Election of 1800• Federalists vs. Democratic Republicans

- federalists: John Adams/ Charles Pinckney

Democratic Republicans: Thomas Jefferson/Aaron Burr

- they fought a very bitter campaign against each other

- lots of mudslinging and name calling (as demonstrated by the previous slide)

• Didn’t travel around the country like modern politicians. Had mailing campaigns.

Election Outcome• Democratic Republicans won• House of Representatives had to vote to

decide who would be president Jefferson or Burr .

• 16 states voted and whoever had more votes became president and the other became vp.

• 35 times they voted and tied each time• Finally Hamilton persuaded a rep to change

his vote to Jefferson. (J-trustworthy, B- NY Banker wanted power)

• 12th amendment- vote on separate ballots

Jefferson’s Inauguration• How did he present himself? • Main point

- reduce size and power of government • Laissez-faire/ hands off- have the people do as

they please and have the government stay out of the way

Jefferson’s Presidency

• Cut costs- taxes, military spending etc.

• Repealed all interior taxes including the whiskey tax.

• Customs duties- government funding will come from sale of western lands and tariffs (taxes on imports and exports)

Midnight Judges

Judiciary Act of 1801

• Created 16 district courts around U.S.

• Adams had many appointments in an effort to fill positions

- wanted federalists to fill them before Jefferson could appoint DR’s.

• Got most filled before leaving office• Jefferson told his Sec. of State James

Madison not send the rest

Marbury VS. Madison

• 1803- William Marbury(judge) sued James Madison for not delivering his letter.

• Case went to the Supreme Court

- Chief Justice John Marshall voted against Marbury

Judicial Review• Gave the judicial branch the power to

declare laws unconstitutional.1) The Constitution is the supreme Law2) The constitution must be followed

when there is a conflict or disagreement between it and any other law

3) Judicial branch must uphold the Constitution and nullify any unconstitutional laws.

Closing Activity• You are campaigning for the school president

next year when you enter 8th grade.• On a sheet of paper write a campaign mailing

letter (like Jefferson and Adams) that your would send to your classmates.
