Animal Welfare :

The Prevention of Cruelty to Animals Act was enacted in 1960 to prevent theinfliction of unnecessary pain or suffering on animals and to amend the lawsrelating to the prevention of cruelty to animals. After the enactment of this Act, theAnimal Board of India was formed for the promotion of animal welfare.

Wildlife :

The Government of India enacted Wild Life (Protection) Act 1972 with the objectiveof effectively protecting the wild life of this country and to control poaching,smuggling and illegal trade in wildlife and its derivatives. The Act was amended inJanuary 2003 and punishment and penalty for offences under the Act have beenmade more stringent. The Ministry has proposed further amendments in the law byintroducing more rigid measures to strengthen the Act. The objective is to provideprotection to the listed endangered flora and fauna and ecologically importantprotected areas.

R. THE PREVENTION OF CRUELTY TO ANIMALS ACT, 1960 -27. Exemptions : Nothing contained in this Chapter shall apply to -

(a) the training of animals for bonafide military or police purpose or the exhibition ofany animals so trained; or

(b) any animals kept in any zoological garden or by any society or association

which has for its principal object the exhibition of animals for educational orscientific purposes.

28. Saving as respects manner of killing prescribed by religion : Nothing containedin this Act shall render it an offence to kill any animal in a manner required by thereligion of any community.

40. Indemnity : No suit, prosecution or other legal proceeding shall lie against anyperson who is, or who is deemed to be a public servant within the meaning of

section 21 of the Indian Penal Code in respect of anything in good faith done orintended to be done under this Act.Animal Welfare Act, 2011 draft be placed before Indian Parliament, till then issueOrdinance replacing toothless Prevention of Cruelty to Animals Act, 1960.
