Every day, GBLS provides our clients with what should be a basic right: access to justice. This year GBLS staff continues to do terrific legal work helping to make the justice system fair and accessible to all. We prioritize our services to the most vulnerable members of our community. GBLS helps people to solve problems. We help people to grasp a real opportunity to help themselves by working to remove barriers to economic and family stability.

OUR MISSION

Greater Boston Legal Services’ (GBLS’) mission is to provide free civil legal aid to help individuals and families achieve justice and meet their basic needs, such as food security, safety, and adequate shelter. GBLS helps vulnerable individuals and families retain affordable housing, gain protection from domestic violence, access subsistence income for food and necessities, access health care, and recover earned wages. GBLS accomplishes these goals through both individual representation and impact advocacy, working closely with a wide network of community partners. GBLS’ philosophy is that justice should be for all people, not just those with the financial means to pay.

GBLS’ advocacy on behalf of low-income workers includes cases involving: wrong-ful denial of unemployment benefits; violations of wage laws (such as nonpayment of overtime) resulting in wage theft; and tax controversies related to employment income or problems receiving the Earned Income Tax Credit (EITC), through the Low-Income Taxpayer Assistance Project. GBLS also advocates for changes to laws, policies, and regulations negatively affecting low-wage workers, working close-ly with — and representing — many different community-based organizations and partnering with a wide range of worker and immigrant rights advocacy organizations, government agencies, unions, members of the private bar, and law schools.

In 2015 GBLS attorneys obtained an increase in the Massachusetts Earned Income Tax Credit (EITC) from 15% to 23% of the Federal EITC and successfully advocat-ed for a bill amending parents’ rights to unpaid, job-protected leave for the birth or adoption of a child, requiring employers to inform employees in writing prior to their leave that if they take leave beyond the eight weeks, this ends their right to return to work.

GBLS provides legal assistance to low-income survivors of domestic violence (DV) to ensure that their rights and their safety are protected and to restore them and their children to an economically-sustainable life free of abuse. GBLS provides individual representation in divorce and paternity actions and to obtain child support, custody, visitation, and restraining orders; legal counseling to victims who seek to relocate due to family violence and legal technical assistance to the agencies that provide services to these victims; and advice on legal issues related to the relocation of DV victims and victims and witnesses of crime.

Staff provide on-site advocacy at two probate and family courts to assist victims with abuse prevention orders and emergency matters, and provide assistance to DV vic-tims through GBLS’ innovative hospital/health center outreach projects. GBLS also addresses broader legal and public policy issues that perpetuate domestic violence and obstruct the road towards physical and emotional well-being and economic in-dependence for survivors.

GBLS provides legal assistance to low-income individuals of all ages with disabilities and other health challenges to promote access to and retention of quality, affordable, and accessible health care and coverage, disability benefits, Medicare/Medicaid, Social Security, and Supplemental Security Income (SSI). GBLS also represents vul-nerable clients in nursing home eviction cases. The School to Prison Pipeline Inter-vention Project represents Boston-area children facing life challenges, ensuring that they are receiving the trauma-informed treatment they need so they can learn and stay in school. Community partnerships are a mainstay of our health and disability work, enabling us to expand our systemic advocacy efforts that include ensuring access to health care for all age groups, ensuring the rights of isolated nursing home residents, improving access to hospital and transportation services for people with disabilities, and guardianship reform.

One significant achievement in 2015 followed MassHealth’s notification to 300,000 members in January 2015 that they must reapply by March of that year or lose cov-erage, and 150,000 people lost their benefits. GBLS and allies worked to gain an extension from MassHealth allowing more members to re-enroll.

Elizabeth has a serious illness, which causes nausea, vomiting, and abdominal pain. After years of unsuc-cessful treatment, her doctors found a medication which successfully treated her symptoms. Her insur-ance paid for this medication. However in 2014, when she became Medicare eligible and enrolled in a Medi-care drug plan, Medicare denied coverage for the pre-scribed medication. Medicare based its decision on Elizabeth not having cancer and using the drug “off-la-bel.” Medicare (unlike commercial insurance) restricts coverage of off-label uses to diagnoses which are list-ed in one of three drug compendiums. Medicare did this by narrowly interpreting the law governing Medi-care coverage. GBLS Senior Attorney Nancy Lorenz took the case to the United States District Court, ar-guing against Medicare’s narrow interpretation. Judge Young issued a decision in which he complimented the lawyers, saying: “The parties’ briefing here reflects conscientious lawyering.” He then went on to explicit-ly adopt Nancy’s key argument that when care is pal-liative, approval for the drug should be linked to the symptoms being treated and not the diagnosis. This is a major victory not only for Elizabeth, but for other Medicare beneficiaries who are denied coverage for medically necessary off-label drugs.

