Item G-1 ELECTION OF MAYOR AND DEPUTY MAYOR

Officer Recommendation: The office of Mayor and Deputy Mayor be determined by ordinary ballot should more than one nomination be received for the position(s). Purpose of Report The election of Mayor and Deputy Mayor is to take place at this meeting. Report The Local Government Act 1993 and the Local Government (General) Regulation 2005 determine the procedures relating to the election of Mayor and Deputy Mayor. The relevant procedures are as follows:

The election of the Mayor by Councillors is to be held during the month of September and is to be conducted in accordance with Schedule 7 of the Local Government (General) Regulation 2005.

A Mayor elected by Councillors holds office for one year.

The Councillors may elect a Deputy Mayor

The Deputy Mayor may hold office for one year or some shorter period determined by Council.

The General Manager or a person appointed by the General Manager is the returning officer.

The nomination is to be made in writing by two or more Councillors, one of whom may be the candidate.

The nomination is not valid unless the nominee has consented to the nomination in writing.

If more than one nomination is received, the Council is to resolve whether the election is to proceed by preferential ballot, by ordinary ballot or by open voting. Open voting means voting by a show of hands.

The determination of the type of voting and the election are to be held at the same council meeting.

The formality of a ballot paper is to be determined in the same manner as applies to an election for Councillors.

Nomination forms have been included with the business paper. They need to be signed by two Councillors and endorsed by the Councillor being nominated and returned to me prior to the ballot. I have elected to appoint Mrs Nadine Matarazzo as the Returning Officer for the election of mayor and Deputy Mayor. Mrs Nadine Matarazzo will be assisted by the Captains of Balranald Central School.

Purpose of Report At the August Council meeting, Council resolved to invite Sergeant Narelle Tucker of the Balranald Police Force to the September Council meeting to elaborate on their concerns regarding the closing times of Council venues. Report The Balranald Police have written to Council requesting that Council consider the implementation of a midnight closing time on Council venues that are hired for private functions. Council had additional questions that were not addressed in the letter and wanted further clarification before resolving any action on the matter.

1. That Council approve the revote of expenditure of $252,536 from the 2013/14 financial year to the 2014/15 financial year.

2. That Council approve the reinstatement of the Caravan Park reserve of $46,300.

Purpose of Report Revotes of Expenditure for year ending 30th June 2014. Report Attached to this report is the list of restricted funds as at 30/6/14 including carry forward Works in Progress. There is also an amount included to reinstate the Caravan Park reserve as per Council resolution 08.13.3639, in August 2013.

Officer Recommendation: That Councillors note the disclosure of interest return requirements and accept the disclosure of interest register as tabled.

Purpose of Report In accordance with Section 449 (3) of the Local Government Act 1993, to advise of the required disclosure of interest returns. Report Pecuniary interest returns for the period 1 July 2013 to 30 June 2014 are due for submission to Council by 30th September 2014 for Councillors and relevant staff who held office at 30 June 2014. All returns have been completed. The disclosure of interest register is tabled for Council’s information. Under Section 449(3) of the Local Government Act 1993 a Councillor or designated person holding that position at 30 June in any year must complete and lodge with the General Manager within 3 months after that date a return in the form prescribed by the regulations.

1. That the policy be advertised for 28 days to allow any public submissions.

2. That the policy be considered for adoption at the October meeting.

Purpose of Report To advise Council of the requirement to adopt the policy on payment of expenses and provision of facilities for Mayor & Councillors Policy on an annual basis Report Councils are required on an annual basis to review and submit their policy to the Director-General of the Department of Local Government within 28 days of adoption by Council, even if they propose to adopt an unchanged policy. The current policy is attached for Council consideration

POLICY TITLE: PAYMENT OF EXPENSES AND PROVISION OF FACILITIES FOR MAYOR AND COUNCILLORS PART 1 INTRODUCTION COMMENCEMENT OF THE POLICY This policy will take effect from 14 October 2014 PURPOSE OF THE POLICY The purpose of the policy is to ensure that there is accountability and transparency in the reimbursement of expenses incurred or to be incurred by Councillors. The policy also ensures that the facilities provided to assist Councillors to carry out their civic duties are reasonable. OBJECTIVES AND COVERAGE OF THE POLICY To define, in conformity with the requirements of Section 253 of the Local Government Act 1993, the Council’s policy on the payment of expenses and provision of facilities for Mayor and Councillors in discharging the functions of civic office and when attending on Council business. MAKING, ADOPTION AND REVIEW OF THE POLICY The policy was considered by Council at its Meeting held in October 13, when it was endorsed for public exhibition. The policy which was advertised and placed on exhibition for 28 days was developed taking into account legislative and other government policy provisions and guidelines. Council is required each year prior to 30 November to review and submit its policy to the Director-General of the Department of Local Government within 28 days of adoption by Council, even if the policy is unchanged. REPORTING REQUIREMENTS In accordance with Section 428 of the Local Government Act 1993 and Clause 217 of the Local Government (General) Regulation 2005, Council is required to include in its Annual Report the following information regarding the payment of expenses and provision of facilities to the Mayor and Councillors: Expenses

