SHIPPING & DOCUMENTATION INFORMATION

IMPORT RESTRICTIONSThe importation of goods may only be carried out by duly registered

traders in possession of a customs identification number. Some goods are

subject to import licences (importers will advise), but, when buying is

conducted through the state trading organisations, licences are

automatically granted when an order is placed. Animals, plants, animal

and plant products and items such as animal vaccines, serum, testing

fluids, animal and plant discards etc, are subject to Chinese quarantine

regulations. A Quarantine Certificate from this country must accompany

all exports of this nature.

Agricultural goods may be subject to higher duties and tariff quotas. A

few commodities such as cereal, cotton and grain may only be imported

by state trading companies. A licence from the Ministry of Foreign Trade

and Economic Co-operation is required to act as an imported in China.

BILL(S) OF LADINGNo special regulations. As long as there are no payment or title

(ownership) issues then check if the goods can move with an express bill

or on express release to avoid potential delays that may occur when

shipping with the full marine bill of lading (the cargo cannot be released

until the original has been handed to the carrier in your buyer’s country).

CERTIFICATES OF ORIGINNone unless specifically requested by the customer.

SAMPLESSamples with a value of $30 or less can be imported under simplified

procedures. Seek advice from your customer before sending samples of

any substantial value, contact should be made with the appropriate

import corporation, (this also applies to samples taken by commercial

travellers). Temporary importation of commercial samples to be shown at

exhibitions in China or Macao may be temporarily imported under an ATA

Carnet, as long as the goods are re-exported within 12 months of the

issue date of the Carnet.

EXCHANGE CONTROLThe issue of the I/L guarantees availability of exchange

COMMERCIAL INVOICESInvoices to be issued in one original and two copies,

each bearing an original signature. Invoices must

include a full and accurate description of goods; first six

digits of the commodity code (HS code); transport

details; full packing information including weights and

dimensions; value and currency of the supply including

separate indication of additional costs such as freight

and insurance; the shipping term (Incoterm, e.g. FCA,

DDU, etc); country of origin; method of payment and the

full addresses of all parties concerned.

EXPORT CONTROLSCertain classes of goods are controlled under National

and EC regulations. Examples are military goods,

dual-use and military technology (including intangible

transfer of such technology, eg by e-mail or fax). These

are listed at the Department for Business, Innovation &

Skills (BIS) website:

Other goods not listed in the statutory instruments may

be controlled if their end-use involves chemical,

biological or nuclear weapons or the means of

delivering them.

instigation between countries outside the UK, consult

the “trade — trafficking and brokering” rules on the BIS

DUTIESDuties have now been reduced, as China makes

additional efforts to “open up its market”. Full details

about duties are available from the China Unit at UK

China uses the HS coding system for its tariff and the

duty will be set by the customs authorities.Information

on the standard rates of Customs, duty and taxes can

most of the site is not translated into English.

PACKING MATERIALSHay and straw may be used as packing material if

accompanied by a Phytosanitary Certificate. Although

there are still some importers requesting Phytosanitary

Certificates for wood packing going to China, it has

been clarified by the Chinese authorities that they will

accept the import of ISPM15 compliant wood packing

material without a Phytosanitary Certificate as long as

the packaging bears the fumigation mark. Shippers are

recommended to continue to provide “Declaration of

use of Non-wood packing material”. Taiwan, Penghu,

Kinmen and Matsu have confirmed that these separate

Customs territories will now implement ISPM15 on 1st

January 2009. Further information can be found on:

MARKING OF CASESThese are specified in individual contracts. There are

telecommunication equipment, cosmetics and food

UK REGULATIONSAll goods must be declared to Customs on leaving the EC (generally arranged by the freight forwarder/carrier). From 1st

July 2009, with the introduction of increased cargo security measures, all shipments leaving the EC require a

pre-departure message to be sent to the country of destination – it is known as the ECS (Export Control System).

For goods travelling across the EU member states to a non-EU country a new document, the Export Accompanying

Document (EAD), which will have a Movement Reference Number (MRN), came into force. Created by the Office of

Export (i.e. in the UK) it must be closed at the Office of Exit from the EU.

The information required differs depending on the security status of the exporter and freight companies involved, i.e.

whether all or some are approved under the EU’s AEO (Authorised Economic Operator) status.

The export customs declaration for shipments leaving the EC is also required, giving details of the shipment including

the exporter’s EORI (Economic Operator Registration Identification number – similar to the VAT no.), commodity code,

value, customs procedure code (CPC), export licence requirements, and transport and packing information.

Details submitted to Customs on this form must be notified to the freight company by

the shipper and the shipper must check that the declaration has been completed

accurately to avoid customs penalties.

A copy of this official customs declaration and/or certified transport document is

required for VAT purposes.

SPECIAL CERTIFICATE REQUIREMENTSELECTRICAL EQUIPMENT & MACHINERY

China Compulsory Certification (CCC) is

required for certain goods including electrical

equipment and machinery. Mandatory

certification is required for over 320 products

and 20 product groups.

The CCC-list product groups are: wires and

cables; low-voltage electrical apparatus;

electric tools; household and similar electrical

appliances; information technology;

telecommunication terminals; switches for

circuits; small power motors; welding

machines; audio and video apparatus;

lighting; motor vehicles; tyres and safety

parts; agricultural machinery; medical

devices; detector for intruder alarm systems;

safety glasses; latex products and fire

fighting equipment.

Small shipments of goods normally subject

to compulsory certification may qualify to be

imported under the “Special Processing

Program (SPP)”. Goods subject to this

procedure can be tested in China. Further

information can be obtain from the British

Standards Institute or the State General

Administration for Quality Supervision,

Inspection and Quarantine (AQSIQ) in China.

FOODFoodstuffs are subject to the Food Hygiene

Law. State Administration for Quality

Supervision, Inspection and Quarantine

(AQSIQ) must approve labels for foodstuff at

least 90 days before the importation or sale.

PLANT LIFEQuarantine Certificates are required for

animals, plants and biological products.

These products are generally quarantined on

arrival. Phytosanitary Certificates will also be

required for plants and plant products.

WILDLIFEShipments of wildlife and wildlife products

subject to the Convention on International

Trade in Endangered Species of Wild Fauna

and Flora (CITES) require and import permit.

SPECIAL EQUIPMENTCertain special equipment, such as boilers

and pressure vessels, are not subjected to

compulsory certification but require a

separate “Special Equipment Manufacture

Licence”.

PHARMACEUTICALS & MEDICAL GOODSImport of foreign pharmaceuticals, including

raw materials and drugs, may require special

permission from the State Drug

Administration. Imported medical devices

must be registered with the State Drug

Administration.