GBLS helps low-income tenants gain and preserve access to affordable housing; helps tenants and former owners of foreclosed properties pursue affordable purchas-ing options; defends homeowners who were victims of predatory and discriminato-ry lending practices; obtains and preserves shelter for homeless families and helps them obtain permanent, affordable housing; advocates for domestic violence victims to protect their housing options; assists tenant associations to understand housing policies and change unfair policies; and preserves affordable units at risk of being lost to market rates. GBLS works with a wide range of affordable housing advocacy groups, and advocates for changes to agency rules and regulations, as well as legis-lative action and reform.

In 2015 GBLS attorneys achieved a major victory at the Massachusetts Supreme Judicial Court in Pinti v. Emigrant Mortgage Co., creating significantly greater pro-tections for homeowners facing foreclosures; with City Life/Vida Urbana won from a major corporate investor a series of multi-year leases at an affordable rent with an-nual increases capped at 3%; and won a discrimination case at the Massachusetts Commission against Discrimination on behalf of seventeen Latino homeowners who gave an attorney money for loan modifications they never received.

A Weymouth family whom GBLS had been representing for over five years was able to buy their home back from Freddie Mac for over $100,000 less than the original mortgage. They had fallen behind on their mortgage while steeped in grief following the sudden death of their 2-year-old son, but were denied a loan modification. Following the foreclosure on their home, they kept fighting with help from GBLS who represented them in the eviction case. They were able to buy their home back, get the eviction case dismissed, and were also awarded $25,000 in damages in the settlement. After regaining ownership, the father in the case emailed one of his GBLS attorneys: “I truly do not know how to thank you. When I get back down to earth because I still can’t believe this happened I will be in contact to see how I can help the next person in line that was just like me.”

GBLS provides legal representation to and advocates on behalf of low-income im-migrants. We prioritize cases of individuals and families seeking permanent refuge and safe haven, individuals subjected to domestic violence and sexual assault, and unaccompanied children. GBLS represents clients in cases before the U.S. Depart-ment of Homeland Security, U.S. Immigration and Customs Enforcement, the U.S. Department of Justice, and federal courts. GBLS responds to crises affecting the rights of immigrants as they arise, and advocates for law reform and systemic chang-es to secure and expand the right to asylum, withholding of removal and relief under the United Nations Convention against Torture. Staff coordinate GBLS’ immigration work with local, national, and international immigrant rights, civil rights, and human rights networks.

GBLS represents poor individuals and families to help them access and retain financial assistance, Food Stamps (SNAP), child care, and related benefits. GBLS seeks to ensure that our clients are pro-vided with adequate notice of decisions, timely decisions on requests for assistance, and timely receipt of benefits. Staff engage in direct referral of cases from Boston homeless family shelter providers and education and training providers. GBLS provides training on public benefits to partner organizations. GBLS also works to reduce systemic barriers to public benefits by advocating for changes in state laws and in state and federal policy and practice.

In 2015 GBLS’ successful advocacy included persuading the Department of Transitional Assistance Commissioner to delay implementation of harmful regulations. These include a major change that would make it much harder to qualify for a Transitional Aid to Families with Dependent Children disabili-ty exemption, and a new barrier to parents’ ability to apply for a disability exemption.

GBLS started the CORI & Re-entry Project in 2009 in response to numerous requests for help with the devastating effects of criminal records for individuals seeking a path to a better life and getting out of poverty. The project helps individuals in Boston’s poorest communities seal their criminal records; overcome barriers to employment, housing, benefits, education, and other opportunities; and learn about their rights as a result of CORI reform that took effect in May 2012. The project provides legal ad-vice, does intake at the Roxbury and Dorchester divisions of the Boston Municipal Court, and represents clients, one of whom expresses her thanks below. The project also engages in systemic law reform advocacy. GBLS is the only legal aid program in Massachusetts with a large-scale volume practice of CORI clients. The project is funded in part by the Gardiner Howland Shaw Foundation and Equal Justice Works.

Since 2015, attorneys and staff from the Boston offices of DLA Piper have given a helping legal hand to low-income tenants facing eviction. Going into housing court without a lawyer (pro se) often ends in eviction — no matter what the circumstances might be. GBLS runs a weekly clinic to provide information and assistance to clients who will be defend-ing their tenancy pro se, and DLA Piper has increased GBLS’ capacity by running another clinic once a month. “The training by [GBLS attorneys] Jay Rose and Barbara Zimbel as well as the mentoring by [GBLS attorney] Mac McCreight is very thorough,” says Geoff Howell, DLA Piper partner and GBLS Board member. Thanos Matthai, a DLA Piper asso-ciate, adds, “It gives us the chance to work with colleagues in different practice groups with whom we don’t normally work. We also know that by running the clinic, DLA Piper gives GBLS attorneys more time to work on their cases and other matters and we are glad to contribute in that way.”
