    MINUTES OF COUNCIL

    A regular session of Troy City Council was held Tuesday, September 2, 2014, at 7:00 p.m. in Council Chambers.

    Members Present: Heath, Kendall, Oda, Phillips, Schweser, Snee, Tremblay and Twiss. Upon motion of Mr. Schweser, seconded by Mr. Phillips, Mr. Clark was excused from this meeting by unanimous roll call vote.

    INVOCATION: An invocation was given by Council Member Tremblay. The Pledge of Allegiance followed the invocation.

    MINUTES: The Clerk gave a summary of the minutes of the August 18, 2014, meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Phillips, seconded by Mr. Tremblay, to approve these minutes. Motion passed by unanimous roll call vote.

    COMMITTEE REPORTS: Community & Economic Development Committee: Mr. Twiss, Chairman, reported that Committee recommends legislation be prepared to accept dedication of right-of-way on Barnhart Road and the replat of IL 10243 and part of IL 6502 submitted by Speedway LLC. Report signed by Kendall, Schweser and Twiss.

    Discussion. In response to a question of Mrs. Oda regarding the Speedway Station, it was stated that the company plans to add pumps for truck fueling, but this will not be a truck parking area.

    CITIZEN COMMENTS: -Rosaleen Rayman, 31 N Walnut Street, commented opposing the Riverfront Development Project. The commented that the Treasure Island area has been flooded three times this year, the new restroom facility at Treasure Island could not be accessed due to high water, and the debt payment of $640,000 a year for 25 years for the Riverfront Development Project is not a good legacy. -Lester Conard, 1210 S Clay Street, commented that he believes money could be spent on better services for citizens instead of the Riverfront Development Project, and recreation areas of the golf course and Hobart Arena are already being subsidized. -Cheryl Chaney, 263 Swailes Road, commented that she is basically in favor of the Riverfront Development Project. She said that she sees people coming to Troy as there are things to do here. -Vicky Smith, 137 Ridge Ave., commented that she feels there needs to be common sense when things are introduced. She suggested funds be saved to do improvements, and that roads be taken care of first. She commented that the Hobart Arena brings people to Troy, but there should be more thought to the park improvement portion of the project. -David Spencer, 716 Glendale Drive, commented that the $640,000 a year payback over 25 years for the Riverfront Development Project is a burden on people not yet born. He asked if there had been a study about the use of Treasure Island and Hobart Arena, and suggested a private company take over and run the Arena.

    A motion was made by Mr. Twiss, seconded by Mr. Phillips, that Ordinance No. 0-24-2014 go to a fourth reading so that all members of Council could be present to vote on the Ordinance.     PRESENTATION: Police Chief Charles Phelps provided an update related to heroin and other drug abuse issues. Comments of the Chief included: -Like other communities, Troy shows an upward trend of heroin use since 2008; it is not just a local, city, county or state issue, it is a regional and international issue. -Law enforcement recognizes that Mexican drug cartels are behind the trafficking and use of heroin, and the number of users only increases. Heroin capsules sell for $5-$10 in Troy and for about $5 in Dayton. -Troy Fire Department medics use Narcan in treating overdoses. The need to use this product has doubled in the past year, and it had to be used three times the past weekend. -There were seven deaths attributed to a drug overdose in Troy in 2013, and the 2014 number to date is six. -Ohio Attorney General DeWine has acknowledged that there is no city or county that does not have this issue. -Ohio averages over five overdose deaths per day. -Gov. Kasich announced Project Dawn in 2013 as an initiative to try to reduce deaths due to heroin. -Troy's experience is about average with the surrounding communities and region, and he would not consider Troy a drug region. -Drug trafficking is very mobile, and those involved use modern technology. -The ways to address this issue are: avoidance of addiction with programs like DARE, patrolling aggressively and looking for indications of drug abuse or trade, using new investigative tools, and looking for ways to address the issue regionally by pooling resources with neighboring communities to deal with the supply issue as well as addiction. -The Chief asked that the public notify the Police Department as quickly as possible if they see something they think is suspicious. He also noted that a citizen can call 911 anonymously.

