Facts:
1. The appellant filed RTI applications referred to in the appeals (a list of 651
cases is at annexure I to this order). They involve broadly six categories wherein
similar nature of information in respect of declaring Bar Association as public
authority, Land & Building of Bar Association, money spent on the
maintenance/new construction of Bar Association & Advocate Chambers & shops in
the Punjab & Haryana High Court, Chandigarh and its subordinate Courts at Sirsa,
Amloh, Kalka, Patti, Assandh, Shri Muktsar Sahib, Hodel, Hathin and Sangrur etc.
has been sought.
2. Information sought for by the appellant and response given by the respondent on
a sample basis for each of 6 categories of questions is given below:

d) Please provide income & expenditure of Bar Association welfare fund, benevolent fund from 1.1.1996 to 20th May, 2015 with file notings & policies.
e) Whether this Bar association is State as defined under Article 12 of Constitution of India & Public Authority as defined in Section 2(h) of RTI Act, 2015? If yes, how? If no, why? What are the Supreme Court, Punjab & Haryana High Court, Bar council of India rulings on this.

b) How many cases, appeals, writs, petitions, suits, complaints are pending in Sub Divisional judicial courts, Naraingarh as on Ist July, 2015? How many judicial officers are posted there? How many supporting staff including class II, III, IV officers are posted there? How many of them are permanent staff and how many of them are on DC rates? What are the policies of Govt./Punjab & Haryana High Court on hiring staff on DC rates?
c) What are the policies & directions of Supreme Court on selection of Judges of all categories? What are the recommendations of Law commission on having the no. of Judges of all categories? What are the policies on recruitment of supporting staff? Is there any shortage of Judges or supporting staff at these Sub Divisional Judicial Courts? b) In special Leave Petition No. (C )No. 25237/2010 with SLP No. 23984/2010, Supreme Court has stated that ( on the issue of use of vehicles with red lights, we were inclined to agree with Shri Harish Salve, learned Amicus that use of signs & symbols of authority such as red lights etc., is contrary to the constitutional ethos and the basic feature of republicanism---) is this true?
c) If yes, then who are the Officers of State Govt. Or Punjab & Haryana High Court who has authorized the judicial officers to use Amber or Blue lights? Are they liable to be held under the contempt of Court? Whether any action has taken against them so far?

Who are the approving/recommending authorities in Punjab & Haryana High Court. If this is govt land, how much money did it pay to govt to buy/lease/annual rent? Please provide all the policies/proposal/recommendation/allotment details of this land including file notings in Punjab & Haryana High Court.
b) How much money has been spent on the maintenance/new construction of Bar Association & advocates chambers from public/non public funds, from 01 Jan 1996 to 18th May, 2015, along with policies and file notings. and the same is being deposited by the concerned Allottee
in the Account Head of UT Treasury through this Court.
-Only six shops existing in High Court Building on
Chandigarh Administration’s land have been allotted
under the orders of Hon’ble Chief Justice from time to
time. The rent deposited by the allottees of all six shops in
the Account Head of UT Treasury is Rs. 30987/- per month
(including water and scavenging charges)

Architecture Departments of Punjab and Haryana at
Chandigarh. Lay out plan of the buildings of District Bar
Association/Bar Association and Lawyers Chambers are
approved by the Hon’ble Building Committee of Punjab
and Haryana High Court. Monthly rent of Rs. 50/- for each
chamber constructed are being paid by the Lawyers to
concerned Deputy Commissioner in the State of Punjab
and Haryana, as per notification dated 11.11.2002 of the
Haryana Government

maintenance/construction of the building of District Bar
Association/Bar Association in the States of Punjab and
Haryana, is with the Chief Engineer (Sought)-cum Nodal

Chambers are being constructed by the lawyers at their
own expenses and maintenance thereof is also looked
after by them. State Government of Punjab and Haryana
are the approving authorities.

