Customs Information by Entry Points (port, lake/river, airport, overland entry points)

The main gateway for overseas trade to and from the Western DRC is the port of Matadi, which accounts for some two thirds of imports in value terms and more than four fifths in terms of weight.

Matadi therefore accounts for a considerably larger share of physical entry into the DRC. Kinshasa airport is also a significant entry point, accounting for some 10 percent of import values. In the Southern DRC, Kasumbalesa is the main border entry for goods imported into the DRC along the Lubumbashi-Lusaka (ZAMBIA)Corridor though the Kalemie border entry on the Lake Tanganyika plays a significant role for goods imported into DRC as well from TANZANIA.

The most significant entry points in the Eastern provinces are the Goma/Gisenyi border entry for goods imported into the DRC from Rwanda and Tanzania and the Uvira/Bujumbura border point for goods entering the country from Burundi and the Béni/Kasindi border point for goods entering the country from Uganda.

The border entry of ARU connecting the DRC to Uganda along with that of Mahagi can also be mentioned. Goma and Kisangani international airports are the additional entry points in the Eastern part of the Country.

Customs Information and Document Requirements

Prior to arrival of the vessel, imports are subject to three formalities:

First, an import licence/declaration, issued by the Central Bank, must be obtained and deposited with a private bank.

Second, the import licence application is sent to BIVAC, which begins the preshipment inspection and AV(Attestation de vérificaton) procedure, certifying the goods (value, volume, type) prior to loading. The AV is usually available in the DRC in BIVAC offices before the goods arrive. The

procedure concludes with authentification of the hard copy by the OCC/DGDA unit within BIVAC, from which the importer obtains the document.

The third formality is for the shipping agent to obtain a FERI. OGEFREM manages the FERI. The information contained therein is usually identical to that in the BIVAC AV because it is drawn up afterwards. In addition, it is prepared according to the same logic: OGEFREM has foreign partners responsible for collecting the information in the loading ports. (UNs agencies and NGOs are exempted from the FERI procedure)

If there is no FERI and/or AV, the OCC is responsible for preparing these documents at destination, applying penalties (3 per cent of the CIF value for the AV).

The above procedure does not apply to UN and NGOs as per their agreement with their Sectoral Ministries.

Acceptance by the customs.

This commences with obtaining the manifest. According to the regulations, this manifest must be submitted 48 hours before the ship arrives.

Before goods can be unloaded, the quarantine services go on board and then authorization from DGDA and OCC is required. The goods are inspected by DGDA, SCTP and OCC officials, which each draw up their own records (entered by computer, checklist and tally). The manifest is then submitted in hard copy to DGDA, which enters it into the ASYCUDA system (entry of manifest box), together with a checklist record. At the same time, acceptance of the goods is recorded by hand in a register. It should also be noted that OGEFREM is involved in the process of entering the detailed manifest/declaration by the customs. OGEFREM compares the value of the freight declared in the freight manifest, the bill of lading with that appearing on the FERI in order to determine the (highest) taxable value established by DGDA. The same information must be sent to OCC to determine the CIF value used by the latter for the invoice.

Detailed declaration.

The person making the declaration enters the detailed declaration at the customs office in the port of Matadi. He submits it at the acceptance counter, which checks that there is an AV.

Following the declaration, DGDA issues a "prepayment" note based on the taxable value it has determined - which may or may not use the values transmitted by BIVAC and OGEFREM. In fact, these do not appear to be legally binding on DGDA. Based on this note, the person making the declaration pays the total amount to the bank, which pays it into the bank accounts of those entitled in accordance with the respective memoranda of understanding and gives a receipt. An electronic signal is sent to DGDA and the customs officer authorizes printing of the declaration.

Inspection.

The declaration depends on physical inspection by an inspector from the control service. Physical inspection applies to 100 per cent of declarations. In 90 per cent of the cases, the container is unpacked (source: forwarding agent). The inspection certificate is filled in, electronically, and then returned to the inspector, who is responsible for the final payment, and then to the deputy director, who gives his agreement to the clearance note, which is returned to the inspector, who issues the actual note. Then it is sent to the customs officer, who signs it and the payment is cashed.

