Planner’s Comments: The subject property is located on the south side of University Avenue in

the vacant lot across from Kroger and is situated between the Texaco service station and a

small retail strip mall. The property is approximately 21,300 square feet or .5 acres. The

topography of the subject property is mostly flat on the property near University Avenue but

increases in elevation towards the rear of the lot.

The applicant is seeking site plan approval to construct a 7,314 sq/ft, two-story building that

will also utilize the rooftop for PJ’s Liquor and Cigar. The first floor will function entirely as

liquor retail, the second floor will function entirely as cigar retail and the rooftop will serve as a

public smoking area. The building will also contain an open deck that wraps around most of the

building on the second floor. There will be one point of ingress/egress to this site on University

Avenue with a “Right Turn Only” when existing the property. Additionally, the driveway access

to this property is controlled by the Mississippi Department of Transportation (MDOT) requiring

a MDOT permit for all required work on MDOT property, a copy of the approved permit shall be

The applicant is required to provide mitigation into the tree escrow account, prior to

permitting, for the costs of labor and materials for 36 trees. The stormwater plan is still under

review and pending approval by the Public Works department.

The applicant’s site plan has been before the site plan review committee on numerous

occasions and received final approval on 9/29/2015. All revisions have been made for

compliance.

Sec. 196. - Commercial use of unenclosed rooftops.

(a) Definitions. For the purpose of this section, "unenclosed" refers to a rooftop space that is not completely enclosed by a durable and impervious material. This section applies to use by commercial vendors of food and alcohol. And dos not apply to property used for noncommercial purposes. Balconies are not considered to be a commercial use of an enclosed rooftop.

(b) Barriers. Physical barriers shall be located six feet inside the perimeter of any unenclosed rooftop in such a manner that individuals cannot stand with six feet from the edge of the rooftop. Such barriers shall not be visible from the ground.

(c) Non-breakable materials. All food and/or drink served and/or consumed on an unenclosed rooftop shall be served on or in non-breakable items.

(d) Distribution. All food and/or alcohol served must be prepared for consumption within the interior of the building, but, once so prepared, may be transported to the unenclosed rooftop by either a patron or employee of the retailed.

(e) Seating requirement. On any unenclosed rooftop there must be seating available for all persons present on said unenclosed rooftop, and the number of patrons shall not at any time exceed the number of available seats. The number of patrons present shall be complaint in all respects, at all times, with the International Fire Code, The Mississippi Fire Prevention Code and all other applicable laws.

(f) Building age. The commercial use of unenclosed rooftops shall not be permitted on structures 50 years or older.

(g) Existing commercial use of unenclosed rooftops. Any commercial use of an unenclosed rooftop existing at the time of the adoption of this ordinance shall be considered a nonconforming use as defined at section 121 of the City of Oxford's Land Development Code and shall comply with all regulation's for nonconforming uses furthermore the unenclosed nonconforming use will meet all requirements of section 122, Nonconforming Structure.

(h) Additional building permit prerequisites. In addition to the other requirements and conditions imposed elsewhere in the land development code, no building permit shall be issued for a building containing commercial use of rooftop space unless:

(i) The applicant submits structural plans, with all loads listed, bearing an original stamp of a licensed engineer; and

(ii) If, in the building official's sole discretion, the building official deems it appropriate to retain a special inspector to supervise and or/inspect construction, said special inspector is retained at developer's expense.

Unenclosed Rooftop Ordinance for the square footage identified in this plan. 4. Prior to the issuance of any permits, the applicant shall provide mitigation funds into the

tree escrow account. 5. Approval is contingent on an approved stormwater plan. No permits to be issued prior

to approval of that plan. 6. Approval if for the site plan as submitted.
