order at 8:35 a.m. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

Minutes: It was moved by Mr. Yamada, seconded by Mr. Mochida, and

unanimously carried to approve the July 19, 2013 and September 20, 2013 meeting and executive session meeting minutes as circulated.

Amendments to Agenda: It was moved by Mr. Kamai, seconded by Mr. Konishi, and unanimously

carried to approve the following amendments to the agenda: Under “Appearances Before the Board,” add the following:

following under “Owner-Builder Exemption Applications.” e. Tracy and Kim Kent Chapter 91, HRS, Chairperson Lau called for a recess from the Board’s meeting at 8:40 Adjudicatory a.m. to discuss and deliberate on the following adjudicatory matters Matters: pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors Licenses of Noel Madamba Contracting LLC and Noel C. Madamba; CLB 2011-118-L

RICO received a complaint from Ronald Kaufmann against Respondents Madama and Noel Madamba Contracting LLC alleging that they failed to include the requisite contract disclosures/provisions in their contract.

The Board discussed the settlement agreement in which

Respondents do not admit to violating any law or rule, but agree to pay a fine, jointly and severally, in the amount of $2,000.00.

After discussion, it was moved by Mr. Yamada, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

b. In the Matter of the Contractors’ Licenses of Larson-Hicks

Construction, LLC and Guy M. Larson-Hicks; CLB 2011-161-L

RICO alleges that Respondents Larson-Hicks Construction, LLC and Guy M. Larson-Hicks entered into a contract with a homeowner for the construction of improvements on the property. The contract did not contain disclosures as required by HRS section 444-25.5.

The Board discussed the settlement agreement in which Respondents admit to violating HRS section 444-25.5, and agree to pay a fine, jointly and severally, in the amount of $2,500.00.

After discussion, it was moved by Mr. Yamada, seconded by Mr. Kamai, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

a. In the Matter of the Petition for Declaratory Relief of District Council 50 of the International Union of Painters and Allied Trades and Aloha Glass Sales & Service, Inc.; CLB-DR-2006-2

The Board reviewed and signed its Board’s Final Order Upon Remand (“BFO”) that reflected the Board’s July 19, 2013 decision.

b. In the Matter of the Contractor’s Licenses of Robert A.

Ancheta, dba Rob Landscaping and Trees; CLB 2010-241-L Complainants entered into a contract with Robert A. Ancheta, dba Rob Landscaping and Trees (“Respondent”), to set up a sprinkler system on their property. Respondent’s contract did not include lien rights, optional bonding information, complainant’s right to resolve alleged construction defects prior to commencing any litigation, and other required contract information. The sprinkler system was completed; however, Complainants had various problems with the sprinkler system. Complainants notified Respondent of their concerns by telephone and in writing; however, Respondent refused to make corrections or refund any portion of the monies. Complainants spent an additional amount to make corrections to the sprinkler system. Three judgments were filed in 2011 against Respondent. In September 2012 Respondent renewed his license and answered “no” to question number 4, “Are there any liens or judgments against you?” and certified that all statements on his renewal application were true and correct. The Hearings Officer found that Respondent violated Hawaii Revised Statutes sections 436B-19(8), 436B-19(17), 444-17(2), 444-17(10), 444-17(12), 444-25.5, and Hawaii Administrative Rules sections 16-77-80 and 16-77-97. The Hearings Officer’s recommendations were provided to the Board on August 27, 2013. Exceptions were not filed and oral arguments were not requested. Respondent’s copy of the recommended decision was returned marked “Return to Sender, Not Deliverable as Addressed, Unable to Forward”. For the violations found, the Hearings Officer recommended that Respondent be required to pay a fine of $5,000.00, restitution of $1,669.87, and satisfy the judgments described within six months of the Board’s Final Order. If Respondent fails to comply with the

Board’s Final Order, Respondent’s license would be automatically suspended. After discussion, it was moved by Mr. Yamada, seconded by Mr. Polischeck, and unanimously carried to approve the Board’s Final Order in the above case.

Following the Board’s review, deliberation and decisions on these

adjudicatory matters, pursuant to HRS chapter 91, Chairperson Lau announced that the Board was reconvening to its open meeting at 8:44 a.m.