the cost of phone calls including mobiles, home located landlines, facsimile and internet services

spouse/ partner/ accompanying person expenses

conference and seminar expenses

training and skill development expenses

interstate travel expenses

overseas travel expenses

care and other related expenses

Provision of facilities

The cost of the provision, including rental, of dedicated office equipment allocated to councillors on a personal basis such as laptop computers, mobile phones, telephones and facsimile machines and internet installed in the councillors’ homes. This item does not include the costs of using this equipment, such as calls. LEGISLATIVE AND OTHER GOVERNMENT POLICY PROVISIONS The policy was developed and will operate in accordance with Sections 252, 253, 254 & 428 of the Local Government Act 1993, Clause 217 of the Local Government (General) Regulation 2005, Model Code of Conduct, relevant Department of Local Government Circulars, Guidelines and ICAC publications. PART 2 PAYMENT OF EXPENSES TRAVEL EXPENSES Within Council’s Area Where Councillors are required to use their own vehicle for travel to and from home on authorised Council business, reimbursement will be in accordance with the kilometre rate as prescribed in the Local Government (State) Award and will be paid monthly in arrears. Outside Council’s Area The Mayor and General Manager be authorised to determine the appropriate mode of travel having regard to economy, time and safety factors. Travel by air within Australia to be economy class, unless otherwise specified by Council. When travelling by vehicle, a suitable Council vehicle will be provided. If a Council vehicle is not available or it is not feasible to use a Council vehicle, Councillors will be paid the prescribed kilometre rate for using their own vehicle. Should a Councillor decide to use their own vehicle, when a Council provided vehicle is available, they will be reimbursed on the basis of fuel and lubricant costs only. When travelling in private or Council vehicles on Council business, the driver is personally responsible for all traffic or parking fines. OTHER EXPENSES Expenses such as conference registration fees, accommodation costs, reasonable meal and out-of-pocket costs incurred in attendance on authorised Council business, shall be paid by Council or reimbursed to Councillors on production of receipts. Council will also meet the reasonable meal costs of spouses or partners when accompanying Councillors at conferences and seminars, not exceeding the one day journey limits. Any registration fees, reception costs, official dinner costs, additional travel, additional accommodation and conference tour costs associated with a spouse or partner’s attendance at conferences, seminars, etc. will be the personal responsibility of individual councillors. TELEPHONE COSTS AND EXPENSES Council will reimburse costs of telephone, fax and mobile phone calls on Council business to a maximum of $600 per annum. Councillors will need to maintain a record of calls for claim purposes. LIABILITY INSURANCE Council shall take out Public Liability and Professional Indemnity insurance cover which shall extend to actions taken against Councillors in relation to the exercise of their duties as Councillors. PERSONAL ACCIDENT INSURANCE Council shall take out Personal Accident insurance for Councillors whilst engaged in activities connected with the Council business including travelling directly to and from such business.

LEGAL EXPENSES AND OBLIGATIONS Council will determine by resolution the reimbursement of reasonable legal expenses of: a) A Councillor defending an action arising from the performance, in good faith, of a function under the Local Government Act; or b) A Councillor defending an action in defamation provided the statements complained of were made in good faith while exercising a function under the Act; or c) A Councillor for proceedings before the Local Government Pecuniary Interest Tribunal, or an investigation body, provided the subject of the proceedings arises from the performance in good faith of a function under the Act, and the Tribunal or investigation body makes a finding favourable to the Councillor. Legal expenses incurred in relation to proceedings arising out of the performance by a Councillor of his or her function under the Act are distinguished from expenses incurred in relation to proceedings arising merely from something that a Councillor has done during his or her term of office. REIMBURSEMENT AND RECONCILIATION OF EXPENSES Reimbursement of costs and expenses to Councillors will only be made upon the production of appropriate receipts and tax invoices, and the completion of the required claim forms. Expenses and costs incurred must be in accordance with the requirements of this policy. Claims for costs and expenses must be submitted within three (3) months of incurring the cost or expense. DISPUTE RESOLUTION In the event of any disputes that arise about the provision of expenses and facilities, the matter shall be resolved by Corporate Service Committee recommendation to Council.

