2002/96/CE WEEE DIRECTIVE

The amount of waste from electrical and electronic equipment is increasing (WEEE) amongst which

most light sources have been included (fluorescent lamps not included).

The main purpose of the Directive is to prevent WEEE being thrown onto tips or incinerators causing

further damage to the environment.

The 2002/96/CE Directive has tried to introduce a control mechanism that envisions controlled

management of the device at the end of its life span, favouring its re-use or recycling. Moreover,

the legislative mechanism promotes design and production concepts that make disposal of the

products easier both in terms of dismantling and of materials.

In the case of bulbs, the financing of the activities connected to the collection, management and

recycling of WEEE at the end of their life span is guaranteed by a visible fee applied at the

moment of sale.

All of the commercial chain is asked to contribute both economically and actively so that the spirit

of the Directive is respected (and the environment protected).

In Italy, the Directive has been implemented by Decree 151 dated 25th July 2005 and successively

integrated with other existing devices.

MAIN OBLIGATIONS ENVISIONED

The manufacturer (intended broadly and however substantially whoever places his own brand

name on the goods and whoever imports from non-member countries) is responsible for the costs

of disposal of their own products at the end of their life span.

The point of sale must receive the product at the end of its life span if the same is replaced with

a new one of the same type.

The customer is asked to handle the product at the end of its life span with intelligence taking

it to an equipped area, a point of sale or by following instructions provided by the manufacturer.

Beghelli has always been sensitive to environmental problems and is member of the ECOLIGHT

consortium to which it gives the whole sum of the visible fee collected.

Choosing products of companies that belong to voluntary consortiums for the recovery and

recycling of the goods is a responsibile choice and ecologically correct in favour of the environment

and our future.

The products that fall within the field of application of the WEEE Directive are identified

by the symbol indicated at the side (a version without the bar also exists).

Terms and conditions of sale

1. ORDERS - LIMITS OF AGREEMENTAll orders made must be in writing. Once an order has been confirmed it is irreversible. The Seller reserves

the right to carry out an order partially or even cancel the residual order, if the economic situation of the buyer

changes.

All collaboration, orders, commission and agreements are fully understood by written or verbal confirmation

from the Seller or however, by providing an invoice and/or delivery of goods ordered. There is a minimum

order limit.

2. VARIATIONS AND MODIFICATIONSAfter placing an order, all modifications or additions will be validated and become efficient only when the Seller

has provided the buyer with written confirmation. The written or varied confirmation from the Seller will void

any other document in possession.

The Buyer who does not wish to respect the conditions relating to the order, must inform the Seller within 20

days from the confirmation date otherwise, the variation will have been fully accepted.

3. ACCEPTANCEThe Seller cannot be held responsible for the non-acceptance of an order as well as for late or no delivery

of goods ordered. Acceptance and delivery of orders are subject to availability as well as circumstances

which could influence the availability or the delivery of them.

4. DELIVERYDelivery times stated by the Seller are approximate.

Delivery times expressed in days, take into consideration working days only.

Any changes made to delivery times requested by the Buyer must have written confirmation from the Seller.

The Seller will not be liable for compensation for damage and/or refund of any type including interest as a

result of delays in delivery such as total or partial interruption and/or suspension, even if not caused by force

majeure or unforeseeable circumstances. The Buyer can cancel the order if the Seller does not deliver goods

within 30 days after which the Buyer has sent a letter by registered post with acknowledgement of receipt.

5. FORCE MAJEUREThe Seller shall not be liable for any delay or failure in its performance caused by or resulting from acts of

God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment

failures and any other causes beyond the control of the Seller. In all cases, as for the hypothesis of unfore-

seeable circumstances, the Seller reserves the right to suspend and/or delay the delivery of products as well

as voiding the order even if it has been confirmed. The Buyer will have no right in claiming compensation for

damage and/or refund of any type therein including direct, indirect or consequential.

6. SHIPMENTThe Buyer is responsible for risks and dangers of goods being shipped even if carriage has been paid and

/or is by use of Seller vehicles. The Seller will not be responsible for any breakages and/or mishandling of goods.

Goods will be dispatched from Sellers seat in Monteveglio (Bologna).

The Buyer is responsible for transport fees. The Seller does not accept returns.

7. CLAIMS- REPLACEMENT OF GOODSOn receiving goods, the Buyer must check the state and quantity received with that stated on the dispatch

note. Any claims relating to quality, quantity or type of goods must be in writing and sent within 8 days of

receiving goods. After this time, except for conditions covered by goods warranty, no claim can be made

relating to quality, substance or general conditions of the goods. The Buyer cannot return the goods without

written confirmation from the Seller and must not delay and/or suspend total or partial payment of the

invoice, even in cases of claims. If a claim is considered valid by the Seller and has been made within war-

ranty terms stated on instruction leaflet accompanying the individual products, the Seller is limited to

replacing the faulty product using the same shipment method as with the original product. The Buyer can-

not cancel the order and cannot claim compenastion for damage and/or fees. Rights to replacement are

voided if the product is not preserved with care, kept at the Sellers disposition or returned immediately to the

place determined by the Seller.

8. COSTThe prices indicated in the catalogue are not binding for the Seller and as a consequence he reserves the right

to modify the price until delivery has been made. Prices are net of VAT and other taxes.

9. PAYMENTAll payments must be carried out within the terms and modality indicated by the Seller to their seat in

Monteveglio (Bologna) or to the person with written authorisation for receiving payment on the Sellers behalf.

In case of delayed payment, the Buyer will have to pay the Seller interest from the expiry date to the date

of payment carried out, equal to the "prime-rate" enforced from time to time (determined by the Italian ban-

king Associat ion-

ABI) plus 5 (five) points, unless compensation fees are higher. If the Buyer does not comply with the payment

terms stated, the Seller can cancel the order immediately or suspend the delivery of goods already ordered

without informing the Buyer. The Seller reserves the right to request immediate payment of the total credit

due and take action for any compensation for damages.

10. RETENTION OF TITLETitle to the goods shall pass to the Buyer only when the Buyer has carried out full payment of total price.

The Buyer is obliged to inform third parties of the retention of title agreement as well as protect the rights of

the Seller.

11. JURISDICTIONFor any controversy or protest relating to the interpretation, validity or carrying out of orders or in relation to

the contract and general conditions of sale, the Bologna Law Court is exclusively competent.

Elplast products are distributed by Beghelli and manufactured according to the trade rules using safe

materials conforming to regulations 186/68 and 791/77 and do not compromise the safety of people, animals

or objects, if installed and used for their correct purpose only. Products relating to the CEE Directives (Directive

“EMC” 89/336/CEE - enforced the Legislative Decree 476/92 - modified by the 93/68/CEE Directive and “BT”

73/23/CEE Directive - enforced by law 791/77 - modified by the 93/68/CEE Directive) are conform with the

essential requisites they contain. The CE Marking positioned on the goods and/or packaging and/or any user

warnings which accompany the goods indicate the presumed Declaration of Conformity to Directives listed above.

Beghelli preserves a copy of the documentation, which indicates that the product has been examined and con-

forms to regulations, on file in their technical archive. This document includes initial projects, test reports,

drawings and a list of parts and is available for inspection by the competent authority.

The contents of this catalogue are subject to variation without prior notification. All products included are

covered by the Beghelli warranty according to laws in force except for different indications in the warranty

of each individual product.
