1. Meeting Called to Order with the Pledge of Allegiance:
The meeting was called to order by Selina Stoller at 7:00 p.m.. Present were David George, Pete Peterson, John Weingardt, Cecilia Coble, Brad DeReamer, Jocelyn Vare and Samantha DeLong. Todd Zimmerman was virtual until he arrived at 7:48 p.m.

5. Mayor’s Youth Academy:
The students from the Mayor’s Youth Academy introduced themselves and
made their presentation on the fire department. They gave suggestions on
how to get more involved with the youth and young adults in the
community.
6. Finance Committee Report:
Chairman John Weingardt gave a brief update from the Finance Committee meeting.
7. Health Department Update:
Health Department Director Monica Heltz made her presentation to the council members.
The rates have gone up to 12.8%
12,500 calls have been received by the health department.
65,000 tests have been completed.
As of 4/20/2021 27,000 vaccines have been given.
35% of the eligible population have received the vaccine. 8. Consent Agenda:

Lisa Bradford and Chief Ed Gebhart made his presentation to the city council members.
President Selina Stoller opened the meeting for a Public Hearing.
Lance Skeeters came forward. He does not believe that funds for the gun racks should be
paid from the Forfeiture Fund.
Chief Ed Gebhart explained that there is a state statue and formula as to how the funds
can be spent. The schools also receive some of the funds.
President Selina Stoller closed the Public Hearing.
Councilwoman Jocelyn Vare stated she did not believe the practice of the forfeiture fund
should be used for the police department.
Councilman Todd Zimmerman also made some comments regarding how you should use
your words.
John Weingardt made a motion to approve resolution R041921A. Pete Peterson
seconded the motion. Pete Peterson, John Weingardt, David George, Selina Stoller, Cecilia
Coble, Todd Zimmerman, Brad DeReamer, and Samantha Stoller voted yay. Jocelyn Vare
voted nay. The vote was 8 Yay and 1 Nay. The motion passed.

President Selina Stoller opened the meeting for a Public Hearing. No one came forward
and the Public Hearing was closed.
Pete Peterson made a motion to suspend the rules and have the 1st, 2nd, and 3rd
Reading. Cecilia Coble second motion. Pete Peterson, John Weingardt, David George,
Selina Stoller, Cecilia Coble, Todd Zimmerman, Brad DeReamer, and Samantha Stoller
voted yay. Jocelyn Vare voted nay. The vote was 8 Yay and 1 Nay.

project includes 250 residential units, with 210 duplexes and eight (8) five-plex townhomes (40

Steve Harden spoke on the development.
Pete Peterson made a motion to approve ordinance 021521D on the condition that the
trail will be moved to the west side of the street. Todd Zimmerman seconded the motion.
The motion passed. Pete Peterson, Todd Zimmerman, Selina Stoller, Cecilia Coble, John
Weingardt and Brad DeReamer voted yay. Jocelyn Vare and Samantha DeLong voted nay.
David George abstained. The vote was 6 YAY, 2 NAY and 1 ABSTAINED. The motion
passed.
21. 041921B - Consideration of a Text Amendment to Section 3.4.2. Municipal Airport District to

Chad Litton came forward and was unhappy about changes made in the ordinance 021521D - Consideration of a Rezone from EN, I-69 Overlay Zone to PUD-M for a mixed-use PUD on 36 acres east side of USA Parkway, known as County Parcel No. 15-15-06-00-00-002.000. The project includes 250 residential units, with 210 duplexes and eight (8) five-plex townhomes (40 units). The PUD includes a commercial project that will be developed in the future. The fence that is proposed is not what was agreed to.
Mayor Fadness asked him to contact his office to discuss the fence.