    -Mrs. Baker asked if officers are carrying Narcan. The Chief advised that is not being done at this time as the product is fairly costly, has a short shelf life and stability issues, and there is specific training needed to administer Narcan safely. He noted that Troy's EMTs are able to respond quickly and provide services to help avoid death from an overdose. In response to Mrs. Baker asking if the Police Department needs more from Council or the community, the Chief commented that he would make any future needs known. -Mr. Phillips asked about the Neighborhood Watch Program involvement in addressing drug issues. The Chief advised that there are some neighborhoods that have active watch programs, and the Department can assist neighborhoods wanting to establish a program. Regarding regional task forces working on drug issues, the Chief noted that there are several, primarily from Montgomery County, and Troy is working with those agencies.

    -Mr. Kendall asked about ages of heroin users and if the responses have been for Troy citizens. The Chief replied that not all the responses have involved residents, but persons in Troy when the call for service was made. Regarding age groups, the Chief indicated that is from late teens to late 50s, a broad spectrum of ages and incomes, but the Police Department is not seeing much usage by juveniles. -Mr. Tremblay asked about educational programs for adults, and the Chief advised that the Detectives can do presentations to fit a variety of audiences. -Mrs. Oda asked about the forms of heroin and if people temporarily come into Troy to sell drugs. The Chief advised that heroin can be smoked, snorted or injected, with the capsules an easy means to hide and carry the drug. He commented that sellers do set up temporary locations, including hotels and motels, and the operators of those establishments work well with the Department.

    COMMENTS OF THE MAYOR. Mayor Beamish noted that the employee and volunteer picnic would be held September 3. He also thanked Council for their deliberations, discussions, and decisions.

    AUDIENCE COMMENTS: -Rosaleen Rayman, 24 N. Walnut Street, commented that she believes money should be spent on providing services to the citizens and paying the increased costs of those services, and taking care of streets before money is spent on new projects. She commented that Council is not addressing what the citizens want regarding services, and is leaving a legacy of debt. -Richard Burns, 1460 Michael Drive, stated he concurred with Mrs. Rayman's comments. -Lester Conard, 1210 S. Clay Street, stated he did not believe Council cared about the citizens, and should work on bringing in jobs. -David Denoyer, 1209 N. Walnut Street, stated he chose to move back to Troy after living in Mason and Middletown. He commented that no town is perfect, but Troy is a good town, a town where people do not have to fear going outside, and he stands by Troy. -Vicky Smith, 137 Ridge Ave., commented that people want to live in Troy because it is a conservative town, and she does not feel that all decisions made may be for the good of the City. -Cheryl Chaney, 263 Swailes Road, asked that graffiti be cleaned up.

    There being no further business, the meeting adjourned at 8:10 p.m.

    SUBJECT: Bidding Authorization, Marina Building Renovation Improvements

    SUMMARY REPORT: (to be read at Council meeting) Committee Members Oda and Snee met on September 10 to consider recommending bidding authorization of the renovation improvements to the Marina Building. The recommended $1 Million authorization is included in the Reappropriation Ordinance approved by Council on September 2. The renovation work will increase the potential use and value of the building.

    RECOMMENDATION: (to be read at Council meeting) So that Council can vote on the bidding of the improvements, the undersigned recommend that legislation be prepared and presented to Council authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for the Marina Building improvements at a cost not to exceed $1,000,000.

    Chairperson Snee is recommending that the legislation be approved.

    Committee Member Oda commented that while she recommends the legislation be presented so that it can be voted on by Council, at this time she is not in favor of approving the legislation.

    Committee Members Oda and Snee met on September 10, 2014, to consider recommending bidding authorization of the renovation improvements to the Marina Building. This meeting was also attended by Mayor Beamish, the City Auditor, the Director of Public Service and Safety, and members of the City staff.