1(a) Total 1735804 cases have been registered in this Court during the period from 01.01.1996 to 30.06.2015, the year wise detail of which are given below:-

members of Bar Association, Hodel? c) How much professional fees have these
advocates charged from their clients? Whether they informed Punjab & Haryana High Court and its subordinate courts/govt about this fee? Whether this financial transaction was done by cheque/credit card or cash? If this professional fee is taken by cash, are there any rules by Supreme Court or Punjab & Haryana High Court or BCI to disclose this income? Do they issue receipt for fees taken? Who issues Form 16 to these advocates including Advocate Generals & their subordinate advocates? Is this the convenience of these advocates to file their IT returns as per their discretion, if there is no check on their fees and expenditure? Does this lead to black money generation? Are these advocates paying any service taxes? Are these advocates paying VAT/Sales Tax/ Octroi or any other local or central taxes on their purchases of books, software etc. How much do these advocates pay to their juniors/clerks /munshis & issue Form 16 to them ? Do they deduct income tax at source from their salary & deposit with govt?
d) On what authority, these clerks/munshis & even advocates enter Punjab & Haryana Court premises & who is responsible for security checks carried on them.

However, no data is maintained about the Vakalatnama/POAs etc. and such, no information can be supplied in this regard. 1(b). No such data is maintained regarding the membership of Advocates with the Punjab and Haryana High Court Bar Association and the District Bar Associations in the States of Punjab and Haryana and therefore, no information is available in this regard. 1(d) The Advocates and Munshies enter in the High Court premises after showing their respective identity to the security personnel deputed at the entry gates of this Court. The security of this Court premises is provided by the Chandigarh Police. Rest of the information does not relate to this Court/not available in this Court.

3. The appellant has prayed in the second appeals that-
a) Bar Association, its members & Advocates should be declared ‘State’ as defined in
Article 12 of the Constitution of India, as well as Public Authority as per section 2(h)
of the RTI Act, 2005.
b) He should be given information requested in his applications as per section 6 of
the RTI Act.
c) Penalty as applicable may be imposed as per section 20(1) of the RTI Act.
d) Disciplinary action may be initiated against Sh. Malik, Central Public Information
Officer, Punjab & Haryana High Court, and Chandigarh as per section 20(2) of the
RTI Act.
f) Any other relief as deemed fit by the Commission.
Hearing
4. The appellant and the respondent both participated in the hearing personally.
Both the parties agreed to hearing of the cases together.
5. The appellant stated that the nature of information sought for by him can be
classified into six categories viz four with regard to administration side and two with
regard to judicial side of the Hon’ble High Court of Punjab and Haryana.
6. The appellant referred to following documents for perusal for this Commission:
a. Reply of CPIO, Hon’ble Punjab & Haryana High Court dated 30.05.2015 along
with Govt. of India; Chandigarh Administration Gazette Extraordinary dated
September 16, 1988,
b. Copy of Judgment of Punjab & Haryana High Court Bar Vs Union of India And
Ors on 30 May, 2007 cited as (2007) 147 PLR 565,
c. The Bar Council of India Rules, the Advocate Act, 1961 & the Certificate of
Practice & Renewal Rules, 2014, and
d. This Commission’s decision CIC/SA/A/2015/001262, 1263, 1264, 1265
dated 17.03.2016.

