Agenda Item No. 1. Confirmation of minutes of the 188th meeting of

Executive Committee and its Adjourned meeting held on 04.03.2014 & 07.03.2014 at New Delhi.

It was noted that 188th meeting of Executive Committee and its Adjourned meeting

was held on 04.03.2014 & 07.03.2014 at New Delhi. The minutes of the same will

be placed before the Committee at the time of consideration of the same.

Executive Committee confirmed the minutes.

Agenda Item No. 2. The Establishment of New Medical College, opening

of New or higher Course of Study or Training and

Increase of Admission Capacity by a Medical College

(Amendment) Regulations, 2013 - Notification

regarding.

It was noted that the Govt. of India has forwarded a copy of Draft Regulation

namely; “The Establishment of New Medical College, Opening of New or Higher

Course of Study or Training and Increase of Admission Capacity by a Medical

College (Amendment) Regulations, 2013” approved by Hon’ble Minster of Health

and Family Welfare and duly vetted and translated in Hindi by Legislative

Department of Ministry of Law & Justice and further requested to get it notified in

the Gazette of India and to send 100 copies of the same for taking further action

to lay on the table of both the Houses of the Parliament in the coming session.

Accordingly the Executive Committee at its 188th meeting considered the matter

and deferred the same to the next meeting.

Executive Committee referred the matter to Regulation Amendment

Committee.

Agenda Item No. 3. Ratification of the decision of President

I/C in respect of payment to Senior

Advocates appearing on behalf of CCIM.

It was noted that given below are the details of payments done by CCIM to

Senior/Additional Advocates with the sanction of President I/c, CCIM for

pursuing the cases before the Supreme Court of India, High Court of Delhi

and Nanital.

With regard to appointment of Senior/Additional Advocates, suggestions

were made by Legal Axis to President I/c, CCIM & President I/C CCIM

accordingly approved the appointment of Senior/Additional Advocates and

sanctioned their bills.

Executive Committee ratified the same.

REGISTRATION

Agenda Item No. 4. Request for permanent Registration at the

Medical Council Travancore- Cochin Kerala.

It was noted that a letter has been received from Dr. Carina Miorin, Trivandrum

regarding request for permanent Registration at the Medical Council Travancore-

Cochin Kerala. The contents of letter are as under:- “I am a German national and have graduated from the University of Kerala in 2012

after studying BAMS at Shree Narayana Institute of Ayurvedic Studies and

Research. I am trying to get my registration at the Medical Council of Travancore- Cochin after the completion of my internship in December 2013. Unfortunately

there is no provision provided for foreign nationals who graduated in BAMS for

registration.

The Medical Council Registrar has mentioned that the IMC has issued a direction to

Medical Councils to provide permanent registration to foreign MBBS medical graduates.

We request you to provide a similar direction to the Medical Council Travancore-

Cochin so that foreign nationals could get registration in the Council so that I could

get my registration done at Travancore-Cochin Medical Council.”

Executive Committee decided to get information from MCI about the

procedure followed for Foreign students and then put up in EC.

TECHNICAL

Agenda Item No. 5. Suggestions on teacher’s eligibility issue

based on 186th Meeting of EC by Screening

Committee.

It was noted that a letter is signed by Dr. B.P. Pandey & Dr. Udaykumar, EC

Member is received in the office. The contents are as under:-

“In the Agenda Item No.6 of 186th EC held on 04.02.2014, it is decided that all

issues will be categorized by the Screening Committee on the basis of the decision

of the additional Agenda Item No.6 of 184th meeting of the EC except point no. 20.

Thereafter, the recommendation of Screening Committee will be placed before EC.

The matter again considered and Committee suggests that these teachers are put

in false/controversial list shall be asked to submit an affidavit stating that they are

accepting the decision of the Screening Committee and make then eligible/not

eligible. Those teachers are cleared by the Screening Committee based on the

policy accepted by the 184th EC shall be made eligible/not eligible and send letters

accordingly”.

Executive Committee agreed to the same.

