Comal County Order Adopting Rules of Comal County, Texas for On-Site Sewage Facilities:

§366.051 (a) of the Texas Health and Safety Code states that a person must hold a permit and an approved plan to construct, alter, repair, extend, or operate an on-site sewage disposal system (OSSF).

§285.33(d)(2)(A) of Title 30 of the Texas Administrative Code, states; Land acceptable for surface application shall have a flat terrain and shall be covered with grasses, evergreen shrubs, bushes, trees or landscaped beds containing mixed vegetation. There shall be nothing in the spray application area within ten feet of the sprinkler, which would interfere with the uniform application of the effluent.

§285 .1(b)(2) of Title 30 of the Texas Administrative Code Chapter 285 states that any person who participates in any activity relating to the development of planning materials, construction, alteration, repair, extension, operation, maintenance, permitting, inspection, or investigation of an OSSF shall fall under the applicability of Chapter 285 .

§285.3(a) of Title 30 of the Texas Administrative Code, Chapter 285 states that a person shall hold a permit for an OSSF.

§7.173(a) of the Texas Water Code states that a person commits an offense if the person violates a rule adopted by the commission under Chapter 366, Health and Safety Code, or an order or resolution adopted by an authorized agent under Subchapter C, Chapter 366, Health and Safety Code.

It was observed on May 10, 2017 that an alteration has been made to the On-site sewage facility by adding a Tennis Court in the spray application area. This alteration to the OSSF was made without applying for a permit from the Comal County Engineer's Office.

Note: It is the owner' s responsibility to notify the Comal County Engineers Office at the time of permit submittal in order to ensure that the permit will be expedited.

This is an official Notice of Violation that your property is in violation of the Order Adopting Rules of Comal County, Texas for On-Site Sewage Facilities. You must comply with the following instructions:

Within thirty-calendar days (30) from receipt of this notice, you must:

1) Obtain a new permit from Co mal County Engineers Office. 2) Install an On-site sewage facility as per above permit in Step 1. 3) Obtain a License to Operate from Coma! County Engineers Office.