If the goods are to be transferred to Kinshasa, the formalities are exactly the same but the goods are covered by a permit subject to security.

OCC (Congolese Control Office) procedures

At the same time, the person making the declaration has to go through a second series of controls at OCC. He submits his application to the OCC division at Matadi (outside the port) comprising the following:

• Four copies of the invoice; • Bill of lading; • FERI (either drawn up on loading or endorsed by OCC at

destination at the request of OGEFREM or certified by OGEGREM upon arrival); • Declaration order; • Client's invoice;

• Laisser suivre (authorization to go ahead); • Authenticated BIVAC AV; • Attestation of origin (used clothing); • Authorization to import if required (foodstuffs, pharmaceuticals);

• Fumigation certificate (used clothing).

The OCC's "import control" service in the Matadi division (in town) cross-checks the information. The application is then sent to the "central price office" (in the port), which draws up a note of the value. It is also responsible for adjustments if there is no AV on the basis of the service on the quay which has compiled the checklist (entered by computer).

The application is transmitted to the OCC's one-stop shop (port), which registers it. It is examined by the "applications acceptance" office. DGDA's manifest is compared with the findings of the service on the quay. If they correspond, the office gives the application a number. If not, the application is rejected.

The application then goes to the "codification office", which enters the information in the computer system, checks the tariff heading and enters the information in the invoice and the bill of lading. After this it goes to the "invoicing office", which checks the AV value against the value verified by the central price office. The fees are calculated as follows: control fees, tally fees and additional charges as determined by OCC. The taxable base is the OCC value and not the value accepted by DGDA as regards not only the f.o.b. value but also the freight and insurance value. Controls by OCC are on the VERITAS (BIVAC) basis.

OCC also takes part in the visit with the customs, DGM and ANR. It reserves the right to inspect the quality of the goods, taking samples if needed, in addition to verifying conformity with the information given in the AV. This is done systematically for pharmaceuticals and foodstuffs.

Exit of the goods. After the DGDA visit has been completed and the clearance note issued, DGDA's acceptance service issues an exit voucher to the person making the declaration. The DGDA brigade records the actual exit in a register. OCC's services note the exit. If the carrier has no security or if there is a change of vehicle, the goods are escorted by DGDA and OCC at a cost of US$800/five vehicles for three or four days.

Other formalities If the goods are unloaded outside the opening hours of DGDA's services, a request for special

services and a written authorization are required. If there is an increase in the duties and taxes, DGDA's services draw up a report and put a cross-

Customs Information and Document Requirements

There are four public service providers at the border: Customs, Immigration, Bureau and Health Department. In order to ease congestion at the border, commercial goods are cleared inland DRC at a Customs facility 7 kilometers from the border. Only light trucks up to 10 tons are cleared at the border using manual clearance. It was further established that most of the consignments were cleared in Lubumbashi, thus the process done at Whisky is for Customs to generate a transit document for clearance in Lubumbashi. When physical examination is required, Customs Bureau and Health undertake joint inspections and are all signatories to the physical examination form. Inspections are done in a well shaded shed which can take up to 12 trucks for inspections at a time. Parking space at Whisky is managed by a private company called PACIFIC and they collect parking fees from all trucks going through the facility.Clearing System

For Entry points of BUNAGANA and ISHASHA, all imports are taken to GOMA for customs clearance.Trucks are escorted to Goma by customs officers from DGDA, upon payment of US$80 per escort. (This fee is payable for the whole escort (up to 7 trucks), and not for each truck). Due to the ongoing crisis in the North – Kivu province, Bunagana border has been closed by the Congolese government as this entry point is occupied by M23. All trucks from Kampala (Uganda) and Mombasa (Kenya) for Goma and Bukavu transit through Rwanda to enter DRC.

Customs have a “customs bonded parking lot called “TCB” (Container Terminal of BENI) in Mupanda area. The TCB is for parking of the trucks awaiting the completion of the customs clearing procedures.

There are three majors entry points in South Kivu

The lake port called Kalundu at the southern end of the Uvira town, which provides links by boat to Kalemie, Kigoma in Tanzania, and Bujumbura, the capital of Burundi.