    The improvements to the Marina Building are part of the Riverfront Development Project. The funds for the Marina Building Improvement, estimated at $1,000,000 were included in the Reappropriation Ordinance approved by Council on September 2.

    Earlier this summer, members of Council participated in a tour of the building and in a presentation by the architect regarding the work that has been done since the City has owned the building, and the proposed renovation work to increase the potential use and value of the building. We were advised that a meeting has been held with the current concession operator who occupies a portion of the building as that operation will not be able to be open during the renovation period, which could be six months or longer. When the proposed work is completed and other areas of the building available to be used, those areas may be operated by the City or other concession operators.

    RECOMMENDATION: So that Council can vote on the bidding of the improvements, the above signed recommend that legislation be prepared and presented to Council authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for the Marina Building improvements at a cost not to exceed $1 ,000,000.

    Chairperson Snee is recommending that the legislation be approved.

    Committee Member Oda commented that while she recommends the legislation be presented so that it can be voted on by Council, at this time as she is not comfortable with spending $1 million on a building that is located in a flood plain. It was noted that the Marina Building itself has not had water within the main building floor.

    This Committee met on September 9, 2014, to consider the request that a 0.49 acre parcel located off Foss Way be declared as surplus and no longer needed for a public purpose, and that the parcel be sold.

    RECOMMENDATION: (to be read at Council meeting) It is the recommendation of this Committee that legislation be prepared declaring parcel 008-250107, located off Foss Way, as surplus and not needed for a public purpose.

    DETAILED REPORT: This Committee met on September 9, 2014, to consider the request that a 0.49 acre parcel located off Foss Way (parcel 008-2501 07) be declared as surplus and no longer needed for a public purpose, and that the parcel be sold. This meeting was also attended by Mayor Beamish, Council Members Phillips, Tremblay and Oda, the City Auditor, the Director of Public Service and Safety, members of the City staff, and citizens.

    Many years ago the City was deeded a parcel of land off Foss Way that provided access to an apartment building. That apartment building has burned, has been demolished, and access is not required as the lot can no longer be considered a buildable site. So that the City can dispose of this land and not need to maintain it, it has been requested that it be declared surplus and offered for sale.

    An adjacent property owner, interested in acquiring the land, asked that if land is not sold that it be secured.

    RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared declaring parcel 008-2501 07, located off Foss Way, as surplus and not needed for a public purpose.

    This Committee met on September 9 to review the certifications forwarded for acceptance by the Miami County Budget Commission for the rates of tax to be levied on the general duplicates for 2014 for collection in 2015. The certifications are to be based on the City's tax budget, which Council approved earlier this year. The certifications are done geographically by school districts.

    RECOMMENDATION: (To be read at Council Meeting) It is the recommendation of this Committee that legislation be prepared accepting the tax levies for the City of Troy as certified by the Miami County Budget Commission for both school districts. We also support emergency legislation to meet the October 1 date by which acceptance of the certifications are to be returned to the County.

    This Committee met on September 9 to consider the request to authorize bidding the maintenance and repair of the City's fleet of vehicles and equipment. The current fleet maintenance contract expires at year end. That contract commenced in 2012, and staff has estimated that the annual savings of outsourcing this work to be about $105,000 over the contract period.

    A renewal contract would be based on a three-year period, with two mutually agreeable one-year renewal options. The not to exceed amount would be $400,000 per each calendar year of the contract.

    RECOMMENDATION: (to be read at Council meeting) As this program has worked favorably for the City, it is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for a fleet maintenance program at a cost not to exceed $400,000 for each year of the contract.

    This Committee met on September 9, 2014, to consider the request to authorize bidding the maintenance and repair of the City's fleet of vehicles and equipment. Also attending the meeting Mayor Beamish, Council President Baker, Council Members Oda, Phillips and Heath, the City Auditor, the Director of Public Service and Safety, members of the City staff, and citizens.

