Case No. 2287 – 5410 Broadway Application of Alonzo C Alston, RA, NCARB, of Sol Studio Architects, LLC, applicant, representing Luis Dengeville Oseguera Kernion of Prize Permanent Holdings LLC, owner, requesting the following variance(s) in order to demolish the existing commercial building and construct a new commercial building with parking at the property located at 5410 Broadway, zoned B-1:
1. The proposed overall height of twenty-two (22) feet instead of the minimum twenty-eight (28) feet required per Section 3-68(2),
2. No landscape areas provided along the rear instead of the minimum 8ft wide required per Section 3-70(1), and
3. Zero (0) canopy street trees proposed for planting at lot frontage instead of the minimum three (3) required per Section 3-70(3) of the City’s Zoning Code.

Dear CSD,
Introduction: Request Variance for the LOK Properties Broadway Project listed above.
• Code Issue and Justification for Exemption: Unified Development Code (UDC) Minimum Building Height Requirement Sec. 3-68. Existing adjacent structures (including the historic Magnolia Petroleum Station at 5424 Broadway) massing’s are currently below the minimum 28’ building height. We believe the height and proportion of the proposed building (22’-0) will better suit the current context of the surrounding buildings.
• Code Issue and Justification for Exemption: Unified Development Code (UDC) Street Trees Requirement Sec. 3-50. Due to the lot size and minimum parking ratio required for the building use the best location for the minimum required trees is at the rear of the building to screen the parking spaces. In lieu of trees the design team is proposing to place a generous landscape bed along the Broadway street frontage to coincide with the adjacent existing buildings and proposed architecture of the building.
• The Owner of the property has taken all practicable measures to minimize any adverse impacts on the public health, safety and public welfare with regard to all other aspects to the property improvement.
As required by the UDC for Variances:
• If the applicant complies strictly with the provisions of these regulations,
he/she can make no reasonable use of his/her property; and
• The hardship relates to the applicant's land, rather than personal circumstances; and
• The hardship is not the result of the applicant's own actions; and
• The granting of the exception/variance will not be injurious to other property and will not prevent the orderly subdivision of other property in the area in accordance with these regulations.
• Conclusion: Provide a summary statement such as “In our professional opinion, the proposed variance remains in harmony with the spirit and intent of the UDC as it will not adversely affect the health, safety, or welfare of the public”.
