Financial Crisis Litigation
• Our attorneys are representing the Federal Deposit Insurance Corporation (FDIC) and Freddie Mac in widely publicized cases involving allegations that 16 of the world’s largest commercial banks (such as Bank of America) fraudulently and collusively suppressed the global interest rate benchmark LIBOR.
• We prosecuted a $2.67 billion claim objection and adversary proceeding as special counsel to the official creditors’ committee in Chapter 11 proceedings for General Motors Corporation and then on behalf of the General Unsecured Creditors Trust.
• We serve as lead counsel for the plaintiff in an action against Bank of America seeking repurchase of more than 250 loans due to breaches of representations and warranties concerning the origination and underwriting of loans pooled into a commercial mortgage-backed securities trust. The potential damages in the case exceed $300 million.
• We represented Destiny USA in connection with the construction of a multibillion dollar project that breaks new ground in green technology and retail concepts. The project is financed by both public and private funding from a commercial lender, municipal bonds, state Brownfield tax credits, and federal green bonds. After we obtained a precedent-setting injunction compelling Citigroup to fund the construction loan required to complete the project, the matter settled successfully.

Plaintiff-Side Litigation
• We represented more than 125 large purchasers of bulk vitamins in a variety of industries in litigation against vitamin manufacturers accused of participating in a global price-fixing cartel, securing billions in recoveries.
• Our attorneys represent several clients who were the major purchasers of polyurethane chemicals against manufacturers accused of conspiring to fix the price of those chemicals for almost a decade.
• On behalf of the liquidator of Investors Equity Life Insurance Co., we prosecuted six lawsuits and arbitrations against securities brokers to recover more than $50 million lost by the company in allegedly illegal financial futures transactions and secured an award in excess of $8 million from a three-judge arbitration panel.
• We represented a large group of plaintiffs, including Tyson Foods, Inc., to recover damages for overcharges resulting from the alleged price fixing of methionine, an ingredient in animal feed.