    In 2012, through a bidding process, Troy outsourced the maintenance of nearly all vehicles and equipment. Staff has estimated that the annual savings in outsourcing has been approximately $105,000, with the vehicles and equipment being maintained, serviced, repaired and ready to go. The current contract expires at year end, and a new contract would have to be bid. The new contract will be based on a three-year period, with two mutually agreeable one-year renewal options. The not to exceed amount would be $400,000 per each calendar year of the contract. As a part of the contract, the successful vendor is required to maintain and provide to the City a maintenance record for each vehicle and piece of equipment.

    RECOMMENDATION: As this program has worked favorably for the City, it is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for a fleet maintenance program at a cost not to exceed $400,000 for each year of the contract.

    On September 9, 2014, this Committee met to consider a request that some vehicles and equipment be declared surplus and offered for sale. This meeting was also attended by Mayor Beamish, Council President Baker, Council Members Oda, Phillips and Heath, the City Auditor, the Director of Public Service and Safety, members of the City staff, and citizens.

    We reviewed the attached listing of vehicles and equipment not needed by any City operation. As the listed items have an estimated value in excess of $1,000, Council action is required to declare them as surplus and authorize the sale. The City has had good success with the internet auction site GovDeals, and we were advised staff intends to use that site to advertise these items.

    RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared declaring the attached listing as surplus City equipment as the items are no longer needed for a public purpose and authorizing the Director of Public Service and Safety to advertise for the sale of the items listed.

    The following is 8rdinaneetResolution enacted by the City of Troy, Miami County, Ohio, hereinafter referred to as the CITY, in the matter of the stated described project.

    SECTION I -Project Description

    WHEREAS, the STATE has identified the need for the described project:

    On various structures within the City of Troy, Miami County, Ohio, including Structure File Number (also known as SFN further in the document) 5501873 MIA 75-6.08, SFN 5501989 MIA 75-623 R, SFN 5501954 MIA 75-623 L, SFN 5502055 MIA 75-6.81 , SFN 5502438 MIA CR 133-885, flood entire decks with SRS (Soluble Reactive Silicate) 705.24. Said project is further identified as D07 BRDG DECK SEALING PART 1.

    NOW THEREFORE, be it ordained by the City of Troy, Ohio.

    SECTION II - Consent Statement

    Being in the public interest, the CITY gives consent to the Director of Transportation to complete the above described project.

    SECTION III - Cooperation Statement

    The CITY shall cooperate with the Director of Transportation in the above-described project as follows :

    The CITY has no obligation for costs for the project as described in Section I. ODOT will provide all Federal-aid and State funds as set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation.

    In addition, the CITY also agrees to pay One-Hundred Percent (100%) of those features requested by the CITY which are determined by the State and Federal Highway Administration to be unnecessary for the Project.

    If curb ramps are constructed by ODOT in compliance with the Americans with Disabilities Act, future maintenance of installed sidewalk curb ramps shall be the responsibility of the City. The City shall adjust any existing castings, as required, with City forces.

    SECTION IV - Utilities and Right-of-Way Statement

    The CITY agrees that all right-of-way (if applicable) required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. The CITY also understands that right-of-way costs include eligible utility costs. The CITY agrees to be responsible for all utility accommodation, relocation, and reimbursement and will comply with the current provisions of23 CFR 645 and the ODOT Utilities Manual.

    SECTION V- Maintenance

    Upon completion of the Project, and unless otherwise agreed, the CITY shall: (1) provide adequate maintenance for the Project in accordance with all applicable state and federal law, including, but not limited to, Title 23, U.S.C. Section 116; (2) provide ample financial provisions, as necessary, for such maintenance of the Project; (3) maintain the right-of-way, keeping it free of obstructions; and, (4) hold said right-of-way inviolate for public highway purposes.

    SECTION VI - Authority to Sign

    The Director of Public Service and Safety of said City of Troy is hereby empowered on behalf of (Contractual Agent Title)

    the City of Troy to enter into contracts with the Director of Transportation necessary to complete the above described project.

