PC 09 09 Mike Fitzsimmons and Sons Feedlot 08 05 09 CONDITIONAL USE PERMIT TO CONSTRUCT THREE MANURE STORAGE STRUCTURES AT AN EXISTING FEEDLOT FACILITY NO INCREASE IN ANIMAL UNITS IS PROPOSED THE FEEDLOT SITE IS LOCATED IN THE NE 1 4 OF THE NW 1 4 OF SECTION 1 LYRA TOWNSHIP Applicant Mike Fitzsimmons and Sons 56437 l64th Street Good Thunder MN 56037 Request To construct three manure storage structures each measuring 72 feet in diameter and 44 inches deep at an existing feedlot LAND USE INFORMATION Location Part of the NE 14 of the NW 14 of Section 1 Lyra Township Zoning The feedlot is located in the Agricultural Zoning District The feedlot meets the minimum standards for all setbacks Land Use Plan The Conditional Use is consistent with the goals and policies established in the Blue Earth County Land Use Plan for the Agricultural Zoning District Existing Land Use Mile North 1 64th Street a Township Road and cropland Northwest One residence owned by one of the applicants at approximately 1300 feet South Cropland East Cropland and one residence with a feedlot at 1 800 feet West Cropland one residence with a feedlot owned by one of the applicants one residence with a feedlot at 1 900 feet and two other residences at 2 100 and 2 650 feet Description of Existing Facility and Proposed Expansion The existing facility consists of five total confinement swine barns that house a total of 4 000 nursery pigs The proposal is to construct three steel ring structures measuring 72 feet in diameter and 44 inches tall Each structure will be lined with a composite liner Design plans have been submitted to and approved by the MPCA The structures will be used to temporarily store liquid swine manure that is removed from deep pitted swine barns The manure will go through a compo sting process and stored for later use The product may be used as a starter fertilizer or be applied to actively growing crops during the months of July and August 1

Access RoadAn existing driveway provides access to and from Township Road 164th Street No

change is proposed to this access

MANURE MANAGEMENT The applicants have ahistory ofworking with a certified

crop consultant on manuremanagement 100 percent ofthe manure ownership is transferred

Manure transfer records have been and will continue to be provided to the recipient s ofthe

manure and maintained for review by the county feedlot officer

Nearly level poorly drained soils with adepth to the seasonal high water table of 1 to 3

There are no rivers streams lakes ditches or wetlands within 1 000 feet ofthe proposedbarn

Flood PlainThe proposed facility is not located in a flood plain

Tile Inlets

Open tile intakes are located within 1 000 feet ofthe feedlot site

Depth to Bedrock

Depth to the bedrock is approximately 150 feet according to the Geologic Atlas for

Blue Earth County

Well

An existing well serves the site and will be located aminimum of 100 feet from the

proposed structures

Potential for Run Off

The Minnesota Pollution Control Agency requires acover for newly constructed liquidswine manure storage structures The manure will be added to the pit manually As a

result the risk ofrunoff is minimal In the event ofan emergency the applicants do

have manure handling equipment that can be used to transfer manure to other storagestructures i e deep pitted swine barns located on site

Lyra Township Review In an e mail dated March 26 2009 the Township Board indicated

no problem with the request

Blue Earth County Environmental Health Review

General As long as there are no impacts to the septic system and to the well setbacks this

project appears to have no environmental health impacts to the propertySeptic System There is a current septic system mound drainfield installed in 2002 servicingthe house

Water Wells There is at least one water well servicing the property The location ofthe

storage structures must be at least 100 feet form the closest point ofany well

Wetlands Within the property boundaries there are no apparent wetlands

OPINIONSBased on the information submitted by the applicant as required in Sec 24 466 Subpart a

Findings Required ofthe Blue Earth County Land Use Ordinance the following opinionshave been developed for this request

1 That the proposed use conforms to the county land use plan

2 The demonstrated need for the proposed use

3 That the proposed use will not degrade the water quality ofthe county

4 That the proposed use will not adversely increase the quantity of water runoff

5 That soil conditions are adequate to accommodate the proposed use

6 That the proposed use does not create apotential pollution hazard

7 That adequate utilities access roads drainage and other necessary facilities have been

or are being provided That adequate measure has been or will be taken to providesufficient offstreet parking and loading space to serve the proposed use

9 That facilities are provided to eliminate any traffic congestion or traffic hazard which

may result from the proposed use

10 That the conditional use will not be injurious to the use and enjoyment ofother

property in the immediate vicinity for the purposes already permitted

11 That the establishment of the conditional use will not impede the normal and orderly

development and improvement of surrounding vacant property for predominant uses

in the area

12 That adequate measures have been or will be taken toprevent or control offensive

odors fumes dust noise and vibration so that none ofthese will constitute a

nuisance and to control lighted signs and other lights in such amanner that no

disturbance to neighboring properties will result

RECOMMENDATIONStaff recommends approval for Conditional Use Permit PC 09 09 to construct three above

ground manure storage structures at an existing feedlot contingent upon the followingconditions

1 That the manure storage structures conform to the site plan attached to this report PC

09 09 and with the plans submitted to the MPCA

2 That the feedlot be located on asingle legally described parcel consisting ofaminimum

often contiguous acres The parcel shall be aparcel ofrecord properly recorded in the

Blue Earth County Land Records Office

3 That the applicant obtains aBlue Earth County Construction Permit and an MPCA

Construction Short Form Permit before construction begins and within one year from

the date the County Board ofCommissioners approves the Conditional Use Permit

4 A manure management plan meeting the MPCA s requirements for the transfer of

manure shall be maintained This plan must be reviewed by the operator each year and

updated each year and adjusted for any changes in the amount of manure productionmanure nutrient test results or other practices which affect the available nutrient

amounts or crop nutrient needs on fields receiving manureas required by the MPCA

Records ofmanure transfer shall be maintained as required by the MPCA Manure

application setback standards for the fields on which the manure is applied shall be

followed as required by the MPCA and the County

5 That all manure storage structures must be designed by a registered engineer accordingto MPCA requirements A copy ofthe designed plans and soil investigation report must

be submitted to Blue Earth County Environmental Services prior to the issuance ofa

construction permit

6 That the applicant will furnish a final construction report to Environmental Services

verifying that the concrete manurestorage structure was constructed per approvedengineered design plan within 60 days ofcompletion of any new or modified manure

storage area Said construction report shall be signed by the design engineer

7 That the proposed structures shall be located a minimum of 100 feet from any water

supply well a minimum of20 from the septic mound and a minimum of 10 from the

septic tank
