General Information & Conditions

Your booking contract is with Australian Pacific Touring Pty Ltd (trading as Travelmarvel). Your contract incorporates all of the following terms and conditions. You should read and understand your contract, and please ask Travelmarvel or your travel agent if you require any clarification.

FARES, BOOKING CONFIRMATIONS A $200 security deposit per person, per tour and the balance of any airfares booked by Travelmarvel is required within seven days of booking. Some seasonal special offers may require an additional deposit, which will be advised at the time of reservation. Balance is required 100 days before departure, unless restrictions apply for air or cruise travel. Full payment is required if booking less than 6 weeks prior to departure date. Credit card surcharges will apply. Where connecting air travel, domestic airfare payment is due within 7 days from date of booking. All fares quoted are in Australian currency and supersede all prices previously advertised. Stated duration counts day of departure and day of return. Twin share prices are per person unless otherwise stated. Travelmarvel reserves the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by Travelmarvel within the specified time. Prices include Australian Government Goods and Services Tax (where applicable). Discounts: Past passenger discounts may be combined with some other discounts. Please ask at the time of booking for more details. Group concessions for 10 or more adults may be available, details on application. Past passenger discounts are not applicable for groups of 10 adults or more. Children under 15: When sharing with one adult 20% off adult coach fare. Children under 7 years of age are not recommended to participate in an escorted coach tour. Children under 18 years must be accompanied by an adult. Concession fares: Apply to Australian and New Zealand pensioners and Australian Seniors Card Holders. Refer to fare tables for relevant discounts.

All cancellations must be received in writing by Travelmarvel and are not effective until this notification has been received.

If tour has commenced, 100% of the full tour price is charged.

There is no refund for unused services or if portions of the land arrangements are missed. Cancellation fees also apply to additional accommodation reserved prior to and after the tour. These cancellation fees are in addition to any fees that may be levied by your travel agent. You acknowledge that the amounts estimated under the Cancellation Policy are reasonable and represent a genuine pre-estimate of Travelmarvel’s loss.

Deposit Cancellation Cover applies to new bookings only. After five years, unused credit funds will incur the original cancellation conditions as per brochure. This does not replace travel insurance, which we strongly recommend is organised at the time of booking.

INDEMNITIES The involvement of airlines, rail, boat or any other relevant operator is as air, rail, sea and road carriers only. They shall not be responsible for statements in this publication relating to the transport arrangements. Travelmarvel shall indemnify these operators against any claim action, loss or damage arising there from.

LUGGAGE LIMIT Each passenger is entitled to take one case, the sum of its length, width and depth not to exceed 160 cm (63 inches), weight limit 20 kilos (44 lbs.). Airlines permit only 1 cabin bag per person, in which personal items such as cameras, make-up etc. should be carried. Over-limit luggage cannot be carried. Baggage is at ‘owners risk’.

IMPORTANT INFORMATION EXCLUSION OF LIABILITY 1. While Travelmarvel will take all reasonable steps to provide an enjoyable tour, it accepts no liability for any loss of enjoyment experienced by passengers due to circumstances beyond its control. Travelmarvel further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the Trade Practices Act 1974, and nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.

2. Your travel agent will forward booking confirmations and other payments to us on your behalf, but your travel agent is not our agent for the purpose of receipt of monies. Receipt of booking confirmations and subsequent payments by the travel agent does not constitute receipt of those monies by us and the travel agent has no authority expressed or implied to receive monies on our behalf. There is no liability on the part of Travelmarvel in respect to any monies paid to the passenger’s travel agent unless and until Travelmarvel notifies the passenger

(by way of a booking confirmation advice or payment receipt advice) that monies have been received by Travelmarvel.

3. The optional tour excursions are not operated by or at the direction or on behalf of Travelmarvel or its employees or agents or any other persons or companies associated with Travelmarvel. By taking bookings for these tours, Travelmarvel acts as each optional tour operator’s agent.

4. These tours include the services of operators other than Travelmarvel e.g. hoteliers, airlines and optional tour excursions, which are not under the direct control of Travelmarvel, and whilst Travelmarvel takes all reasonable care in selecting these operators, it cannot accept responsibility for those operators’ conduct or the conduct of their representative employees or agents or for any ramifications of that conduct.

5. On tours including activities such as trekking, swimming and snorkelling, passengers accept that degrees of risk are involved.

6. No passenger will be permitted to embark or continue on tour while their mental or physical condition is, in the opinion of any representative of Travelmarvel, such as to render them incapable of caring for themselves, or whereby they become objectionable to other passengers, or they become a hazard to themselves or other passengers. Travelmarvel will not be responsible for expenses resulting in such persons being precluded from completing the tour.

AMENDMENT FEES A charge of $70 will apply to any addition or modification requested after the original booking has been confirmed.

SERVICE ENQUIRIES If a problem occurs during your tour, in your own best interests, you should advise your Tour Director so that steps can be taken to resolve the matter on the spot. Any complaint must be made in writing to us within 30 days.