    SECTION VII- Emergency

    Public Defender Agreement- 2015

    On an annual basis the Law Director prepares legislation for the renewal of the Public Defender Agreement. This agreement covers services for representing indigent defendants under ordinance violations. The Constitution requires that indigent defendants who face the prospect of jail be afforded legal representation. By entering into this agreement, the City satisfies its Constitutional obligation to provide such representation .

    The agreement for 2015 will be on Council's agenda. The 2015 cost will be $20,341.13, which is the same amount since 2009. The history of this agreement is:

  • CONTRACT FOR COUNTY PUBLIC DEFENDER SERVICES TO MUNICIPAL CORPORATIONS

    AGREEMENT

    THIS AGREEMENT entered into between the Miami County Public Defender Commission hereinafter called the "Commission" and the City of Troy, Ohio, hereinafter called the "City".

    WHEREAS, the City recognizes its responsibilities under the laws of the State of Ohio and of the United States of America to provide legal counsel to indigent persons charged with Joss of liberty offense in its Municipal Court, and

    WHEREAS, the city in furtherance of the execution of its legal responsibilities, desires that the legal services of the Commission be delivered to the City's indigent citizens and others so situated;

    NOW THEREFORE, the parties do mutually agree to bind themselves as follows:

    I. Scope of Work.

    The Commission shall in a satisfactory and proper manner under the terms and conditions contained herein, perform the following services:

    Provide legal counsel to indigent persons charged with loss of liberty offenses under, by or through, the Codified Ordinances of the City of Troy, Ohio. The within representation shall include such cases filed in the Miami County Municipal Court, and/or Miami County Common Pleas Court, and Miami County Juvenile Court.

    2. Compensation.

    The City shall pay to the Commission a sum not to exceed Twenty Thousand Three Hundred Forty One Dollars and Thirteen Cents ($20,341.13) which shall constitute full and complete payment for all the Commissions services during the term of tills contract. Said sum shall be paid in the following manner: One Third of this contract, to wit, Six Thousand Seven Hundred Eighty Dollars and Thirty Seven Cents ($6,780.37) shall be paid at the beginning of the term of this contract; thereafter Commission shall be paid the balance in two equal payments of one third of the contract price, the first of said payments at the expiration of the first four (4) months of the term of this contract in the amount of Six Thousand Seven Hundred Eighty Dollars and Thirty Eight Cents ($6,780.38), and the second at the expiration of the first eight (8) months of the term of tills contract in the same amount of Six Thousand Seven Hundred Eighty Dollars and Thirty Eight Cents ($6,780.38).

    9. Indigent Eligibility Standards.

    In determining the indigent status of all individuals receiving representation pursuant to tills agreement, all applicable standards of indigency and other rules and standards established by the Ohio Public Defender Commission and the Ohio Public Defender will be followed.

    I 0. Verification of Contract Amount.

    EXHIBIT "A" 3. Term of Service.

    The duration of this contract shall be for one (I) year commencing January I, 2015, and shall terminate on December 31 , 2015 .

    4. Non-Assignment.

    The Commission shall not assign all or any part of this Agreement without the prior written consent of the city, which consent shall not be unreasonably withheld.

    5. Termination.

    If the Commission shall fail to fulfill in a reasonable timely and proper manner its obligations w1der this Agreement, or if the Commission shall substantially violate any of the covenants, agreements or stipulations of this Agreement, the City shall thereupon have the right to terminate this Agreement by giving written notice to the Commission of such termination and specifYing an effective date thereof at least sixty (60) days before the effective date of said tennination. Termination by the City shall not constitute a waiver of any other right or remedy it may have at law or in equity for breach of this Agreement by the Commission.

    6. Amendments.

    All Amendments to this Agreement agreed upon by the parties shall be in writing and made a part of this Agreement.

    7. Anti-Discrimination.

    There shall be no discrimination against any employee who is employed in the work covered by this Agreement or against any application for such employment because of race, color, religion, sex or national origin. This provision shall apply to but not be limited to, employment, upgrading, demotion or transfer, recruitment or recruitment advertising, lay-off or termination, raises of pay or other forms of compensation, and s.election for training including apprenticeship. The Commission shall insert a similar provision in any sub-contract for services covered by this Agreement.