Executive At 8:45 a.m., it was moved by Mr. Lee, seconded by Mr. Yamada, Session: and unanimously carried to enter into executive session to consult with

Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:03 a.m., it was moved by Mr. Yamada, seconded by Mr. Mochida,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

unanimously carried to approve Mr. Duncan’s application for licensure in the C-62 classification and to deny his application for licensure in the C-13 classification.

Executive At 10:36 a.m., it was moved by Mr. Kamai, seconded by Mr. Akasaki, Session: and unanimously carried to enter into executive session pursuant to

After discussion, it was moved by Mr. Matsuzaki, seconded by Mr. Lee,

and unanimously carried to defer Mr. Christopher’s application pending the submittal of additional C-60 projects, and deny his application for licensure in the C-13 classification.

unanimously carried to order Ms. Smith to pay restitution of $2,000 each to the two remaining complainants and, thereafter $150 per month to each complainant until the remaining balance is paid off.

Mr. Matsuzaki, and carried with Mr. Polischeck recusing himself, to approve Mr. Carreiro’s application for licensure in the “A” classification.

At 1:52 p.m., it was moved by Mr. Yamada, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Kagawa, seconded by Mr. Lee, and

unanimously carried to deny Mr. Madariaga’s application for licensure in the C-52 classification. Mr. Kagawa asked Mr. Madariaga if he had experience in new installations and had a more varied background working on different equipment. Mr. Madariaga responded that he did have more experience to provide to the Board.

It was then moved by Mr. Kagawa, seconded by Mr. Lee, and

unanimously carried to change the motion from deny to defer.

a. SCR 84, S.D. 1 – Report of the Contractors License Board

Chairperson Lau announced that the Investigative Committee’s recommended changes to the various contractor licensing classifications was posted on the Board’s website, and the Board will be approving the recommendations of the Investigative Committee today. The Investigative Committee read and considered the oral and written testimonies that were presented to the Board on the different classifications. He also stated that the proposed rule amendments are not set in stone, and can be changed even after the final report is sent to the Legislature. He then asked if anyone from the audience who did not previously submit testimony would like to speak and gave each speaker a five minute time limit.

Mr. Wong of the Ironworkers Local 625 asked if their testimony

submitted in June 2013 will be part of the Board’s final report. Chairperson Lau stated that all testimony received will be attached to the report.

Dwayne Arelliano of the Glaziers Local Union 1889 suggested that

the C-5 follow what California’s C-6 classification covers, which is millwork and cabinet finishing but does not include remodeling. He felt that if remodeling is deleted from the C-5 scope, it will eliminate the issues that have been coming up on the application of the “incidental and supplemental’ definition. Shannon Alivado of the General Contractors Association requested that the draft report not be approved because there is no rationale or justification for the changes being proposed. Executive Officer Oda stated that what is posted online is not the complete report. The Board’s final report will be posted online. Ron Amemiya of the Ironworkers Local 625 stated that the rules process is a precise process that has to be followed, including newspaper publications. He felt the Board did not follow the procedures. The changes the Board is recommending should be done through rule changes and not through legislation, and that any changes to the rules cannot be in violation of the DC 50 and Okada Trucking cases. Deputy Attorney General Tam stated that this is only a report in response to a Resolution passed by the Legislature this past session; it is not an official rule amendment process. Any

amendment to the Board’s rules must be done pursuant to the formal rule making process. After no further comments from the audience, it was moved by Mr. Lee, seconded by Mr. Yamada, and unanimously carried to approve and adopt the recommendations of the Investigative Committee and draft a final report to the Legislature that must be submitted by November 1, 2013.

It was moved by Mr. Akasaki, seconded by Mr. Lee, and unanimously carried to accept the recommendations made by the Applications Committee on items E-1 through E-100.

Randall B. C. Lau, Chairperson a. Interpretation of Section 444-25.7, HRS, regarding the

roofing contractors guarantee bond. This item was deferred for discussion at the last meeting. Gary G. Grimmer & Associates is requesting clarification on whether a bond is required for a manufacturer’s warranty pursuant to HRS section 444-25.7. After discussion, it was moved by Mr. Akasaki, seconded by Mr. Yamada, and unanimously carried that HRS section 444-25.7 addresses guarantees offered by roofing contractors and does not apply to manufacturers’ warranties.
