Purpose

To implement the State Planning Policy Framework and the Local Planning PolicyFramework, including the Municipal Strategic Statement and local planning policies.

To identify areas which require the preparation of a development contributions plan for thepurpose of levying contributions for the provision of works, services and facilities beforedevelopment can commence.

45.06-1 Development contributions plan

A permit must not be granted to subdivide land, construct a building or construct or carryout works until a development contributions plan has been incorporated into this scheme.

This does not apply to the construction of a building, the construction or carrying out ofworks or a subdivision specifically excluded by a schedule to this overlay.

A permit granted must:

� Be consistent with the provisions of the relevant development contributions plan.

� Include any conditions required to give effect to any contributions or levies imposed,conditions or requirements set out in the relevant schedule to this overlay.

45.06-2 Preparation of a development contributions plan

The development contributions plan may consist of plans or other documents and may,with the agreement of the planning authority, be prepared and implemented in stages.

The development contributions plan must:

� Specify the area to which the plan applies.

� Set out the works, services and facilities to be funded through the plan, including thestaging of the provision of those works, services and facilities.

� Relate the need for the works, services or facilities to the proposed development of landin the area.

� Specify the estimated costs of each of the works, services and facilities.

� Specify the proportion of the total estimated costs of the works, services and facilitieswhich is to be funded by a development infrastructure levy or community infrastructurelevy or both.

� Specify the land in the area and the types of development in respect of which a levy ispayable and the method for determining the levy payable in respect of any developmentof land.

� Provide for the procedures for the collection of a development infrastructure levy inrespect to any development for which a permit is not required.

The development contributions plan may:

� Exempt certain land or certain types of development from payment of a developmentinfrastructure levy or community infrastructure levy or both.

� Provide for different rates or amounts of levy to be payable in respect of different typesof development of land or different parts of the area.

43.01 HERITAGE OVERLAY

Purpose

To implement the State Planning Policy Framework and the Local Planning PolicyFramework, including the Municipal Strategic Statement and local planning policies.

To conserve and enhance heritage places of natural or cultural significance.

To conserve and enhance those elements which contribute to the significance of heritageplaces.

To ensure that development does not adversely affect the significance of heritage places.

To conserve specifically identified heritage places by allowing a use that would otherwisebe prohibited if this will demonstrably assist with the conservation of the significance of theheritage place.

Scope

The requirements of this overlay apply to heritage places specified in the schedule to thisoverlay. A heritage place includes both the listed heritage item and its associated land.Heritage places may also be shown on the planning scheme map.

43.01-1 Permit requirement

A permit is required to:

� Subdivide land.

� Demolish or remove a building.

� Construct a building or construct or carry out works, including:

� Domestic services normal to a dwelling if the services are visible from a street (otherthan a lane) or public park.

� A solar energy facility attached to a building that primarily services the land onwhich it is situated if the services are visible from a street (other than a lane) orpublic park.

� A rainwater tank if the rainwater tank is visible from a street (other than a lane) orpublic park.

� A fence.

� Road works and street furniture other than:– traffic signals, traffic signs, fire hydrants, parking meters, post boxes and seating– speed humps, pedestrian refuges and splitter islands where the existing footpaths

or kerb and channel are not altered.� A domestic swimming pool or spa and associated mechanical and safety equipment.

� A pergola or verandah, including an open-sided pergola or verandah to a dwellingwith a finished floor level not more than 800mm above ground level and a maximumbuilding height of 3 metres above ground level.

� A deck, including a deck to a dwelling with a finished floor level not more than800mm above ground level.

� Non-domestic disabled access.

IMPORTANT : Abandoned pipes may contain asbestos cement and/or fibro cement. Special work and handling procedures to deal with these potentially hazardous materials are required. Metallic water mains and associated fittings may pose an electrocution hazard if electrical earth wires have been connected to the property service or water main. The contractor shall ensure that adequate electrical testing is carried out prior to working on these mains. If a positive reading is recorded the contractor shall cease all works and notify the relevant power distributor, the customer and YVW.