Agenda Item No. 6. Chance limitation in BAMS Examinations

It was noted that a letter is signed by Dr. B.P. Pandey & Dr. Udaykumar, EC

Member is received in the office. The contents are as under:-

“Accordingly to the Rules and Regulations of CCIM that is following by the Kerala

University of Health Science under BAMS course, those students who are admitted

in the affiliated institutions by the University are still facing the threat of

termination system. But the same rule is not in practice for the batches admitted

under the University from 2012 academic year onwards and also not applicable for

the students under Calicut University.

But, by making this termination system specific for two batches admitted in the

academic years of 2010 and 2011, they are the only batches who come under this

special rule as the genuinely deserved a consideration in the view of the fact that

one or two years before”..

Executive Committee decided to inform all the Universities in view of GOI

letter received in the matter.

Agenda Item No. 7. Submission of Part I and Part II of visitation

reports separately by College and Visitation

Team -Regarding.

It was noted that the office of CCIM, received the visitation report in respect of

Govt. Nizamia Tibbia College, Hyderabad separately by College and Visitation Team.

Part I of the report was sent by College on 22.01.2014, whereas Part II was

submitted by the Visitation Team and was received in the office on 28.01.2014.

-In this regard it was noted that the visitation of the college was carried out on

20-21.01.2014. Part I of the visitation report is neither verified by the visitors and

nor by the principal of the college. Part II of the report is also not properly verified -

-by the visitors as most of the pages are not signed by them. In view of the same,

the said visitation report could not be assessed.

The matter was placed before President I/c, CCIM and he directed to place the

matter before Executive Committee.

Executive Committee decided to get re-visitation of the college done.

Further, explanation may be called from the visitors and the reply of

visitors is to be placed before EC for settling their TA Claim of the said

visitation.

Administration & Establishment:

Agenda Item No. 8. Extension for the tenure of Ayurved Experts.

It was noted that as per decision of Executive Committee, Dr. Ratna, Ayurved

Expert has been appointed on 13.12.2013 and her tenure was expired on

12.03.2014

The President I/c, CCIM extended the tenure of Dr. Ratna, Ayurved Expert for

further 11 months owing to her satisfactory services.

Agenda Item No. 9. To provide the High Tea, Working Lunch

(Deluxe Thali) and Evening Tea for 19th to

21st March, 2014 – regarding.

It was noted that a Sub-Committee constituted of for the purpose of obtaining and finalizing the quotations for the arrangement of catering services i.e. tea, lunch,

high tea, tent and waiters etc. to be provided during the meeting /election to be

held on 19th -21st March, 2014, collected three quotations from the following agencies:-

After going through the above comparative statement, the rates quoted by M/s

Balaji Caterers, New Delhi were found the lowest amongst all.

Keeping in view the lowest rates quoted by M/s Balaji Caterers, the work order for

providing the catering services has been given to the said agency after obtaining

approval of the President I/c, CCIM.

Agenda Item No. 10. To provide the bags to the Hon’ble Members

of CCIM on the occasion of Special General

Body Meeting to be held on 19th March, 2014-

It was noted that a Sub-Committee constituted for the purpose of obtaining and

finalizing the quotations for the arrangement of Bags to be distributed to the Hon’ble Members of the CCIM on the occasion of the Special General Body Meeting

to be held on 19th March, 2014, collected three quotations from the following

After going through the above comparative statement, the rates quoted by M/s

M/s Shree Sita Laxmi International, New Delhi were found the lowest amongst all.

Keeping in view the lowest rates quoted M/s Shree Sita Laxmi International, the

work order for the supply of Bags has accordingly been given to the said agency

after obtaining approval of the President I/c, CCIM.

Executive Committee ratified the same.

MISCELLANEOUS

Agenda Item No. 11. Enhancement of remuneration- regarding.

It was noted that two representations dated 05.03.2013 received from Mr. Satish

Chander and Mr. Gilbert, Retd. Assistant (on contract basis) stating that they have joined the Council on 16th September,2010 and 03rd October,2010 respectively

and after three months, their contracts were renewed for another six months on

consolidated salary i.e Rs.15,000/- per months each.

