(To be printed on Rs 100/- non judicial stamp paper to be purchased in the name of the Distributor) INDEMNITY – CUM - UNDERTAKING

I (Name) _______________, son/wife of ________________________, aged about ______________, being a permanent resident of ____________________________ and doing business as a Sole Proprietor/Partner/Director/Authorised Signatory, in the name and style “____________________”, the principal place of business/registered office being situated at __________________________________ do hereby solemnly confirm and undertake that;

i. I have read and understood the above terms and conditions of the letter dated _________ issued by Idea Cellular Ltd w.r.t. “SIM Replacement Process- Distributors obligations”

ii. I shall provide SIM replacement service as notified by the company and shall carry out the following : a. Shall procure a written request for SIM replacement from the subscribers approaching for

such service in the prescribed format circulated by Idea. b. Shall personally verify the customer requesting for the SIM replacement against his original

photo ID (as per the approved list of POI circulated by DoT) and his other antecedents as per the process prescribed by Idea on a time to time basis.

c. Shall mandatorily verify the name and address of the subscriber along with any one of the other mandatory fields (as specified in the SIM exchange request form prescribed by Idea) with the subscriber requesting for SIM replacement vis-à-vis information provided by IDEA.

d. Shall mandatorily collect a copy of identity proof, produced by the subscriber and duly verified by you with the original.

e. Shall also ensure that the address on the proof of identity (POI) and proof of address (POA) of the requesting subscriber matches with the existing information and make note of the same on the SIM replacement form.

f. In the event the details of the requesting subscriber are the same vis-à-vis the existing information, then I / we shall provide the SIM replacement to the requesting subscriber and note the same on the SIM exchange form for the record purpose and future reference.

g. In the event, the details of the requesting subscriber does not match with the details of the subscriber of the existing information, then I / we shall not process the SIM replacement request. I/We shall also notify that to the requesting subscriber that the SIM replacement request cannot be processed due to the mis-match and store the SIM exchange form for record and future reference.

h. The terms and conditions mentioned above shall be read along with the covenants mentioned in the prepaid distributor agreement.

i. The clauses of the prepaid agreement namely i) termination clause, ii) confidentiality clause, iii) indemnity clause iv) claw back and claiming back shall be equally applicable to the above said services.

I/We shall indemnify Idea Cellular Ltd, for all and /or any costs and consequences without limiting to any penalty, legal proceedings or otherwise being instituted or claimed on Idea Cellular Ltd, in the event of any failure on my part to adhere to the terms and conditions specified above or as notified by the IDEA Cellular Limited from time to time. I also undertake and indemnify Idea Cellular Ltd, against any claim/ proceedings (Statutory or otherwise), instituted against Idea Cellular Ltd by the original Owner/Subscriber in respect of the aforesaid SIM replacement being done by us is found fraudulent or otherwise.
