4.3 CustomerDataWemayuseCustomerDatatoprovidetheService,includingupdating,enhancing,securingandmaintainingtheSubscriptionServiceandprovidingSupportandExpertServices.NotwithstandinganythingelsetothecontraryinthisPolicy,wewillnotuse,disclose,review,share,distribute,transferorreferenceanyCustomerDataexceptaspermittedintheCustomerAgreementorasrequiredbylaw.

4.4 CommunicationPreferencesandChoicesandAccessingandCorrectingYourPersonalData

SinceeachCustomerisincontrolofwhatinformation,includinganypersonalinformation,itcollectsfromitsUsers,howthatinformationisusedanddisclosed,andhowthatinformationcanbechanged,UsersoftheSubscriptionServicemustcontacttheapplicableCustomeradministratorwithanyinquiriesabouthowtheCustomerusesanddisclosespersonalinformationandhowtoaccessorcorrectpersonalinformationcontainedinCustomerData.

ToaccessorcorrectanypersonalinformationCustomerhasprovidedaspartoftheGeneralInformation,theCustomershouldcontacttheiraccountrepresentative.

4.5 MobileApplicationsWithoutlimitingthegeneralityofthisPolicy,inadditiontotheinformationcollectedthroughtheWebsiteandtheService,ServiceNowmayobtainadditionalinformationthroughMobileApplicationsthatCustomerortheirUsersdownloadtotheirmobiledevices(“Devices”).MobileApplicationsprovidedbyServiceNowmayobtainorcollectinformationfromUsers’DevicesinconnectionwiththeServiceandaredesignedtointeroperatewiththeSubscriptionService;forinstance,toprovideaUserwithaccesstoinformationwithintheSubscriptionServiceortoprovideinformationfromaUser’sDevicetotheSubscriptionService.

MobileApplicationsmayaccessthegeographiclocationofaUser’sDevice.MobileApplicationsmayalsoprovideServiceNowwithinformationrelatedtoUsers’useoftheMobileApplications,includinginformationregardingUsers’DevicesandOSidentification,logincredentials,languageandtimezone.MobileApplicationsmayalsocollectinformationregardingUsers’interactionwithMobileApplications,whichServiceNowmayusetoprovideandimprovetheMobileApplicationservices.

InformationaccessedorobtainedbytheMobileApplicationonaUser’sDevicemaybeaccessibletotheCustomeranditsorganization,dependingontheintendedfunctionalityoftheMobileApplication.

CustomeranditsUsersmayconfigureMobileApplicationsaffectingtheinformationcollectedoraccessedonaUser’sDevice.

4.6 TransferofPersonalData

ServiceNow,Inc.complieswiththeEU-U.S.PrivacyShieldFrameworkassetforthbytheU.S.DepartmentofCommerceregardingthecollection,use,andretentionofpersonalinformationtransferredfromtheEuropeanEconomicAreatotheUnitedStatesinconnectionwiththeService.PleasereviewourPrivacyShieldPolicyformoreinformation.TolearnmoreaboutthePrivacyShieldFrameworkandthescopeofServiceNow’sparticipation,pleasevisittheDepartmentofCommerce’swebsite,locatedat:https://www.privacyshield.gov/welcome.

FortransfersofpersonaldatafromSwitzerlandtolocationsoutsidetheEuropeanEconomicArea,ServiceNowcomplieswithapplicablelegalrequirementsprovidingadequatesafeguardsforthosetransfers.

5 HumanResources

YoumayprovideHRDatatousorwemaycollectitfromthirdpartiesinconnectionwithyouremploymentapplication,aspartoftheinterviewprocessandwhencompletingtheon-boardingprocessandduringthecourseofyouremploymentwithServiceNow.

