RECOMMENDATION(S}

That the CRA/LA Board of Commissioners ratify actions taken by the Transportation Committee and City Council (Council File 1 0-2277) approving the City's final list of projects and authorizing applications to be submitted for the 2011 MTA Call for Projects.

That the CRA/LA Board of Commissioners, subject to City Council approval:

1. Authorize the Chief Executive Officer (CEO) or designee to execute necessary grant agreements (Memorandums of Understanding or Letters of Agreement) with the Los Angeles County Metropolitan Transportation Authority (LACMTA) for the acceptance and conveyance of any awarded funds;

2. Authorize the CEO or designee to execute necessary agreements and/or amendments with the Public Works Department for conveyance of awarded funds through master agreements with the State of California for this Call for Projects and successor Calls for Projects;

3. Authorize the CEO or designee to execute necessary agreements and/or amendments with the Los Angeles Department of Transportation (LADOT) for any local matching funds that may be allocated by that department from City accounts for this Call for Projects and successor Calls for Projects; and

4. Authorize the CRA/LA to amend the budget for those Project Areas that are awarded MTA Call for Projects funds to recognize receipt of the applicable grant funds in the year in which they are received.

The CRA/LA Board of Commissioners is being requested to ratify actions taken by the City Council authorizing the submission of eight CRA/LA grant proposals into the 2011 MTA "Call for Projects" competition for discretionary regional transportation funds (Attachment A - Council Action). The grant requests for all of CRA/LA's eight projects would be $14,462,000, supporting $29,290,000 in programming. Should MTA award grant funding to any of CRA/LA's proposals, CRAJLA will need to provide between 20 and 87 percent of the total project cost as matching funds (Attachment B- CRAJLA 2011 MTA Call for Project Submissions). Overall, CRA/LA's matching funds commitments total $14,328,000.

The funding that would be awarded from the 2011 MTA Call for Projects would first be made available for grantee programming and expenditure in FY2016 and FY2017. Program delivery would have to be completed no later than June 2019.

Most of the grant funds awarded by MTA will be federal transportation monies which must first flow to the Board of Public Works under the City's Master Agreement with the State Department of Transportation (Caltrans). In order for Public Works to convey federal and state grant fund reimbursements to CRAJLA, CRA/LA needs to execute and keep current a cooperation agreement with Public Works. The cooperation agreement that has been in operation has expired and a new agreement needs to be put in place. For this reason, authority is being requested for the CEO to take the necessary actions to execute and keep current a new cooperation agreement in order to provide for the continued conveyance of previously awarded grant funds and for prospective awards from the 2011 and future MTA Calls.

In addition to the grant funds awarded by MTA in the Call for Projects, CRA/LA has also been eligible, where deemed appropriate, to draw upon City fund accounts to help meet the matching fund requirements for MTA grant applications. In the past, CRA/LA projects were able to benefit significantly by contributions from the City's Proposition C account; in the future, there may be the possibility of augmenting matching funds from Measure R "local return" funds conveyed back to the City. In order for LADOT to convey these funds to CRA/LA, CRA/LA needs to execute and keep current a cooperation agreement with LADOT. The cooperation agreement that has been in operation has expired and a new agreement needs to be put in place. Although the 2011 MTA Call was one of the first times that CRA/LA did not draw upon these funds, authority is being requested for the CEO to execute a new cooperation agreement with LADOT to insure continued conveyance for past allocations of funds and to allow for the possible use of such funds in future Call cycles.

PREVIOUS ACTIONS

January 19, 2011 - City Council adopted a resolution authorizing the submission of City's MTA Call applications and the execution of all agreements and actions necessary to receive any grant funds that might be awarded to City agencies. (CF# 1 0-2277)

DISCUSSION & BACKGROUND

Out of 13 CRA/LA proposal topics that had been identified by staff for possible inclusion in the City's 2011 MTA Call submission, the CRA/LA submitted nine project proposals for consideration by the LADOT Inter-Agency Call Task Force (Task Force), which evaluated proposals from the various City departments. On December 17, 2010, the Task Force issued its recommendations on projects to be included in the City's submission, which included seven of the CRA/LA proposals. Those project proposal topics were:

In addition, subsequent to the conclusion of the I Task Force evaluation process, the Bunker Hill-Broad Museum Regional Connector Station Transit Plaza was identified and approved for inclusion in the City's submission by the City Council:

Locations of Proposed Projects Of the eight CRA/LA Call for Projects selected or under consideration, five are sponsored by the Downtown Region, one is jointly sponsored by the South Los Angeles and Downtown regions, one by the West Valley Region and one by the Hollywood & Central Region. One of the projects sponsored by the Downtown Region is along the Slauson corridor on the south end of the Ninth Council District and another Downtown Region project is actually region-wide, involving a number of cultural destinations in other cities as well as throughout the City of Los Angeles.

