Neeti, dated 17.11.2017 in compliance of the directions of Hon'ble CAT order dated 29.11.2017. 2. The candidature of Ms. K. Neeti has been kept pending for want of clarification regarding her eligibility for the post of TGT (Computer Science), Post Code-192/14 as per the provisions contained in the Recruitment Rules. 3. The Hon'ble CAT vide order dated 29.11.2017 directed the DSSSB to . consider Annexure A/2 representation of the applicant and pass appropriate speaking and reasoned order. The operative part of the order is as under:- "In the circumstances, the O.A. is disposed of without going into the other merits of the case, with a direction to the respondents to decide Annexure A/2 representation of the applicant, and to pass appropriate speaking and reasoned orders within a period of 30 days from the date of receipt of a copy of this order, in accordance with law, It is further ordered that till then, one post of TGT (Computer Science) under OBC category (Post Code No.192/14) vide, Advertisement No.Ol/14 shall remain unfilled. If the respondents pass any order adverse to the applicant, he is at liberty to question the same, in accordance with law. " 4. Brief facts of the .case are that the candidate, Ms. K. Neeti has been shortlisted for the post of TGT (Computer Science), Post Code-192/14 under OBC category on the basis of her declaration regarding eligibility on her application form. 5. The eligibility conditions laid down in the Recruitment Rules as well in advertisement No.Ol/14 are as under:- "Bachelor's Degree in Computer Application (BCA) from a recognized University OR Graduation in Computer Science from a recognized University (Provided that the Computer Science subject must be studied in all years as main subject) OR B.E./B. Tech. (Computer Science/Information Technology) from a recognized University OR Graduation in any subject and A level course from DOEACC, Ministry of Information & Communication and Technology, Govt. of India." 6. On scrutiny of the documents uploaded by her in the e-dossier module, it has been found that she acquired her degree in B.Sc (Applied Physical Sciences) and not Graduation in Computer Science as required. Further She studied the subject 'computer science' as main subject for 200 marks (100 marks each in her 2 nd & 3 rd year of graduation) and for 50 marks in her 1 st year of graduation. As per the eligibility conditions, the candidate should have Graduation in Computer Science, provided that the Computer Science subject studied in all years as main subject.

    ORDER

    This order shall dispose of the representation of Ms. K. Neeti, dated17.11.2017 in compliance of the directions of Hon'ble CAT order dated 29.11.2017.

    2. The candidature of Ms. K. Neeti has been kept pending for want ofclarification regarding her eligibility for the post of TGT (Computer Science), PostCode-192/14 as per the provisions contained in the Recruitment Rules.

    6. On scrutiny of the documents uploaded by her in the e-dossier module, ithas been found that she acquired her degree in B.Sc (Applied Physical Sciences)and not Graduation in Computer Science as required. As perthe eligibility conditions, the candidate should have Graduation in ComputerScience, provided that the Computer Science subject studied in all years as mainsubject.

    7. Since the Recruitment Rules falls under the domain of User Department, thematter was referred to Directorate of Education, the User Department vide Board'sletter dated 22/02/2018 alongwith the mark sheets of BSc (Applied PhysicalSciences) degree acquired by Ms. K; Neeti, the applicant with the request to clarifyas to whether the degree in BSc Applied Science be equated with Graduation inComputer Science as mentioned in the Recruitment Rules.

    8. Assistant Director of Education (E.IV) vide his letter No.DEA/1/(75)/E-IV/Court Case/2017/48-49 dated 01/03/2018 has informed that the matter has beenconsidered in the Directorate including the letter dated 26.02.2018 written by Ms.K. Neeti wherein she mentioned that she has studied Computer Science as asubject in all the three years is of the view that since the RRs specifically mentionsGraduation in Computer Science and the applicant has Graduation in AppliedPhysical Science, the said degree is not as per RRs of TGT (Computer Science), i.e.Graduation in Computer Science from a recognised University (provided that thecomputer science subject must be studied in all years as main subject).

    9. Keeping in view the clarification of the User Department, i.e. Director ofEducation that B.Sc Applied Sciences cannot be equated with Graduation inComputer Science, the candidature Ms. K. Neeti for the post of TGT (ComputerScience), Post Code-192/14 is hereby rejected.

    10. This issues with the approval of Competent Authority and in compliance ofthe directions of Hon'ble CAT.

    11. Let this order be served upon Ms. K. Neeti through Speed post.
