1. Alegal affidavit on Rs. 100/- non-judicial Stamp Paper, duly attested by Notary Public, stating that:-

Details of Expansion / activity undertaken in violation of EIA notification, if any, be submitted with photographs, and point-wise compliance report of conditions of EC (if any) /CTE/CTO/NOC of RPCB & details of Notices received from RPCB and compliance their of as per MoEF, O.M. no. J-11013/41/2006-IA.II (I) dt. 01.07.2011. Non submission of such affidavit about Violation would be construed as willful non submission/concealing of information regarding Violation of the Environment (Protection) Act, 1986/Environment Impact Assessment (EIA) Notification, 2006 in relation to MoEF O.M. (b) In case of construction Projects listed under item 8 of the schedule, details of adverse impacts from new constructions on the existing structures should be submitted, along with information about the considerations taken into account.

Not Applicable as it is a new project.

(iii) In case of both new & existing projects it should also be categorically declared by the Project Proponent that, “There is no litigation pending against the project and/or land in which the project is proposed to be set up (please give name & ownership etc. of the project) and that for any such litigation whatsoever, the sole responsibility will be borne by the Project Proponent.”

(iv) In all cases, one legal affidavit by the PP stating that, “(a) I hereby give undertaking that the data and information given in the application, enclosures and other documents are true to the best of my knowledge and belief and I am aware that if any part of the data and information submitted is found to be false or misleading at any stage, the project will be rejected and clearance given, if any to the

Project will be revoked at our risk and cost. (b) I hereby also submit this undertaking as part of the EIA Report, owning the contents (information and data) of the EIA Report”.Another legal affidavit by the consultant (if any) stating “(a) that the prescribed ToRs have been complied with (to be deleted if not applicable) & (b) that details and the data presented are factually correct”, as per along with other informationis also to be submitted. Contents of the affidavit in the form other than that mentioned above shall be construed as misleading the committee.

2. In cases of Mining Projects (applying for ToRs/EC): (i) Provide information in Annexure-E (Part-A, B & C), (ii) Certificate regarding mine lease area not falling in the Aravalli Hills to be issued by the Mining Engineer/ Assistant Mining Engineer in the prescribed format, as per the instructions contained in the letter no. DMG/ADM/Env/EC/F11/06/17-76 dt. 17.01.2011 issued by the Director, Department of Mines and Geology, GoR, Udaipur, should be countersigned by the Additional Director (Mines), DMG of concerned Region and copy be submitted with other required documents.(III)Projects covered under MoEF Notification Dtd. 9.9.13 should submit all relevant documents as per the Notification .Projects being claimed under B2 category by the PP as per MoEF OM Dtd 24.6.2013 and/or Dtd 24.12.13 along with following :-

(i) Part-A, B & C of Annexure-E is attached as Annexure-8

(ii) Certificate regarding mine lease area not falling in the Aravalli Hills is attached as Annexure-9

ii. The PP should submit a copy of the Laboratory reports that clarifies that the quality of the mined mineral (for parameters like Sp. Gravity, Water Absorption, Impact, Crushing Strength etc) confirms to the required quality and specifications for use in the proposed project.

The quality of the mined mineral with parameters is shown in Annexure-12

iii. Considering the limited area, for cases where it is not feasible to carry out plantation on 33% of the area in the proposed project, an alternate land of 33% area should be identified in the nearby area in consultation with the concerning Gram Panchayat and the PP should submit a commitment to carry out the entire plantation in that area in this coming rainy season.

iv. The PP should submit information regarding local geology of the area.

v. The PP should submit a copy of the map along with a letter from the competent authority (SME/ ME/AME) of the Mining Deptt. Regarding details of other mining leases falling within 500 mts.from the periphery of the proposed mine under consideration for EC. The details must include the name of the mineral,(major/minor), name of the lease holders, lease no., area of that mine and total area of all the mines as per the Survey plan/mining plan so as to ascertain whether the unit falls under B2 category as per MoEF, OM dtd24.12.2013.The certificate from competent authority along with a map showing all such mines with index as follows be submitted :-

vi. The Air, Noise monitoring data for the site, for 24 hrs should be submitted for parameters like PM2.5 ,PM10, SOx, NOx and CO.

The monitoring data at the project site for air, noise is attached as Annexure-16

vii. The ground water table data at the proposed mine should be submitted. Ground water sample analyses for one location, at or near the site for all relevant parameters (physical and chemical) should be submitted. It should be clearly indicated that the water table will not be affected by mining activity.

viii. The PP should submit a certificate regarding mine lease area not falling in the Aravalli Hills, to be issued by the Mining Engineer/ Assistant Mining Engineer in the prescribed format, as per the format contained in the letter no. DMG/ADM/Env/EC/F11/06/17-76 dt. 17.01.2011 issued by the Director, Department of Mines and Geology, GoR, Udaipur. For B2 category of projects countersign by the Additional Director (Mines), DMG of concerned Region may not be necessary.

3. In all cases, the land ownership documents along with latest position/status regarding title of land should be submitted with other documents required for ToRs/EC. Land document/agreement letter should be duly registered and submitted.