7. The appellant stated that he had sought certain information through separate
RTI applications in respect of the Land & Building of Bar Association, Advocate
Chambers & shops in the Punjab & Haryana High Court, Chandigarh, and its
Subordinates Courts, financial assistance provided to the Bar Associations of
Punjab & Haryana High Court and District Bar Associations of Subordinate Courts
from 01.01.1996 to 20.05.2015; whether the Bar Association is registered under
Constitution of India/Act of Parliament/any other law; money spent on the
maintenance/new construction of Bar Association Shops and restaurants from these
ventures in the last 20 years; how much income tax, sales tax, VAT, Octroi, service
tax and other Govt. taxes have been paid by Bar Associations in the last twenty
years; other facilities/subsidies/assistance provided by Punjab and Haryana High
Court to Bar Association like electricity bills, water bills, furniture etc. from
01.01.1996 to 20.05.2015 with file notings and policies; whether the Bar Association
is ‘ State’ as defined under Article 12 of Constitution of India and ‘ Public Authority’
as defined in Section 2(h) of RTI Act, 2005, if yes , how? If no, why? What are the
Supreme Court, Punjab & Haryana Court & Bar Council of India ruling on this and
any other relevant information?
8. The appellant stated that he has to spend lot of time, energy and money in
filing these applications to combat the corruption in the Bar Associations, High
Court of Punjab & Haryana and its subordinate Courts and to make them
accountable and bringing transparency.
9. The appellant stated that he has filed these second appeals on two grounds.
First, he has not been provided information and second, Bar Associations to be
declared Public Authority under section 2(h) of the RTI Act.
10. The appellant stated that the High Court is avoiding to provide him all the
information, even those information, which are required to be disseminated u/s 4 of
the RTI Act. The appellant stated that the respondent is hiding the information with
wrong motive.
11. The appellant referred to his RTI application and stated that the issues
regarding payment of water and electricity charges of Bar Association of Punjab and
Haryana, Chandigarh, has been elaborately dealt with by the Hon’ble Punjab and
Haryana High Court in CWP No. 2042 of 2007 where it held that the Bar Rooms, Bar

Library, office of the Bar Association and Bar Lounge are part and parcel of the High
Court and , therefore, their water and electricity charges should be borne by the
High Court as had been done in the past. The appellant stated that the Government
and Punjab and Haryana High Court have financial, functional and administrative
control over the Bar Association and advocate chambers and the control lies with the
Chief Justice of the Punjab and Haryana High Court.
12. The appellant stated that land & buildings of Bar Associations as well as
Advocates Chambers is given free of cost by State Government. Electricity & water
bills of Bar Association are borne by the High Court; many employees of the High
Court are working for Bar Association of Punjab & Haryana High Court. The
appellant stated that about 60-70 shops are run by the Punjab & Haryana High
Court Bar Association in the Punjab & Haryana High Court complex. The appellant
stated that the Bar Association of Punjab & Haryana High Court is substantially
funded directly or indirectly by the State and the Punjab & Haryana High Court. The
appellant stated that the allotments and cancellation of advocate chambers are done
by the Hon’ble Chief Justice of Punjab & Haryana High Court in consultation with
the President of the Bar Association. The details of the allotment of chambers and
file notings of any approval relating to financial approval must be available with the
Punjab & Haryana High Court. The appellant stated that the building Plan of the
Bar Association has to be approved by the High Court therefore the minutes of
meeting/file notings must be available with the High Court. The Appellant stated
that that the same analogy is applied for the subordinate District & Session Courts.
The appellant stated that there must be a policy in this regard. The appellant stated
that no information has been provided to him.
13. The appellant further stated that the opinion ‘whether Bar Association is a
State’ comes under section 2(f) of the RTI Act and respondent is expected to answer
this query. The appellant stated that when someone files contempt petition, the
Registrar (Judicial) is the final authority to decide, whether it is maintainable or not
i.e. Registrar’s opinion is final.
14. The appellant further stated that he has not been provided the polices &
directions of Supreme Court on selection of Judges of all categories,
recommendations of Law Commission in relation to strength of Judges, shortage of

