Patent Litigation Spinal Kinetics, the designer and manufacturer of innovative artificial disc products, was sued for patent infringement by a competitor seeking to block market access. In this high-stakes defense case, we secured a jury verdict which found that our client did not infringe and also found the asserted claims of the competitor’s patent to be invalid.

Trade Secrets Our attorneys obtained a temporary restraining order on behalf of our client, a solar panel manufacturer, against a former employee alleged to have misappropriated trade secrets and breached his employee technology and confidentiality agreement with the company in his work for a competitor. The matter was settled favorably for the client with the defendent being permanently enjoined and restrained from participating in the competitor’s manufacturing process.

Copyrights When our client was targeted for alleged software copyright infringement by The Software Alliance, we worked to secure a favorable settlement for a fraction of the potential liabilities.

Patent Prosecution We successfully obtained more than 15 U.S. patents for Wolfson Microelectronics plc (UK) on microelectronic circuits used in many of the most popular smart phones, including a fundamental patent on technology that allows cell phone users to perform multiple communication tasks simultaneously on smart phones.

Licensing We provided IP counsel on an international, multimillion-dollar royalty stream agreement between our client and a private equity firm for a pharmaceutical product.

Due Diligence When international materials manufacturer Saint-Gobain sought to acquire Sage Electrochromics, our team provided comprehensive due diligence on the target company’s IP portfolio. The deal for the strategic acquistion closed successfully.

Life Sciences & Chemicals We secured a major victory for Arthrex, Inc., in connection with patent litigation relating to a high-strength suture, in which we successfully defended Arthrex against an infringement claim by Johnson & Johnson seeking a multi-hundred million dollar award.

Trademarks We represented Blue & White Food Products, LLC against another company for trademark infringement and dilution of Blue & White’s “Sabra” trademarks for Mediterranean salads and other food products. We enforced an unsigned settlement agreement against the defendant after it agreed to settlement terms and then subsequently reneged. The court found communications between parties’ counsel and the court sufficent to establish an enforceable settlement agreement.
