Account No: All the customers will have a unique account number. The unique account number is an alpha numeric code consisting of 12 characters. The Customer’s unique “account number” is a combination of the AHB’ SAP code along with the 6 digit bidder SAP ID and can be used as reference.. for all subsequent transactions. 2. Bidding modalities: 2.1 Price Bid Basis: In Indian rupees as per unit of measurement as given in Material List. Price to be quoted is basic, ex- location exclusive of taxes and any other statutory

levies.2.2 Bid Increment: Rs.100/- (Rupees Hundred only) / (or as specified)2.3 All the prices shall be quoted in Rs/MT basis (ex-Location basic exclusive of all taxes.)2.4 Type of Auction: English No Ties 2.5 Bid Validity: Bid shall be valid for 06 (Six working days excluding Saturdays, Sundays and holidays) working days counted from the next day of auction process in case of

auction against a catalogue which is completed on the same day. And if it is continuing on any other day the counting of days for lot confirmation shall be from the next day of completion of entire auction process.

2.6 Bid duration: For 1st four lots 20 minutes and balance lots 10minutes. If, No bids received within these specified time the lots are closed automatically.2.7 Auto Extension of the Auction Timings: In the event of bids in the last sixty (60) seconds of the scheduled bid time, the Bid Timings are automatically extended for One hundred

eighty (180) seconds from each such bid. Such Auto Extension shall continue until no bids are placed for sixty (60) seconds (Engine remains inactive for sixty (60) seconds. The Inactivity Time for Auto Extension purpose is normally “3” minutes. "Service Provider" however retains the right to change the “Inactivity Time” as well as “Extension Period”. The Inactivity Time applicable for the particular Online Bid shall be visible to the customers on the Bidding page.

3. Taxes & duties:3.1 GST: If location of supplier (JCAPCPL) and recipient (Customer to whom we will raise invoice/Bill to Party as per invoicing methodology) are into same state, 9% CGST and 9%

SGST would be charged. If they are into two different state, 18% IGST would be charged.3.2 TCS: Not applicable

3.3 Any change in taxes applicable at the time of lifting shall be applicable. 3.4 It is the responsibility of the buyer to furnish the valid GST no. & necessary documents to A H Bilimoria & Co. before participating in the auction. In case during the transactions,

4. Payment terms & conditions : 4.1 Payments: Payment shall be accepted only thrugh online (RTGS) mode. Bank details of JCAPCPL as under :

4.2 Quoted price would be exclusive of taxes. GST as per prevailing rate would be charged in extra on basic price. Any change in tax structure would be borne by customer.4.3 Advance money to be recovered from customer now basic price +18% GST4.4 Any loss due to wrong submission/Non submission of GSTIN data will be on account of customer for which JCAPCPL will not be responsible.4.5 Delayed Payment Charges (DPC): Payments with DPC @ Rs 1 per Rs. 100 per day shall be accepted up to two (02) working days from due date of payment as

mentioned in the confirmation letter.4.6 Saturdays & Sundays are excluded for counting purpose for payment schedule.4.7 In the event of Non-Receipt of Payment within the stipulated period of Payment, the Sale Offer for the approved Lot shall stand withdrawn automatically.4.8 Buyers have to send the payment deposit slip (UTR No /Scan Copy of NEFT/RTGS Transaction Slip) against Lot No. immediately after the payment to AHB at email id:

5. Lifting terms & conditions:5.1 DOs will be handed over to authorized representatives of bidders on receipt of payment. Authorization letter to be issued via registered e-mail id’s. Authorized letter must be duly stamped and signed by the proprietor or partner or director on receipt of payment. Lifting date is calculated from the next day of DO Release date. 5.2 Loading Charges: Loading by customer as per JCAPCPL safety norms5.3 Loading Time: 6 AM to 6 AM (JCAPCPL)5.4 Loading shall be given strictly as per the statutory norms & safety norms of JCAPCPCL.5.5 Loading will be done on Sunday also @ JCAPCPL only 5.6 Lifting with Ground Rent: Lifting with GR @ Rs. 1 per Rs.100 per day shall be allowed up to two (02) working days from the last date of original validity period of the

DO.5.7 DO validity can be extended Only ONCE against each Delivery Order upto a maximum of 2 days from last date of original validity period of the DO, subject to receipt of GR

Payment through online mode before the expiry of original validity period of DO& validity would be extended after receipt of Credit of the GR Payment. Kindly note that all Delivery Orders (DO) which meet the Lot Closure Norms shall be automatically closed within one day from the date of expiry of original Delivery Order (DO) validity.