    8. Conflicts.

    Commission covenants that it presently has no interest and shall not acquire any interest direct or indirect, which would conflict in any manner with the performance of services required under this Agreement. No members of, nor delegates to, the Congress of the United States of America, and no resident Commissioner shall share in any part hereof or any benefits to arise herefrom.

    Street- Including Solid Waste- Jerry Mullins, Foreman Collected and transported 241 tons of residential trash since the last report of

    220 tons. Delivered recycling bins as requested. Asphalted 2 areas marked for repair, 1 main break, and 4 water services. Dura-patched 36 spots marked for repair. Replaced various signs throughout the city and painted roadways. Staff has used over 576 tons of asphalt to repair street openings since the plant

    opened. Cleaned the downtown for weekend events. Mowed and weed-whipped ditches and rights-of-way. Repaired concrete catch basin on West Main Street. Took down storm damaged tree on South Walnut Street. Picked up brush and yard waste bags. Prepared leaf collection equipment for the upcoming season. The sign shop has finished painting at night and will now tum its attention to

    sign replacement and repair. Cleaned up trash illegally dumped at the old sewer plant site on Staunton Road. Installed two additional brine assemblies on trucks for pretreatment during the

    winter season. The three brine trucks in the department will give us the ability to pretreat all roadways in an eight hour day.

    Checked progress of leaf collection equipment - trailer unit and self-contained truck. The trailer unit is on schedule to be delivered by October 1. The self-contained truck model is on schedule to be here the middle to late October.

    Electrical - Brian Ferree, Foreman Completed Ohio Utilities Protection Service requests as needed. Began repairing the Christmas decorations for the downtown area. Completed the annual traffic conflict monitoring testing. Began the 3-year preventative maintenance on the traffic intersections. Replaced a photo-cell in an outside light at Hobart Arena, and assisted the

    Hobart Arena staff with installing a 100HP motor for the ice compressor. Repaired two exit lights at the Riverside Cemetery Maintenance Building. Repaired a tree outlet downtown.

    Water Distribution/Sewer Maintenance - Tom Parsons, Foreman Marked numerous Ohio Utilities Protection Service tickets. Investigated numerous high consumption alerts. Completed a number of work orders for Billing and Collection. Shut-off non-payment customers and reconnected as payments were made. Ross Waterline Project- pressure tested the water line and it passed.

  • McKaig Road Improvements Phase 2- prior to meeting with the design architect, jetted and TV'ed sewer line from Monroe to railroad tracks to see if lines needed to be replaced.

    Assisted with installation of air stripper tank and modified influent and effluent piping for air stripper.

    Repaired a 4" main break at Miami Street and Virginia Avenue.

    Water Treatment Plant- Tim Ray/Jeff Monee For the month of August 2014, the WTP pumped a total of 124.415 million

    gallons (MG) to our distribution system and customers in West Milton and parts of Miami County (avg. 4.013 MG/day). Total precipitation recorded at the WTP for August was 2.53". Respective totals for August in previous years are:

    10 bulk water account holders withdrew a total of 180,590 gallons from the WTP Bulk Water Station during the month of August, total revenue was $1,539.24.

    A total of 10,433,329 gallons were pumped to the Extra High Service pressure zone in northwest Troy by the EHS Booster Station for August 1-31, for an average daily consumption in that zone of 0.3366 MG.

    The 26-ton replacement Carbon Dioxide tank was delivered, set in place, and installed into the WTP chemical feed system.

    The carbonair stripper tower was transported from the WTP to its permanent site east of the old Low Service Pumphouse. The tower has now been erected in its final position.

    Vendor was on site to assist WTP maintenance with the installation of two vertical turbine pumps and related discharge piping at the modified old Low Service Pumphouse Building, which will now serve as the Pumphouse for the new air stripping process.