TERMINATION OF BOOKING CONTRACT OR CHANGE OF TRAVEL ARRANGEMENTS DUE TO FORCE MAJEURE If Travelmarvel, in its reasonable opinion, considers that any Force Majeure event prevents Travelmarvel (whether directly or through its employees, contractors, subcontractors and agents) from lawfully and/or safely providing any products and/or services subject of the booking contract to you, Travelmarvel may immediately by written notice: (a) terminate the booking contract (in whole or in part); and/or (b) change your travel arrangements as reasonably practicable to ensure your safety and invoice you for any additional costs of performing this paragraph.

LIMITATION OF LIABILITY IN THE EVENT OF FORCE MAJEURE In the event that Travelmarvel cancels or changes your travel arrangements in any way due to a Force Majeure event, Travelmarvel will not be liable to you in contract, tort, statute or restitution for any loss (including but not limited to loss of deposit or purchase price and loss of enjoyment), damage, costs, charges, expenses or injury resulting from or in connection with (whether directly or indirectly): (a) the cancellation or change to your travel arrangements; and/or (b) the Force Majeure event. For the avoidance of doubt, Travelmarvel is not liable to refund any part of the deposit and/or purchase price paid by you if Travelmarvel subsequently changes or cancels your travel arrangements in connection with a Force Majeure event. World weather, civil unrest and terrorism are becoming more erratic and unpredictable and these are risks beyond Travelmarvel’s control. It is your responsibility to purchase adequate comprehensive insurance to protect yourself against these risks.

FORCE MAJEURE Force Majeure means the occurrence of an event that is beyond Travelmarvel’s reasonable control and which could not have been reasonably prevented by Travelmarvel, which includes but is not limited to: (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (b) natural disaster (including but not limited to flooding, fire, earthquake, landslide), adverse weather conditions, high or low water levels; (c) nuclear or other industrial accident causing environmental pollution or contamination; and/or (d) change in law, meaning enactment, amendment (including repeal) in the law or administration of any law in Australia or any jurisdiction or territory relevant to the booking contract, which include changes in statute, regulation, determination, by-law, declaration, licence and includes the common law as applicable from time to time.

ITINERARIES Itineraries are subject to alteration without notice and intended as a guide only. Alterations may come about due to road, weather or tidal conditions, strikes, public holidays, local festivals or other reasons. Due to the nature of the terrain and remote areas, weather fluctuations can adversely affect road conditions which may necessitate alterations to itinerary with little or no notice. Any additional expense incurred by the passenger is not Travelmarvel’s responsibility. Travelmarvel can give no guarantee as to the exact arrival and departure times for carriers and operators used by Travelmarvel in the tour and Travelmarvel will not be

liable for failure to make connections with any other services or attractions beyond its control. As is normally the case with group tours, a minimum number of bookings is required in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate numbers cannot be achieved, it may be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or a full refund of monies paid for Travelmarvel ground content touring). The date on which the decision is made whether a tour will operate is usually four to eight weeks before the scheduled departure date.

SMOKING Government regulations forbid smoking in tourist coaches, however frequent stops are made for those wishing to smoke. Smoking is not permitted in twin share ‘matched’ rooms. Requests for smoking/non smoking rooms will be passed on to hotels but cannot be guaranteed.

HEALTH AND FITNESS A good level of fitness and health is required to participate on our tours. In some of the destinations, there is extensive sightseeing on foot and climbing of stairs, and good mobility is needed getting on/off coaches, boats and, in places, trains. We recommend a visit to the doctor and dentist before travelling. It is your responsibility to advise Travelmarvel of any pre-existing medical conditions that may affect the normal conduct of a trip and the enjoyment of others while on tour.

PASSENGERS NEEDING SPECIAL ASSISTANCE Travelmarvel welcomes passengers with disabilities or special needs provided they are accompanied by a companion capable of providing all assistance required. Any disability or medical condition requiring special attention must be reported to Travelmarvel at the time of booking. Travelmarvel will make reasonable efforts to accommodate the special needs of disabled participants, but is not responsible for any denial of services by carriers, hotels, restaurants or other independent suppliers, or any additional expenses incurred. Coaches and minibuses are not equipped with wheelchair ramps. Wheelchairs and walkers may be carried on coaches, dependent on type and space limitations. We regret that we cannot provide individual assistance to a passenger for walking, dining, getting on and off coaches or other transportation vehicles or other personal needs.

SEAT ALLOCATION ON COACH TOURS To ensure all passengers enjoy forward and window facing seats, we have incorporated a daily seat rotation system.

TRANSFER POLICY On the first and final day of your tour we’ll provide a free airport transfer. When you book pre-tour accommodation with us in the city the tour departs from, we’ll provide a transfer from the airport on the day you arrive, and a hotel transfer on the first day of your tour.

TRAVEL INSURANCE We strongly recommend passengers to take out travel insurance to cover any unforeseen circumstances which may arise (including cancellation fees, medical and curtailment expenses, loss of luggage, early departure from tour due to death or illness etc.). Ask your Travel Agent at time of booking.

DATA PROTECTION POLICY Your personal data will be passed on by Travelmarvel to any relevant independent suppliers connected with your holiday package who need to know it so that your holiday can be provided and may also be provided to government/public authorities such as customs, immigration and the security services if required. All personal data you give us (including sensitive personal data) will be kept. We will use only names and contact details for marketing purposes unless you notify us that you do not wish to receive future marketing material by writing to APT, Level 4/1230 Nepean Highway, Cheltenham, Victoria, 3192.