City Process and Program History In 1991, Congress enacted Public Law 1 02-240, the lntermodal Surface Transportation Efficiency Act (ISTEA) which, for the first time, made significant amounts of federal transportation funding available for non-highway projects and non-highway agency sponsors. MT A, in its role as the transportation finance commission for Los Angeles County, developed a competitive, biennial process, now referred to as the MT A Call for Projects, to award these discretionary transportation funds (primarily capital) to the most worthy project proposals submitted by the 88 cities in the region.

Because MT A limits each municipal jurisdiction to one omnibus, pre-scored and rank-ordered submission, the City Council directed LADOT to organize and oversee an interdepartmental process to assemble the most competitive submissions from participating City departments and agencies.

The CRA/LA has successfully competed in every round of the MTA Call for Projects since its inception in 1993. The growing State budget crisis interrupted the MTA Call in 2003 and 2005; funding available in the 2007 and 2009 calls were significantly reduced and funding from the 2011 call will hopefully be an historic low. Call for Projects funding going forward is projected to increase significantly by 2015 and 2017.

CRA/LA Internal Selection Process On July 27, 2010, the CRA/LA grants procurement officer alerted Project Area staff that the announcement of 2011 MTA Call for Projects was expected shortly and specified a process by which all prospective proposal topics were to be submitted for review and approval by the Management Team. On August 31, 201 0, the Management Team convened to hear brief presentations by each of the proposal proponent staff. Management Team members present provided detailed scoring and comments to the manager for grants procurement who tabulated these evaluations and forwarded them to the CEO for resolution.

After extended deliberation, 11 of the 14 project proposals presented were approved by the CEO to go forward for consideration by LADOT and the City's Interdepartmental Task Force.

ECONOMIC IMPACT

CRA/LA proposals could bring up to $14,462,000 in external resources (primarily federal Congestion Management/Air Quality plus local in-kind resources) to support CRA/LA programs. A more detailed analysis of construction jobs will be completed for those projects awarded.

SOURCE OF FUNDS

Matching funds for grant applications provided by Project Area Tax Increment Revenue and (for Hollywood-Western) in-kind contributions.

PROGRAM AND BUDGET IMPACT

Receipt of grant funds will require amending the budget for those Project Areas that are awarded MTA Call for Projects funds. Depending upon what funding awards are made by MTA, up to $14,328,000 in CRA/LA resources could be ultimately required to support up to $29,290,000 in programming, starting in FY15-16. Agency resources would be needed to front­end program delivery, pending quarterly grant reimbursements.

There is no impact on the City's General Fund as a result of this action.

COMMUNICATION FROM CHAIR, TRANSPORTATION COMMITTEE relative to submitting project applications to the Los Angeles County Metropolitan Transportation Authority (Metro) for the 2011 Transportation Improvement Program Call for Projects.

Recommendations for Council action:

1. APPROVE the City's Final Project List accompanying the Department of Transportation (DOT) report to Council dated December 28, 2010 (attached to the Council file), and schedule.

2. AUTHORIZE the General Manager, Department of Transportation (DOT), on behalf of the City, to submit applications for funding to Metro for all projects included in the City's Final Project List

3. AUTHORIZE the General Manager, DOT, or Director of the lead department or agency for each project, to execute the necessary funding and contractual documents with Metro, subject to the approval ofthe City Attorney as to form and legality, and to accept any funds awarded by Metro.

4. DIRECT the General Manager, DOT, or Director of the lead department or agency for each project, to submit to DOT, for inclusion in the Transportation Grant Fund report, any resource needs, Including match and front-funding and staff and overtime funding, for the implementation of funded projects by Metro.

Fiscal Impact Statement: DOT reports that this action will not impact the General Fund. Generally, some of the City's future Proposition C Local Transit Assistance funds will be needed to provide matching funds forthe projects selected by Metro. Since Metro's awarded funds are available only on a reimbursement basis, Prop C funds will also be needed as fronHunding. Other potential sources of matching funds may include private developer fees, Community R.ei:levelopmeritAgency funds, Port of Los Angeles funds, Proposition A Local Transit Assistance funds, and other sources. Match and front-funding wilt be included In DOT's budget for Fiscal Year 2015-16 under Prop C fund and successive budgets.

Community Impact Statement: None submitted.

Summary:

In a report to Council dated December 28, 2010 (attached to the Council file), DOT states that Metro issued the 2011 Transportation Improvement Program Call for Projects on November 10, 2010. Federal, state, and regional transportation funds will be awarded on a competitive basis through this Call. The deadline for submitting applications is January 28, 2011. DOT's report includes a prioritized list of proposed City projects from the City's Interdepartmental Task Force Committee, for consideration by Council.