In this connection, it was noted that after completion of six months remuneration

was enhanced by Rs.5,000/- each with the approval of Executive Committee in

March/April,2010. Since then their remuneration has not been enhanced for the last three years.

Therefore, they have requested to enhance their remuneration.

Considering the satisfactory services, EC agreed to enhance the

remuneration of Rs.5000/- per month.

Agenda Item No. 12. Fake Registration Certificates issued by State

Council of Ayurvedic & Unani Systems of

Medicine, – Patna ( Bihar) to various persons.

It was noted that an application dated 27.07.2013 alongwith all documents has

been received from Dr. Ramrao Dhondiba Chavan, Beed (Maharashtra) for

obtaining Enrolment Certificate.

Further, it was noted that the name of applicant was not found/included in the

Central Register of Indian Medicine therefore, the matter was referred to State

Council of Ayurvedic & Unani Systems of Medicine, Patna ( Bihar) for verification

about the genuineness of the registration of Dr. Ramrao Dhondiba Chavan. In this

connection, the genuineness vide their letter dated 30.01.2014 has clarified that

Registration Number 1026 the name of Dr. Ramrao Dhondiba Chavan Beed (MS) is

not mentioned, therefore, Bihar State Council has requested to take legal action

against Dr. Ramrao Dhondiba Chavan who has submitted fake documents to the

CCIM for obtaining Enrolment Certificate.

It is also submitted that the copy of State Register/List of ISM practitioners

registered with Bihar State Council from April 2011 to March 2012 was also been

received. The Copy of the same was also sent to State Council of Ayurvedic & Unani

Systems of Medicine – Patna – Bihar/ for verification of its genuinity and

authenticity. In response of this Council letter, the Registrar of above said Council

confirmed that the State Register/ISM practitioners registered with Bihar said State

Council lists are fake/bogus and also informed that legal action be initiated by this

Council vide their letter dated 05.03.2013.

Executive Committee constituted a sub-committee consisting of Dr.

Shuhabuddin , Dr. V.G. Udayakumar, Dr. B. Muthukumar (EC Members), Dr.

Jagjit Singh, Dr. Vishwajeet Phokat and Dr. Ariz Qadri to look into the

matter.

Agenda Item No. 13. Unauthorised agencies/persons are involved

in running a racket to cheat innocent

applicants and misusing and affixing the seal

of CCIM/Ayush on application form for

obtaining Enrolment Certificate.

It was noted that the applications have been received from the following 12

applicants for obtaining Enrolment Certificate from CCIM and their details are as

In this connection, it was noted that all the applicants have not submitted the

requisite fee for obtaining Enrolment Certificate alongwith their applications & the

forms are not as per CCIM’s format. On perusal of the applications received, it has

been observed that out of the above 12 applications, names of 5 applicants are not

included in the Central Register of Indian Medicine.

It appears that some unauthorized agencies/persons are involved in running a

racket to cheat innocent applicants and misusing and affixing the seal of their own.

If agreed to please, the Council may adopt some measures to prevent such

malpractice to avoid further harassment and cheating.

Executive Committee decided that sub-committee constituted at Agenda

No. 13 will also look into this matter.

Agenda Item No.14. Matter regarding applications received for

LDCs post through open advertisement and an

online requisition from District Employment

Exchange, Delhi Govt. and to fill the post of

LDCs

It was noted that two (02) posts of LDCs (01- reserved for OBC and 01-General)

were fallen vacant in CCIM for which an advertisement was published in the

newspapers i.e. Hindustan Times(English), Navbharat Times (Hindi) all over India

and Employment News/Rozgar Samachar dated 25.12.2011 and 07-13.1.2012

respectively in which the last date of receiving of application was mentioned 31st

January, 2012 and the prescribed fees was Rs.50/-.

As per rule, an online requisition dated 22.12.2011 was also filled up by CCIM and

sent to District Employment Exchange, Delhi Govt. to sponsor the name of

candidates for the post of Lower Division Clerk.

