecting the personal information of the individuals involved. I therefore weight the factor for non-disclosure more highly than the factor in favour of release in this instance. As a result, I have decided that release of this information (email addresses, mobile numbers and names of individuals not employed by the ACT Public Service) could prejudice their right to privacy under the Human Rights Act 2004.

In reviewing the documents, I consider that overall the weight of factors in favour of disclosure outweigh the factors in favour of non-disclosure. However, I consider that there are some documents where this does not apply. Noting the pro-disclosure intent of the Act, I am satisfied that redacting only the information that I believe is not in the public interest to release accordance with section 50(2) of the Act will ensure the intent of the Act is met and will provide you with access to the majority of the information held by MPC within the scope of your request. Details of the documents to be released and the relevant sections which information has been withheld from release are at Attachment A.