The residentsacross the lake should have been noticed and allowed to comment. City Council Meeting – 4/19/21 at 7 p.m. I am voicing my opposition to both above numbered items on the Agendafor the City Council Meeting on 4/19/2021. This property was not intendedto be zoned for use as a warehouse/distribution center as indicated in theMetro Park Development Opportunities in Fishers, Indiana brochure andthe City's Plan. In that brochure the Phase I Conceptual Site Plan for the64+/- acres was conceived to be Flex Employment Centers for R&D andOffice/Employment Nodes. Those uses are consistent with the "smart,vibrant, and entrepreneurial city" that has been and is a consistent part ofthe vision for development in Fishers, Indiana. A warehouse/distributioncenter off of one of the busiest streets in Fishers, that already has hightraffic counts of semis and noise pollution receives due to big box retailestablishments, will only lead to further congestion and safety issues. Theturn areas from 96th Street onto Masters Road and from Masters Road to96th Street, and the new proposed access street off of 96th Street to thefacility will not accommodate large semis/trucks without encroaching intothe second lane of the streets, creating unsafe driving conditions. TheNickle Plate Trail will cross 96th Street between the proposed project andaccess to Interstate 69, creating unsafe conditions for walkers, runners,and bikers due to the increase of semi truck/large truck traffic. If thesemi/truck traffic from the proposed project proceeds west on 96th Street,additional issues of safety arise due to Michigan left hand turns androundabouts. In an email to Fishers resident Shirley Smith, dated March15, 2021 from City Planner Ross Hilleary, he states that under the currentproposed site plan there is parking for 78 trailers and 210 automobiles. Healso sates that "This parking number could change". The proposed facilitywill operate 24 hours a day, creating a higher volume of traffic around theclock. The variances requested drastically cut the required setbackminimums. This in itself should set off red flags. If the proposed projectcannot adhere to the required setbacks and other requirements this is notthe right location for the project. Additional air, light and noise pollution willbe added to our city's environment. The City of Fishers and its residentstake great pride in and tout the rankings that the City receives for safety,best place to live and raise a child, and its awards for being a greencommunity. All of these attributes will be threatened by allowing projectssuch as this warehouse/distribution center to locate in an area thatspecifically was not intended for that use. This proposed project will alsohave a negative impact on the value of the homes in the area due to all ofthe above stated concerns. I respectfully ask that you do not allow thisproject to proceed and that you continue to adhere to smart growth anddevelopment as touted by the city, and locating warehouse/distributioncenters away from residential and retail areas in an industrial/distributionpark meant for this type of project. It is important to the quality of life alongthis area of the 96th Street corridor that the integrity of our neighborhoodsand residential areas be preserved. Do not set a precedent here that willcreate havoc on 96th Street and change the landscape of the area. Pleasechoose quality of life and place over the increase in tax base that thisproject, and others that will follow it in this area because you allowed thisproject, will bring. There are more suitable uses for this property that willenhance, not detract, from our city; and ones that will not require
decreasing safety, environment, esthetic, and living standards for theresidents of Fishers. Thank you for the opportunity to share my concerns.

City Council Meeting – 4/19/21 at 7 p.m. Dear Councilors,
I am writing to ask you to vote no on this project at the present location. Myunderstanding is that the airport grounds was to be zoned commercial andthat the goal was to have office buildings or office hubs on the property.
Several concerns:
1. Proposed building is already large and then to add more size to it byextending the set backs from the road only increase the building size.
2. This project is on the residential side of the airport property therefore itwill impact the residences by the increase in traffic , the noise from thetraffic, the increase in exterior lighting and the possible crime it could bringto the neighborhood. What are the landscape barriers that are going to berequired to shield the neighborhood from this project?
3. Has there been any traffic studies on the increase of traffic onWillowView which is a residential street and 96th Street? Willow View is anarrow residential road not one that can handle the increase in traffic.
4. Has there been any environmental and wildlife studies on how thisproject will impact the wildlife from Richie Woods? Are there any bats orother protected wildlife on this ground ?
5. Drainage is a concern since the run off is going into a small creek?
5. Could this project be re-located to the commercial and business side ofthe property that is closer to Hague Road. It seems that the industrialnature of this project fits well with the other commercial and industrial typesof buildings on the Hague side of the building.
This is not the type of project that Fishers discussed building on the airportgrounds and it is one that will negatively impact the neighborhood.