In response to the above, following Number of applications were received through

It was noted that the number of application received were too large therefore, it

was not possible to scrutinize all the applications, therefore, the whole matter was

placed before the 178th meeting of Executive Committee held on 09.5.2013.

The Executive Committee decided to sought the legal opinion in respect of

cancellation of previous advt. and calling new applications from applicant with 60%

marks in Graduation beside other requirement as per approved Recruitment Rules.

The legal opinion was obtained from Legal Consultant of office and thereafter the

matter was placed before the then President and thereafter before the President

I/C, CCIM. The President I/C constituted a Sub-Committee consisting of three

members i.e. Dr. Bhrigupati Pandey, Member, Executive Committee, Dr. Uday

Kumar, Member, Executive Committee and Sh. Wasiq Imam, Admn. Officer,

RRI(CCRUM) .

The meeting of Sub-Committee was held on 14.3.2014 at 3.00 p.m. to examine the

applications of LDCs. The opinion of Sub-Committee is as under:-

“As regards to the large number of applications received for 02 posts of LDCs (01-

applications, these could not be sort out as the CCIM has limited manpower for this

job and it is not possible to prepare datas of these applications.

Keeping in view, the recommendations of Legal Consultant, Official Secretary, the

Sub-Committee is also in favor to defer all the applications and also recommend to

re-advertise the vacancies in Local Newspaper i.e. Hindustan Time (English) and

Navbharat Times (Hindi). Employment Exchange may also be approached to

submit limited applications.

The Sub-Committee is also recommend to fix a criteria to short out applications on

basis of experience/qualification etc. at the time of selection to the post of LDC”.

Further, it was noted that after promotion of Sh. Rajpal Singh from the post of LDC

to UDC, one more post of LDC has also fallen vacant w.e.f. 24.1.2013. The said

post falls on OBC category.

Now, at present, total number of vacancy of LDCs are 03 (three) which are lying

vacant w.e.f. 25.3.3010, 29.6.2011 and 24.1.2013 respectively.

Addl. Agenda Item No.1. Visitation report of Baba Hira Das ji

Ayurved Medical College, Muktsar,

Punjab under section 13A.

It was noted that the visitation report of Baba Hira Das ji Ayurved Medical College, Muktsar, Punjab under section 13A has been received from Dr. Gajendra Bharali on

04.03.2014. The date on the report has been mentioned as 30-31.12.2013.

However, it is noted that the date has been written over the whitener on the first

and last page of visitation report and signed by only the said visitor. With the visitation report a letter of said visitor has been attached in which he has stated

that he went to muktsar on 30th dec. 2013 alongwith DR. D.P. Das and Dr. G. P.

Reddy for the visitation of the said college as per direction vide letter no. 26-75/2013-14 dated 23.12.2013. It is also mentioned that there was no infrastructure

available for the proposed college, only two new buildings were undergoing

construction so the question does not arise for filling up the visitation performa.

Further, it was noted that the visitation of the said college had been postponed and

the same was rescheduled on 17-18.01.2014 and regarding this visitors has already informed well in advance telephonically before 30.12.2013 followed by letter of

postponement of visit dated 30.12.2013 was sent by email.

It was also noted that the visitation report dated 17-18.01.2014 signed by two

visitors namely Dr. D.P. Das and Dr. Rama Reddy, of the said college has already

been received on 31.01.2014 and placed before screening committee and then

before meeting of EC held on 04.03.2014. EC decided to not to recommend for issuing LOI and accordingly recommendation has already been sent to GOI on

11.03.2014.

It was noted that Late Kedari Redekar Ayurvedic Mahavidyalaya, Dist. Kolhapur,

Maharashtra was visited on 29-30.01.2014 in compliance of the court order dated 09.12.2013 in WP(C) No. 9563 of 2012 to assess the available infrastructure for

teaching and practical facility for BAMS course for the session 2012-13. The

visitation report was placed before screening committee on 13.03.2014 and after

going through the contents of the case screening committee decided as under:-

“The committee carefully examined the visitation report for the year 2014-15 and

found the following facts.