PART 3 PROVISION OF FACILITIES The following facilities will be provided to allow the Mayor and Councillors to discharge the functions of civic office Councillors Council will provide Councillors with the following facilities:- a) Secretarial and basic photocopy facilities in upon request. b) Where appropriate, prior to, during or following Council and Committee meetings, a light meal, supper and refreshments. c) Where Council resolves to approve the electronic form of delivery of Council agendas and business papers, Council will provide for the issue of a laptop/notebook computer with email capacity and other support equipment such as printers.

d) Council will pay for the cost of providing and connecting equipment and the operating costs and costs associated with any of the disposable items related to the use of any of the equipment. Council provided equipment will remain the property of the Council and is to be used for Council purposes only and is to be returned to Council offices at the time the Councillor ceases to hold office. Mayor In addition to facilities provided for Councillors, Council will provide the Mayor with the following additional facilities:- a) An Executive standard motor vehicle for official and private use. Where the vehicle is used privately the fuel cost will be the personal responsibility of the Mayor. Receipts for such fuel will be submitted with the monthly reimbursement claim. b) An office in the Council’s administration building. c) Secretarial support as required. d) A mobile phone including up to $200 per month call and rental charges. Any Charges in excess of this amount to be reimbursed to the council. No General Expenses Council will not meet any general expenses.

RETURN OF FACILITIES AND EQUIPMENT Any facilities and equipment provided to the Mayor and Councillors will be returned to Council immediately following the completion of their term of office, extended leave of absence or at the cessation of their civic duties.

Council Team 1 has completed a maintenance grade of Boree Plains Road. It is currently maintenance grading the Mildura Ivanhoe Rd at the western boundary.

2. Council Team 2 Team 2 recently completed patrol grading of Turlee Leaghur Rd. The team has now commenced patrol grading of Magenta Wampo Rd.

3. Council Team 3 Council Team 3 has completed a gravel reconstruction section on the Mildura Ivanhoe Road under the Roads to Recovery Program, in the Clare Bank/Hartshorn area. This team is currently patrol grading MR 514 gravel section towards Oxley. Following this the team is scheduled to maintenance grade Weimby Kyalite Rd.

4. Market Street Reconstruction The final section of footpath repaving at the Foodworks corner is currently underway. Minor completion works in the Main Street will follow including some replacement of grass and watering system, bin enclosure, and seating.

Miscellaneous

Tree replacement to the Bank St median between Court and Market Streets, and Moa St. between Church and Dowling St. is underway. Anzac Park foundation works to accommodate the memorial walls, including the relocation of the canon and flag pole has been completed.

Roadside slashing to MR 67 and Windomal Rd has been completed. This will be followed with a spray program from the edge bitumen to the invert of the tabledrain. Grading of a break on MR67, behind the tabledrain will follow under the RFS firebreak funded program.

Roadside slashing of the Yanga Way between Balranald and Kyalite was recently completed as part of the RMS maintenance contract.

A section of kerb and gutter is currently being replaced on the corner of Market and Bank Streets to improve drainage in this location. This work was programmed to be completed prior to the RMS main street upgrade works between River and McCabe St.

All camping be restricted to self-contained recreational vehicles only and a maximum of twenty (20) be permitted on site at any one time. 3. Euston Bowling & Recreational Club advertise the facility as self-contained camping only with no amenities for caravan park camping in place.

Purpose of Report To present the above Development Application for Council’s consideration. Report Euston Bowling & Recreation Club have lodged an application to provide a parking area for self-contained recreational vehicles together with a sewer dump point, pumping station, rising main, and access off Selwyn Street on lots 1, 2 and 3 DP 758048 facing the unmade Broughton St, Euston. In 2012, the Club gained Councils consent to fill this site to a level at the top of the flood levee to accommodate parking space for some of the expected influx of RV’s with the pending CMCA rally. Specifically that application, DA 12/2012, was approved with the following conditions:

1. All site filling is to be undertaken to the satisfaction of Council or it’s delegate. Any disturbance to the Euston flood levee should be reinstated at the developers full cost and to the satisfaction of the respective agencies and/or Council.

2. Head works charge of $1,409.80 representing an equivalent of three residential lots for water and sewer be remitted prior to the completion of works and establishing any business activity on the site.

3. The installation of any effluent pump station and rising mains are at the developers full cost and must connect to the town sewer network as directed by Council.