Project Name/Number Scannel Properties proposed Distribution Center at 96th and Masters Rd.
City Council Meeting – 4/19/21 at 7 p.m. This location is a poor fit for a high traffic facility that will bring numeroussemi-trucks through an already congested area. The 96th Street corridorfrom I-69 to Masters was recently refurbished to create traffic chokepointsto slow down traffic due to safety issues, so the last thing the area needs isa significant increase in traffic, especially heavy vehicle traffic.Furthermore, trucks may attempt to bypass this congestion by cutting downMasters Road to 82nd Street, taking them through residential areasill-suited for heavy traffic, especially given the poor condition of MastersRoad.
This will also increase the hazards to pedestrian and bicycle traffic onMasters Road. If this project is to go through, Scannel should fund thewidening of 96th Street from Masters to I-69, resurfacing Masters Roadfrom 96th St. to 82nd St with durable material able to withstand semi-trucktraffic, the addition of a bicycle lane and sidewalk from 96th Street to 82ndStreet. To do any less is a disservice to area residents and puts people,especially children, at risk.

City Council Meeting – 4/19/21 at 7 p.m. My family moved over here from Zionsville in 2017. Which was a bigchange for us all. However, we love it! Having a sense of "small suburbs"amongst limitless amenities. We live just blocks from this proposeddevelopment. Traffic is already bad and the roads are rarely ever fixed andstill dealing with years of left over pot holes. The light pollution isn't too badand some nights we can still star gaze. I dread mass industrial typedevelopments near homes. Increased traffic, 24/7 noise, the inevitablepollution from places like this will most likely effect the nature preserve onthe North side of the air field, light pollution will make the stars disappear,most people working in these places will not be from Fishers or aroundhere. Reduced safety with more traffic. I'm raising 2 boys and one isalready driving. So it's a big concern. We love the little shops around here. Icould see something smaller retail etc go in there. I know many residentswouldn't oppose that. Living on the Indy side of 96th street I know we getlittle say. But we are all talking and the chatter is loud over here. This willchange this area in a horrible way. Please rethink this mass industrialDistribution Center development!! Please keep the homeowners & families nearby in mind!

Theresidents have not been provided enough information to show why thisappropriation and expense is necessary. Additionally, our police should notbe incentivized to stop or arrest individuals for financial gain. Our stateforfeiture laws are controversial and amendments have been discussed foryears. Until the law is updated to ensure that it is used fairly andappropriately, our city should not be using these funds to supplement ourpolice budget.

City Council Meeting – 4/19/21 at 7 p.m. Concerning the Buffer area by Walnut Hills, there has been a recentchange moving the privacy fence from the west side of the sewer easementto the east. By doing this, the residents of Walnut Hills are concerned thatthere will no longer be room for the planed trees along that fence. Thebuffer along Highpoint Ridge is clearly defined, and distance as well asnumber of trees. If the fence is moved, and the tree line is no longerconsistent, it will have a poor visual effect, and no longer provide a visualburrier for up to 40% of the homes along Walnut Hills. We would like thefence in its original planned location on the west side of the easement toallow room for a consistent tree line.

City Council Meeting – 4/19/21 at 7 p.m. 1. please provide a reasoning on why the pond cannot be moved southother than "we looked at it and it doesn't fit with our plans". Moving thepond south would alleviate issues with the 3 homes in walnut hills that willbe affected most by proximity to villa units, lighting, noise, privacy andsafety issues.
2. There is a sewer easement running east and west along the southernpropertly line of the project. plans show building on top of this easment? will it be relocated?
3 . where will the low rent villas Mr. Fadness has promised be located? Will they be the ones closest to the walnut hills neighborhood at the southeastern corner of the project?
4. Who do we contact for issues with drainage, both current, and after thisproject is approved?
5. How can we determine an area to be zoned as residential when thereisn't any "ownership" of the property, only rentals? This doesn't share thesame zoning designation as other massive rental areas within fishers?
