    (b)apersonwhoislawfullypresentandentitledtopermanentlyresideinCanadaisdeemedtohavebeenlawfullyadmittedtoCanadaforpermanentresidenceand

    (c)apersonagainstwhomaremovalorderhasbeenmaderemainsunderthatorder

    5.(1)TheMinistershallgrantcitizenshiptoanypersonwho

    (a)makesapplicationforcitizenship

    (c)isapermanentresidentwithinthemeaningofsubsection2(1)oftheImmigrationandRefugeeProtectionAct,andhas,withinthefouryearsimmediatelyprecedingthedateofhisorherapplication,accumulatedatleastthreeyearsofresidenceinCanadacalculatedinthefollowingmanner:

    (i)foreverydayduringwhichthepersonwasresidentinCanadabeforehislawfuladmissiontoCanadaforpermanentresidencethepersonshallbedeemedtohaveaccumulatedonehalfofadayofresidence,and

    (ii)foreverydayduringwhichthepersonwasresidentinCanadaafterhislawfuladmissiontoCanadaforpermanentresidencethepersonshallbedeemedtohaveaccumulatedonedayofresidence

    (d)hasanadequateknowledgeofoneoftheofficiallanguagesofCanada

    (e)hasanadequateknowledgeofCanadaandoftheresponsibilitiesandprivilegesofcitizenshipand

    Residence

    (1.1)AnydayduringwhichanapplicantforcitizenshipresidedwiththeapplicantsspousewhoatthetimewasaCanadiancitizenandwasemployedoutsideofCanadainorwiththeCanadianarmedforcesorthefederalpublicadministrationorthepublicserviceofaprovince,otherwisethanasalocallyengagedperson,shallbetreatedasequivalenttoonedayofresidenceinCanadaforthepurposesofparagraph(1)(c)andsubsection11(1).

    CanadianArmedForcespermanentresident

    (1.2)Paragraph(1)(c)doesnotapplytoapermanentresidentwithinthemeaningofsubsection2(1)oftheImmigrationandRefugeeProtectionActwho,withintheperiodreferredtointhatparagraph,completedanumberofyearsofserviceintheCanadianArmedForcesthatisequaltothelengthofresidencerequiredunderthatparagraphlessoneyear.However,thatparagraphdoes

    CanadianArmedForcespersonattachedorseconded

    (1.3)Paragraph(1)(c)doesnotapplytoapersonwhoisorwasattachedorsecondedtotheCanadianArmedForcesandwho,withintheperiodreferredtointhatparagraph,completedanumberofyearsofservicewiththeCanadianArmedForcesthatisequaltothelengthofresidencerequiredunderthatparagraphlessoneyear.

    Grantofcitizenship

    (2)TheMinistershallgrantcitizenshiptoanypersonwhoisapermanentresidentwithinthemeaningofsubsection2(1)oftheImmigrationandRefugeeProtectionAct,andistheminorchildofacitizenifanapplicationforcitizenshipismadetotheMinisterbyapersonauthorizedbyregulationtomaketheapplicationonbehalfoftheminorchild.

    WaiverbyMinisteroncompassionategrounds

    (3)TheMinistermay,inhisdiscretion,waiveoncompassionategrounds,

    (a)inthecaseofanyperson,therequirementsofparagraph(1)(d)or(e)

    (b)inthecaseofaminor,therequirementrespectingagesetoutinparagraph(1)(b),therequirementrespectinglengthofresidenceinCanadasetoutinparagraph(1)(c)ortherequirementtotaketheoathofcitizenshipand

    (c)inthecaseofanypersonwhoispreventedfromunderstandingthesignificanceoftakingtheoathofcitizenshipbyreasonofamentaldisability,therequirementtotaketheoath.

    Specialcases

    (4)DespiteanyotherprovisionofthisAct,theMinistermay,inhisorherdiscretion,grantcitizenshiptoanypersontoalleviatecasesofspecialandunusualhardshiportorewardservicesofanexceptionalvaluetoCanada.

    Statelessnessbloodlineconnection

    (5)TheMinistershall,onapplication,grantcitizenshiptoapersonwho

    (a)isbornoutsideCanadaafterthecomingintoforceofthissubsection

    (b)hasabirthparentwhowasacitizenatthetimeofthebirth

    (c)islessthan23yearsofage

    (d)hasresidedinCanadaforatleastthreeyearsduringthefouryearsimmediatelybeforethedateofhisorherapplication

    (e)hasalwaysbeenstatelessand

    (f)hasnotbeenconvictedofanyofthefollowingoffences:

    (i)aterrorismoffence,asdefinedinsection2oftheCriminalCode,
