order at 8:39 a.m. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

Minutes: It was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously

carried to defer action on the July 19, 2013 meeting and executive session meeting minutes to the August meeting.

Amendments to Agenda: It was moved by Mr. Mochida, seconded by Mr. Kamai, and unanimously

carried to approve the following amendments to the agenda: Under “Appearances Before the Board,” add the following: e. Wesley N. Cabreros (Individual) “B” General Building f. Chance M. “Applications Committee Report, Brian J. Presley (Individual).” Chapter 91, HRS, Chairperson Lau called for a recess from the Board’s meeting at 8:40 Adjudicatory a.m. to discuss and deliberate on the following adjudicatory matters Matters: pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractor’s License of Adon Construction Inc.; CLB 2012-184-L

RICO alleges that Adon Construction Inc. (“Respondent”) offered to perform and did perform roof coating and PV installation work, which, if proven at an administrative hearing before the Board, would be in violation of HAR section 16-77-33, out-of-scope contracting.

The Board discussed the settlement agreement in which

Respondent does not admit to violating any law or rule, but agrees to pay a fine in the amount of $500.00.

After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

b. In the Matter of the Contractors’ Licenses of Pacific Islands

Group, LLC, also known as Pacific Islands Construction; Kevin J. Kruszona; Dennis P. Swart; CLB 2012-287-L

RICO received a complaint alleging that Pacific Islands Group, LLC, Kevin J. Kruszona, and Dennis P. Swart (“Respondents”) failed to disclose bond and lien rights to the homeowner.

The Board discussed the settlement agreement in which Respondents do not admit to violating any law or rule, but agree to pay a fine in the amount of $2,500.00.

After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

pursuant to HRS chapter 91, Chairperson Lau announced that the Board was reconvening to its open meeting at 8:41 a.m.

Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:37 a.m., it was moved by Mr. Suehiro, seconded by Mr. Yamada,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:59 a.m., it was moved by Mr. Lee, seconded by Mr. Akasaki, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Lee, seconded by Mr. Akasaki, and

unanimously carried to defer Mr. Madamba’s application for licensure in the “A” and “B” classifications pending additional information/documents on the Romero and Shammath Ltd. Partnership cases.

b. Vince S. Tanaka, RME Alternate Energy Inc. (Additional classification) C-52 Ventilating & air conditioning

Executive At 10:00 a.m., it was moved by Mr. Yamada, seconded by Mr. Suehiro, Session: and unanimously carried to enter into executive session pursuant to

HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited

At 10:14 a.m., it was moved by Mr. Lee, seconded by Mr. Yamada, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Matsuzaki, seconded by

Mr. Kagawa, and unanimously carried to deny Mr. Tanaka’s application for licensure in the C-52 classification.

When the reasons for the denial were explained to Mr. Tanaka, he stated

that he worked for past employers and may have the varied experience the Board is looking for.

It was then moved by Mr. Matsuzaki, seconded by Mr. Mochida, and

unanimously carried to change the previous motion from deny to defer pending additional information from Mr. Tanaka.

c. Antonio A. Leal (Individual) (Additional classification) “B” General Building Executive At 10:25 a.m., it was moved by Mr. Mochida, seconded by Mr. Kamai, Session: and unanimously carried to enter into executive session pursuant to

HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:35 a.m., it was moved by Mr. Akasaki, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Matsuzaki, seconded by Mr. Kamai,

and unanimously carried to defer Mr. Leal’s application for licensure in the “B” classification pending additional “ground-up” projects.

unanimously carried to defer Mr. Hale’s application for licensure in the “B” classification pending the submittal of additional information.

e. Wesley N. Cabreros (Individual) “B” General Building Executive At 10:55 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, Session: and unanimously carried to enter into executive session pursuant to

HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. At 11:03 a.m., it was moved by Mr. Yamada, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

and unanimously carried to approve Mr. Cabreros’ application for licensure in the “B” classification.

h. Patrick Schellerup, RME Kamana O’Kala, LLC “B” General Building Executive At 11:39 a.m., it was moved by Mr. Kagawa, seconded by Mr. Lee, Session: and unanimously carried to enter into executive session pursuant to

HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. and unanimously carried to allow Mr. Schellerup to withdraw his

carried (Mr. Kamai recused himself) to approve conditional licenses for Makena Homes LLC/Charles B. Gierhart, RME; and unanimously carried to approve Mosese H. Heimuli; State Wide Plumbing Inc./John E. Spencer, RME; Epicenter Technologies Inc./Brian T. Yahata, RME; and Joseph M. Pavon for conditional licenses, subject to quarterly reports or updates on financial information; and defer consideration of a conditional license for Birdseye Construction Pools & Landscape LLC/Christopher D. Birdseye, RME, pending additional financial information.

The agenda was taken out of order and continued with “Committee

motion was made by Mr. Lee, seconded by Mr. Akasaki, and unanimously carried to approve the following:

After discussion, it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to defer Mr. Presley’s application for licensure in the “B” General Building classification pending additional information.