staff, monthly quota of disposal of case by judicial officers, inspection report of
Judges, number of class IV employees working at the judicial officers residence etc.
The appellant stated that there is a system that every judge of the High Court is
administrative Head of one District Court and carried out inspection periodically.
The appellant stated that subordinate Court submits their cases disposal data to the
High Court. The appellant stated that all data are available in the computer of the
High Court and with a click on computer the data can be retrieved. The appellant
stated that the performance data of the Judicial Officers should not only be provided
to him but also put on public domain in public interest.
15. The appellant further stated that details of the advocates who are members of
the Bar Association and doing different business after enrolment in the Bar Council
of India (BCI), number of advocates struck off the roll of BCI for doing other business
and using different names etc. has not been provided to him. The appellant stated
that every case in a Court is filed with a vakalatnama. Hence, the details of
practicing advocates can be provided by the respondent.
16. The appellant further stated that in view of the Supreme Court’s Orders, he
has sought information with regard to use of Amber , red or Blue light, colour of
lights with flasher used by the Judicial Officers on their official or private vehicles
and authorization authority for the same. The appellant stated that he has been
provided misleading information that the beacons are used as per Transport
Department directions. The appellant stated that the Transport Department cannot
direct the District & Sessions Judges regarding use of colour of lights on their
vehicles. The appellant stated that he wanted to know; whether the judicial officer is
liable to contempt of Courts for violation the Supreme Court’s direction and what the
policy/guidelines are in this regard.
17. The appellant stated that information which was available with the Hon’ble
Punjab & Haryana High Court should have been provided to him and for the rest his
applications should have been transferred under section 6(3) of the RTI Act to the
concerned public authorities. However, the respondent neither transferred his
applications nor provided the sought for information.
18. The respondent stated that the appellant was duly intimated that most of the
requested information does not relate to the Punjab and Haryana High Court and

whatever information available in that Court was supplied to him. He submitted
that the rent for space occupied by the Bar Association of Punjab and Haryana High
Court Chandigarh, was waived off by the Chandigarh Administration vide letter
dated 13.06.2014 issued by the Joint Secretary (Home), Chandigarh Administration,
Home Department, Chandigarh, wherein it was stated that the Bar Rooms, Bar
Library, Office of the Bar Association and Bar Lounge etc. are part and parcel of the
Hon’ble High Court complex at Chandigarh and under these circumstances, it is not
advisable for Chandigarh Administration to claim rent from the Bar Association of
Punjab and Haryana High Court. He submitted that the bill of electricity and water
charges of the Bar Association of Punjab and Haryana Chandigarh is being paid in
compliance of the above said judgment, whereas rent for the space occupied by said
Bar Association is waived off in view of the said letter issued by the Chandigarh
Administration, as the High Court Building is located on the Chandigarh
Administration land. The respondent stated that no benefit is given to the chambers
being occupied by the members of the Bar Association or any other part of the
building which has been leased on commercial purpose. The respondent stated that
so far as Bar Associations of Subordinate Courts at the level of District & Sub-
Divisions and other public authorities, located in the States of Punjab & Haryana as
well as U.T. Chandigarh, are concerned, they have nothing to do with the matter as
under the RTI Act, the scope and duties of the PIO is very limited. The PIO is only
supposed to supply the information, which is available on the record of a Public
Authority.
19. In reply to the queries during the hearing, the respondent stated that no
regular fund is given by the Punjab and Haryana High Court to the Bar Associations.
The respondent stated that the chambers for the Advocates are allotted by the
Hon’ble Chief Justice of the High Court in consultation with the President of the Bar
Association. The respondent stated that the allotment of chambers is made under
the ‘High Court of Punjab and Haryana Lawyer Chambers (Allotment and
Occupancy) Rules, 1988’. As per the Rules, the allottee of a chamber is liable to pay
the electricity charges as per separate electric meter to be provided for electricity
consumption. The respondent stated that license fee is collected by the High Court
and remitted directly to Chandigarh Administration. The respondent stated that they

