BACKGROUND
SITE DESCRIPTION AND PRESENT USE. The subject site is 103,731 square feet and consists of an existing 46,500 square foot building and several surface parking lots with a total of 150 spaces. The building on-site is occupied by Shiloh Temple International Ministries and is a place of assembly. In addition to a place of assembly, a child care center operates out of the building during the week.
SURROUNDING PROPERTIES AND NEIGHBORHOOD. The property is located at the intersection of West Broadway, a Commercial Corridor, and Fremont Avenue N, a Community Corridor. Neighboring properties along West Broadway include a mix of commercial, residential, and institutional uses. Moving away from West Broadway, there is a mix of residential densities including single-family homes, duplexes, and multiple-family apartment buildings with interspersed institutional uses. Directly south of the project site is North High School’s football field which occupies more than one city block.
PROJECT DESCRIPTION. The applicant is proposing to construct a 105-foot telecommunications tower with a 4-foot lightning rod directly to the south of the existing building on site. The tower would occupy a 58 foot by 34 foot leased area that would house the telecommunications tower and base unit. The leased area would include a 1,399 square foot (53.8 feet by 26 feet) fenced area surrounded by landscaping and screening. The enclosure includes enough space to accommodate the equipment for at least three communications carriers. The proposed tower compound is bordered by the church building to the north, an outdoor children’s play area to the east, the existing parking lot to the south, and an access drive and utilities to the west. The tower is proposed to be a monopole design.
The applicant has proposed to screen the tower enclosure and mechanical equipment with twenty-five evergreen shrubs, which will reach 6 feet in height at maturity. The construction of the tower would require the removal of a mature deciduous tree on site. The applicant has proposed two canopy trees to be planted along Fremont Avenue N to mitigate the removal of the mature tree.

ANALYSIS
CONDITIONAL USE PERMIT The Department of Community Planning and Economic Development has analyzed the application to allow a telecommunications tower based on the following findings:
1. The establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the public health, safety, comfort or general welfare.

compliance with local, state and federal laws as well as standard regulations set forth by the FCC and OSHA. The site will be secured with a locked and gated security fence. The telecommunications tower is proposed to be constructed immediately adjacent to the existing church building and would require slightly relocating children’s play equipment in an adjacent outdoor play area. Due to the proximity of the tower to the church building and play area, staff is recommending a condition of approval that applicant shall submit a letter from a licensed engineer stating that the tower has the structural integrity to withstand typical wind loads and inclement weather.
The construction of the telecommunications tower would require removing the only mature canopy tree on site. The applicant has proposed screening and landscaping for the base of the tower and has proposed planting two canopy trees on the site to mitigate the impact of the tree removal. Staff recommends a condition of approval that would require the applicant to plant a total of three canopy trees of 3” caliper size on the site along Fremont Avenue N. The addition of these three trees would mitigate the impact of removing a mature canopy tree and would partially screen the tower from West Broadway and neighboring uses.
2. The conditional use will not be injurious to the use and enjoyment of other property in the vicinity and will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district.
The conditional use will not be injurious to any existing or proposed uses or enjoyment in the vicinity, nor will it impede the development and/or improvement of surrounding properties. The entire facility will be confined to a small area located behind the existing church building. The tower will not be located within any required setbacks. The proposed tower will have the capacity to support three communications carriers.
3. Adequate utilities, access roads, drainage, necessary facilities or other measures, have been or will be provided.
Adequate utilities, access roads, drainage, necessary facilities or other measures have already been provided to the site. The proposed tower will not require additional utilities beyond what is already in place.
4. Adequate measures have been or will be taken to minimize traffic congestion in the public streets.
Staff finds that the proposed communication tower will not impact the amount of traffic coming to and from the site. The applicant has indicated that the proposed telecommunications tower will be inspected for purposes of routine maintenance only, approximately once every one to three months.
This site received variances for parking in 2004 when Shiloh Temple International Ministries first located in the building. Since that time, the minimum requirement for off-street parking for places of assembly has been reduced from 20% to 10% of the capacity of persons in the main auditorium and any rooms which can be added to the main auditorium by opening doors or windows to obtain audio or video unity. The main auditorium for Shiloh Temple is approximately 15,715 square feet. The building code defines capacity for a place of assembly as 15 square feet per person. The capacity of the auditorium would therefore be 1,048 persons. The parking requirement for the place of assembly is 105 parking spaces. The minimum parking requirement for a child care center is 1 space per 500 sq. ft. of gross floor area plus two drop-off spaces. The child care center on site is approximately 14,000 square feet. The parking requirement for the child care center is 28 spaces. The total parking requirement for the place of assembly and child care center uses is 133 spaces plus two drop off spaces.
The applicant has indicated that the site includes 153 parking spaces, three of which are accessible parking spaces. The proposed project would result in the removal of three parking spaces for a total of 150 spaces, which is greater than minimum off-street parking requirement of 133 spaces plus two drop off spaces.
5. The conditional use is consistent with the applicable policies of the comprehensive plan.
The proposed development would be consistent with the following policies of The Minneapolis Plan for Sustainable Growth:

