FULL-TIME PAS-LEVEL APPOINTMENT PROCEDURE

I. Candidate Selection

Four of Presidential Personnel's Associate Directors are responsible for searching for candidates to fill specific positions in those departments and agencies in his or her areas. The areas are: National Security, Legal and Financial, Human Resources, and Energy, Environment and Transportation. In searching for candidates, the Associate takes into consideration the qualifications of each candidate, as well as his philosophical and political commitment to the President and the policies of his Administration. A fifth Associate Director is responsible for part-time Boards and Commissions.

Personnel Committee/Presidential Approval

Once a final candidate has been selected for a position, and after a final interview with the Director, the name and qualifications are presented to the Personnel Committee. During the past two years, this Committee was chaired by the Chief of Staff and the members were the Director of Presidential Personnel, the Assistants to the President for Political Affairs and Legislative Affairs, and the Deputy to the Chief of Staff. (Names of candidates for national security-related positions are reviewed by the National Security Advisor.) On the following day , the candidate's name and qualifications are presented to the President for his approval by the Director of Presidential Personnel and the Chief of Staff.

Clearance Process

After the candidate has been approved by the President, the Director of Presidential Personnel notifies him of the President's decision, and he is then put into the clearance process. This involves a security investigation handled through the White House Counsel's Of f ice (this investiga­tion normally takes six to eight weeks) , and a legislative clearance handled through the Office of Legislative Affairs.

Press Announcement

After the Director is informed of Legislative and White House Counsel approvals, the Office of Presidential Personnel notifies the Press Office of the President's intent to make the appointment or nomination.

A memorandum from the Director to the Staff Secretary and Deputy Assistant to the President notifies him that the announcement is to be made the following day. Courtesy copies of this memorandum are sent to Legislative Affairs and the White House Counsel to notify them that the announcement will be made.

The press announcement indicates whether it is an "intent to appoint" (does not require Senate confirmation) or an "intent to nominate" (requires Senate confirmation).

After the press announcement has been made, the Executive Clerk is notified by the Director to begin preparing the formal appointment document. If it is a Presidential appointment (not requiring Senate confirmation) a Commission of Appointment is prepared for the President's signature. If it is a Presidential nomination (requiring Senate confirmation) , the Clerk prepares the formal nomination document that goes to the Senate.

II. Judicial Selection

Judicial candidates are recommended to The White House Judicial Selection Committee by the Justice Department. The Selection Committee consists of the Attorney General, the Assistants to the President for Legislative Affairs and Political Affairs, and the Director of Presidential Personnel, and is chaired by the Counsel to the President. The Committee meets regularly to select final candidates for recommendation to the President.

Ambassadorial Selection

The Ambassadorial Selection Committee consists of the National Security Advisor, the Deputy Secretary of State, and the Director of Presidential Personnel and is chaired by the Chief of Staff. They meet to discuss candidates proposed by the Department of State (career Foreign Service Officers) and Presidential Personnel (political candidates). The Director of Presidential Personnel presents the candidates for Presidential approval at the next regularly scheduled Personnel meeting with the President •

The Director of Presidential Personnel presents the Ambassadorial candidates for Presidential approval at his next regularly scheduled meeting with the President.

It should be noted that currently the percentage of non-career Ambassadors is higher than at any time since the Truman Administration. (This is a source of great satisfaction to the Director of Presidential Personnel and a source of consternation to the Department of State.)

The clearance process for Judges and Ambassadorial candidates differs from the clearance process described above. (The Department of Justice initiates background checks on Judicial candidates and requests ABA review and rating prior to Legislative and White House Counsel review. Ambassadorial candidates' clearances are handled by the Department of State; Legislative clearances by The White House.)
