AN ORDINANCE AMENDING CHAPTER 129 OF THE CODE OF THE TOWNSHIP OF PEQUANNOCK AND CLARIFYING BADGE AVAILABILITY FOR RESIDENTS ONLY AT WOODLAND LAKE
BE IT ORDAINED by the Township Council of the Township of Pequannock, in the County of Morris and State of New Jersey, as follows:
Section 1. Chapter 129, Section 129.02.090 entitled “Pequannock Valley Park and Woodland Lake Operating Policy; Fees,” of the Revised General Ordinances of the Township of Pequannock shall be amended by the following amendment to subsections B and C (1) and (2) which shall read as follows:
B. Pequannock residents and nonresidents shall be eligible to purchase badges for PV Park. Only Pequannock residents shall be eligible to purchase badges for boating and fishing on Woodland Lake.

Section 2. Chapter 129, Section 129.02.060 entitled “Recreational Activity” of the Revised General Ordinances of the Township of Pequannock shall be amended by the following amendment to subsection C which shall read, in its entirety as follows:
C. Fishing and Boating. Fishing and boating shall be allowed in Woodland Lake or such areas as may be designated by the Director and under such regulations as may be prescribed by the Director. Fishing and boating in Woodland Lake shall only be permitted to residents of Pequannock Township who have obtained badges as provided for in Section 129.02.090.
Section 3. If any section or provision of this Ordinance shall be held invalid in any Court of competent jurisdiction, the same shall not affect the other sections or provisions of this Ordinance, except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.
Section 4. All Ordinances or parts of Ordinances which are inconsistent herewith are hereby repealed to the extent of such inconsistency.
Section 5. This Ordinance shall take effect immediately after final passage and publication in the manner provided by law.

WHEREAS, there appears on the tax records overpayments or otherwise as shown below; and
WHEREAS, the overpayments were created by the reasons indicated below, and the Collector of Taxes recommends the refund or transfers of such overpayments;
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Pequannock, in the County of Morris, State of New Jersey as follows:
1. The proper officers are hereby authorized to make the following refunds and/or cancellations for the reasons stated.

Resolution of the Township Council awarding a contract for the Kent Place Sanitary Sewer Extension Project to Messercola Excavating, Inc. for the total contract amount of $91,180 in accordance with the bid specifications.

WHEREAS, the Township of Pequannock received bids for the Kent Place Sanitary Sewer Extension Project on June 24, 2020; and
WHEREAS, a total of seven (7) bids were submitted and have been reviewed by the Township’s Water and Sewer Consulting Engineer, Township Attorney and Manager/Purchasing Agent, who have recommended that an award be made to the lowest responsible, responsive bidder for the bid amount; and
WHEREAS, the lowest responsible, responsive bidder is Messercola Excavating, Inc., located at 549 East Third Street., Plainfield, New Jersey 07060, having submitted a bid in the amount of $91,180; and
WHEREAS, the Chief Financial Officer has certified that 08-216-55-695-0000 (Ord 2017-01) has funds available in an amount not to exceed $91,180 for the construction of sewers on Kent Pl as part of the Route 23 Sewer Project; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Pequannock as follows:
1. The contract for the Kent Place Sanitary Sewer Extension Project be awarded to Messercola Excavating, Inc. for the total contract amount of $91,180, in accordance with the bid specifications.
2. The Township Manager is hereby authorized and directed to execute the necessary documents related to this bid award.
3. The Township Clerk is directed to forward copies of the resolution to the Township Manager, CFO and Treasurer.