have no role in respect of allotment of chambers to the Advocates in the Subordinate
Courts of Punjab and Haryana and U.T. Chandigarh. The respondent stated that
they have no record regarding employees of the Bar Association. The respondent
stated that the ‘Vakalatnama’ related issues are totally out of control of the High
Court. The respondent stated that there are about 1100 Bar Associations and it is
not feasible for them to transfer appellant’s RTI applications to concerned Bar
Associations. The appellant stated that the information with regard to the tax
liability of the individual Advocates is not available with them. The respondent
stated that Building Committee of the Hon’ble High Court had taken suggestions
and no file notings was generated in this regard.
20. In reply to the queries during the hearing, the respondent further stated that
inspection report of the subordinate Courts is not available with them. It is at the
discretion of the inspecting Judge to submit report in writing or not. The respondent
stated that the primary authority for keeping inspection record is the District &
Sessions Judge. The respondent stated that every Court has its own PIO and First
Appellate Authority under the RTI Act. The respondent stated that it is not feasible
for the PIO of the High Court to collect the information from all subordinate Courts
or transfer the appellant’s huge number of RTI applications to the concerned
concerned Courts. The respondent stated that the appellant should directly file the
RTI applications to the concerned Courts or Authority.
21. In reply to query during the hearing, the respondent further stated that they
are of the view that the appellant only asked about the selection of Judicial Officers
of Subordinate Courts and not about the High Court Judges. Therefore, the
information on selection criteria/process of High Court Judges has not been
informed to the appellant. The respondent stated that the appellant was informed
that the information relating to number of Judicial Officers is available on the
website of the High Court. The process of selection of District Judge/Additional
District & Sessions Judge for the States of Punjab & Haryana is under the sole
domain of the High Court. The appointments are made as per provisions of
Punjab/Haryana Superior Judicial Service Rules, 2007 as amended from time to
time. So far as the recruitment process for selection of Civil Judges (Jr. Division) is
concerned, the examination for the purpose is being conducted by the High Court

and the concerned State Governments and respective Public Service Commissions.
The respondent stated that on an yearly basis vacancies are filled up through exam
as per the extant Rules. The respondent stated that D.C rates are not applicable in
the High Court.
22. The respondent stated that appellant is seeking mainly
advice/comments/opinion/explanation/interpretation/presumption which is
beyond the jurisdiction/duties of the PIO and not covered under section 2(f) of the
RTI Act.
23. The respondent stated that the appellant has been seeking vexatious
information from the Hon’ble High Court of Punjab & Haryana, Chandigarh under
RTI Act, 2005. The respondent stated that the appellant is an Advocate and well
qualified person. He is supposed to know where the information requested is
available. The respondent stated that the appellant is in the habit of filing
applications after applications knowingly for repeated information despite having
been made to understand many a time that such information is not with the High
Court of Punjab and Haryana.
Discussion/Observations
24. On thorough perusal of the case files and hearing both the parties at length by
giving ample opportunity of hearings and submitting written submission, it is
observed that the appellant and the respondent both categorized the requested
information in 6 categories as stated above.
25. As regards category no. 1 (RTI application dated 21.05.2015), during the
hearing respondent, clarified that no regular fund is given by the Punjab and
Haryana High Court to the Bar Associations He submitted that the bill of electricity
and water charges of the Bar Association of Punjab and Haryana Chandigarh is
being paid in compliance of the High Court order, whereas rent for the space
occupied by said Bar Association is waived off in view of the letter issued by the
Chandigarh Administration, as the High Court Building is located on the
Chandigarh Administration land and no benefit is given to the chambers being
occupied by the members of the Bar Association or any other part of the building
which has been leased for commercial purpose. The information with regard to Bar