5.2 HowWeUseInformationCollectedServiceNowobtains,uses,disclosesandotherwiseprocessesHRDataregardingServiceNow’sEmployeesandJobApplicantsforrecruitmentandHRmanagementatagloballevel,including(i)carryingoutandsupportingServiceNow’shumanresourcesfunctionsandactivities;(ii)carryingoutServiceNow’sobligationsunderemploymentcontractsandemploymentandbenefitslaws;(iii)managingworkplacesafetyandhealth;(iv)administeringemployeeparticipationinbenefits,compensation,humanresourcesandtrainingplansandprograms;(v)managingemployeeperformance;(vi)implementingcomplianceanddisciplineprocedures,andinvestigatingand

reportingonEmployeecomplianceanddiscipline;(vii)complyingwithServiceNow’slegalobligationsandinternalpolicies;(viii)managinginternalcomplaintsorclaimsandlitigation;(ix)implementingandoperatingawhistleblowerhotline;(x)managingandconductingServiceNow’sbusinessactivities,includingallocatingcompanyassetsandhumanresources,projectmanagement,recordsmanagementandcompilationofaudittrailsorotherreportingtools,managingmergers,acquisitions,sales,re-organizationsordisposalsandintegrationwithpurchaser;(xi)operatingITandcommunicationsystemsandmonitoringEmployeeemailandInternetusagetotheextentpermittedbyapplicablelaw;and(xii)managingtheonlinecareerportalandconductingbackgroundandotherpre-employmentcheckstotheextentpermittedbyapplicablelaw.

YouunderstandthatServiceNowreservestheright,wherepermittedbylaw,tomonitorandscreenEmployeeemailandInternetusagetoenforcecompliancewithallapplicableServiceNowpolicies.

5.3 HowWeShareInformationCollectedWemaydiscloseHRDatatothefollowingthirdparties:


• Serviceprovidersthatperformservicesonourbehalf,includingfortheusesoutlinedin5.2above.WedirecttheseserviceproviderstouseHRDataonlyinaccordancewithourinstructions.WerequireourserviceproviderstoappropriatelysafeguardtheprivacyandsecurityofHRData.OurserviceprovidersarenotauthorizedbyServiceNowtouseordiscloseHRDataexceptasnecessarytoperformservicesonourbehalfandonlyinaccordancewithourinstructions,ortocomplywithlegalrequirements.

• Intheeventofmerger,acquisition,oranyformofsaleortransferofsomeorallofourassets(includingintheeventofareorganization,dissolutionorliquidation),inwhichcaseHRDataheldbyuswillbeamongtheassetstransferredtothebuyeroracquirer.Shouldasale,mergeroracquisitionoccur,wewillusereasonableeffortstodirectthetransfereetousetheHRDatainamannerconsistentwiththisPolicy.

WemayalsodiscloseyourHRDatatothirdparties:

5.4 YourChoicesEmployeesandJobApplicantshavetheabilitytodirectlyaccessandmodifymuchifnotallHRDatathroughourinternalsystemsandsystemsprovidedbyourthirdpartyserviceproviders.YoumayalsocontactyourHumanResourcesrepresentativeforadditionalaccessaswellformodificationofyourHRData.Subjecttoapplicablelaw,youhavetherighttorequestaccesstoandreceiveinformationaboutyourHRData,updateandcorrectinaccuraciesintheHRData,andhaveHRDatablockedordeleted(asappropriateoraspermittedbyapplicablelaw).TherighttoaccessHRDatamaybelimitedinsomecircumstancesbylocallaw.Uponrequest,ServiceNowshallusecommerciallyreasonableeffortstoremoveanynon-essentialHRDataaboutyouinaccordancewithapplicablelaw,howevertheremovalofessentialHRDatamayaffectyourworkplaceduties,responsibilitiesaswellasbenefits.

6 General

6.1 SecurityStatementServiceNowmaintainsreasonableandappropriatemeasurestoprotectHRDataandtheinformationobtainedthroughtheWebsiteandinconnectionwiththeServiceandMobileApplicationsfromloss,misuseandunauthorizedaccess,disclosure,alterationanddestruction.