Arnold Wong, on behalf of the Ironworkers Stabilization Fund, asked to

tape the meeting, which Chairperson Lau consented to the request. The agenda continued with the rest of the Committee Reports. Committee 1. Examination Committee: Reports: Guy Akasaki, Chairperson

The Contractors Examination Summary for July 2013 was distributed in the Board’s packet.

2. Recovery/Education Fund Committee: None. 3. Legislation Committee: Peter Lee, Chairperson

None.

4. Rules Committee: Randall B. C. Lau, Chairperson

Chairperson Lau informed everyone present that the last Rules Committee meeting regarding SCR No. 84 (2013) will be held at 1:00 p.m. today. Chairperson Lau stated that additional comments will be taken at that meeting, and requested that only one representative testify for each group. In order for the Board to complete their report by November 1, 2013, he appointed the following six members to serve on an Investigation Committee pursuant to HRS section 92-2.5: Gerald Yamada and himself (general contractors); Kent Matsuzaki and Guy Akasaki (specialty contractors); and William Kamai and Peter Lee (public members). The purpose of the Committee is to investigate and discuss the matters raised in the Resolution, and make recommendations to the Board at a future Board meeting.

It was moved by Mr. Suehiro, seconded by Mr. Konishi, and unanimously

carried to approve the above members to serve on the Investigation Committee.

requests a determination that a contractor’s license is not required to install storage racks to the ceilings of garages and carports using either lag bolts or self-tapping screws. Mr. Cooney feels that this falls under the exemption of section 444-2(3) for the installation of finished products that are not fabricated into or become a permanent fixed part of the structure, as the racks are easily removed.

Mr. Cooney stated that he does not do any modifications to the ceilings or

rafters. The work involves installing storage racks to the ceilings of garages and carports using either lag bolts or self-tapping screws.

Recommendation: The C-25 Institutional and commercial equipment

license classification is required to install ceiling hung storage racks. Ka’eo Gouveia Mr. Gouveia requested a determination on whether “outside plant

telecommunication work” may be performed under the C-15b Telecommunications classification. The work involves the placement and removal of telecommunication cables and their supporting structures, including the installation, maintenance and removal of poles, cross arms, anchors, down guys, and aerial or underground OSP telecommunication cables; and also placing access point cabinets, fiber distribution hubs, and other equipment; OSP copper and fiber optic splicing; line conditioning; grooming; and cable loading.

The Board deferred Mr. Gouveia’s inquiry at the July 19, 2013 meeting for

additional information on the supporting structures. Mr. Gouveia provided drawings, and stated that they will remove/install associated manufacturer designed supports to secure telecommunication cables, including the following support structures: steel messengers, suspension clamps, down guys, anchors, cross arms, telecommunication cabinets/terminals and associated hardware, and stansion/racks. They will not be doing any conduit or electrical cabinet work.

Recommendation: The telecommunication cabling work may be

performed under the C-15b Telecommunications classification; pole and guy work may be performed under the C-62 Pole and line classification; trenching work for underground cabling may be performed under the “A”

City and County of Honolulu The City and County of Honolulu requests determination on license

classification required to install steel channel shelf extensions for the seismic retrofit project to Paakea Road Bridge No. 809. Triton Marine Construction Corp. indicated that these are stand-alone items and typically installed during the course of the concrete construction, similar to steel nosing for expansion joints, weld plates for handrail attachments, and armor edging for corners.

Joseph O’Donnell of the Iron Workers Local 625 testified that it appears

that they are structural and load bearing items, and therefore felt the C-48 Structural steel license is required.

After brief discussion, the Board felt additional information was required, such as the plans and specifications, in order to make a determination.

Johanson Contracting, Inc.

Johanson Contracting, Inc. requests determination on whether the removal of trees blocking the fence line for the Kamehameha Schools Pu’u Kali’u fencing projects may be performed under their “A” General Engineering license.

After brief discussion, the Board felt additional information was required, such as copies of plans, specs, and/or drawings of the project, and specifics on what tree removal/trimming techniques will be utilized, including necessary equipment, and the project cost estimates, including a breakdown for the tree removal work, if available. After discussion, it was moved by Mr. Suehiro, seconded by Mr. Lee, and unanimously carried to defer the City and County of Honolulu and Johanson Contracting, Inc.’s requests pending additional information, and approve the scope recommendations for Advanced Overhead Storage of Hawaii, LLC and Ka’eo Gouveia.

It was moved by Mr. Suehiro, seconded by Mr. Yamada, and unanimously carried to accept the recommendations made by the Applications Committee on items E-1 through E-121.

Sandra Roberts, as a condo owner, informed the Board about problems

they were having with unlicensed contractors who allegedly took money for work they did not start or finish. Therefore, she had requested that the applications be open for the public to review and was glad that an Investigation Committee was formed for this.

Chairperson Lau explained that the Investigation Committee was formed

to gather information for the Board’s report on SCR 84 due to the Legislative Reference Bureau by November 1, 2013. It was also explained to Ms. Roberts that the Board reviews applications based on the experience information, notarized documents, and financial information presented to them, some of which are considered confidential information. Complaints on contractors and unlicensed activity should be filed with the Regulated Industries Complaints Office.