Resolution of the Township Council approving submission of a 2021 NJDOT Municipal Aid grant application and authorizing execution of a grant contract for the West Parkway North improvements project.
Resolution No. R2020-148
WHEREAS, the Township Engineer has prepared a New Jersey Department of Transportation (NJDOT) grant application for 2021 NJDOT Municipal Aid funds for West Parkway North Improvements project; and
WHEREAS, the Engineer has recommended the Township Council authorize the submission of this grant application.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Pequannock, in the County of Morris, State of New Jersey as follows:
1. The NJDOT 2021 Municipal Aid grant application for the project identified MA-2021-West Parkway North-00621, is hereby approved.
2. The Township Manager, Township Clerk and other appropriate Township Officials are hereby authorized to submit an electronic grant application identified as MA-2021-West Parkway North-00621 to the New Jersey Department of Transportation on behalf of the Township of Pequannock.
3. The Township Manager, Township Clerk and other appropriate Township officials are authorized to sign the grant agreement on behalf of the Township which shall constitute acceptance of the terms and conditions, and approves the execution of the grant agreement.
4. The Township Clerk is directed to forward a certified copy of this resolution to the Township Engineer and three (3) certified copies to the NJDOT.

Scope Of Work
Please provide description for Scope of Work:
West Parkway is a high volume major collector running north-south from NJ State Route 23 to
multiple major collector roads including Jacksonville Road (County Route 504) and Sunset Road
in Pequannock. The northern reach connects to the NJDOT maintained jug handle accessing the
Boulevard and West Parkway. West Parkway is a significant collector roadway serving as the
primary route into Pequannock Township if traveling south on US Route 23 North. West Parkway
provides access through Pequannock Township to Lincoln Park and Kinnelon . It is actively used
by emergency services as the primary route to Chilton Hospital from all points north via US Route
23. This length of West Parkway is identified as the truck route to the adjacent industrial facilities .
The truck route terminates at the entrance to Foothills Park, the southerly limit of this project.
Existing Conditions – West Parkway is a major connector as stated above. The existing
pavement averages 38’ – 40’ throughout. The area adjacent to the jug handle contains an existing
inlet surrounded by distressed pavement. There is an existing TBSA sanitary sewer trunk line and
manhole network for the entire length. The trench exhibits considerable settlement. The area
adjacent to a few manholes previously required emergency work because the settlement
presented a potential hazard. The TBSA video examined the sewer line and verified the system is
sealed and not causing the settlement.
By standard pavement maintenance guidelines, most of the pavement has reached the level of
deterioration where a cost-effective mill and overlay process will adequately extend the life of the
road. Approximately 250 square yards of trench and settlement areas associated with the
sanitary trench and manholes requires full depth remediation. The attached pictures illustrate the
various degrees of pavement stress from settlement, “alligator” and longitudinal cracking. The
pavement condition index implies the timing is right for isolated subbase repair with a functional
overlay to avoid the additional structural rehabilitation. The New Jersey State Recommendations
for Pavement Management Systems stresses the importance of timing preventive maintenance
and rehabilitation treatments in advance of structural failure.

WHEREAS, certain General Capital Improvement appropriation balances remain dedicated to projects no longer needed; and
WHEREAS, it is necessary to formally cancel these balances in order for the unexpended funds to be returned to Capital Fund Balance, Capital Improvement Fund, Capital Reserve or reduce Deferred Charges to Future Taxation based on the original source of funds; and
WHEREAS, the Township Manager and Chief Financial Officer have recommended these balances be cancelled at this time.

WHEREAS, N.J.S.A. 40:55D-23 authorizes the municipal governing body, by ordinance, to establish a Planning Board; and
WHEREAS, section 16.02 of Chapter 16 (Land Use Procedures) of the Pequannock Township Code established a Planning Board and provides the manner in which its members shall be appointed, and pursuant to this ordinance the Class IV members of the Planning Board shall be appointed by the Township Council;
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Pequannock, in the County of Morris, State of New Jersey, as follows:

WHEREAS, pursuant to §3.32 of the Code of the Township of Pequannock, a Parks and Recreation Advisory Committee has been established consisting of eleven (11) members appointed by the Township Council who shall serve without compensation for terms of three (3) years; and
WHEREAS, the Township Code also provides for the appointment of one (1) resident under the age of twenty-one (21) to serve as a non-voting youth liaison for a one (1) year term; and
WHEREAS, it is the desire of the Township Council to appoint individuals who have expressed interest in serving on the Parks & Recreation Advisory Committee.