4. For construction projects under category 8 of schedule, i. The PP and consultant should submit an affidavit on Rs

10 non judicial stamp paper, duly attested by the notary, as per annexure „G‟.

ii. All the plans/maps should be on an appropriate scale (preferably on a linear scale) and should bear the sign and seal of the architect.

5. The construction project would be appraised on the basis of From 1, From 1A and the conceptual plan as per the EIA notification Dtd 22.8.2013, as such the PP should ensure submission of detail information on each points of Form 1, Form 1A and the conceptual plan.

6. Each page of all relevant documents (prepared as per the notification and guidelines available on the website of MoEF, GoI) and the affidavit/undertaking should be signed by the same person (PP or Representative) duly authorized in this regard, copy ofAuthorization Letter along with copy of resolution passed by the Company in support of being Authorized Signatory for the specific project, in such case be submitted).

7. (a) The resume and nature of the consultants/disclosure of Consultants engaged for the project should be provided with their telephone numbers and e-mail addresses as per the format in EIA Notification dt. 14.9.2006 and related circulars (Annex-C), indicating

(a)Disclosure of Consultants engaged and details indicating status of accreditation of the Consultant company by QCI/ NABET (Annex-C) is

status of accreditation by QCI/ NABET (quoting the accreditation number). The Consultants and the PP should ensure that the Consultant qualifies for the presentation for the proposed project sector as per the QCI Circulars issued from time-to-time. Ineligible consultant should not appear for presentation. (b) The consultant should mention the serial no. at which the name of the consultant appears in the latest list available on MoEF website.The accredited consultant should also submit a copy of accreditation letter issued by MoEF/QCI/ NABET indicating approval of sectors and experts.

8. A statement of commitments related to the proposed project, for compliance during post E.C. period should be submitted in the format prescribed at Annex-“F”.

The statement of Commitments by the PP for compliance during Post EC period is attached as Annexure-20

9. The Pre-Feasibility Report should be prepared in the prescribed format, as per the instructions in the guidelines issued by the MoEF vide circular no. J-11013/41/2006-IA.II (I) dt. 30.12.2010 and be submitted with other required documents to the SEAC office and to all Members of the Committee.

10. Each page of all documents, including reports, statements, annexure, appendices, maps, plans, diagrams, plates etc. should be serially / properly numbered for ready reference during presentation. In the beginning of the documents, “Contents / Index” should serially list the items included in the report, indicating the page no./ annexure no./ appendix no./ map no./plate no. etc. Each page of all the documents including photographs (displaying date of photo taken) to be submitted should be signed, dated & sealed by the proponent as well as the consultant. Unsigned / unsealed documents shall be construed as not submitted. Un-necessary splitting of the report in volumes should be avoided.

All documents are serially numbered. Each page is signed, dated & sealed by the proponent and consultant.

11. The cover page of the documents submitted should contain following information only. (i) Title of the project and its location, (ii) Capacity per annum (in case of mining project the lease area and lease validity) and in case of increase in capacity the existing and proposed capacity, (iii) Objective of the project report (whether “for TOR” or “for EC”), (iv) The period of study, (v) In case more than one documents are submitted, Vol. No and its content should be mentioned,(vi) Name and address of proponent and project in-charge, E-Mail address, Fax no. telephone/mobile no., (vii) Project cost, (viii) Dispatch number and date of issue of work order to consultant by P.P., (ix) If different fonts are used, font used for the title be the largest one. (x) Information as per MoEF office Memorandum no. J-11013/41/2006-IA II (I) dt. 04.08.2009.

12. Changes if any, in the information that has already been submitted should be clearly highlighted and detailed out along with reasons / clarification and it should be informed at the beginning of the presentation also.

14. Any deficiency regarding the title of the land (either whole or part), ownership (either whole or part), and violation of agreement condition of land allotment/sale deed should be specifically mentioned/ highlighted by the PP and / or Consultant. In case of agreement letter, the document should be registered.

15. The source of monitoring data, specifications of equipments used, details of agency if outsourced, date and time of collection of data, latitude and longitude of sampling points (Air/Water/Soil/Noise etc.) should be clearly mentioned.

16. (i) Does the area fall under the CGWA notified zone or not. If yes, information regarding the source & necessary approval from related agency for procuring water from a legal source should be submitted.

The area does not fall under the CGWA notified zone so NOC from CGWA is not required.

17. The P.P. and the Consultant should clearly report in writing {yes/No(Details if yes)} whether there has been any violation of provisions of EIA Notification dt. 14.09.2006, and amendments made thereafter, circulars and O.M. issued their under and also inform at the start of presentation clearly (to be a part of computer presentation also).

18. 19. Used filter papers (Air monitoring) along with photographs of the site showing Air / Water / Noise/ Soil sampling / monitoring activity / equipment being used at each station (giving latitude and longitude of each sampling points) should be submitted. 21. A separate site lay out plan indicating the Number and Location of Existing well / Bore-well / Tube-well (if any) in the proposed project should be submitted giving details of the year of digging of each of the well and its use. Photographs of each of such wells should be enclosed mentioning date of photographs. In case there does no exist well / tube well / bore well it should be clearly stated in writing.

26. The P.P. shall ensure and confirm that the documents have been received by the members in time for its critical examination by them {by 15th March, 2014 (Saturday) }, because if the documents, complete in all respect are not received within the specified date, the case may not be discussed in the meeting at all.