Economic Development Policy 4.3: Develop and maintain the city’s technological and information infrastructure to ensure the long-term success and competitiveness of Minneapolis in regional, national and global markets.
4.3.1 Promote the use of best available technology in upgrading communication linkages to the region and the world.
4.3.4 Electronically link schools, libraries and community centers into telecommunications and information infrastructure.
Public Services and Facilities Policy 5.6: Improve the safety and security of residents, workers, and visitors.
5.6.4 Maintain and enhance a public safety infrastructure that improves response time to police and fire calls, implements new technologies, provides operation and training opportunities and facilities, and improves communication among public safety agencies.
6. The conditional use shall, in all other respects, conform to the applicable regulations of the district in which it is located. If approved, the proposed telecommunications tower will meet the requirements of the OR2 zoning district.
In addition to the findings required for a CUP, approval of a telecommunications tower/antenna requires the applicant to submit written documentation indicating compliance with the following standards:
535.530. - Specific standards for conditional uses. All communication towers and antennas requiring a conditional use permit shall be subject to the provisions of Chapter 525, Administration and Enforcement, and the submittal requirements of section 535.510(b). In addition, the applicant shall comply with the following standards and submit written documentation indicating such compliance:
(1) Tower type. Communication towers shall be of a monopole design. The city planning commission may consider the substitution of alternative tower types in cases where structural, radio frequency, and design considerations, location or the number of co-locators suggests a tower other than a monopole.
The applicant is proposing to construct a 105-foot monopole with a 4-foot lightning rod.
(2) Co-location of communication antennas. Shared use of existing communication towers shall be preferred to the construction of a new tower.
The applicant has submitted documentation indicating that there are two existing telecommunications towers within a one-mile radius. The applicant has indicated that neither of these two towers would be suitable due to being too far away from the target site. The proposed tower would include space for the co-location of two additional communications carriers.
(3) Height of freestanding towers and antennas.
a. Residence, office residence and commercial districts. The height of freestanding communication towers and antennas located in the residence, office residence and commercial districts shall not exceed seventy-five (75) feet.
The applicant has proposed to exceed the allowable height of a freestanding communication tower and has submitted statements to address finding (c) below.
b. Industrial districts. The height of freestanding communication towers and antennas located in the industrial districts shall not exceed one hundred (100) feet.
Not applicable.
c. Excess height. The city planning commission may increase the height of freestanding towers and antennas, provided that in the residence, office residence and commercial districts such increase shall not exceed the maximum height by more than fifty (50)

percent. The applicant shall submit an inventory of existing and approved communication towers within a one (1) mile radius of the proposed site outlining opportunities for shared use as an alternative to the construction of a new tower, and shall demonstrate to the satisfaction of the city planning commission the following:
1. The proposed antenna cannot be accommodated on an existing or approved tower due to one (1) or more of the following reasons:
i. The unwillingness of the owner of the existing or approved tower to co-locate an additional antenna.
ii. The planned antenna would exceed the structural capacity of existing or approved tower.
iii. The planned antenna would cause radio frequency interference with other existing or planned equipment, which cannot reasonably be prevented.
iv. Other reasons affecting technical performance, system coverage and system capacity make it impractical to place the proposed equipment on existing or approved towers.
v. The proposed co-location on an existing or approved tower would not conform to the requirements of the zoning ordinance.
The applicant has submitted documentation indicating that the two existing towers within a one-mile radius would not be close enough in proximity to the target site to improve cell coverage.
2. The surrounding topography, structures, vegetation and other factors make a tower that complies with the district height regulations impractical.
The applicant has submitted a statement indicating that the proposed tower height of 109 feet is the minimum height that will result in coverage and capacity objectives in the area given the surrounding topography, vegetation and existing structures. The applicant has identified the height of nearby mature trees at 60 feet, the height of nearby buildings of 60 feet or taller and ground elevation changes as factors that require the additional tower height.
3. The proposed tower is designed to structurally accommodate both the applicant's antenna and at least one (1) additional user. The applicant shall submit a letter indicating the proposed tower is available for co-location with a phone number for interested parties to call.