1. The college is having 53 teachers including 11 Professor, 17 Reader and 25

Lecturer against the requirement of 33.

2. The additional faculty for running PG course is sufficient.

3. IPD and OPD attendance are sufficient.

4. The college is having 7 OPD against the requirement of 8.

In view of the above the college is found eligible to be recommended for the year

2012-13.”

It was noted that an email/letter has been received from Dr. Shaik Shahul Hameed,

Chennai furnishing clarification of his two T.A. claims for the two separate journeys

of Jaipur to conduct visitation of two Unani colleges. In his letter, it has been stated

that just during the visitation of first Unani college on 17.1.2014, he was intimated

over phone that the Minister of Health, Govt. of Tamil Nadu is going to visit the

Govt. Unani Medical College, Chennai on 20.1.2014 and being the Principal and

Head of the Institution, he was supposed to be at Chennai all of sudden. That’s

why, he had to leave Jaipur just after completing the visitation of the first Unani

college and after attending to the urgent and sudden visit of the Hon’ble Minister of

Health, he again participated in the visitation of the second Unani college at Jaipur.

With this justification and clarification, Dr. Shaik Shahul Hameed has requested to

admit the said two T.A. bills.

Executive Committee accepted the clarification and directed office to clear

the T.A. Bill of the member.

It was noted that an email is received in the office of CCIM by Dr. Vishwajeet Singh,

standards of Ayurvedic College.

2. Legal definition of Ayurvedic drugs in India as there is no legal definition of

Ayurvedic drugs as per AYUSH department, Govt. of India.

3. Recommendation to Central and State Governments to include BAMS degree in Employment departments as many states are not having this degree to get

registered as unemployed although MBBS, MD, BDS, MDS, B.Vsc etc are

included. 4. Recommendation to the Central Government and other concerned agencies

BAMS eligible for admission to MPH/MHA/MBA (Health/Hospital

Management)/direct Ph.D as for MBBS. 5. Nationally accepted Legislative framework for the practice of MD (Rog

vigyan)/MS Ayu. Surgery) etc.

6. Legislative guidelines for all the Central/State departments to accept the

medical certificate sign by the BAMS Graduates (Section 17-c IMCC Act) 7. Regulations of Indian Government meant for identification and differentiation

of Ayurvedic drugs from Allopathic drugs and vice-versa.

8. Recommendation to Central and State Governments for giving rights under different acts to graduates of Ayurveda for purpose of Gynecology and

Obstetrics to the extent of their teaching and training in this subject.

9. Constitution of IMCC Act 1970 Amendment Committee as various Sections of

this Act are in immediate need to be amended as per the need in today scenario and need of ISM community of India.

10.CCIM Members may be empowered to visit colleges in their state on receipt of

complaint by Student’s /teachers/practitioners and submit a confidential report to President/Secretary CCIM. This report shall be presented before EC for

necessary action.”

translation of Hindi documents into English by

Govt. approved translator for filing in

Supreme Court.

It was noted that as a rule for filing petition in Supreme Court the documents are

required to be translated from Hindi to English by Govt. approved translator. The

SLP was in process to be filed before Supreme Court for vacation of stay on

forwarding recommendations to GOI, granted by Nainital High Court in W.P. No.

1754/2013. The President I/C, CCIM considering the emergency in matter directed

Legal Axis to get the work done on urgent basis as the SLP was ready for filing in

Supreme Court on 14.02.2014. Accordingly Legal Axis got the translation work

Addl. Agenda Item No.16. Denial of Admission to ISM Courses by some

Universities during one month extension of cutoff date by GOI- regarding.

The matter was discussed in EC that GOI has extended the cutoff date of admission

to ISM Courses from 31.10.2013 to 30.11.2013 as a one time measure for admission in 2013-14 session and the same has been circulated to all the

Universities. However, EC objected that some Universities are not considering the

students admitted after 31.10.2013 upto 31.11.2013.

Executive Committee decided that a strong letter is to be written to all

Universities to the effect to comply the order of GOI in respect of cutoff date for 2013-14 session.

The meeting concluded with a vote of thanks to the Chair.