    Water Distribution staff continues to alter the west well field piping at the air stripper site, installing valves to separate the stripper influent and effluent flows and allow for a bypass option if necessary.

    A new ultrasonic flowmeter was installed in the wash water recovery line to replace a 20-year old meter that was damaged during the May 21 flood.

    Vendor completed scheduled service and minor repairs to the Train 1 primary basin rake and turbine gear motors. Annual changeover of softening trains is scheduled for early October.

    Wastewater Treatment Plant - Tim Snider Vendor continued work on the painting project on final clarifiers# 1 and #2. Worked with vendor to complete repairs on the valve actuator at de-gritter #3. Vendor completed repairs to the anti-rotation sensors at Madison Street storm

    water station. Continuing to work with contractor on overvoltage trip issue on WAS pump #1. Contractor will be on site to relocate the bio-augmentations generators. Completed the required preventive maintenance work orders.

    Project Status ACTIVE PROJECTS

    This phase of the project is between the Adams Street Bridge and Staunton Road. Project Adams Street Phase 2 has been awarded to L.J. DeWeese. Contract execution is complete. We will be working

    with the contractor to schedule the construction. Cherry Street Parking Lot Renovation is complete. Evaluating alternate kiosk options.

    ODOT has funded a portion this project. Design updates will be made by Poggemeyer Downtown Streetscape Phase 3B Design Group. Initial survey work is complete. ODOT has completed the environmental documentation. Design has been submitted to ODOT for their approval prior to proceeding

    with the completion of construction. Hobart Arena Renovation The RFP for design has been issued and is due back October 2.

    City Council authorized bidding at $75,000. A purchase order was issued to the Lighthouse at Treasure Island manufacturer for less than $50,000. The lighthouse is currently being fabricated. We are

    working on getting the base started in the next few weeks.

    McKaig Road Phase 2 Work from Monroe to the RR tracks. The RFP for design has been issued and is due back September 25. Marina Boathouse Renovation A Reappropriation Ordinance was approved for funding design of the improvements.

    The City has received a grant from The Troy Foundation to pay for design of a Mountain

    Mountain Bike Trail Bike Trail on land owned by the City. A purchase order was issued to the International Mountain Biking Association (IMBA) to design the project. The consultant has been in town and will be providing feedback in the upcoming weeks.

    Staff is working with ODOT regarding the paving along SR 55 on the west side of town as ODOT Paving well as the traffic circle. Council approved preliminary concent legislation. Work will take

    place in SFY 2015, with the City's estimated share of the cost to be $75,563.28. Staff will be submitting pre-applications for the three year pipeline of projects that we

    OPWC propose to be funded with this program. The projects are: McKaig Road Phase 3, N. Market Phase 2, and McKaig Road Phase 4.

    Piqua-Troy/Troy-Urbana Intersection Bids were openend and the project awarded to Double Jay Construction. Pre-construction meeting is being scheduled with the contractor and a start date will be determined. 9/12/20 4

    Project Status

    Water Regionalization Council has authorized a contract with RA Consultants. Staff has submitted all requested information for evaluation. Workshop #2 was held and the project will continue.

    Water Tower An RFP has been issued for the design of a new Extra High Service Water Tower. Responses are due to the City September 25.

    Council authorized the bidding of $2.8 M of sewer work. Bids were opened July 9 with bid 2014 Sewer Lining totals under the authorization. Work has been awarded to Layne lnliner, LLC and Miller

    Pipeline. Conctract execution is complete. Staff will determine schedules for these projects.

    Sidewalk Program 7 All work is complete. For those properties where the owner did not make payment to the City, information has been forwarded to the County Auditor for future assessment.

    Sidewalk Program 8 Council authorized bidding for the Phase 8 sidewalks where the property owner did not take out a permit to do the work. Project was awarded to I. F. Weber. Work is underway.

    Sidewalk, Sewer, and Sump Inspections Inspections are continuing to be completed when requested.