(4) Height of all other towers and antennas allowed by conditional use. The maximum height of all other towers and antennas shall be as approved by conditional use permit.

535.540. - Development standards for all permitted and conditional communication towers, antennas and base units. In addition to the standards of sections 535.490, 535.500 and 535.530 above, all communication towers, antennas and base units shall be subject to the following standards:
(1) Encroachments and setbacks.
a. The tower site and setback shall be of adequate size to contain guyed wires, debris and the tower in the event of a collapse.

The tower location is set back from property lines and adjacent residential dwellings but is immediately adjacent to the existing church building and an outdoor children’s play area. As a condition of approval, staff recommends replacing this requirement with the condition that the applicant must submit a letter from a licensed engineer stating that the tower will have the structural integrity to withstand inclement weather conditions.
b. Communication towers shall maintain a minimum distance from the nearest residential structure equal to twice the height of the tower. For the purposes of this article, residential structures shall also include any parking structure attached to a principal residential structure.
The submitted plans show that the nearest residential structure is located 230 feet from the proposed tower, more than twice the height of the tower.
c. No part of any communication tower, antenna, base unit, equipment, guyed wires or braces shall extend across or over any part of a public right-of-way, except communication antennas and transmission equipment mounted to city-owned light poles or traffic signal davits in public rights of way for which a valid attachment permit has been granted pursuant to Chapter 451 of the Minneapolis Code of Ordinances.
No part of the telecommunications tower or base equipment extends across or over any public right-of-way.
d. Communication towers, antennas and base units shall comply with applicable regulations as established by the Federal Aviation Administration.
The applicant has indicated that the project will be in compliance with the regulations established by the Federal Aviation Administration.
e. Communication towers, antennas and base units shall comply with the minimum yard requirements of the district in which they are located.
The rear and side yard setbacks in the OR2 District are 5+2x, where x equals the number of stories above the first floor. Since a story is defined as 14 feet, a 109-foot tower would be classified as an eight-story building. An eight-story building would require a 19-foot setback. The applicant’s leased area is located over 100 feet from both the west and east interior side property lines and over 97 feet from the rear property line.
(2) Compatibility with nearby properties. Communication towers, antennas and base units shall utilize building materials, colors and textures that are compatible with the existing principal structure and that effectively blend the tower facilities into the surrounding setting and environment to the greatest extent possible. Metal towers shall be constructed of, or treated with, corrosive resistant material. Outside of the industrial districts, unpainted, galvanized metal, or similar towers shall be prohibited, unless a self-weathering tower is determined to be more compatible with the surrounding area.
The proposed telecommunications tower will be located in the middle of a 2.38 acre property. The tower will be located to the rear of a building used as a place of assembly. Communication towers shall maintain a minimum distance from the nearest residential structure to twice the height of the tower. The height of the proposed tower is 109 feet and the nearest residential building is 230 feet to the west. To the south of the site is a large football field used by North High School. The closest residence to the south is over a full city block away from the proposed tower location. The applicant has proposed an unpainted tower constructed of galvanized steel. Outside of the industrial districts, unpainted, galvanized metal or similar towers are prohibited. Staff recommends a condition of approval that the tower be painted light blue to blend in with the sky.
(3) Screening and landscaping. A screening and landscaping plan designed to screen the base of the tower and the base unit shall be submitted. The plan shall show location, size, quantity and type of landscape materials. Landscape materials shall be capable of screening the site all year. One (1) row of evergreen shrubs or trees capable of forming a continuous hedge at least six (6) feet in

height within two (2) years of planting shall be provided to effectively screen the base of the tower and the base unit, except for towers and antennas designed for private reception of television and radio signals and used for amateur or recreational purposes, and light poles and traffic signal davits in public rights-of-way that support communication antennas and transmission equipment. A maintenance plan for the landscape materials shall also be submitted. The city planning commission may consider the substitution of other architectural screening plans such as a decorative fence or masonry wall in lieu of planted materials.
The applicant has proposed an enclosure of 53.8 feet by 26 feet for the tower base and equipment. The enclosure would be secured by a chain link fence and screened by twenty-five evergreen shrubs, which will reach 6 feet in height at maturity, planted along the exterior of the chain link fence. Staff is recommending a condition of approval that the chain link fence be coated with vinyl to enhance its aesthetic appearance.
The construction of the tower would require the removal of the only mature deciduous tree on site. The site contains a large amount of surface parking that is nonconforming to the parking and loading landscaping and screening requirements of section 530.170 of the zoning code, specifically the requirement that in parking lots of ten spaces or more, no parking space shall be located more than fifty feet from the center of an on-site deciduous tree. The applicant has proposed two canopy trees to be planted along Fremont Avenue N to mitigate the removal of the mature tree. As noted above, staff is recommending a condition of approval to require three canopy trees, of at least 3” caliper size at the time of installation, to be planted on the site along Fremont Avenue N.
(4) Rooftop mounted towers and antennas. Rooftop mounted communication towers and antennas shall not be located on residential structures less than fifty (50) feet in height, except for towers and antennas designed for private reception of television and radio signals and used for amateur or recreational purposes.

