I am directed to state that the Cabinet Secretariat vide its letter No. I1112/3/2016-Cab. III dated29.12.2017 has forwarded a copy of draft guidelines prepared by the Ministry of Communicationsregarding settlement of claims for compensation to the families of the victims dying at public places due tothe negl igence and / or unforeseen causes. The draft guidelines have been prepared by the DoT inconnection with a case within their jurisdiction. The Additional Solicitor General handling the case hasrequested that DoT guidelines may be examined by all Ministries/Departments to follow the same or drafttheir own guidelines along similar lines.

Accordingly, the M/o MSME has forwarded a copy of the guidelines to the % DC (MSME) withI a request to examine the same for adoption with or without modifications as per need. A copy of the

guidelines along with copies of letters received from the Cabinet Secretariat and the M/o MSME areenclosed. It is requested that the draft guidelines may be examined with specific emphasis on the definitionof accident in the context of your office, the workshops attached to your office, the safeguards in place etc.

Specific suggestions may be offered immediately, so as to take an appropriate decision whether toaccept the guidelines or not and if the guidelines are to be accepted, whether the same should be done withor without modifications.

With reference to Cabinet Secretariat's 1.0 No. 11.1/2/3/2016-Cab III dated 12.07.2017 anddated 29.12 2017(copy enclosed) on the above mentioned subject, I am directed to Gay that 0/0Telecommunications (DoT) had framed quidelines (copy enclosed) under the directions of Delhi HighCourt for compensation in cases of death I permanent incapacitation due to negligence and I orunforeseen causes in the course of provision of public services.