Associations does not relate to the High Court and declaring Bar Association as
‘State’ is beyond the jurisdiction/duties of the PIO and is not covered under section
2(f) of the RTI Act. This Commission concurs with the views of the respondent.
26. As regards category 2 (RTI application dated 26.05.2015), the information with
regard to the details of advocates and their membership in the Bar Associations, it is
evident that the appellant was informed that the information is not available with
the High Court. The Commission concurs with the reply of the respondent.
27. As regards category 3 ( RTI application dated 05.07.2015), the information
with regard to establishment, vacancy of the High Court Judges and Judicial
Officers, Selection criteria of Judges and Judicial Officers, pendency of cases in the
Sub Divisional Courts, recommendation of the Law Commission etc. it is evident
that the available information has already been provided to the appellant. However,
the information such as policies & direction of Supreme Court on selection of Judges
of all categories could have been provided to the appellant. The application, to the
extent the information sought relates to the recommendations of the Law
Commission, could have been transferred to the Law Commission.
28. As regards category 4 (RTI application dated 06.07.2015), the information with
regard to the authority for the Judicial Officers to use of beacon/Red, Amber or blue
lights etc., it is observed that the appellant’s 114 applications had already been
transferred to the concerned authorities. However, the direction of the Hon’ble High
Court regarding use of beacons could have been provided to the appellant.
29. As regards category 5 (RTI application dated 19.05.2015), the information with
regard to the land on which the Advocates Chambers, shops are built, allotment
details, money spent on maintenance/ new construction on chambers etc. It is seen
that the appellant has already been informed that the Bar Association, Advocate
Chambers & Shops of Punjab and Haryana High Court are built on Chandigarh
Administration’s land and the buildings of District Bar Associations Divisions/Sub
Divisions and Advocate Chambers are built on the land provided by the respective
State Government. It is observed that a detailed reply regarding rent of shop and
license fee of chamber, construction of chambers has already been given to the
appellant. It is observed that the satisfactory reply has been given to the appellant.
However, details of the allotment of Advocates Chambers, details allotment

committee and file notings could have been provided to the appellant as the
Chairperson of the Allotment Committee is the Hon’ble Chief Justice of the Punjab
and Haryana High Court.
30. As regards category 6 (RTI application dated 30.06.2015) the information with
regard to cases received along with Vakalatnama in the High Court of Punjab and
Haryana and professional fee of the advocates, membership of advocates in the Bar
Associations etc. it is evident that the yearwise data of cases registered in the High
Court has already been provided to the appellant. The appellant has also been
informed that no data is maintained about the Vakalatnama and Membership of the
advocates in the Bar Associations, fee charged by the advocates etc. The
Commission concurs with reply of the respondent. However, the application, to the
extant information related to membership of the advocates and practice ethics of
advocates, could have been transferred to the Bar Council of India.
31. It is observed that the appellant has sought for very huge/voluminous
information such as information related to Bar Associations of the Hon’ble High
Court of Punjab & Haryana and Subordinate Courts, Bar Council of India, Law
Commission of India, etc.
32. It is observed that some requested information, which is available with the
respondent, could have been provided to the appellant.
33. It is observed that the appellant has not filed any application against the Bar
Association, Punjab and Haryana High Court. Thus, the issue of declaring the Bar
Association as a ‘Public Authority’ under section 2(h) of the RTI Act cannot be
considered by this Commission in these appeals.
34. This Commission in its decision No. CIC/AT/A/2008/01280 dated
22.09.2009 held that-
“56. A public authority which does not hold or is not related to an information
sought by a petitioner, will not be obliged to provide an answer to the
petitioner only for the reason that that public authority was the Apex body or
the nodal office of others sub-ordinate public authorities. Such a public
authority ⎯ such as the CBEC or the Ministry of Finance/ Department of
Revenue ⎯ when it receives an RTI-application for disclosure of an information
which both the petitioner and the CBEC or the Ministry know is held by

