I see where you stated that you lack jurisdiction over Judge Loy but you felt he did not violate Rule 2.11(A) after you spoke with Judge Loy. I thought that Rule 2.11(A) had to do with an "ORDER"I received in case number 2012LM356P where Honorable Wachter was disqualified out of that case and the reason stated was for 2.11(A): Ajudge shall disqualify himself or herself in any proceeding in which the judge's impartiality might reasonably be questioned ... In that "ORDER"it says that the standard of review of rulings on disqualifications of a judge are stated in Smith v. Printup, 262 Kan. 587, 1997, at SyI.8: "The standard to be applied to a charge of lack of impartiality is whether the charge is grounded in facts that would create reasonable doubt concerning the court's impartiality, not in the mind ofthe court itself, or even necessarily in the mind of the litigant filing the motion, but rather in the mind of ~ reasonable person with knowledge of the circumstances." Judge Lynch states in this "bRDER" However, Judge Wachter's or this court's satisfaction that he could rule impartially does not resolve the case.     I have received your letter dated December it 2014 regarding my complaint againstRobert Tomassi and Mark Werner.     I see that you wrote where Judge Loymeant he did not accept the law assignment cases offormer law partner Kip Sagehorn because he has continued business dealings with Mr.Sagehorn and feels it would be inappropriate for him to hear cases involving Mr.Sagehorn.

  • I have included with this complaint a copy of Judge Loy's Judicial Financial DisclosureReport for 2013 from a court order in case number 2014CV7P and on the first page ofcompensation he lists first "Loy & Sagehorn, LLC"Jan-Dec 2013 and then on the same pagelower he lists "Loy, Sagehorn & Harding, LLC"Nov-Dec 2013 which would prove that he isalso in "continued business dealings with Mr.Burton Harding as well and he is currentlyhearing the case of 2014LMSSP where attorney Burton Harding is the attorney in the caseand that should violate KRPC Rule 1.7(b), KRPC Rule 4.4, and KRPC Rule 8.3(b) for notreporting Judge Loy when he knew it was inappropriate as an economic conflict ofinterest for Judge Loy to hear his case and lie about it. I would also feel that Kip Sagehornhas violated the rules of KRPC as well since he is the attorney in case number 2014LM409Pand the judge is in fact "Kurt Loy" and Mr. Sagehorn failed to report him for beinginappropriate by hearing his case and that should violate KRPC Rule 8.3(b).

    I also would like to make a complaint against Kurtis Loy for when he was an attorney in2008 because he was going in front of Judge Gariglietti and they played golf together asprivate members of the "Crestwood Country Club" as Gargilietti was in the A flight and KurtLoy was in the B flight. Their wives also worked as directors at Coldwell Banker and I haveincluded that for you to view as well to see if that was economically inappropriate as wellsince their wives would have "continued business dealings". I haven't seen anywherethat there is a statute of limitations on inappropriate issues of misconduct so that is why Iwould like to bring up the issue of Mr. Loy as an attorney in 2008. Judge Loy made a rulingin case number 11DM136P "which I have included with this complaint "where he recuseshimself for All Star baseball with his son over 24 years ago under what I would assumewould be Rule 2.11(A) as I don't see anything specifically referring to All Star baseball as areason to disqualify yourself from a case. I noticed how you pointed out to me under Rule2.11(A)(S) that nothing specific under that rule applied, however if recreation all starbaseball with Judge Ley's son over 24 years ago is a conflict of interest then surelyrecreation golf at a private club 7 years ago with the judge of your cases and your wivesmake money together as workers at "Coldwell Realty" it would seem to me to be more of aconflict than youth all star baseball 24 years ago but I don't always interpret the statutesand court rules the correct way since I am not an attorney and that is why I would like youropinion on these issues that I think are inappropriate.

    I understand that you don't have jurisdiction over judges and just attorneys and that is whyI have also filed a another complaint against Honorable Loy with "THE KANSASCOMMISSIONON JUDICIALQUALIFICATIONS" for newer issues. I will mail a copy of thiscomplaint to "THE KANSASCOMMISSION ON JUDICIALQUALIFICATIONS" along with yourletter back to me to show that Honorable Loy once again seems to be telling a lie as casenumbers 2014LM55P and 2014LM409P show that Sagehorn and Harding both are infront of Judge Loy and for some reason they both did not report Judge Loy under Rule

  • 8.3(b). I would like for you to investigate Rule 8.3(b) and any other rule under KRPC thatMr. Harding and Mr. Sagehorn could have possibly violated that I am not aware of.

    Please consider this reply to the "Werner & Tomassi" letter dated December 11, 2014 my"INITIAL COMPLAINT" against attorneys Kip Sagehorn and Burton Harding of 112 W. 4th inPittsburg Kansas. It also seems to be a concern to me that Judge Loy does not list anymoney on his financial disclosure report form for the "buyout of his former law practice"and the amount that he was paid by Mr. Sagehorn and Mr. Harding to use the name of "Loy"with their firm. I know that the name "Loy" has been associated in Pittsburg around law fora very long time and probably comes with a price just like an "Applebees" would charge fortheir franchise name compared to starting your own original clientele, original restaurant,and original name.

    I don't know if Judge Kurtis Loy was paid money for a buyout from "Sagehorn andHarding" and just forgot to properly list the money and fill out the financial disclosurereport under Rule 3.12,3.13,3.14, and 3.15 or ifhe is currently still a partner and that'swhy he did not list any money on the buyout. I also don't know if it is a conflict of interestfor yourself Mr. Hazlett to investigate this matter or if you have to have someone else takethis complaint since Judge Loy lists on his financial disclosure report form that he holds thecurrent position of Trustee with the Kansas Bar Foundation and "Chairman Fee DisputeResolution Committee" with the Kansas Bar Association at 1200 SW Harrison, Topeka and Ihad my complaint on Fee Disputes mailed back to me a couple weeks ago in case number2012LM356P.

    Thank you for taking the time to respond to me and explain why Mr. Tomassi and Mr.Werner did not violate Rule 1.7(b) and 4.4 and Iwould appreciate another determinationon my allegations in this complaint as well.

    P.S. It states under the "Commentary" of the old "RULES RELATINGTO JUDICIALCONDUCT" "Under this rule, a judge is disqualified whenever the judge's impartiality mightreasonably questioned, regardless whether any of the specific rules in Section 3E(1) apply"and 3E(1) is the same as the new Rule 2.11(A).

    arguments he may have had. Judge Wachter then fairly applied the law and rendered

    appropriate rulings.

    The standard of review of rulings on disqualification of a judge are stated in Smith

    This court is satisfied that a jurist of Judge Wachter's experience can easily put

    aside any prejudice he may have against the defendant and decide the case only on the

    law and the evidence. This court is satisfied that it could do the same under similar

    circumstances. This court is satisfied that most if not all1awyers who practice before

    Judge Wachter would be satisfied of the same.

    However, Judge Wachter's or this court's satisfaction that he could rule

    impartially does not resolve the case. . The issue is the appearance to a "reasonable

    person with knowledge of all of the circumstances", Such a person might welJ question

    the ability of a judge to be impartial under the circumstances.