5.8 The loading of materials under the category PUP Coil (Less than 3 Ton), such material shall not be given in the flat bed trailers. Trucks having its body covered with all three sides (also popularly known as Half-daala covered trucks / trailer) shall be accepted at loading plant as per compliance to safety norms and policy of the company.

5.9 Loading shall be given strictly as per the statutory norms & safety norms. of JCAPCL and given by JCAPCPL.

5.10 The Delivery Order shall be issued against one to one correspondence with Lot. The lifting to be done as per the DO issued. No mixing of materials of different DO's allowed for lifting and invoicing process".

5.11 "Kindly note that material on auction might slightly vary in Qty post lot confirmation intimation and no detention charges to be claimed if the Material Invoicing is stuck up due to ITS / SAP issue while vehicle is under loading inside Plant”.

5.12 JCAPCPL is not responsible for getting the vehicles placed at the loading point (JCAPCPL Site), However JCAPCPL shall extend support for possible resolution of any issues if brought into the notice of JCAPCPL by customer / authorized transporter.

5.13 JCAPCPL responsibility is only to get the material loaded and invoicing done.

5.14 No claim of amount to be made for vehicle being detained/kept on hold by plant for whatsoever reason.

5.15 All payments being made by Customers shall be no-interest bearing and if any claim made by customers shall not be entertained by JCAPCPL.

5.16 Authorized persons (of the customer) which is endorsed by A H Bilimoria & Co. involved in lifting of the materials will be allowed only with Personal Protective Equipments (PPE) i.e., Safety Shoes, Safety, Helmet, Safety Goggles, Fluorescent Jacket and Hand Gloves. No "people movement" shall be allowed at the time of loading/delivery of materials from the yards”. JCAPCPL will not be responsible for any delays arising out of Non- Compliance to the Safety Norms.

5.17 Documents for verification regarding entry of vehicles inside Tata Steel works :All customers to note that presentation of following set of documents to TATA STEEL authorities is COMPULSORY at the time of reporting of vehicles at TSL designated Gate for entry of Customer trucks/vehicles.a. Driving License of driver,b. Registration Card,c. Commercial Certificate,d. Fitness Certificate of Vehicle,e. Re-registration for vehicles older than 15 yearsf. InsuranceThe checklist form will be filled in at TSL designated Gate for entry of Customer trucks/vehicles before entry of vehicle.

5.18 If, for any reason, JCAPCPL is not able to give the material within twenty four (24) hours after the placement of vehicle then the buyer will have the option to take refund of the unlisted quantity.5.19 Any dispute on quality & quantity of material and bid cancellation shall not be entertained at any point after the auction.

5.20 All lots are offered/sold on “As is Where is Basis” and “No Complaint Basis”.

5.21 Lot transfer will not be allowed. Payment and invoicing has to done in the name of the H1 bidder, subject to the prices being approved.5.22 Dispatch is subjected to FORCE MAJEURE conditions.5.23 The seller reserves the right to terminate any offer at any point of time without assigning any reasons.

5.24 In the event of termination of the offer, seller shall refund the balance amount after due reconciliation.5.25 No claims whatsoever would be entertained after cancellation of the bid.

6 Penalty:6.19 The following penalties shall be applicable in the eventuality of a buyer defaulting in making the payment as per the stipulated schedule for each lot, in a financial year:

Security deposit will be forfeited & defaulting customer will be debarred from participation in future e Auctions for a period of 3 months from the date of debarment.

6.20 In case of non- lifting of full lot quantity after making full payment, a penalty equivalent to 20% of the material value for the un-lifted quantity against each lot shall be recovered from the customer.

DEFAULTS WOULD BE COUNTED AGAINST TATA STEEL LIMITED AND NOT AGAINST A PARTICULAR AUCTIONEER

7 Lot Closure Norms :For Lot Closure, the tolerance would be ± 01 (One) MT of the original quantity.

8 Refund : 8.1 Refund would be processed on the basis of request letter having details of auctions, SO and material lifted post Lot Closure, If anyone receipt of required documents (Original Copy) i.e. .Refund Request letter & cancelled cheque.8.2 Refund would be process only when gross/cumulative refundable amount is equal to and more than Rs 500. Any refund below Rs 500 would be hold back and would be processed only when gross/cumulative refundable amount is exceeds threshold limit of Rs 500 at any point of time. No refund application would be submitted to F&A for refund amount below than Rs 500.