subordinate offices such as the Commissionerates, then the public authority
(CBEC or the Ministry) may inform the petitioner that it was not the holder of
the information and hence not the ‘concerned public authority’. In the
alternative, such a public authority may choose to help the petitioner by
transferring his request to the subordinate public authorities where the
information was known or expected to be held. This latter decision is to be of
the public authority given the circumstances and the conditions surrounding
the petition and the case. It cannot be claimed by the petitioner as a matter of
right ⎯ a substitute for his own due diligence, i.e. to file the petition under
Section 6(1) appropriately before the public authority which is known to hold
the information requested and, more importantly, which the petitioner himself
knows holds the information.”
35. The Hon’ble Supreme Court of India in Civil Appeal No. 6454 of 2011 (Central
Board of Secondary Education & Anr Vs. Aditya Bandopadhyay & Ors. held that-
“37. The right to information is a cherished right. Information and right to
information are intended to be formidable tools in the hands of responsible
citizens to fight corruption and to bring in transparency and accountability.
The provisions of RTI Act should be enforced strictly and all efforts should be
made to bring to light the necessary information under clause (b) of section
4(1) of the Act which relates to securing transparency and accountability in
the working of public authorities and in discouraging corruption. But in
regard to other information,(that is information other than those enumerated
in section 4(1)(b) and (c) of the Act), equal importance and emphasis are given
to other public interests (like confidentiality of sensitive information, fidelity
and fiduciary relationships, efficient operation of governments, etc.).
Indiscriminate and impractical demands or directions under RTI Act for
disclosure of all and sundry information (unrelated to transparency and
accountability in the functioning of public authorities and eradication of
corruption) would be counter-productive as it will adversely affect the
efficiency of the administration and result in the executive getting bogged
down with the non-productive work of collecting and furnishing information.

The Act should not be allowed to be misused or abused, to become a tool to
obstruct the national development and integration, or to destroy the peace,
tranquility and harmony among its citizens. Nor should it be converted into a
tool of oppression or intimidation of honest officials striving to do their duty.
The nation does not want a scenario where 75% of the staff of public
authorities spends 75% of their time in collecting and furnishing information
to applicants instead of discharging their regular duties. The threat of
penalties under the RTI Act and the pressure of the authorities under the RTI
Act should not lead to employees of a public authorities prioritising
‘information furnishing’, at the cost of their normal and regular duties.”
36. The appellant is an Advocate and well qualified person. It seems that he is
filing applications knowingly for repeated information that is not with the High Court
of Punjab and Haryana. It is observed that once he was informed that the requested
information was not related to or not available with the High Court, he should have
filed the application for such information direct to the concerned public authority.
Decision:
37. In view of the above facts, hearing and observations, the respondent is directed
to:
(a) Provide information, in the context of RTI applications, to the appellant as
follows- (i) the details of the allotment of Advocate’s chambers and file notings
relating to allotment of chambers (ii) The building Plan of the Bar
Association approved by the Hon’ble High Court of Punjab and Haryana and
the minutes of meeting/file notings and policy in this regard. (iii) Polices &
directions of Supreme Court on selection of Judges of all categories, if
available (iv) Subordinate Court’s case disposal data submitted to the Hon’ble
High Court. (v) policy/guidelines/orders with regard to use of beacons by the
Judicial Officers, if any, issued by the Hon’ble High Court of Punjab and
Haryana.
(b) Transfer the RTI applications of the appellant under section 6(3) of the RTI Act
to (i) Law Commission with regard to recommendations of Law Commission in

relation to strength of judges, shortage of staff, monthly quota of disposal of
cases by judicial officers etc. as concerns the Law Commission (ii) Bar Council
of India, with regard to advocate related information etc. as concerns the Bar
Council of India; and
(c) Comply with the above within 30 days of receipt of this order.
38. There is no doubt that the appellant is a man of caliber having retired as a
Wing Commander from the Air Force and an Advocate by profession. He is expected
to know the public authority which holds the information sought for by him. As a
matter of right he cannot claim that his applications be transferred by the
respondent to appropriate public authorities. Hence, he is advised to file RTI
application/s to the appropriate public authorities and avoid filing multiple RTI
applications seeking similar nature of information.
The appeals are disposed of. Copy of this order be given free of cost to the
parties.