(5) Façade mounted antennas.
a. Mounted on freestanding towers and poles. A façade mounted antenna shall not extend above the façade of the tower or pole on which it is mounted, but otherwise may project outward beyond such façade.
The proposed antennas will not project above the façade of the tower.
b. Mounted on city-owned light poles or traffic signal davits in public rights of way. A façade mounted antenna on an existing city-owned light pole or traffic signal davit shall comply with the standards of Chapter 451 of the Minneapolis Code of Ordinances. Such antennas and transmission equipment shall be painted to match the structure to which they are mounted and shall be designed to minimize the visibility of cables and other appurtenances.
Not applicable.
c. Mounted on all other structures. A façade mounted antenna shall be mounted flush against the structure on which it is mounted and shall not extend beyond the façade of such structure, except that antennas designed for private reception of television and radio signals, used for amateur or recreational purposes, may extend above the façade of the structure.

(6) Base units. Base units shall not exceed five hundred (500) square feet of gross floor area. The city may require as a condition of approval that base units be located underground.

According to the applicant, the base unit will occupy an area that measures approximately 150 square feet. The base unit will be located within the fenced enclosure that is proposed to be screened by evergreen shrubs that will reach 6 feet in height at maturity.
(7) Security. All sites shall be reasonably protected against unauthorized climbing. The bottom of the tower, measured from ground level to twelve (12) feet above ground level, shall be designed in a manner to discourage unauthorized climbing.
The applicant has indicated that the security fence will be locked and secured at all times. Climbing pegs will not be installed as part of this project.
(8) Signage. Advertising or identification of any kind on towers, antennas and base units shall be prohibited, except for applicable warning and equipment information signage required by the manufacturer or by federal, state or local regulations.
The proposed tower would not include any signage besides the applicable warning and cautionary signage required by the Federal Communications Commission.
(9) Lighting. Communication towers and antennas shall not be illuminated by artificial means, except when mounted on an existing light pole or where the illumination is specifically required by the Federal Aviation Administration or other federal, state or local regulations.
According to the applicant, there will be no lights attached to the telecommunications tower unless required by the Federal Aviation Administration.
(10) Heritage Preservation Ordinance compliance. Communication towers and antennas proposed for any locally designated historic structures or locally designated historic districts shall be subject to all requirements of the city's Heritage Preservation Ordinance.
The State Historic Preservation Offices (SHPO) has evaluated this site. In a letter dated September 25, 2017, Sarah Beimers, Manager of Government Programs and Compliance for SHPO, indicated that no historic properties are located within the area of potential effect for direct effects. SHPO identified three historic properties are located within the area of potential effects for indirect visual effects: Minneapolis Public Library: North Branch, Plymouth Masonic Lodge and the John Lohmar House. Overall, SHPO determined that this project will have no adverse effect on historic properties.
(11) Radio frequency emissions and noninterference. The applicant shall comply with all applicable Federal Communication Commission standards.
The applicant has indicated that they will meet all regulations established by the Federal Communications Commission.
(12) Public safety communication system. The location of the proposed antenna, if located on publicly owned property, shall not be needed for use by the public safety communication system, or if needed, it shall be determined by the director of the property services division of the finance department that co-location of the proposed antenna with a public safety antenna is agreeable.