4. The concurrence of Essential Energy is to be provided for the development.

5. Entrance driveway, drainage structures off Selwyn Street and any hard standing areas on sire are to be flush sealed and suitably line marked to satisfaction of Council or it’s delegate and at the developers full cost.

The intent of this application, whilst overlapping in many ways, seeks to gain approval for ‘leave no trace’ or self-contained RV’s to continue to utilise this site. The application was advertised for public comment under the provisions of section 88 of the Environmental Planning and Assessment Regulation 2000, and two (2) submissions were received, one supported by a letter from the author’s solicitor (see three letters attached). The submission from the Euston Caravan Park was also accompanied by a petition of approximately 150 signatures, this will also be tabled at the meeting. The question raised through the above submissions (and many of the petition signatures) relates to competition within the community. Council, as the consent authority, must consider an application on its merit, and compliance with standards, safety, and relevant legislation. In this instance if Council were to grant consent it would be accommodated under Section 79 of the EP&A Act 1979 and Section 68 of the Local Government Act for an accommodation park area. Any approval could be conditioned to restrict persons to being self-contained due to the absence of amenities such as showers and toilets as per caravan and camping grounds legislation. If a determination were to recommend refusal on the grounds of unfair competition alone, Council may well be exposed to an upheld appeal from the applicants. Nevertheless, Council will remain the determining authority. Council is also aware that any approval is valid for 60 months and the Club reserves the right to commence, or otherwise stage the development in conjunction with the cabin facilities on an adjacent site in that time, if approved.

Officer Recommendation: Council approve a maximum height of 1.6m frontage fence to No 15 Murray Terrace, Euston. Purpose of Report To consider an application to erect a 1.6m screen type front fence at 15 Murray Terrace, Euston. Report Abeo Architects on behalf of Euston Bowling and Recreation Club have lodged an application for approval to build a 1.6m high composite brick and timber panel screen fence at Lot 1, DP1046562, 15 Murray Terrace, a club residence. The attached drawing and artist impression depicts a brick panel to part of the front fence varied with mod wood horizontal timber screens and powder coated gates. Due to the location of the residence in the commercial precinct of Murray Terrace the applicant seeks to provide the property with greater security. Council has, as a precedent, previously approved similar screen fencing to a number of properties in Euston and Balranald. Adjacent landowners have been notified of the proposal under the provisions of Section 88 of the Environmental Planning and Assessment Regulation 2000. No submissions were received. The owner of the property has given careful consideration to the design of this fence to maintain an attractive fence appearance which retains the style and character of the street.

Officer Recommendation:

1. That Council approves the closure of its office and operations between Christmas Day 25 December 2014 to Friday 2 January 2015 and re-opening on Monday 5 January 2015.

2. The General Manager to advertise Council’s closure over the Christmas and New Year period.

Purpose of Report To advise Council of arrangements over the Christmas and New Year period. Report Council’s office and depot has traditionally closed down between the Christmas and New Year period, which normally results in closure for three working days. This year with New Year’s Day falling on a Thursday it is considered appropriate that Council officers and operations are closed on Friday 2 January 2015. The office staff is normally provided leave for three days over the period in lieu of additional hours worked and not renumerated for during the year. Annual Leave or an RDO will be taken for the additional day over the Christmas and New Year period. The office and depot closure will be from Thursday 25 December 2014 to Friday 2 January 2015 inclusive. The majority of works staff are usually on block annual leave for four weeks over this period and January, however, arrangements will be in place for normal essential services and emergency call outs over this period.

Purpose of Report To advise Council of a summary of meetings held. Report The General Manager and Director of Infrastructure and Development met with representatives from Iluka on Wednesday 20 August to discuss the accommodation facility. Iluka have been invited to present at Council’s Strategic workshop held on 10 September 2014. The General Manager and Director of Corporate and Community Development met with Stobon Lloyd, Careers Advisor at the Central School on Thursday 28 August. School based employment opportunities were discussed and an inspection of School’s facilities was undertaken. The General Manager attended an Office of Water facilitated meeting in Hay on 9 September 2014. Representatives from the Office of Water, Wakool Shire and Hay Shire were present to discuss funding opportunities under the Murray Darling Basin Economic Diversification Program. The Executive Team and Councillors attended a one day strategic workshop on Wednesday 10 September addressing key issues including Iluka Mine accommodation facility, maximising grant opportunities from the State and Federal Government, preplanning major projects and reviewing the Community Strategic Plan. The workshop was the first to take place under the new management team and provided Councillors and management the opportunity to work closely together to establish shared goals and objectives.