9 Jurisdiction :Any dispute arising out of any contract shall be decided in Jamshedpur by the courts in Jamshedpur and by no other courts. The courts in Jamshedpur shall have exclusive jurisdiction to adjudicate upon any such dispute.

10 General terms & conditions:10.19 Any dispute on quality & quantity of material and bid cancellation shall not be entertained at any point after the auction.

10.20 All lots are offered/sold on “As is Where is Basis” and “No Complaint Basis”.

10.21 Lot transfer will not be allowed. Payment and invoicing has to done in the name of the H1 bidder, subject to the prices being approved.

10.22 Lot purchased should consist of material from the same lot and designated location only. JCAPCPL has the right to check any vehicle at any moment of time. If material lifted differs from the material that is purchased by the buyer, then the buyer and authorized representative will be permanently debarred. Also JCAPCPL can take any penal action against the buyer/authorized representative. All the material loaded in the vehicle is to be covered in order to follow the safety compliance of JCAPCPL works.

10.23 If the safety compliance is not followed, then JCAPCPL can penalize the buyer / authorized representative as deemed fit.10.24 These terms and conditions as stated above supersede the relevant terms & conditions that are given in JCAPCPL secondary general terms and conditions.10.25 Customer/ Transporter/Authorised Representative/Lifters/Drivers are not allowed to take any photograph /Videos within JCAPCPL EX WORKS /ALL JCAPCPL

STOCKYARS’S & SPC’S Plant premises for any lifting of seconds/scrap materials. If anyone found to do that a heavy penalty will be imposed & also debarment could be done.

10.26 Only Sundays are excluded for counting purpose for payment schedule. Second and Fourth Saturday of month is excluded for counting purpose of payment schedule as per notification of RBI.

10.27 These terms and conditions as stated above supersede the relevant terms & conditions that are given in JCAPCPL secondary general terms and conditions.

11. SPECIAL TERMS AND CONDITIONS FOR INTERNET AUCTION BANDWIDTH PROBLEMS, CONNECTIVITY PROBLEMS WITH THE LOCAL ISP (INTERNET SERVICE PROVIDER), SLOWNESS TO ACCESS PAGES FOR DOWNLOADING ETC. ARE BEYOND THE CONTROL OF JCAPCPL. AND A H BILIMORIA & COMPANY. HENCE NO RESPONSIBILITY LIES WITH THE JCAPCPL. OR A H BILIMORIA & COMPANY FOR THE ABOVE PROBLEMS FACED, IF ANY, BY THE BIDDERS BEFORE/DURING THE AUCTION ANY BID PLACED USING THE BIDDER'S USERNAME AND PASSWORD IS UNCONDITIONALLY BINDING ON THE BIDDER TO WHOM SUCH USERNAME AND PASSWORD HAD BEEN ALLOTTED AND HE SHALL BE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF THE SAME AND FULLY RESPONSIBLE FOR ALL ACTIVITIES THAT OCCUR UNDER THEIR USERNAME AND PASSWORD. HENCE THE USER IS ADVISED TO CHECK THE USERNAME AND PASSWORD BEFORE THE AUCTION IN ORDER TO FAMILIARISE HIMSELF WITH THE SAME AND IS ADVISED NOT TO REVEAL IT TO ANYONE ELSE SO AS TO PREVENT MISUSE OF THE SAME. SAFETY - Any violations in Safety by drivers / Supervisors/ Transporters / Vehicle/ Property Damage within Company Premises will lead to a heavy penalty of Rs 25000 directly to respective Customers.

1. As & when safety norms are being changed by TSL Security / CSD for better feasibility & tracking of Vehicles in every aspect, every Customers/ Transporters need to follow the same without any deviation.

2. For any in humanitarian behaviour (Discipline / being Caught with Any Unwanted Issue / being Caught with Animals), A penalty of Rs 25000 will be deducted to Customer / Transporter & instantly Customer/Transporter will be debarred from any Auction of JCAPCPL.