RECOMMENDATIONS
The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application(s) by Kristian Olson for the properties located at 1201 West Broadway:
A. Conditional Use Permit for a telecommunications tower.
Recommended motion: Approve the application for a telecommunication tower, subject to the following conditions:
1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a

conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
2. The applicant shall submit a letter from a licensed engineer stating that the tower has the structural integrity to withstand typical wind loads and inclement weather.
3. The applicant shall provide landscaping and screening to the base of the tower and mechanical equipment as required by sections 535.70 and 535.540(3) of the zoning code.
4. The chain-link fence used to screen the base of the telecommunications tower and mechanical equipment shall be vinyl-coated and shall not include barbed wire.
5. The applicant shall plant three (3) deciduous, canopy trees on the site along Fremont Avenue N. The canopy trees shall be capable of growing to at least fifty (50) feet in height. The trees shall be at least 3” caliper size at the time of installation. The tree species, installation and maintenance shall comply with sections 530.200 and 530.210 of the zoning code. CPED staff shall review the proposed canopy trees prior to issuing building permits.
6. The proposed telecommunications tower shall be constructed of, or treated with, a corrosive resistant material and be painted light blue to blend in with the sky. All proposed antennas, supporting equipment and structural equipment upon which they are mounted shall be painted to match the tower.
7. No portion of the mounting pipes shall extend above or below the antenna. Empty mounting pipes shall not be permitted. No antennas shall protrude above the tower.
8. The visibility of cables and wires will be reduced whenever possible. Exposed cables will be painted to match the tower. Free-floating wires will only be permitted when no other concealment option is available.

Statement of Proposed Use and Description of the Eco-Site Tower Project at 1201/1225 West Broadway Ave North, Minneapolis, MN
On behalf of Eco-Site, LLC, we are requesting a Conditional Use Permit for the installation of a 105’ tall (with 4’ lightning rod, 109’ overall) monopole telecommunications tower on property located at 1201/1225 West Broadway Avenue North in Minneapolis. The tower is being built for the purpose of installing a new T-Mobile telecommunications facility (installation of T-Mobile’s antennas on the tower and base station equipment near the tower base), but will be available for colocation by other wireless communications providers as well.
The tower will be located directly behind an existing church building on the property and enclosed within a 58’ x 34’ fenced compound. The tower is designed to accommodate at least three total carriers and the 8’ tall chain-link security fence at the base of the tower covers a large enough area to accommodate the future base station equipment of any future co-locators. The fence will also be gated and locked at all times.
The tower compound is located behind the existing main building owned by Shiloh Temple International Ministries, in between the building and the existing parking lot. The proposed tower compound is bordered by the main building to the north, an outdoor play area to the east, the existing parking lot to the south, and an access drive and utilities to the west. The tower will be of a monopole design, as required by the zoning ordinance.
New landscaping is also planned to the east and west of the compound to provide additional screening for the property owner and other nearby properties. This involves small evergreen ferns to the west and one to three trees to the east. The trees to the east are to provide additional screening and also replace the existing tree that will be removed at the tower site.
The proposed tower has been designed to meet all required setbacks, to discourage any unauthorized climbing, and it shall not contain any advertising or signage outside of applicable warning or cautionary signage required by regulation.

Statement on Required Findings for a Conditional Use Permit for Eco-Site Tower Project at 1201/1225 West Broadway Ave North, Minneapolis, MN
1. The establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the public health, safety, comfort or general welfare.
The installation, maintenance and operation of the proposed tower and conditional use will be in full compliance with local, state and federal laws, including but not limited to the ordinance of the city of Minneapolis as well as standard regulations as set forth by the FCC and OSHA. The site will also be secured with a locked and gated security fence. As a result, the site will not be detrimental to or endanger the public health, safety, comfort or general welfare. It has been designed in accordance with the performance standards of the Minneapolis ordinance and it meets all setbacks and requirements.
2. The conditional use will not be injurious to the use and enjoyment of other property in the vicinity and will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district.
The conditional use of the telecommunications facility will not be injurious to any existing or proposed uses or enjoyment in the vicinity, nor will it impede the development and/or improvement of surrounding properties. The entire facility is confined to the fenced area behind the church building and much of the lower part of the tower and compound is screened by surrounding buildings and existing vegetation. The tower will not be lighted at night, nor will it create any disturbances of any kind to others in the vicinity.
3. Adequate utilities, access roads, drainage, necessary facilities or other measures, have been or will be provided.
The proposed telecommunications facility has fully adequate utilities adjacent to or already existing on the subject parcel. There is already adequate drainage and access roads as well.
4. Adequate measures have been or will be taken to minimize traffic congestion in the public streets.
The proposed telecommunications facility should have no impact on traffic congestion. The facility is un-manned and outside of initial installation, T-Mobile’s technicians will visit the site on an average of once every 1-3 months.
5. The conditional use is consistent with the applicable policies of the comprehensive plan.
The conditional use of this telecommunications facility is consistent with the policies of the comprehensive plan and follows the Minneapolis Zoning Ordinance completely for how and where telecommunications towers are to be located, designed, and built.
6. The conditional use shall, in all other respects, conform to the applicable regulations of the district in which it is located.