    Staff has started working with Miami Valley Lighting and MVCC to determine the best way to convert the City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS) street

    Street Light Conversion lights as required by law. The City will be working with MVCC and MVL to install trial LED street lights in several locations in the City as a demonstration. We anticipate that LED lights 1 will be installed on Plum Street, Short Street, on Adams Street, and along Shaftsbury Road

    Based on the application submitted February 19, Troy was again named as an Honorable Bicycle Friendly Community Mention Community by the League of American Bicyclists. While we were hoping for better

    recognition, this is a great accomplishment. General Specifications and Information A draft of the revision has been submitted to the Service Director's Office.

    GPS Data Collection This outdoor work continues as time and weather permit.

    SUBDIVISION STATUS

    Hawk's Nest Section 2 Waiting for final course of asphalt. Pleasantview Estates Section 4 The plat has been approved. Construction has not yet begun.

    Stonebridge Meadows Section 1 is complete. Infrastructure in Sections 2 is complete except for the final asphalt. Section 3 construction will follow in the spring. City Council has approved the rezoning and Planning Commission has approved the

    Halifax Preliminary Plan. Section One was presented to Planning Commission at the April 23 meeting. The plat was approved by City Council. Infrastructure work is expected to begin soon.

    Peters Road Development Frank Harlow recently purchased City property and will be building a few houses. This minor subdivision only requires staff approval and permits have been issued for three new homes.

    Subject: Items of Interest- Troy Development Council's 2014 Bi-Annual Report

    Please find attached an interim 2014 report on the Troy Development Council's Partners in Progress initiative.

    The Troy Development Council (TDC) began Partners in Progress in 2011. Its primary goal was to help TDC reach the next stage of its evolution by engaging additional local companies. The other major goal was to provide extra value to the private sector businesses participating in our very successful public-private economic development partnership, the TDC.

    Continuing initiatives are: Develop a Workforce Development Program Continue to improve the Troy Area's Retention and Expansion Program Continue to improve the Troy Area's Attraction Program Develop a Communications Program to provide information about Troy area businesses

    As noted in the report, Workforce Development is in progress, with a new Wage & Benefit Survey already started and refinements being made to the Professional Recruitment video program. The 2014 Job Fair is scheduled for Thursday September 18th, immediately following Career Day, which has attracted more participation this year from other Miami County schools- over 1,200 students are expected. TDC's new job opportunities website will be rolled out that same day. Although not mentioned in the report, planning also is in progress for another Manufacturers' Day later this autumn.

    The R&E Program update features focused visits to local plants and also to companies' headquarters. This maintains good communications which can help TDC to help Troy manufacturing plants as they meet changing conditions. The report lists recent expansions such as F&P's and ConAgra's newly operational production lines. West Troy Tool & Machine's conversion of the former tennis bam is nearing completion, with significant assistance from a City of Troy business expansion loan.

    While recruitment of new business is always slower than expansion of existing ones, Troy continues to attract a few. New recent additions are Select-Arc, which purchased the former RevWires building on West Stanfield Road and Crown Equipment, which has been converting the former Motoman space for a new product. Even progress in Downtown Troy is included in the TDC report, which notes the addition of the Mayflower Arts Center, Basil's on Market Street, In the Patch Designs, and Primm 'N Proper. These small businesses add specialty products to the already lively mix of Downtown Troy businesses.

    TDC's Communications Program is in full operation, with this written report now coming bi-annually and being added to the already innovative internet video and job listing efforts. TDC investors also are receiving e-mail notifications and newsletters. Numerous golf outings arranged with the Troy Country Club also give individual TDC investors the opportunity for one-on-one interaction with each other and with plant managers new to the community.

The first report shows all permits that were issued by the Planning Division. The report contains the address and type of permit and separates the information by each ward. There were 16 permits issued during this time period.

    The second report contains the address, type of concern, and a summary of the current status of on-going issues. Both open and closed concerns are listed and are separated by each ward.

    As in the past, all costs associated with the removal of trash and elimination of noxious weeds will be invoiced to the property owner. If the property owner does not pay the invoice, the cost will be assessed to the property taxes.
